कारखाने अधिनियम, १९४८.
क्रमांक एफएसी-२०१९/प्र.क्र.१५७/कामगार-४.----- कारखाने अधिनियम, १९४८ (१९४८ चा त्रेसष्ठ) (यात यापुढे ज्याचा ""उक्त अधिनियम"" असा उल्लेख करण्यात आला आहे) च्या कलम १९ चे पोट-कलम (३) तसेच कलम ११२ अन्वये प्रदान करण्यात आलेल्या अधिकारांचा आणि या बाबतीत महाराष्ट्र शासनास समर्थ करणाया इतर सर्व अधिकारांचा वापर करून महाराष्ट्र शासन याद्वारे महाराष्ट्र कारखाने नियम, १९६३ मध्ये आणखी सुधारणा करण्यासाठी पुढील नियम तयार करीत आहे. हे नियम उक्त अधिनियमाच्या कलम ११५ द्वारे आवश्यक असल्याप्रमाणे यापूर्वी प्रसिद्ध करण्यात आलेले आहेत.
नियम
१. ह्य नियमांना महाराष्ट्र कारखाने (सुधारीत) नियम, २०१९ असे म्हणावे.
२. महाराष्ट्र कारखाने नियम, १९६३ (यापुढे ज्याचा ""मुख्य नियम"" असा उल्लेख करण्यात आला आहे) च्या नियम ४५ च्या खंड (ब) नंतर खालील खंड दाखल करण्यात यावेत :-----
""(क) महिलांच्या वापराकरिता त्यांच्या प्रसाधनगृहामध्ये भारतीय मानकानुसार पुरेशा प्रमाणात सॅनिटरी नॅपकिन्स पुरविण्यात याव्यात व सुस्थितीत ठेवण्यात याव्यात, तसेच त्यांच्या साठयाची दररोज भरपाई करण्यात यावी.
(ड) वापरण्यात आलेल्या सॅनिटरी नॅपकिन्स गोळा करण्यासाठी महिला प्रसाधनगृहामध्ये नष्ट करता येऊ शकेल अशा झाकण असलेल्या कचरा कुंडया पुरविण्यात याव्यात. वापरण्यात आलेल्या सॅनिटरी नॅपकिन्सची निरीक्षकांनी मंजूर केलेल्या पद्धतीप्रमाणे विल्हेवाट लावण्यात यावी."" २ महाराष्ट्र शासन राजपत्र असाधारण भाग एक-ल, सप्टेंबर १९, २०१९/भाद्र २८, शके १९४१ In pursuance of clause (3) of Article 348 of the Constitution of India, the following translation in English of the Government Notification, Industries, Energy and Labour Department, No. FAC-2019/C.R.157/Lab-4, dated the 19th September 2019 is hereby published under the authority of the Governor of Maharashtra. NOTIFICATION
THE FACTORIES ACT, 1948.
No. FAC-2019/C.R.157/Lab-4.—In exercise of the powers conferred by Section 19(3) and section 112 of the Factories Act, 1948 (63 of 1948), and of all other powers enabling it in that behalf; the Government of Maharashtra hereby makes the following rules further to amend the Maharashtra Factories Rules, 1963, after the same having being previously published as required by section 115 of the said Act, namely :—
Rules
1. These Rules may be called The Maharashtra Factories (Amendment) Rules, 2019.
2. In Rule 45 of the Mahrashtra Factories Rules, 1963 (hereinafter referred to as " the principal Rules"), after the clause (b), the following clauses shall be added namely :—
"(c) Sanitary Napkins of adequate quantity conforming to Indian Standards shall be provided and maintained in the women's toilets for their use, and the same replenished on daily basis.
(d) Disposable bins with lids shall be provided within the women's toilets for the collection of the used napkins. The used napkins shall be disposed off as per the procedure approved by the Inspector."
