क्रमांक खाक्षेस. २००८/प्र. क्र. ८०/भाग-२/रस्ते ९.----ज्या अर्थी महाराष्ट्राचे राज्यपाल यांच्या वतीने सचिव, सार्वजनिक बांधकाम विभाग, मंत्रालय, मुंबई आणि मेसर्स ईसीए ईन्फ्रास्ट्रक्चर इंडिया प्रायव्हेट लिमिटेड, ज्यांचे नोंदणीकृत कार्यालय- एम-२, रिजेन्सी गार्डन अपार्टमेंट सपना गार्डनच्या बाजुला, उल्हासनगर ४२१ ००३, जिल्हा ठाणे येथे आहे, यांचे मध्ये ""डी.बी.एफ.ओ.टी."" या तत्वावर जाम-वरोरा-चंद्रपूर रस्ता (राज्य महामार्ग क्र. २६४) कि.मी. ०/००० ते ४०/००० रस्त्याचे चौपदरीकरण करणे भाग-जाम ते वरोरा (एकूण लांबी ४०.०० किमी) तसेच सदर रस्त्याचे परिक्षण, देखभाल व दुरुस्ती करणे. (यापुढे ""सदरचा रस्ता"" म्हणून संबोधण्यात येईल) या प्रकल्पाचा करारनामा दिनांक २४ फेब्रुवारी २०११ रोजी साक्षांकित करण्यात आलेला आहे ;
आणि, ज्याअर्थी, सदर करारनाम्यानुसार सदर रस्त्याचे बांधकाम, वापर व देखभाल दुरुस्तीकरिता ३० वर्षे इतका सवलत कालावधी, २ वषार्ंचा बांधकाम कालावधीसह उद्योजकास दिनांक ०५ एप्रिल २०११ या प्रकल्प सुरू होण्याच्या दिनांकापासून मंजूर करण्यात आलेला आहे ;
आणि, ज्याअर्थी, महाराष्ट्र शासनाची अशी धारणा आहे की, सदर रस्त्याचे बांधकाम, वापर आणि देखभाल दुरुस्ती ही जनतेला दिलेली विशेष सेवा आहे, आणि त्यामुळे सदर रस्त्यावर कि.मी. ८/४०० येथे आरंभा गावाजवळ पथकर स्थानक उभारून पथकर आकारणे व वसुली करणे महाराष्ट्र शासनास योग्य वाटत आहे;
आणि, ज्याअर्थी, महाराष्ट्र शासनाने, शासन अधिसूचना, सार्वजनिक बांधकाम विभाग, क्रमांक खाक्षेस. २००८/प्र.क्र.८०/रस्ते-९, दिनांक २५ जुलै २०१२ अन्वये दिनांक २६ जुलै २०१२ ते २५ जुलै २०१७ पयर्ंत सदर रस्त्यावरून जाणाया वाहनांवर पथकर शुल्क आकारण्यास परवानगी देण्यात आली. तद्नंतर दिनांक २५ जुलै २०१७ अन्वये निर्गमित करण्यात आलेल्या शासन अधिसूचनांद्वारे ३१ मार्च २०१९ पयर्ंत पथकर आकारण्यात आला आहे ;
आणि ज्याअर्थी, महाराष्ट्र शासनास, सदर कालावधी दिनांक ३१ मार्च, २०२२ पयर्ंत वाढविणे योग्य वाटत आहे ;
भाग चार--ब----११५----१
(१)२ महाराष्ट्र शासन राजपत्र असाधारण भाग चार-ब, एप्रिल १, २०१९/चैत्र ११, शके १९४१ आता, त्याअर्थी, महाराष्ट्र मोटार वाहन कर अधिनियम, (१९५८ चा ६५) यांच्या कलम-२० ची पोटकलमे (१-अ), (१-ब), (१-क), (१-ड) आणि (१-इ) द्वारे प्रदान करण्यात आलेल्या आणि त्याला समर्थनीय करणाया अधिकारांचा वापर करून महाराष्ट्र शासन याद्वारे घोषीत करते की, खाजगीकरणाच्या माध्यमातून ""डी.बी.एफ.ओ.टी."" या योजनेतून मेसर्स ईसीए ईन्फ्रास्ट्रक्चर इंडिया प्रायव्हेट लिमिटेड, उल्हासनगर यांनी स्वखर्चाने व शासन सहभागासह सदर रस्त्याचा वापर करणाया व खालील अनुसूचीच्या स्तंभ (२) मध्ये अनुक्रमे विनिर्दीष्ट केलेल्या प्रकाराच्या मोटार वाहनांवर आणि वाहनांकडून ओढून नेल्या जाणाया, अनुयानांवर अनुसूचीच्या स्तंभ (३) मध्ये त्यांच्या समोर विनिर्दीष्ट केलेल्या दराने दिनांक ०१ एप्रिल २०१९ पासून दिनांक ३१ मार्च २०२२ पयर्ंतच्या कालावधीसाठी जाम-वरोरा-चंद्रपूर रस्ता (राज्य महामार्ग क्र.२६४) कि.मी. ०/००० ते ४०/००० रस्त्याचे चौपदरीकरण करणे भाग- जाम ते वरोरा एकूण लांबी ४०.०० किमी या रस्त्यावरील कि.मी. ८/४०० येथे आरंभा गावाजवळ बांधण्यात आलेल्या पथकर वसुली स्थानकावर पथकर शुल्क वसुली करण्याकरिता प्राधिकृत करण्यात येत आहे.

(अ) कार, जीप, टाटा सुमो, कमांडर, ट्रॅक्स, वाहन चालक वगळून सहा आसनी प्रवासी पथकर नाही रिक्क्षा, व इतर तत्सम (चालक वगळून १२ पयर्ंत प्रवासी क्षमता असलेली) वाहने ;
(ब) मिनी बस किंवा तत्सम वाहने (चालक वगळून १२ पेक्षा जास्त पण २० प्रवासी ९५ क्षमते पयर्ंत) आणि क्र. ३, ४ व ५ येथे नमूद केलेल्या वाहनांव्यतिरिक्त्त माल वाहतूक करणारी वाहने.
३ ट्रक (दोन आसांचे), बस.
१८० ४ मोटार वाहन अधिनियम, १९८८ मध्ये व्याख्या केल्याप्रमाणे व अनुक्रमांक ३ मध्ये नमूद ३१० केलेले ट्रक वगळून २ पेक्षा बहु आसांची अवजड वाहने.
१. वरील दर्शविलेल्या पथकर नाक्यावर पथकर शुल्क गोळा करण्याचा व पथकर शुल्काची संपूर्ण रक्कम ठेवून घेण्याचा हक्क मेसर्स ईसीए ईन्फ्रास्ट्रक्चर इंडिया प्रायव्हेट लिमिटेड, उल्हासनगर, जिल्हा ठाणे यांना प्रदान करण्यात आला आहे.
२. खालील वाहनांना पथकरातून सूट देण्यात येईल :----
(१) भारताचे राष्ट्रपती, उपराष्ट्रपती, राज्यांचे राज्यपाल व वाहनांना लाल दिवा अनुज्ञेय असलेल्या अति महत्वाच्या लोकप्रतिनीधींची वाहने.
(२) लोकसभा व राज्यसभेचे विद्यमान सदस्य तसेच महाराष्ट्र विधानसभा व महाराष्ट्र विधानपरिषदेचे विद्यमान सदस्य प्रवास करीत असलेली वाहने.
(३) लोकसभा व राज्यसभेचे माजी सदस्य तसेच महाराष्ट्र विधानसभा व महाराष्ट्र विधानपरिषदेचे माजी सदस्य प्रवास करीत असलेली वाहने.
(४) महाराष्ट्र राज्य रस्ते परिवहन महामंडळाच्या (एस.टी.) प्रवासी बसेस.
(५) स्कूल बसेस.
(६) केंद्र व राज्य शासनाची वाहने.

(८) पोलीस विभागाची वाहने.
(९) टपाल आणि तार खात्याची वाहने.
(१०) रुग्णवाहिका.
(११) शववाहिका.
(१२) अग्निशमन दलाची वाहने.
३. पथकर दराचा फलक पथकर नाक्यावर सवार्ंना दिसेल अशा पद्धतीने लावण्यात यावा. तसेच वाहन धारकांस प्रत्येक वेळी पथकर शुल्क वसुलीची संगणकीकृत पावती देण्यात यावी.
४. सर्व पथकर नाक्यांवर सवार्ंना दिसेल अशा पद्धतीने इलेक्ट्रॉनिक फलक लावण्यात यावा.
टीप.---पथकर शुल्काच्या दरामध्ये खालीलप्रमाणे सूट देण्यात येईल.
(१) पथकराच्या ५० कुपन्सची पुस्तिका आगाऊ खरेदी करणायास पुस्तिकेच्या किंमतीमध्ये १० टक्के सवलत देण्यात येईल.
(२) पथकराच्या १०० कुपन्सची पुस्तिका आगाऊ खरेदी करणायास पुस्तिकेच्या किंमतीमध्ये २० टक्के सवलत देण्यात येईल.
(३) वारंवार प्रवास करणाया वाहनांसाठी परतीच्या प्रवासाचे व दैनिक पासाचे दर हे त्या वाहनाच्या एकेरी प्रवास दराच्या अनुक्रमे दीड पट व अडीच पट राहतील. परतीच्या प्रवासाचा पास व दैनिक पास हा ज्या दिवशी पास काढला जाईल त्या दिवशीच्या रात्री १२.०० वाजेपयर्ंत ग्रा राहील.
(४) मासिक पासाचे दर एकेरी प्रवास दराच्या ५० पट राहतील.
(५) पथकर स्थानकापासून ५ कि.मी. त्रिज्येमधील स्थानिक वाहनांना पथकराच्या एकेरी दराच्या १० पट दराने मासिक पासची तरतूद (वरील वाहन प्रकार अनुक्रमांक ३ व ४ वगळून) करण्यात यावी (ही सवलत फक्त्त स्वत:च्या मालकी वाहनांकरिता राहील),----
(अ) सदर वाहनाची नोंदणी त्या परिसरात केलेली असावी.
(ब) सदर वाहन त्या परिसरात नोंदणी केलेले नसल्यास ज्या व्यक्त्तीच्या नावाने वाहन आहे तो त्या परिसरातील रहिवाशी असल्याबाबत रेशन कार्डाचा किंवा अन्य पुरावा देणे आवश्यक राहील.

NOTIFICATION
MAHARASHTRA MOTOR VEHICLES TAX ACT.
No. PSP. 2008/CR-80/Part-II/Road-9.—Whereas the Governor of Maharashtra through Secretary, Public Works Department, Mantralaya, Mumbai and M/s ECA Infrastructure India Private Limited, having its registered office at M-2, Regency Garden Apartment, Beside Sapna Garden, Ulhasnagar 421 003, District Thane, have entered into Concession Agreement, on the 24th February 2011, including all the subsequent agreements entered between them, for construction, operation and maintenance of Four lanning of Jam - Warora - Chandrapur Road, State Highway No. 264, in kilometers 0/000 to 40/000, section from Jam to Warora under the "Design, Built, Finance, Operate and Transfer (DBFOT) Scheme" by M/s ECA Infrastructure India Private Limited, Ulhasnagar, District Thane ;
And whereas, as per the said agreement the total concession period of 30 years has been granted to the Concessionaire to construct, operate and maintain the said road from the date of commencement of the work. i.e., from the 5th April 2011, which includes the period of construction of two years ;
And whereas, the Government of Maharashtra is of the opinion that the construction, operation and maintenance of the said road is special service to the public and, therefore, considers it expedient to levy and collect the toll on the said road at the toll collection center constructed at kilometer 8/400 near Arambha Village ;
And whereas, the Government of Maharashtra has, vide Government Notification, Public Works Department, No. PSP. 2008/CR-80/Road-9, dated the 25th July 2012, levied toll on the vehicles passing over the said Road, with effect from the 26th July 2012 to the 25th July 2017and thereafter by the Government Notifications, dated the 25th July 2017 upto 31st March 2019 ;
And whereas, the Government of Maharashtra considers it expedient to extend the said period up to the 31st March 2022 ;
Now, therefore, in exercise of the powers conferred by sub-sections (1-A), (1-B), (1-C), (1-D) and (1-E) of section 20 of the Maharashtra Motor Vehicles Tax Act (LXV of 1958), the Government of Maharashtra hereby declares that, the toll shall be levied, on the classes of motor vehicles specified in column (2) of the Schedule appended hereto, passing over the said road, constructed under the "Design, Built, Finance, Operate and Transfer (DBFOT) Scheme" by M/s ECA Infrastructure India Private Limited, Ulhasnagar, District Thane, at the rates and for the period specified against each of the said motor vehicles mentioned in column (3) of the said Schedule, and collected at toll collection center constructed in kilometer 8/400 near Arambha Village on the above mentioned road for the period commencing from the 1st April 2019 and ending on the 31st March 2022.

(3) 2 Light motor vehicles as defined in the Motor Vehicles Act, 1988
(59 of 1988),—
(a) Car, Jeep such as Tata Sumo, Trax, Commander and any other NIL similar vehicles having carriage capacity upto twelve passengers, excluding driver and Six Seater Rickshaw (Tum-Tum);
(b) Mini Bus or any other similar vehicles having carriage capacity of 95 more than twelve and upto twenty passengers excluding driver and goods carriage vehicles, except vehicles included in entries at serial numbers 3 and 4.
3 Trucks (two axles), Buses.
180 4 Heavy goods vehicles and heavy passenger motor vehicles defined in 310 the Motor Vehicle Act, 1988 (59 of 1988), such as multi-axle vehicles except vehicles covered by the entry at serial number 3 above.
1. For the purpose of this notification, M/s ECA Infrastructure India Private Limited, Ulhasnagar, District Thane is authorized to collect and retain the amount of toll at the toll collection center constructed at kilometer 8/400 near Arambha Village on above mentioned road.
2. The following types of vehicles are exempted from payment of toll, namely :—
(i) VVIP vehicles carrying President of India, Vice-President of India, Governor of State, Public Representatives entitled for red lamp on their vehicles.
(ii) Vehicles carrying sitting Members of Parliament, Maharashtra Legislative Assembly and Maharashtra Legislative Council.
(iii) Vehicles carrying Ex-Member of Parliament, Maharashtra Legislative Assembly, Maharashtra Legislative Council.
(iv) Buses of the Maharashtra State Road Transport Corporation (ST).
(v) School Buses.
(vi) State and Central Government vehicles.
(vii) Defence vehicles.
(viii) Police Department vehicles.
(ix) Post and Telegraph Department vehicles.
(x) Ambulances.
(xi) Hearses.
(xii) Fire fighting vehicles.
3. The above mentioned rates shall be displayed on boards clearly visible to the people in the vicinity of the toll collection centre. A computerised toll receipt shall be issued on each and every occasion of recovery of toll.
4. Electronic Display Board clearly visible to the people shall be installed in vicinity of toll collection centre.
Notes.—Concessions in rates of toll are as given below, namely :—
(i) 10 per cent. rebate will be given to the purchaser of booklet containing 50 coupons in advance.
(ii) 20 per cent. rebate will be given to the purchaser of a booklet containing 100 coupons in advance.
६ महाराष्ट्र शासन राजपत्र असाधारण भाग चार-ब, एप्रिल १, २०१९/चैत्र ११, शके १९४१(iii) For frequently traveling vehicles, return and daily pass will be 1.5 times and 2.5 times of their respective one way travel rates. Return journey pass and daily pass will be valid up to 12.00 hours at midnight for the day of issuing the pass.
(iv) Rate of monthly pass will be 50 times of their respective one way travel rates.
(v) The monthly pass concession shall be given to the local vehicles (except for types of vehicles mentioned in serial numbers 3 and 4 of the Schedule above) within the radius of 5.00 kilometers from the toll collection centre and shall be charged 10 times of single journey rate subject to the following conditions (This concession will be valid only for own vehicles),—
(a) the vehicle shall be registered within that area ;
(b) if it is not so then the owner shall give proof of residence by producing ration card or any other the proof of residence.
