कीटकनाशके अधिनियम, १९६८.

क्रमांक सीपीएस-१११९/प्र.क्र.२९७/१७-अे.ज्याअर्थी, राज्य शासनाचे-(क) यासोबत जोडलेल्या अनुसूचीमध्ये विर्िनदिष्ट केलेल्या कीटकनाशकांचा वापर केल्यानंतर अमरावती महसूल विभागातील अकोला, अमरावती, बुलढाणा, वाशिम व यवतमाळ या जिल्ह्यंमधील मोठया प्रमाणावर शेतमजूरांना व शेतकयांना विषबाधा झाल्याचे उघड झाले असल्याचे कळविण्यात आले आहे ;

(ख) अशा कीटकनाशकांमुळे विषबाधा झाल्याच्या घटना राज्यात, विशेषत: अमरावती महसूल विभागामध्ये पुन्हा उद्भवल्या आहेत. या घटनांमध्ये, कीटकनाशकांमुळे झालेल्या विषबाधेच्या उपचारासाठी विविध रुग्णालयांमध्ये माहे एप्रिल २०१९ पासून शेतमजूर व शेतकरी यांना उपचारासाठी दाखल करण्यात आलेले आहेत ;

(ग) ही कीटकनाशके एकतर आत्यंतिक किंवा अति विषारी आहेत, परंतु अनधिकृत रीतीने संमिश्रणासाठी वापर केल्यामुळे त्यांचा अत्यंत विषारी प्रभाव असतो ;

(घ) महाराष्ट्र शासनाने, आपल्या दिनांक २७ मार्च २०१८ च्या प्रस्तावाद्वारे या कीटकनाशकांची विक्री, वितरण किंवा वापर यांवर कायमस्वरुपी बंदी घालण्याची विनंती केंद्रीय कीटकनाशक मंडळ व नोंदणी समिती, फरिदाबाद यांना केली आहे. केंद्र सरकार उक्त प्रस्तावाबाबत अजूनही आढावा घेऊन चौकशी करीत आहे;

यांसारख्या कारणांसाठी असे मत आहे ;

आणि ज्याअर्थी, या कीटनाशकांचे धोकादायक स्वरुप तसेच कीटकनाशकांमुळे विषबाधा होण्याच्या वारंवार घडणाया घटना विचारात घेता, राज्य शासनाने सादर केलेल्या प्रस्तावावर केंद्र सरकारकडून आढावा घेऊन चौकशी करण्याच्या कालावधीमध्ये, या कीटकनाशकांची यापुढील विक्री, वितरण व वापर करण्यास तातडीने बंदी घालणे गरजेचे आहे ;

भाग चार-अ–२५०—१ (१)२ महाराष्ट्र शासन राजपत्र असाधारण भाग चार-अ, सप्टेंबर १८, २०१९/भाद्र २७, शके १९४१ आणि ज्याअर्थी, उक्त अनुसूचीमध्ये विर्िनदिष्ट केलेल्या कीटकनाशकांचा किंवा त्यांच्या कोणत्याही गटांचा किंवा अशा कीटकनाशकांच्या कोणत्याही मिश्रणांचा वापर मनुष्यजातीस किंवा प्राण्यांना धोकादायक असण्याचा संभव आहे ;

त्याअर्थी, आता, कीटकनाशके अधिनियम, १९६८ (१९६८ चा ४६) याच्या कलम २७ च्या पोट-कलम (१) द्वारे प्रदान केलेल्या अधिकारांचा वापर करुन, महाराष्ट्र शासन, याद्वारे, या प्रकरणातील अन्वेषण पूर्ण होईपयर्ंत, यासोबत जोडलेल्या अनुसूचीमध्ये विर्िनदिष्ट केलेल्या कीटकनाशकांची किंवा त्यांच्या कोणत्याही गटांची किंवा त्यांच्या कोणत्याही मिश्रणांची, राजपत्रात अधिसूचना प्रसिद्ध झाल्याच्या दिनांकापासून साठ दिवसांच्या कालावधीकरिता अमरावती महसूल विभागातील अकोला, अमरावती, बुलढाणा, वाशिम व यवतमाळ जिह्यंमध्ये विक्री, वितरण किंवा वापर करण्यास मनाई करीत आहे.

NOTIFICATION

INSECTICIDES ACT, 1968.

No.CPS-1119/C.R.297/17A.—Whereas, the State Government is of the opinion, for the reasons such as-

(a) large number of farm labourers and farmers have been reported to have been exposed to poisoning, after using insecticides specified in the Schedule appended hereto, in Akola, Amaravati, Buldhana,Washim and Yavatmal districts of Amaravati revenue division ;

(b) the occurrences of such insecticides poisoning has again arise in the State particularly in Amravati Revenue Division. In these occurrences, farm labourers and farmers are admitted in the various hospitals for the treatment of the insecticides poisoning since the month of April, 2019 ;

(c) these insecticides are either extremely or highly toxic, but have highly toxic effect due to use for blending in an unauthorised manner ;

(d) the Govrnment of Maharashtra has requested Central Insecticides Board and Registration Committee, Faridabad by its proposal dated the 27th March 2018, to ban these insecticides to distribute, sale or use, permanently. The Central Government is still reviewing and enquiring the said proposal ;

And whereas in view of hazardous nature of these insecticides and repeated occurrences of insecticides poisoning, it is in urgent need to ban for further sale, distribution and use of these insecticides during the period of review and enquiry by the Central Government in the proposal which has been submitted by the State Government ;

And whereas, the use of the insecticides specified in the said Schedule or any batches thereof any combinations of such insecticides is likely to involve risk to human beings or animals ;

Now, therefore, in exercise of the powers conferred by sub-section (1) of section 27 of the Insecticides Act,1968 (46 of 1968), the Government of Maharashtra hereby prohibits the sale, distribution or use of the insecticides or any batches thereof or any combinations thereof, as specified in the Schedule appended hereto in Akola, Amaravati, Buldhana, Washim and Yavatmal districts of Amravati Revenue Division for the period of sixty days, from the date of publication of the notification in the Official Gazette, pending investigation into the matter.
