ORDER
No. D.T.P.-10081-3419-D.P.Warora-Sec. 127(2)-Order-TPV-2-1030-2019.—
Whereas, The Government of Maharashtra vide Notification No. TPS-2278-CR-421-83-1968-UD-1, dated 26th August, 1986 had approved the Original Development Plan of Warora Municipal Council (hereinafter referred to as "the said Original Development Plan") under Section 31(1) of the Maharashtra Regional and town Planning Act, 1966 (Maha. Act XXXVII of 1966) (hereinafter referred to as "the said Act") & the same had came into force with effect from 15th October, 1986 ;
And whereas, in the said Development Plan, the land bearing S. No. 290/1 (Old Kh. No. 50/1] 52/1, 53 and 54), are admeasuring 1.88 Hectare, situated at Mauja Warora (hereinafter referred to as "the said Land") was reserved for "site No. 40 Open Space, Site No. 41 Market and Site No. 51 Parking" (hereinafter reffered to as "the said Original Development Plan Reservation") and for which Appropriate Authority was Warora Municipal Council (hereinafter referred to as "the said Appropriate Authority") ;
And whereas, the said land has not been acquired by the said Appropriate Authority within 10 years from the date on which the said Development Plan came into force ;
And whereas, the owner of the said land has served a notice dated 15th December, 2009 under Section 127 of the said Act, on the said Appropriate Authority, informing to acquire the said Land within stipulated period ;
And Whereas, even after service of the said notice under sub-section (1) of Section 127 of the said Act, as aforesaid, the said land is not acquired, nor the Notification of Land acquisition required under Section 126(4) of the Maharashtra Regional and Town Planning Act, 1966 read with Section 6 of the Land Acquisition Act, 1894, had been published under sub-section (1) of Section 127 of the said Act, within the stipulated period from the date of the service of the said notice, by the said Appropriate Authority ;
And Whereas, the Government of Maharashtra vide Notification No TPS-2212-521(N)-Rebuilding No. 57-CR-102-12-/UD-9, dated 28th December, 2012 has approved the Revised Development Plan (here -inafter referred to as the "said Revised Development Plan") of Warora Municipal Council under Section 31(1) of the said Act and the same had came into force with effect from 27th January, 2013, in which said Origional Development Plan reservation were replaced with reservation "Site No. 54-Recreational Ground" (hereinafter referred to as the "said Revised Development Plan Reservation") for which Appropriate Authority is Warora Municipal Council ;
And Whereas, the Hon'ble High Court of Judicature at Bombay, in Writ Petition No. 796-2011 filed by the Owners of the said land, vide its order dated 25th October, 2016 held that the said Original Devel- opment Plan reservations on the said land stand lapsed ;
And Whereas, according to Writ Petition No. 796/2011, its order dated 25th Ocotber, 2016, the Chief Officer, Municipal Council, Warora has requested to delete Reservations of said Development Plan as per Section 127(2) of the said Act, by letter No. 193-2018, dated 22nd February, 2018 ;
And Whereas, Government in Urban Development Department vide letter No. TPS-2217-263-C. No. 362-2018-UD-9, dated 8th February, 2019 (hereinafter referred to as "the said Government Letter") has instructed the Director of town Planning, Maharashtra State, Pune to issue order under Section 127(2) as per powers delegated to him vide Government Resolution dated 1st December, 2016 immediately, by stating that the said Original Development Plan reservation viz. Reservation No. 40 Open Space, Reser- vation No. 41 Market and Reservation No. 51 Parking in the said Original Development Plan are lapsed to the extent of area mentioned in the notice, also mentioning the reservation No 54 Recreational Ground in the said Revised Development Plan is also null and void to the exent of area mentioned in the notice.
४ द्धन्रु]क्ष् रू न् ॅ-+ न् ह्यम््र ान्म््र, द्ध २८-ह्य ३, २०१९/- ७-१३, ॅ १९४१And Whereas, as instructed in the Government letter, in accordance with the provision of Sub- section (1) of Section 127 of the said Act, Reservation No. 40 Open Space, Reservation No. 41 Marked and Reservation No. 51 Parking pertaining to the said land, has lapsed from the said Original Development Plan and it is accordingly expedient to notify such lapsing under sub-section (2) of Section 127 ;
Now, therefore, in exercise of the powers delegated to him vide Government Notification No. TPS- 1813-3211-CR-508-UD-13, dated 1st December, 2016, the Director of Town Planning, Maharashtra State, Pune, hereby issues order under sub-section (2) of Section 127 of the said Act, that the said Origional Development Plan Reservation viz Reservation No. 40 Open Space, Reservation No. 41 Market and Reservation No. 51 Parking, in the said Original Development Plan on the said land (as specified in the schedule hereinbelow) has been lapsed to the extent of area mentioned in the notice.

The said revised Development Plan Reservation viz. "Site No. 54 Recreational Ground" in the said Revised Development Plan on the said land is also null & void and the land so released from reserva- tions shall become availabe to the owneres for the purpose of Development as otherwise permissible in the case of adjacent land under the said Revised Development Plan.
A copy of the part plan showing the area which is lapsed from the said reservation, shall be made available in the office of the Chief Officer, Warora Municipal Council, Warora during office hours on all working days for inspection of public upto one month.

Whereas, Pauni Municipal Council is 'C' class Municipal Council. Pouni Municipal Council is Planning Authority for Pauni City. First Development Plan for Pauni sanctioned by Government letter No. TPV-2480 dated 17th June 1991 and came into force from 1st September 1991.
And whereas, by the government Notification dated 18th April, 2018 Pauni Municipal Council was newly form in Bhandara District. The Pauni Municipal Council by its adminsitrative resolution de- clared its intention to prepare Development Plan as per the provisions of Section 23(1) read with 21(2) of the Maharashtra Regional and Town Planning Act, 1966 for the area within its jurisdiction.
