महाराष्ट्र खाजगी वने (संपादन) अधिनियम, १९७५.
क्रमांक एस-१०/२०१९/प्र.क्र.९७/फ-३.---- ज्याअर्थी, महाराष्ट्र शासनाच्या असे निदर्शनास आले आहे की, सोबतच्या अनुसूचीत नमूद केलेल्या जमिनी (यापुढे "सदर जमीन" म्हणून उल्लेख केलेली) शासनाची मालमत्ता नसून त्यामध्ये झाडे, झुडपे व गवत आहे आणि ती लोकहितास्तव, महाराष्ट्र खाजगी वने (संपादन) अधिनियम, १९७५ (१९७५ चा महाराष्ट्र अधिनियम २९) (यानंतर अधिनियम म्हणून उल्लेख केलेला) च्या तरतुदीप्रमाणे खाजगी वने म्हणून घोषित करावयाची आहे ;
त्याअर्थी आता, अधिनियमाच्या कलम २१ (१) च्या तरतुदीनुसार महाराष्ट्र शासनाला खाजगी वन घोषित करण्याचे अधिकार प्रदान करण्यात आले आहेत. त्यास अनुसरुन सदर जमीन खाजगी वन म्हणून घोषित करण्यात येत आहे आणि जिल्हाधिकारी, रायगड यांना कलम २१ (२) प्रमाणे चौकशी अधिकारी म्हणून नियुक्त करण्यात येत असून त्यांनी सहा महिन्यांच्या कालावधीत आपला अहवाल शासनास सादर करावा.
जर सदर जमीन खाजगी वने म्हणून घोषित करण्याचा शासनाने निर्णय घेतला तर तो निर्णय महाराष्ट्र शासनाच्या राजपत्रात योग्य वेळी प्रसिद्ध करण्यात येईल. जर सदर जमीन किंवा तिचा काही भाग खाजगी वने म्हणून घोषित न करण्याचा शासनाने निर्णय घेतला तर तो निर्णय सदर जमिनीच्या किंवा तिच्या काही भागाच्या हितसंबंधित व्यक्तींस तसे कळविण्यात येईल.
ही अधिसूचना प्रसिद्ध झाल्याच्या तारखेपासून एक वर्षाचा कालावधी किंवा या अधिनियमाचे कलम २१, पोट-कलम (५) अन्वये अधिसूचना महाराष्ट्र शासनाच्या राजपत्रात प्रसिद्ध करण्यात येईल. त्या तारखेपयर्ंतचा किंवा यथास्थित या अधिनियमाचे कलम २१, पोट-कलम (७) अन्वये निर्णय कळविण्याच्या तारखेपयर्ंतचा कालावधी यापैकी जो कालावधी आधी संपेल त्या कालावधीत अशा जमिनीच्या मालकांनी किंवा कोणत्याही इतर व्यक्तीने, विभागीय वन अधिका-यांच्या लेखी पूर्वपरवानगीने असेल त्याखेरीज, त्या जमिनीत पुढीलपैकी कोणतीही गोष्ट करणे विधिसंमत असणार नाही :----
(अ) लागवडीसाठी वनाची तोड किंवा जमिनीची सफाई करणे.
(ब) गुरे चारणे.

(ड) कोणत्याही झाडाच्या खोडाभोवती कडे करणे किंवा त्याला खाप पाडणे किंवा ते जाळणे किंवा कोणत्याही झाडाच्या साली किंवा पाने काढणे.
(ई) झाडाच्या फांदया तोडणे व वरचा भाग छाटणे.
(फ) झाडे व इमारती लाकडाची झाडे तोडणे, करवतीने त्यांचे रुपांतर करणे आणि ती हलविणे, किंवा
(ग) खाणीतून दगड काढणे किंवा चुना किंवा कोळसा भाजणे किंवा कोणतेही उत्पादन गोळा करणे किंवा हलविणे किंवा त्यावर कोणतीही र्िनमितीची प्रक्रिया करणे.

NOTIFICATION
MAHARASHTRA PRIVATE FORESTS (ACQUISITION) ACT, 1975.
No. S-10/2019/C.R.97/F-3.— Whereas, it appears to the Government of Maharashtra that the tract of land described in the schedule hereto (hereinafter referred to as "the said land") not being the property of the Government contains trees, shrubs and pasture lands, and that it should be declared, in public interest and for futherance of the object of the Maharashtra Private Forests (Acquisition) Act, 1975 (Mah.XXIX of 1975) (hereinafter referred to as "the said Act") to be a private forest;
Now, therefore, in exercise of the powers conferred by sub-section (1) of section 21 of the said Act, it is hereby declared by the Government of Maharashtra that it is proposed to declare the said land to be a private forest and Collector, Raigad is appointed as Enquiry Officer under sub-section (2) of section 21 to hear the objections, if any and submit the report to Government within six months.
If the Government decides to declared the said land or any part therefore to be a private forest, the decision will be published by the Government in the Maharashtra Government Gazette, in due course. If it is decided by the Government not to declare the said land or any part thereof to be a private forest such decision will be communicated to all persons interested in the said land or any part thereof.
From the date of publication of this notification in the Maharashtra Government Gazette, in respect of the said land, it shall not be lawful for the owner of the said land or any part thereof, or any other person to do therein, except with the previous permission in writing of the Deputy Conservator of Forests, any of the following things, for a period of one year from the date of such publication or till the date of the publication of the notification under sub-section (5) or the said section 21 notifying Government's decision declaring the said land or any part thereof, to be a private forest, or as the case may be till the date if communication, under sub-section (7) of the said section 21, to all persons interested in the said land or any part there of, The Government decision not to declare the said land or any part thereof to be a private forest, whichever period expires earlier, namely :—
(a) the said breaking up or clearing of the said land for cultivation;
(b) the pasturing of cattle;
(c) the firing or clearing of the vegetation;
(d) the girdling tapping or burning of any tree or the stripping off the bark of leaves from any tree;
(e) the lopping and pollarding of tree;
(f) the cutting sawing, conversion and removal of trees and timber; or
(g) the quarrying of stone or the burning of time or charcoal or the collection or removal of any forest produce or its subjection to any manufacturing process.
