Whereas, the Government has sanctioned the Second Revised Development Plan of Nagpur Municipal Corpora- tion (hereinafter referred to as " the said Development Plan ") vide Urban Development Departments Notification No. TPS-2496-2643-CR-300(A)-97-UD-9, dated 7th January, 2000 under sub section (1) of Section 31 of the Maharashtra Regional and Town Planning Act, 1966 (Mah. XXXVII of 1966) (hereinafter referred to as " the said Act ") which has come into force with effect from 1st March, 2000 ;

And whereas, in the said Development Plan, the land bearing Khasara No. 109, 110/2,3, C.T.S. No. 62(pt.) admeasuring area 42103.92 Sq. Mt. of Mouja Nari are included in Residential Zone and land bearing Khasara No. 24/4, 24/6, C.T.S No. 29 & 30 admeasuring are 14164.15 Sq. Mt of Mouja Wanjara is included in Industrial Zone (hereinafter referred to as " the said Lands ") ;

And whereas, the Chief Executive Officer, Slum Rehabilitation Authority, Nagpur has requested to Government to make modification on the said lands to reserve for Public Housing to implement "Pradhan Mantri Awas Yojana" through Slum Rehabilitation Authority (hereinafter referred to as "the said Proposals") ;

And whereas, the State Government is of opinin that, in the public interest, it is necessary to reserve said lands for "Public Housing" and for that purpose appropriate authority as Nagpur Municipal Corporation/Slum Rehabilitation Authority, Nagpur (hereinafter referred to as the said "Modification") ;

Now therefore, in exercise of the powers vested under section 37 (1AA) (a) of the said Act, The Government hereby publishes this Notice for inviting suggestion/Objection from the general public in respect of the said Modification, as specified in the Schedule, within a period of one month from the date of publication of this notice on the Official Gazette. Any Suggestion/Objection in respect of the said Modification should be forwarded to the Joint Director of Town Planning, Nagpur Division, Nagpur, having his office at "Old Secretariat, Room No. 108/109, First Floor, Civil Lines, Nagpur-1" who has been appointed as the Officer under section 162(1) of the said Act, to hear suggestion/objection and submit his report to the Government, within 30 days after the expiry of the above mentioned period ;

Whereas, Revised Development Plan of Nagpur has been sanctioned by the Government vide Urban Development Department's Notification No. TPS-2496-2643-CR-300(A)-97-UD-9, dated 07th January, 2000 and Notification No. TPS-2400-1628-C.R. 200-2000-UD-9, dated 10th September, 2001 and has come into force with effect from the 01st March, 2000 and 21st September, 2001 respectively. Also Nagpur Improvement Trust has been declared as "Planning Authority" for the Seven Improvement Schemes being completed by the Nagpur Improvement .-ॅ-+-३ (१६५२).

Trust vide Government Notification No. TPS-2401-855-C.R. 76-UD-9, dated 27th February, 2002 (hereinafter referred to as "the said Development Plan") ;

And whereas, in the said Development Plan, land bearing Khasara No. 67 (pt.) of Mouja Gorewada is reserved for Site No. MNW-4 "Dispensary & Maternity Home", Site No. MNW-5 "Secondary School", Site No. MNW-6 "Primary School" & Site No. MNW-14 "Town Hall" (hereinafter referred to as "the said Reservations") ;

And whereas, the Nagpur Improvement Trust, Nagpur being the Planning Authority (hereinafter referred to as "the said Planning Authority") vide its Board of Trustee's Resolution No. 25/1162, dated 18th October 2016 has resolved to delete the said reservations and to include the same in Public/Semi Public Zone. Accordingly after following all the legal procedure as per the provisions of sub-section (1) of Section 37 of the said Act, submitted to the Government, for its sanction a modification proposal (hereinafter referred to as "the said Modifiction Proposal") ;

And whereas, after making necessary enquiries and consulting the Director of Town Planning, Maharashtra State, Pune, the Government is of opinion that (1) Modification in respect of Site No. MNW-14 "Town Hall" shall be rejected and (2) the Modification proposal in respect of Site No. MNW-4 "Dispensary & Maternity Home", Site No. MNW-5 "Secondary School", Site No. MNW-6 "Primary School" shall be sanctioned ;

And whereas, the Land Owners of the said lands have deposited Rs. 74,31,450 towards the 50% Government share of premium amount worked out as per 5% rate of the said land as prescribed in the Annual Statement of Rates (ASR) in the Government Treasury on 04th July, 2019 through the Assistant Director of Town Planning, Nagpur Branch, Nagpur and remaining 50% of the premium amount worked out @ 5% of land rates of Annual Statement of Rates (ASR) Rs. 74,31,450 payable to the Planning Authority has been deposited with the Nagpur Improvement Trust, Nagpur on 07th August, 2019.

Now, therefore, in exercise of the powers conferred on it under sub-section (2) of Section 37 of the said Act, the Government hereby, rejects proposed modification at Sr. No. (1) and sanctions the Proposed Modification at Sr. No. (2) and for that purpose amends the aforesaid Notification dated the 07th January, 2000 as follows :—

In the Schedule of Modifications appended to the Notification dated 07th January, 2000 sanctioning the said Development Plan, the following new entry shall be added after the last entry.

Whereas, Development Plan of Deori Nagar Panchayat has been sanctioned by the Director of Town Planning , Maharashtra State, Pune vide Notification No. TPV-2-1704, dated 20th March, 1992 under sub-section (1) of Section 31 of the Maharashtra Regional and Town Planning Act, 1966 (Mah. XXXVII of 1966) (hereinafter referred to as "the said Act") which came into force with effect from 1 June, 1992 (hereinafter referred to as "the said Development Plan") ;

And whereas, in the said Development Plan, land bearing Survey No. 65/1, 66, 67, 68 and 69 (New) concurrent Gut No. 351 and 353 (old) admeasuring area 3.25 H. A. of Mouja Deori (hereinafter referred to as "the said Lands") are included in Agricultural Zone ;

And whereas, the Deori Nagar Panchayat, Deori (hereinafter referred to as "the said Planning Authority") vide its General Body Resolution No. 07, dated 01st December, 2016 has resolved to delete the said land from Agriculture Zone and to include the same in Residential Zone and accordingly submitted to the Government, for its sanction, a modification proposal as per the provisions of sub-section (1) of Section 37 of the said Act, (hereinafter referred to as "the Proposed Modification") ;

And whereas, after making necessary enquiries and consulting the Director of Town Planning, Maharashtra State, Pune, the Government is of opinion that the proposed Modification should be sanctioned with some conditions ;

And whereas, the land Owners of the said land have deposited Rs. 5,36,250 towards the 50% Government share of premium amount worked out as per 5% rate of the said land as prescribed in the Annual Statement of Rates (ASR) for the year 2019-2020 in the Government Treasury on 26th July, 2019 through the Assistant Director of Town Planning, Gondia Branch, Gondia and remaining 50% of the premium amount worked out @ 5% of land rates of Annual Statement of Rates (ASR) for the year 2019-2020 Rs. 5,36,250 payable to the Planning Authority has been deposited with the Chief Officer, Deori Nagar Panchayat, Deori on 03rd August, 2019.

Now, therefore, in exercise of the powers conferred on it under sub-section (2) of Section 37 of the said Act, the Government hereby, sanctions the proposed Modification and for that purpose amends the aforesaid Notification dated the 20th March, 1992 as follows ;

3. It is compulsory for the land owner/developer, to provide all the Basic Amenities required for the said land at his own cost.

Declaration of Intention to prepare Draft Development Plan in Mouza Hudkeshwar (B.) and Narsala area,

Tah. & Distt. Nagpur under Sections 23 to 30 of the Maharashtra Regional and Town Planning Act, 1966.

No. NMC-TPD-D.D.P.-Section 23-482-2019.—

Whereas, the Revised Development Plan of Nagpur City prepared under the provisions of Maharashtra Regional and Town Planning Act, 1966, Section 31(1) has been partly sanctioned by the Govt, vide Urban Development Depart- ment Notification No. TPS-2496-2643-CR-300(a)-97-UD-9,Dt. 7th Jan. 2000 and came into force from 1st March 2000.

Excluded part of Development Plan has been sanctioned vide Government Notification No. TPS-2400-1628-CR-200- 2000-UD-9,dt.10th September 2001 and came into force from dt. 21st september 2001. Also Nagpur Municipal Corpora- tion has been declared as the 'Planning Authority' for Nagpur City except the areas covered under seven scheme vide Govt. Notification No TPS-2401-855-CR-76-UD-9,dt 27th February 2002.

And, whereas, Government had declared the Nagpur Metropoliton Area vide it's Notification No. TPS-1899-1191- CR-80-99-UD-13,dt 23rd July 1999. And for this Metropoliton are vide Government Notification No TPS-2409-2890-CR- 356-UD-9, dt. 31st August 2010 the Government had declared the Nagpur Improvement Trust as a Special Planning Authority. As per the Government Notification No. NMC 2011-CR-1-UD-26, dated 14th May 2013 the revenue villages of Mouza-Hudkeshwar (Bk.) and Mouza-Narsala excluded from Metropoliton Area and included in Nagpur Municipal Corporation area and also as per the Government Notification No. TPS-2413-405-CR-213-2013-UD-9, Dt. 14 October 2013, the Nagpur Municipal Corporation has declared as the Planning Authority for a area of Mouza-Hudkeshwar (Bk.) and Mouza-Narsala.

And whereas, the work of preparation of Development Plan for additional area i.e. Mouza-Hudkeshwar (Bk.) and Mouza-Narsala was started as per Maharashtra Regional and Town Planning Act, 1966 according to the Resolution No. 411 of General Body Meeting of dated 23rd July 2019.

And whereas, Nagpur Municipal Corporation has declared its intention to prepare the Draft Development Plan for an area about 972.82 Hectare of Mouza-Hudkeshwar (Bk.) and Mouza-Narsala under Section 23 and to appoint Town Planning Officer for the said Draft Development Plan and to submit it to Government as per Maharashtra Regional and Town Planning, Act, 1966 under Section 30 vide its resolution No. 411 of General Body Meeting of dated 23rd July 2019 and whereas to preparation of Draft Development Plan to delegate the power to the Commissioner, Nagpur Municipal Corporation, Nagpur to complete all necessary formalities and to be submitted to Government for final approval. As per U/s. 23 of Maharashtra Regional and Town Planning Act, 1966 declared a intention for preparation of Development Plan of Mouza-Hudkeshwar (Bk.) and Mouza-Narsala.

Now, therefore, the Boundary Plan of the area in which the Draft Development Plan is to be prepared for Mouza Hudkeshwar (Bk.) and Mouza-Narsala, area admeasuring about 972.82 Hectare is made available for inspection of public in working hours and excluding holiday under Section 23 of Maharashtra Regional and Town Planning Act, 1966 in the office of the Town Planning Deptt., Wing B, Third Floor, Shri. Chhatrapati Shivaji Maharaj Administrative Building, Mahapalika Marg. Civil Lines, Nagpur-440 001.
