क्रमांक आयडीसी २०१९/प्र.क्र. १६९/उ-१४.----म.औ.वि.अधिनियम, १९६१ (१९६२ चा महा. तीन) चे कलम १, पोट-कलम (३) अन्वये प्रदान केलेल्या शक्तींचा वापर करून महाराष्ट्र शासन याद्वारे मौजे उसाटणे, तालुका अंबरनाथ, जिल्हा ठाणे येथील सोबत जोडण्यात आलेल्या अनुसूचीत उल्लेखिलेल्या क्षेत्रात उक्त अधिनियमाचे प्रकरण ६ ज्या तारखेस अंमलात येईल ती तारीख २६ मार्च, २०१९ म्हणून नियुक्त करीत आहे व उक्त क्षेत्र अधिनियमाच्या कलम २ खंड (ग) अन्वये औद्योगिक क्षेत्र म्हणून जाहीर करत आहे.

उक्त क्षेत्र मुख्य कार्यकारी अधिकारी, महाराष्ट्र औद्योगिक विकास महामंडळ, अंधेरी (पूर्व), मुंबई-९३ यांचे कार्यालयात ठेवलेल्या नकाशात लाल रंगाने जास्त स्पष्टपणे दाखविले आहे आणि सोबतच्या अनुसूचीत दर्शविल्याप्रमाणे त्याच्या चतु:सीमा आहेत.

MAHARASHTRA INDUSTRIAL DEVELOPMENT ACT , 1961.

No. IDC 2019/(C.R.169)/IND-14.—In exercise of powers conferred by sub-section (3) of section 1 of the Maharashtra Industrial Development Act, 1961 (Mah. III of 1962), the Government of Maharashtra hereby appoints 26th March, 2019 to be the date from which the provisions of Chapter VI of the said Act shall take effect in certain areas of village Usatane in Taluka Ambernath of District Thane, mentioned in the Schedule appended hereto and declares the said area to be an industrial area under clause (g) of section 2 of the said Act, for the purpose of the said Act ;

The said area is more clearly defined in red in the maps deposited in the offices of the Chief Executive Officer, Maharashtra Industrial Development Corporation, Andheri (East), Mumbai-400 093 and is bounded by the areas as indicated in the said schedule.

MAHARASHTRA LAND REVENUE CODE, 1966.

No. TLC. 2015/C.R.58/M-10.—The following draft notification, which the Government of Maharashtra proposes to issue in exercise of the powers conferred by clause (vi) of sub-section (1) of section 4 of the Maharashtra Land Revenue Code, 1966 (Mah. XLI of 1966), is hereby published as required by sub-section (4) of the said section 4 for the information of all persons likely to be affected thereby; and notice is hereby given that the said draft will be taken into consideration by Government of Maharashtra on or after the 7th June 2016.

2. Any objections or suggestions, which may be received by the Collector Beed, Central Building, Nagar Road, Beed-431122, from any person with respect to the said draft notification on or before the aforesaid date will be considered by the Government.

DRAFT NOTIFICATION

No. TLC. 2015/C.R.58/M-10.—In exercise of the powers conferred by clause (vi) of sub-section (1) of section 4 of the Maharashtra Land Revenue Code, 1966, (Mah. XLI of 1966), and of all other powers enabling it in this behalf, and in modification of all the previous notifications or orders, in so far as they relate to the village Malewadi hitherto included in the Ambajogai Taluka of the Beed District, the Government of Maharashtra, after previous publication, as required by sub-section (4) of the said section 4, hereby specifies that the said village shall, with effect from the 1st day of July, 2016 be exculuded from the Ambajogai Taluka of the Beed District and shall be included in the Parali Taluka of the Beed District.

क्रमांक सीडीए २०१६/(१९१/१६)/लाक्षेवि (कामे).----- महाराष्ट्र सिंचन पद्धतीचे शेतक-यांकडून व्यवस्थापन अधिनियम, २००५ मधील कलम १ चे उप कलम (३) अन्वये प्रदान करण्यात आलेल्या अधिकारांचा वापर करून महाराष्ट्र राज्याचे राज्यपाल खालील तक्त्यात स्तंभ (२), (३), (४), (५) व (६) मध्ये विर्िनदिष्ट केल्याप्रमाणे उपरो अधिनियम लागू करण्यासाठी पाटबंधारे प्रकल्पाचे नाव, क्षेत्र, अधिनियमातील कलमे, लागू करण्याच्या तारखा व इतर तपशील अधिसूचित करत आहेत. प्रस्तुत अधिनियमातील कलम ७ मधील तरतुदीनुसार अधिसूचित क्षेत्रात समुचित प्राधिकरण वैयकि जमीनधारकास अथवा भोगवटाधारकास पाणीपुरवठा करणार नाही आणि पाणी वापर संस्थेतर्फेच पाणीपुरवठा करण्याची पद्धत सिंचन पद्धतीचे शेतक-यांकडून व्यवस्थापन या योजनेखालील कार्यक्षेत्रातील सर्व जमीनधारक व भोगवटाधारकास बंधनकारक राहील.

MAHARASHTRA MANAGEMENT OF IRRIGATION SYSTEM BY FARMERS (MMISF) ACT, 2005.

No. CDA-2016/(191/16)/CAD (Works).— In exercise of the powers conferred by Sec. 1(3) of Maharashtra Management of Irrigation System by Farmers (MMISF) Act, 2005 (Mah. 23 of 2005) the Governor of the State Government of Maharashtra, hereby, notifies Areas, Irrigation Projects, Sections of the Act and Date of Applications as specified in columns (2), (3), (4), (5) & (6) of the table below for bringing in force the Act. In said notified area, as provided under Sec. 7, no water shall be supplied by the Appropriate Authority to an individual holder or occupier of such land and the system of supply of water through Water Users Association shall be binding on all the holders and occupiers of the land under Management of Irrigation System by Farmers.

क्रमांक सीडीए २०१६/(१९१/१६)/लाक्षेवि (कामे).---- महाराष्ट्र सिंचन पद्धतीचे शेतक-यांकडून व्यवस्थापन अधिनियम, २००५ मधील अधिकाराचा वापर करण्यासाठी आणि कर्तव्ये पार पाडण्यासाठी कालवा अधिकारी यांची नियुी करण्यासाठी या कायद्यातील कलम २ (च) नुसार राज्य शासनास अधिकार दिले आहेत.

त्यानुसार महाराष्ट्र पाटबंधारे अधिनियम, १९७६ च्या कलम २ च्या खंड (४) अन्वये महाराष्ट्र सिंचन पद्धतीचे शेतक-यांकडून व्यवस्थापन अधिनियम २००५ अंतर्गत अधिकाराचा वापर करण्यासाठी आणि कर्तव्ये पार पाडण्यासाठी खाली नमूद केलेप्रमाणे महाराष्ट्राचे राज्यपाल खालील तक्त्यात स्तंभ क्र. (३) व (४) मध्ये र्िवनिदीष्टीत केल्याप्रमाणे कालवा अधिका-यास अधिकार प्रदान करण्यात येत आहेत :-----

महाराष्ट्र शासकीय कर्मचा-यांच्या बदल्यांचे विनियमन आणि शासकीय कर्तव्ये पार पाडताना होणा-या विलंबास प्रतिबंध अधिनियम, २००५.

क्रमांक बदली. १०१४/प्र. क्र. ८१/२०१४/आ (संनि).----- महाराष्ट्र शासकीय कर्मचा-यांच्या बदल्यांचे विनियमन आणि शासकीय कर्तव्ये पार पाडताना होणा-या विलंबास प्रतिबंध अधिनियम, २००५ (२००६ चा महा. २१) मधील कलम ६ खालील दुस-या परंतुकानुसार जलसंपदा विभागाच्या कार्यकक्षेतील क्षेत्रीय कार्यालयांतील गट अ, गट ब (राजपत्रित) व गट ब (अराजपत्रित) मधील अधिका-यांच्या बदल्यांचे अधिकार यासंदर्भातील यापूर्वीचे आदेश अधिक्रमित करून खालीलप्रमाणे प्रत्यर्ापित करण्यात येत आहेत :-----

(१) सोबत जोडलेल्या तक्ता अ मध्ये दर्शविल्यानुसार क्षेत्रीय कार्यालयांतील स्तंभ २ मधील गट अ, गट ब (राजपत्रित) व गट ब (अराजपत्रित) संवर्गातील स्तंभ ३ मध्ये वेतनेश्रेणी दर्शविलेल्या अधिका-यांच्या बदल्या करण्याचे अधिकार तक्ता अ मधील स्तंभ ४ मध्ये नमूद केलेल्या दुय्यम सक्षम प्राधिका-यास प्रत्यर्ापित करण्यात येत आहेत.

(२) सोबत जोडलेल्या तक्ता ब मध्ये दर्शविल्यानुसार क्षेत्रीय कार्यालयांतील स्तंभ २ मधील गट अ, गट ब (राजपत्रित) व गट ब (अराजपत्रित) संवर्गातील स्तंभ ३ मध्ये वेतनश्रेणी दर्शविलेल्या अधिका-यांच्या एकाच महामंडळातील दोन मुख्य अभियंता कार्यालयांतर्गत बदल्या/ महामंडळाबाहेरील/राज्यस्तरावरील बदल्या करण्याचे अधिकार स्तंभ ४ व ५ मध्ये नमूद केलेल्या दुय्यम सक्षम प्राधिका-यास प्रत्यर्ापित करण्यात येत आहेत.

(३) तक्ता अ च्या स्तंभ ५ मध्ये व तक्ता ब च्या स्तंभ ६ मध्ये नमूद केलेले प्राधिकारी हे विशेष अपवादात्मक परिस्थितीत, बदली अधिनियमाच्या कलम ४ (४) व ४ (५) नुसार बदल्यांसाठी सक्षम प्राधिकारी आहेत.

MAHARASHTRA GOVERNMENT SERVANTS REGULATION OF TRANSFER AND PREVENTION OF DELAY IN

DISCHARGE OF OFFICIAL DUTIES ACT, 2005.

No. Transfer. 2014/C.R. 81/14/Estt (CR).–– In exercise of the powers conferred by the second proviso to section 6 of the Maharashtra Government Servants Regulation of Transfers and Prevention of Delay in Discharge of Official Duties Act, 2005 (Mah. XXI of 2006), and in supersession of all existing Notifications, Orders or Instruments in this behalf, the Government of Maharashtra is hereby declares and directs that the powers of the Chief Minister and the Minister for Water Resources Department being the Competent Transferring Authorities for the Officers in Group A, Grup B (Gazzeted) and Group B (Non Gazzeted) under the control of Water Resources Department are hereby delegated in the following manner :—

(1) The powers as the Competent Transferring Authority to make transfer of all the Government Officers in Group A, Group B (Gazzeted) and Group B (Non Gazzeted) in regional offices, for the officers classified in column (2) of the Table -A appended herewith having Pay Scale with Grade Pay, specified in column (3) of the Said Table -A, are delegated to the competent subordinate authority mentioned in column (4) of the Table -A appended herewith ;

(2) The powers of out zone transfers of Government Officers in Group A, Group B (Gazzeted) and Group B (Non Gazzeted) in regional offices, for the officers classified in column (2) against having Pay Scale with Grade Pay, Specified in column (3) of the said Table -B are Delegated to the competent subordinate authority mentioned in column (4) and (5) of the Table -B appended herewith ;

(3) The authorities specified in column (5) of the Table A and column (6) of the Table B shall be the authorities for the purposes of sub-section (4) and (5) of section 4 of the said Act.

क्रमांक मुद्रांक २०१६/१९०/ अनौ.सं.क्र. ०२/प्र.क्र. २७२/म-१.----महाराष्ट्र मुद्रांक अधिनियम (१९५८ चा अधिनियम, ६०) याच्या कलम ९ च्या खंड (अ) द्वारे प्रदान करण्यात आलेल्या अधिकारांचा वापर करून लोकहितास्तव पुढील कार्यवाही करणे आवश्यक असल्याची खात्री पटत असल्याने याद्वारे, शासन निर्णय गृह विभाग क्र. धोरण-२०१५/प्र. क्र. २६५/बंदरे-१, दिनांक ४ फेब्रुवारी २०१६ अन्वये मंजूर करण्यात आलेल्या "महाराष्ट्र बंदर विकास धोरण, २०१६" अंतर्गत, बंदर प्रकल्पांचा विकास, कार्यचलन परिरक्षण व विस्तार, यांसह रस्ते जोडणी, रेल्वे जोडणी, पाणीपुरवठा, वीज पुरवठा, दूरसंचरण व तत्संबंधित कामे यांच्याशी संबंधित पहिल्या संलेखावर आकारणी योग्य असलेले मुद्रांक शुल्क दिनांक ४ फेब्रुवारी २०१६ रोजी सुरू होणा-या व दिनांक ३ फेब्रुवारी २०२१ रोजी संपणा-या कालावधीसाठी (दोन्ही दिवस धरून) खालील शर्तीवर माफ करण्यात येत आहे.

शर्ती.---(१) या आदेशानुसार मुद्रांक शुल्कातून सूट मिळण्याकरिता विकासकाने महाराष्ट्र मेरीटाईम मंडळाबरोबर सवलत करारनामा साक्षांकित करणे आणि महाराष्ट्र मेरीटाईम मंडळाच्या मुख्य कार्यकारी अधिका-यांनी दिलेले प्रमाणपत्र उक्त दस्तऐवजांसोबत स्वतंत्रपणे जोडणे आवश्यक आहे.

(२) ज्या बंदर प्रकल्पांनी यापूर्वीच्या बंदर विकास धोरण/बंदर धोरण अंतर्गत किंवा शासनाच्या अन्य कोणत्याही धोरण अथवा योजनेअंतर्गत मुद्रांक शुल्कातून सूट घेतली असेल त्यांना या धोरणांतर्गत सवलत अनुज्ञेय असणार नाही.

(३) महाराष्ट्र बंदर विकास धोरण, २०१६ मधील कोणत्याही शतर्ींचा भंग केल्यास जणू काही सुरुवातीपासूनच माफी देण्यात आली नसल्याप्रमाणे मुद्रांक शुल्क शास्तीसह वसूल करण्यात येईल. गृह विभाग/मेरीटाईम बोर्ड यांनी लाभाथ्यार्ंनी या बंदर विकास धोरणामधील कोणत्याही अटी व शतर्ींचा भंग केला नसल्याबाबतचा तिमाही अहवाल नोंदणी महानिरीक्षक व मुद्रांक नियंत्रक, महाराष्ट्र राज्य आणि संबंधित मुद्रांक जिल्हाधिकारी यांना सादर करावा.

MAHARASHTRA STAMP ACT.

No. Mudrank-2016/190/UOR No. 02/C.R. 272/M-1.—In exercise of the powers conferred by clause (a) of section 9 of the Maharashtra Stamp Act, (hereinafter referred to as ' the said act ') the Government of Maharashtra being satisfied that it is necessary so to do in the public interest hereby remits the stamp duty chargeable, on the first instrument relating to development, operation, maintenance and expansion of port projects, including road connectivity, rail connectivity, water supply, electrical power supply, telecommunication and other related activities as per the '' Maharashtra Port Development Policy 2016 '' prescribed under the Government Resolution, Home Department No. Dhoran-105/CR-265/Bandre-1, dated 4th February 2016 for the period starting from the 4th February 2016 and ending on 3rd February 2021, (Inclusive of both days) subject to following conditions namely :—

Conditions.—(i) To avail the benefit of remittance in stamp duty as per this order it is necessary for the developer to sign the concession agreement with the Maharashtra Maritime Board and to append separate certificate issued by the Chief Executive Officer of the Maharashtra Maritime Board with the said document.

(ii) Stamp duty remission shall not be applicable to those projects who have availed the remission as per the previous Port Development Policy/Port Policy or any other Government Policy or Scheme.

(iii) In case of breach of any of the conditions of the '' Maharashtra Port Development Policy 2016 '' the remittance given in the stamp duty shall be recovered with a penalty as if, there was no remisssion from the beginning. Home Department/Maritime Board shall submit quarterly report to Inspector General of Registration and Controller of Stamp, State of Maharashtra and respective Collector of Stamps that there is no breach of any conditions of this Port Development Policy by the beneficiaries.
