४. श्रीमती शितल तेली-उगले, भाप्रसे (महा : आरआर : २००९), अतिरिक्त महापालिका आयुक्त, पुणे महानगरपालिका, पुणे यांची बदली महानगर आयुक्त, नागपूर महानगर प्रदेश विकास प्राधिकरण, नागपूर त्या पदावर करण्यात आली आहे. त्यांनी या पदाचा कार्यभार दिनांक ३१ डिसेंबर २०१८ (मध्यान्हपूर्व) पासून स्वीकारला आहे.

५. श्री. जे. एस. पापळकर, भाप्रसे (महा : एसीसीएस : २०१०), मुख्य कार्यकारी अधिकारी, जिल्हा परिषद, चंद्रपूर यांची बदली जिल्हाधिकारी, अकोला या पदावर करण्यात आली आहे. त्यांनी या पदाचा कार्यभार दिनांक २१ फेब्रुवारी २०१९ (मध्यान्होत्तर) पासून स्वीकारला आहे.

क्रमांक कक्ष-१/पिओएल/२/६८३/२०१८.— जिल्हादंडाधिकारी, नाशिक, जिल्हा नाशिक यांच्यातर्फे उपरोक्त शासन निर्णयाद्वारे सोबत जोडलेल्या अनुसूचीमध्ये विर्िनदिष्ट केलेल्या व्यक्तींची नाशिक जिल्ह्यचे विशेष कार्यकारी अधिकारी म्हणून शासन मान्यतेनुसार नेमणूक करण्यात आलेली आहे. ही नेमणूक ही अधिसूचना निर्गमित केलेल्या तारखेपासून पुढील आदेश होईपयर्ंत अस्तित्वात राहील. राज्य शासनास विशेष कार्यकारी अधिकारी यांची ही नेमणूक वरील कालावधी पूर्ण होण्यापूर्वी कोणतीही कारणे न देता संपुष्टात आणण्याचा अधिकार आहे.

(अ) विशेष कार्यकारी अधिकारी पुढे उल्लेख केलेली कर्तव्ये पार पाडण्यासाठी सक्षम राहतील .—

(१) साक्षांकनाचे काम.—साक्षांकनासाठी, पडताळणीसाठी किंवा यथास्थिती अधिप्रमाणासाठी त्यांच्यापुढे आणलेल्या दस्ताऐवजीचे साक्षांकन, पडताळणी किंवा अधिप्रमाणान करणे आणि राज्य शासनाने याबाबत काढलेल्या आदेशानुसार असा दस्तऐवजांवर त्यांची विहित मोहोर उमटवणे व तारखेसह स्वाक्षरी करणे व स्वाक्षरीखाली स्वत:चे नावही लिहीणे.

(२) या शासन निर्णयाद्वारे केलेल्या विशेष कार्यकारी अधिकारी यांच्या नियुक्त्या मानसेवी असून त्यांना सोपविण्यात आलेल्या कामांबाबत कोणतेही मानधन, वेतन किंवा भत्ते अनुज्ञेय राहणार नाही.

(३) प्रत्येक विशेष कार्यकारी यांनी आपल्या नियुक्तीची वैध सुस्पष्टपणे दर्शविणारे प्रमाणपत्र आपल्या विशेष कार्यकारी अधिकारी पदाच्या कामाच्या जागी सवार्ंना सहजपणे दिसेल अशा ठिकाणी लावावे व या कामासाठी येणाया व्यक्तीने मागणी केल्यास ते त्या व्यक्तीस दाखवावे.

(१) वसुली अधिकारी यांनी महाराष्ट्र सहकारी संस्था अधिनियम, १९६० चे कलम १५६ व नियम, १९६१ चे नियम १०७ मधील तरतुदीनुसार कर्ज वसुलीची कार्यवाही करावी. कर्ज वसुली करताना सहकार कायदा, नियम यातील तरतुदी व परिपत्रकीय सूचनांचे पालन न केल्याचे निदर्शनास आल्यास, आवश्यक ती चौकशी करून आवश्यकता भासल्यास, सदरचे प्रदान केलेले अधिकार तत्काळ काढून घेण्यात येतील.

(२) सदरचे अधिकार सहकार कायदा कलम १०१ व कलम ९१ अन्वये प्राप्त वसुली दाखल्याची अंमलबजावणी करण्याकरिता असतील.

(३) वसुली अधिकारी यांनी या कार्यालयाने दिनांक २४ जून २०१६ रोजी निर्गमित केलेल्या परिपत्रकानुसार दरमाह विहित नमुन्यात अ-३, अ-४ व ब कर्ज वसुलीची माहिती जिल्हा उप निबंधक, सहकारी संस्था, नाशिक यांना सादर करावी.

(४) वसुली अधिकार प्रदान केलेल्या व्यक्तीची बदली झाल्यास किंवा सदर व्यक्ती सेवानिवृत्ती झाल्यास किंवा सदर व्यक्तीस सेवेतून काढून टाकल्यास किंवा त्याचा मृत्यू झाल्यास, अशा अधिकायास प्रदान केलेले अधिकार आपोआप रद्द होतील.

(५) मा. उच्च न्यायालय, मुंबई यांनी रिट याचिका क्रमांक १९४२/२०१३, दि बेसिन कॅथोलिक को-ऑप. बँक विरुद्ध महाराष्ट्र राज्य व इतर या याचिकेमध्ये दिनांक ५ डिसेंबर २०१५ रोजी दिलेला आदेश विचारात घेऊन वसुलीची कार्यवाही करताना महाराष्ट्र सहकारी संस्था अधिनियम, १९६० व नियम, १९६१ अन्वये प्राप्त असलेल्या अधिकारानुसारच वसुलीची कार्यवाही करावी.

(६) वसुली अधिकारी यांनी नमूद केलेल्या कालावधीत वसुलीचे कामकाज समाधानकारक केले नसल्याचे निदर्शनास आल्यास किंवा प्रदान केलेल्या अधिकाराचा गैरवापर करीत असल्याचे निदर्शनास आल्यास, प्रदान केलेले अधिकार काढून घेतले जातील व भविष्यात असे कोणतेही अधिकार अशा व्यक्तीस प्रदान करण्यात येणार नाहीत.

(७) शासन निर्णय क्रमांक संकीर्ण.१५०४/प्र.क्र.२३१/१५-स, दिनांक २३ नोव्हेंबर २००६ अन्वये वसुली अधिकायांना तीन सिंहाच्या राजमुद्रेचा वापर करता येणार नाही.

(८) वसुली अधिकायास त्याच्या नावापुढे कोठेही ""महाराष्ट्र शासन नियुक्त"" आणि किंवा "" सिव्हील कोर्ट"", ""एक्झीक्युटीव्ह कोर्ट"" या शब्दांचा अथवा तत्सम शब्दांचा वापर करता येणार नाही. त्याऐवजी वसुली अधिकायंानी त्यांच्या नावापुढे "" वसुली अधिकारी (महाराष्ट्र सहकारी संस्था अधिनियम, १९६० व नियम, १९६१ चे नियम १०७ अन्वये)"" असे लिहावे.

(९) वसुली अधिकायास वसुलीसाठी वापर करण्यात येणाया वाहनावर ""वसुली अधिकारी, लोकनेते दत्ताजी पाटील सहकारी बँक लि., लासलगांव"" असा फलक लावता येऊ शकेल.

(१०) वसुली अधिकायाने पगार जप्तीची कार्यवाही करताना कर्जदाराच्या/जामीनदाराच्या पगार कपातीबाबत राष्ट्रीयकृत बँका वा अन्य बँका यांच्याकडे परस्पर वेतन कपातीचा आदेश देऊन परस्पर पगार कपात करता येणार नाही. संबंधित कर्जदार/जामीनदार ज्या आस्थापनेवर काम करीत आहे त्या आस्थापनेवरील आहरण व संवितरण अधिकारी/पगार करणारा अधिकारी यांचेमार्फत पगारातून कर्ज वसूल करण्याची कार्यवाही करावी.

(११) वसुली अधिकायास, थकबाकीदाराकडून वसुली दाखल्यानुसार वसूलपात्र रक्कम व सरचार्च रक्कम याशिवाय इतर कोणतीही रक्कम वसूल करता येणार नाही.

(१२) या कार्यालयाचे आदेश/परिपत्रक दिनांक १ जानेवारी २०१७ मधील क्र. ४ कलम १५६ व नियम १०७ अन्वये वसुली अधिकायांनी करावयाची कार्यवाही यामधील मार्गदर्शक सूचनांचे पालन करावे. बँकेचे मुख्य कार्यकारी अधिकारी यांनी दरमहा वसुली अधिकायांचे कामकाजाचा कर्जदारनिहाय आढावा परिपत्रकातील प्रपत्र पाच मध्ये नमूद केल्याप्रमाणे घ्यावा.

(१३) वसुली अधिकारी यांनी निर्गमित करावयाच्या नोटीस/आदेश/घोषणा यामध्ये त्यांना अधिकार प्रदान केलेल्या या आदेशाचा संदर्भ नमूद करावा.

अटी---

(१) आपण महाराष्ट्र सहकारी संस्था अधिनियम, १९६० चे कलम १५६ व नियम, १९६१ चे नियम १०७ मधील तरतुदीनुसार कर्ज वसुलीची कार्यवाही करावी. कर्ज वसुली करताना सहकार कायदा, नियम यातील तरतुदी व परिपत्रकीय सूचनांचे पालन न केल्याचे निदर्शनास आल्यास, आवश्यक ती चौकशी करून आवश्यकता भासल्यास, सदरचे प्रदान केलेले अधिकार तत्काळ काढून घेण्यात येतील.

(२) सदरचे अधिकार सहकार कायदा कलम १०१ व कलम ९१ अन्वये प्राप्त वसुली दाखल्याची अंमलबजावणी करण्याकरिता असतील.

(३) आपण दरमाह सोबत जोडलेल्या विहित नमून्यात "अ-३", "अ-४" व "ब" कर्ज वसुलीची माहिती संबंधित जिल्हा उप निबंधक, सहकारी संस्था, कार्यालयास सादर करावी.

(४) आपली झाल्यास किंवा सेवा निवृत्ती झाल्यास किंवा सेवेतून काढून टाकल्यास किंवा मृत्यू झाल्यास, प्रदान केलेले अधिकार आपोआप रद्द होतील.

(५) आपण केलेल्या संपूर्ण सरचार्ज रकमेचा भरणा वसुल केलेल्या महिन्यातच चलनाने शासकीय कोषागारात करावा. वसूल केलेला सरचार्ज, त्याचा शासकीय कोषागारात केलेला भरणा या बाबत संस्था स्तरावर स्वतंत्र नोंदवही सोबत जोडलेल्या नमुना "अ-१", "अ-२" "अ-३", "अ-४" मध्ये ठेवावी.

(६) मा. उच्च न्यायालय, मुंबई यांनी रिट याचिका क्रमांक १९४२/२०१३, दि बेसिन कॅथोलिक को-ऑप. बँक विरुद्ध महाराष्ट्र राज्य व इतर याचिकेमध्ये दिनांक ५ डिसेंबर २०१६ रोजी दिलेला आदेश विचारात घेऊन व वसुलीची कार्यवाही करताना महाराष्ट्र सहकारी संस्था अधिनियम, १९६० व नियम, १९६१ अन्वये प्राप्त असलेल्या अधिकारानुसारच वसुलीची कार्यवाही करावी. भाग एक (म.उ.वि.)--३अ२० महाराष्ट्र शासन राजपत्र, भाग एक--मध्य उप-विभाग, गुुरुवार ते बुधवार, एप्रिल २५-मे १, २०१९/वैशाख ५-११, शके १९४१ (७) आपण नमूद केलेल्या कालावधीत वसुलीचे कामकाज समाधानकारक केले नसल्याचे निदर्शनास आल्यास किंवा प्रदान केलेल्या अधिकाराचा गैरवापर करीत असल्याचे निदर्शनास आल्यास, प्रदान केलेले अधिकार काढून घेतले जातील व भविष्यात असे कोणतेही अधिकार अशा व्यक्तीस प्रदान करण्यात येणार नाही.

(८) शासन निर्णय क्रमांक संकीर्ण.१५०४/प्र.क्र.२३१/१५-स, दिनांक २३ नोव्हेंबर २००६ अन्वये आपणास तीन सिंहाच्या राजमुद्रेचा वापर करता येणार नाही.

(९) आपणास आपल्या नावापुढे कोठेही ""महाराष्ट्र शासन नियुक्त"" किंवा "" सिव्हील कोर्ट"", ""एक्झीक्युटीव्ह कोर्ट"" या शब्दांचा अथवा तत्सम शब्दांचा वापर करता येणार नाही. त्याऐवजी वसुली "" वसुली अधिकारी (महाराष्ट्र सहकारी संस्था अधिनियम, १९६० व नियम, १९६१ चे नियम १०७ अन्वये"") असे लिहावे.

(१०) आपण वसुलीसाठी वापर करण्यात येणाया वाहनावर ""वसुली अधिकारी ............................ सहकारी बँक/पतसंस्था ..................."" असा फलक लावता येऊ शकेल.

(११) आपण पगार जप्तीची कार्यवाही करताना कर्जदाराच्या/जामीनदाराच्या पगार कपातीबाबत राष्ट्रीयीकृत बँका वा अन्य बँका यांच्याकडे परस्पर वेतन कपातीचा आदेश देऊन परस्पर पगार कपात करता येणार नाही. संबंधित कर्जदार/जामीनदार ज्या आस्थापनेवर काम करीत आहे त्या आस्थापनेवरील आहरण व संवितरण अधिकारी/पगार करणारा अधिकारी यांचेमार्फत पगारातून कर्ज वसूल करण्याची कार्यवाही करावी.

(१२) आपणास थकबाकीदाराकडून वसुली दाखल्यानुसार वसूलपात्र रक्कम व सरचार्ज रक्कम याशिवाय इतर कोणतीही रक्कम वसूल करता येणार नाही.

(१३) नुतणीकरणाचा प्रस्ताव मा. सहकार आयुक्त व निबंधक, सहकारी संस्था, म.रा.पुणे यांचे परिपत्रक दिनांक १ जानेवारी २०१७ मध्ये दिलेल्या सुचनेनुसारच प्रस्ताव दाखल करण्यात यावा.
