महाराष्ट्र प्रादेशिक व नगररचना अधिनियम, १९६६.
क्रमांक टीपीएस. १७१९/४६/प्र. क्र. ७२/१९/नवि-१२.----ज्याअर्थी, पेण शहराची सुधारित विकास योजना (दुसरी सुधारित) (यापुढे जिचा उल्लेख '' उक्त विकास योजना '' असा करण्यात आला आहे.) महाराष्ट्र प्रादेशिक व नगररचना अधिनियम, १९६६ (यापुढे ज्याचा उल्लेख '' उक्त अधिनियम '' असा करण्यात आला आहे.) च्या कलम ३१(१) अन्वये शासन नगरविकास विभागाची अधिसूचना क्रमांक टीपीएस. १७१५/२४८५/ प्र.क्र. १५०/१५/एसएम/नवि-१२, दिनांक २३ मार्च, २०१७ अन्वये भागश: मंजूर झाली असून, ती दिनांक २३ एप्रिल २०१७ पासून अंमलात आली आहे आणि उक्त विकास योजनेचा वगळलेला भाग उक्त अधिनियमाच्या कलम ३१(१) मधील तरतुदीनुसार शासन नगरविकास विभागाची अधिसूचना क्रमांक टीपीएस. १७१५/२४८५/प्र.क्र. १५०/१५/ईपी/नवि-१२, दिनांक २९ जानेवारी, २०१९ रोजी मंजूर झाला असून तो दिनांक १३ मार्च २०१९ पासून अंमलात आला आहे (यापुढे ज्यांचा एकत्रित उल्लेख '' उक्त अधिसूचना '' असा करण्यात आला आहे.) ;
आणि ज्याअर्थी, उक्त विकास योजनेमध्ये मौ. पेण येथील स.नं. २६१, हिस्सा नं. १ (पैकी) ही जमीन ना-विकास विभागात समाविष्ट आहे (यापुढे ज्याचा उल्लेख '' उक्त जमीन '' असा करण्यात आला आहे.) ;
आणि ज्याअर्थी, पेण नगरपालिकेने (यापुढे जिचा उल्लेख '' उक्त नगरपालिका '' असा करण्यात आला आहे.) उक्त अधिनियमातील कलम ३७(१) अन्वयेची सर्व वैधानिक कार्यवाही पूर्ण करून उक्त जमीन ना-विकास विभागातून वगळून रहिवास विभागात समाविष्ट करण्याचा प्रस्ताव दिनांक ३ डिसेंबर २०१८ च्या पत्रान्वये शासनाच्या मंजुरीकरिता सादर केला आहे. (यापुढे ज्याचा उल्लेख '' उक्त फेरबदल '' असा करण्यात आला आहे.) ;
आणि ज्याअर्थी, आवश्यक ती चौकशी केल्यानंतर व संचालक, नगररचना, महाराष्ट्र राज्य, पुणे यांचा सल्ला घेतल्यानंतर उक्त फेरबदल काही बदलांसह मंजूर करणे आवश्यक आहे, असे शासनाचे मत झाले आहे ;
आता, त्याअर्थी, उक्त अधिनियमाच्या कलम ३७ चे पोट-कलम (२) अन्वये शासनास प्रदत्त असलेल्या शक्तींचा वापर करून शासन उक्त फेरबदल प्रस्ताव काही बदलांसह मंजूर करीत असून, त्यासाठी उक्त विकास योजना मंजुरीच्या अधिसूचनेतील फेरबदसाच्या अनुसूचीमध्ये शेवटच्या नोंदीनंतर पुढील नवीन नोंद समाविष्ट करण्यात येत आहे ;

'' विकास योजना भाग नकाशात दर्शविल्याप्रमाणे मौ. पेण येथील स. नं. २६१, हि. नं. १, ह्य जमिनीपैकी नदी किनारी ३०.०० मी. रूंदीचा पट्टा ना-विकास विभागात कायम ठेऊन, उर्वरित जमीन ना-विकास विभागातून वगळून रहिवास विभागात समाविष्ट करण्यात येत आहे. '' २. सदरचा मंजूर फेरबदल ही अधिसूचना शासन राजपत्रात प्रसिद्ध झाल्याच्या दिनांकापासून अंमलात येईल.
३. उक्त मंजूर फेरबदल दर्शविणारा भाग नकाशा नागरीकांच्या अवलोकनार्थ कार्यालयीन वेळेमध्ये कामकाजाच्या दिवशी खाली नमूद कार्यालयांमध्ये एक महिन्याच्या कालावधीकरिता उपलब्ध राहील.

(२) सहायक संचालक, नगररचना, रायगड-अलिबाग शाखा, अलिबाग.

४. सदर फेरबदलाची अधिसूचना ही महाराष्ट्र शासनाच्या www.maharashtra.gov.in या वेबसाईटवर उपलब्ध आहे.

NOTIFICATION
MAHARASHTRA REGIONAL AND TOWN PLANNING ACT, 1966.
No. TPS. 1719/46/CR-72/19/UD-12.—Whereas, the Revised Development Plan of the city of Pen (Second Revised) (hereinafter referred to as '' the said Development Plan '') has been sanctioned by the Government in Urban Development Department, under section 31(1) of the Maharashtra Regional and Town Planning Act, 1966 (hereinafter referred to as '' the said Act '') Partly vide Notification No. TPS. 1715/2485/CR-150/15/SM/ UD-12, dated the 23rd March, 2017 and the same had come into force with effect from 23rd April, 2017 and the Excluded Part of the said Development Plan has been sanctioned by the Government in Urban Development Department under section 31(1) of the said Act, vide Notification No. TPS. 1715/2485/CR-150/15/EP/UD-12, dated the 29th January 2019 which has come into force with effect from 13th March 2019 (hereinafter collectively referred to as '' the said Notification '') ;
And whereas, in the said Development Plan, land bearing S. No. 261, Hissa No. 1 (pt.) of Village Pen is included in No Development Zone (hereinafter referred to as '' the said land '') ;
And whereas, Pen Municipal Council (hereinafter referred to as '' the said Municipal Council ''), after following the legal procedure under sub-section (1) of section 37 of the said Act, has submitted a proposal for modification in the said Development Plan so as to delete the said land from No Development Zone and to include the same in Residential Zone vide letter dated 3rd December 2018 (hereinafter referred to as '' the said Modification '') ;
And whereas, after making necessary enquiries and after consulting the Director of Town Planning, Maharashtra State, Pune, the State Government is of the opinion that it is necessary to sanction the said modification with some changes ;
Now therefore, in exercise of the powers conferred under sub-section (2) of section 37 of the said Act, the State Government hereby sanctions the said modification proposal with changes as described below :—
'' In the Schedule of modifications appended with the said Notification after the last entry, the following new entry shall be inserted.
ENTRY
'' Out of the land bearing S. No. 261, Hissa No. 1 except a strip of 30.00 mt. wide No Development Zone along the riverside, remaining area is deleted from No Development Zone and land so deleted is included in Residential Zone as shown on part plan of the said Development Plan. ''
2. The date of publication of this Notification in the Maharashtra Government Gazette is fixed as the date of coming into force of this sanctioned modification.
3. The part plan showing the said sanctioned modification is available for inspection by the general public during office hours on all working days at the following offices for a period of one month :—
(i) The Joint Director of Town Planning, Konkan Division, Konkan Bhavan, Navi Mumbai.
(ii) The Assistant Director of Town Planning, Raigad-Alibaug Branch, Dist, Raigad.
(iii) The Chief Officer, Pen Municipal Council, Alibaug, Dist. Raigad.
