क्रमांक आपना-२०११/प्र.क्र.३९/पापु-१५.-----भारताच्या संविधानाच्या अनुच्छेद ३०९ च्या परंतुकाद्वारे प्रदान करण्यात आलेल्या अधिकारांचा वापर करून आणि याबाबत करण्यात आलेले सर्व विद्यमान नियम, आदेश किंवा संलेख यांचे अधिक्रमण करून, महाराष्ट्राचे राज्यपाल याद्वारे, महाराष्ट्र शासनाच्या पाणीपुरवठा व स्वच्छता विभागाच्या नियंत्रणाखालील भूजल सर्वेक्षण व विकास यंत्रणेतील सहायक अभियंता (स्थापत्य) (गट-ब) (राजपत्रित) या पदाच्या सेवाप्रवेशाचे विनियमन करणारे पुढील नियम करीत आहेत :----
१. या नियमांना, महाराष्ट्र शासनाच्या भूजल सर्वेक्षण आणि विकास यंत्रणा संचालनालयातील सहायक अभियंता (स्थापत्य) (गट-ब) (राजपत्रित) (सेवाप्रवेश) नियम २०१८, असे म्हणावे.
२. या नियमांमध्ये, संदर्भानुसार दुसरा अर्थ अपेक्षित नसेल तर,---
(क) "पदवी" याचा अर्थ एखाद्या सांविधिक विद्यापीठाची पदवी असा आहे;
(ख) "पदविका" याचा अर्थ एखाद्या सांविधिक विद्यापीठाची पदविका असा आहे;
(ग) "संचालनालय" याचा अर्थ, महाराष्ट्र शासनाचे भूजल सर्वेक्षण आणि विकास यंत्रणा संचालनालय असा आहे;
(घ) "शासन" याचा अर्थ, महाराष्ट्र शासन असा आहे;
३. संचालनालयातील सहायक अभियंता (स्थापत्य) या पदावरील नियुक्ती एकतर,----
(क) सहायक अभियंता (श्रेणी दोन) हे पद धारण करणा-या आणि स्थापत्य अभियांत्रिकीमधील पदवी किंवा पदविका संपादित केलेल्या आणि त्या पदावर पदवीधारकांच्या बाबतीत किमान पाच वर्षे इतकी नियमित सेवा आणि पदविकाधारकांच्या बाबतीत किमान

भाग चार--अ--२६४----१२ महाराष्ट्र शासन राजपत्र असाधारण भाग चार-अ, ऑक्टोबर ४, २०१९/आश्िवन १२, शके १९४१ आठ वर्षे इतकी नियमित सेवा झालेल्या एखाद्या योग्य व्यक्तीच्या बदलीद्वारे करण्यात येईल; किंवा
(ख) जे उमेदवार,---
(एक) ज्यांचे वय पंचेचाळीस वषार्ंपेक्षा जास्त नाही:
परंतु, जे उमेदवार अगोदरच शासनाच्या सेवेत असतील तर, त्यांच्या बाबतीत उच्च वयोमर्यादा पाच वषार्र्ंपयर्ंत शिथिल करता येईल;
(दोन) स्थापत्य अभियांत्रिकीमधील पदवी किंवा पदविका, किंवा त्यास शासनाने समकक्ष म्हणून घोषित केलेली इतर कोणतीही अर्हता धारण करीत असतील;
(तीन) कोणत्याही औद्योगिक संस्थेमध्ये किंवा कोणत्याही शासकीय विभागामध्ये किंवा शासनाकडून स्थापन करण्यात आलेल्या औद्योगिक उपक्रमामध्ये किंवा महामंडळामध्ये किंवा मंडळामध्ये, उप-खंड(दोन) मध्ये नमूद केलेली अर्हता संपादन केल्यानंतर, कनिष्ठ अभियंता (स्थापत्य) (वेतन बँड ९३००-३४८००, श्रेणी वेतन ४३००) या पदावर, पदवीधारकांच्या बाबतीत किमान तीन वर्षे इतक्या आणि पदविकाधारकांच्या बाबतीत किमान पाच वर्षे इतक्या कालावधीचा काम करण्याचा अनुभव धारण करीत असतील; अशा उमेदवारांमधून नामनिर्देशनाद्वारे करण्यात येईल.
४. नियम ३ मध्ये नमूद केलेल्या पदावर नामनिर्देशनाने नियुक्त करण्यात आलेली व्यक्ती ही, दोन वषार्र्ंच्या कालावधीसाठी परिवीक्षाधीन असेल. परिवीक्षा कालावधी जास्तीत जास्त एक वर्षापयर्ंत वाढविता येईल. नियम ३ मध्ये नमूद केलेल्या पदावर नियुक्त करण्यात आलेल्या व्यक्तीने विभागीय परीक्षा उत्तीर्ण होणे आणि परिवीक्षा कालावधी यशस्वीरित्या पूर्ण करणे आवश्यक असेल. जर ती विभागीय परीक्षा उत्तीर्ण झाली नाही किंवा तिने परिवीक्षा कालावधी यशस्वीरित्या पूर्ण केला नाही किंवा त्या पदासाठी ती योग्य नसल्याचे आढळून आले तर, ती सेवेतून काढून टाकली जाण्यास पात्र असेल.
५. नियम ३ मध्ये नमूद केलेल्या पदावर नियुक्त केलेली व्यक्ती, मराठी व हिंदी भाषा परीक्षा, त्याबाबतीत करण्यात आलेल्या नियमांनुसार अगोदरच उत्तीर्ण केलेल्या नसतील किंवा तिला त्या परीक्षा उत्तीर्ण होण्यापासून सूट मिळालेली नसेल तर, तिने त्या परीक्षा उत्तीर्ण करणे आवश्यक असेल.
६. नियम ३ मध्ये नमूद केलेल्या पदावर नियुक्त केलेल्या व्यक्तीने, महाराष्ट्र शासनाच्या माहिती तंत्रज्ञान संचालनालयाने वेळोवेळी विहीत केलेले संगणक हाताळणीबाबतचे प्रमाणपत्र धारण करणे आवश्यक असेल.

CONSTITUTION OF INDIA.
No. Apana-2011/C.R.39/WS-15.—In exercise of the powers conferred by the proviso to article 309 of the Constitution of India and in supersession of all existing rules, orders or instruments made in this behalf, the Governor of Maharashtra is hereby pleased to make the following rules regulating recruitment to the post of Assistant Engineer (Civil) (Group-B) (Gazetted) in the Maharashtra Ground Water Surveys and Development Agency under the Water Supply and Sanitation Department, Government of Maharashtra, namely :––
1. These rules may be called the Assistant Engineer (Civil) (Group-B) (Gazetted) in the Directorate of Ground Water Surveys and Development Agency of the Government of Maharashtra (Recruitment) Rules, 2018.
2. In these rules, unless the context requires otherwise,––
(a) "Degree" means a degree of a statutory university,
(b) "Diploma" means a diploma of a statutory university,
(c) "Directorate" means the Directorate of Ground Water Surveys and Development Agency of the Government of Maharashtra,
(d) "Government" means the Government of Maharashtra.
3. Appointment to the post of the Assistant Engineer (Civil), in the Directorate shall be made either,––
(a) by transfer of a suitable person holding the post of Assistant Engineer and (Grade II) and possess a degree or a diploma in Civil Engineering and having not less than five years regular service in case of Degree holders and not less than eight years regular service in case of diploma holders in that post, or (b) by nomination from amongst the candidate who:––
(i) are not more than forty five years of age:
Provided that, the upper age limit may be relaxed up to five years in case of candidates who are already in the Government service;
(ii) possess a Degree or a diploma in Civil Engineering or any other qualification declared by the Government to the equivalent thereto;
(iii) possess experience of working on the post of Junior Engineer post (Civil) (Pay band 9300-34800, Grade Pay 4300) in any industrial organization or in any Department of the Government or in industrial undertaking or Corporation or Board established by the Government, for a period of not less than three years in case of Degree holder and not less than five years in case of Diploma holders gained after acquiring the qualification mentioned in above sub-clause (ii).
4. A person appointed to the post mentioned in rule 3 by nomination shall be on probation for a period of two years. The probation period may be extended maximum up to one year. A person appointed to the post mentioned in rule 3 shall be required to pass the departmental examination and complete the probation period successfully. If he does not pass the prescribed departmental examination or does not complete the probation period successfully or is not found suitable for the post, then he shall be liable to be terminated from service.

A person appointed to the posts, mentioned in rule 3, shall be required to pass the examinations in Hindi and Marathi language according to the rules made in that behalf, unless he has already passed, or has been exempted from passing those examinations.
6. A person appointed to the post mentioned in rule 3 shall possess a certificate in computer operation prescribed by the Directorate of Information Technology, Government of Maharashtra, from time to time.
