Whereas, Revised Development Plan of Nagpur City has been sanctioned by the Government vide Urban Development Department's Notification No. TPS-2496-2643-C.R. 300(A)-97-UD-9, dated 7th January, 2000 and has come into force with effect from 1st March, 2000 (hereinafter referred to as "the said Development Plan") under Section 31(1) of the Maharashtra Regional and Town Planning Act, 1966 (Mah. XXXVII of 1966) (hereinafter referred to as "the said Act") and also the Development Control Regulations for the area within the jurisdiction of Nagpur Municipal Corporation have been sanctioned by the Government vide Urban Development Department's Notification No. TPS-2400-1684-CR-192-2000-UD-9, dated 31st March, 2001 and have come into force with effect from 9th April, 2001 (hereinafter referred to as "the said DCR");
द्धन्रु]क्ष् रू न् ॅ-+ न् ह्यम््र ान्म््र, +]क्ष्दन् १०-१६, २०१९/+ह्य १८-२४, ॅ १९४१ ३And whereas, the Nagpur Municipal Corporation being the Planning Authority (hereinafter referred to as the "the said Planning Authority) vide its Resolution No. 254, dated 10th August, 2018 resolved to modify the provisions as mentioned in the "Schedule" of the said DCR, considering that in the sanctioned Development Plan and lay-outs in the City, the recreational open spaces, Play Ground and Public Utility spaces are provided. People of all religions think that the religious facilities should be near for their Physical and Mental peace as a daily need. Therefore, it is necessary for the citizens of the area to construct religious structure in the area as mentioned above. It provides physical and mental peace to the citizens and social interaction is enhanced by mutual interaction among the citizens.
However, there is no specific and clear provision in the Sanctioned Development Control Regulations for Nagpur City, therefore, there is a demand from public to incorporate the clear provision in the sanctioned Development Control Regulations of Nagpur City. Accordingly after following all the legal procedure as per the provisions of sub- section (1) of Section 37 of the said Act, submitted a modification proposal to the Government, for its sanction, (hereinafter referred to as "the said Proposed Modification");
And whereas, after making necessary enquiries and consulting the Director of Town Planning, Maharashtra State, Pune the Government is of opinion that the proposed modification in respect of religious use in "layout open space" needs to be sanctioned and religious use in "Amenity Space" & "Public Utility (PU) Plot" needs to be kept in abeyance;
Now, therefore, in exercise of the power conferred on it under Sub-Section (2) of Section 37 of the said Act, the Government hereby, sanctions the said Proposed Modification as mentioned in the "Schedule" appended hereto and for that purpose amends the said Development Plan Notification as follows.";
In the Schedule of Modifications appended to the Notification sanctioning the said Development Plan, as men- tioned in the "Schedule" new entry shall be added after the last entry--

Whereas, Revised Development Plan of Bhandara City has been sanctioned by the Director of Town Planning, Maharashtra State, Pune vide Notification No. TPV-2-3085, dated 29th May, 1992 and has come into force with effect from 1st November, 1992 (hereinafter referred to as "the said Development Plan") under Section 31(1) of the Maharashtra Regional and Town Planning Act, 1966 (Mah. XXXVII of 1966) (hereinafter referred to as "the said Act");
And whereas, in the said Development Plan, land bearing Gut No. 79, admeasuring area 1885 Sq. Mt. of Mouja Ganeshpur is reserved for Site No. 109 "Extension of High School" (hereinafter referred to as "the said Reserva- tion");
And Whereas, the Bhandara Municipal Council, Bhandara (hereinafter referred to as the "the said Planning Authority) vide its General Body Resolution No. 15(4), Dated 28th April, 2016 has resolved to delete the said reser- vation and to include in Commercial Zone and accordingly submitted to the Government, for its sanction, a modifica- tion proposal as per the provisions of sub-section (1) of Section 37 of the said Act, (hereinafter referred to as "the Proposed Modification");
And whereas, after making necessary enquiries and consulting the Director of Town Planning, Maharashtra State, Pune the Government is of opinion that the proposed Modification should be sanctioned with some condition;
And whereas, the land Owners of the said land have deposited Rs. 2,28,560/- towards the 50% Government share of premium amount worked out as per 5% rate of the said land as prescribed in the Annual Statement of Rates (ASR) in the Government Treasury on 25th July, 2019 through the Town Planner, Bhandara Branch, Bhandara and remaining 50% of the premium amount worked out @5% of land rates of Annual Statement of Rates (ASR) Rs. 2,28,560/- payable to the Planning Authority has been deposited with the Chief Officer, Bhandara Municipal Council, Bhandara on 25th July, 2019;
Now, therefore, in exercise of the powers conferred on it under sub-section (2) of Section 37 of the said Act, the Government hereby, sanctions the Proposed Modification and for that purpose amends the aforesaid Notification dated the 29th May, 1992 as follows;
"In the Schedule of Modifications appended to the Notification dated 29th May, 1992 sanctioning the said Development Plan, the following new entry shall be added after the last entry—

The land bearing Gut No. 79, admessuring area 1885 Sq. Mt. of Mouja Ganeshpur is deleted from Site No. 109 "Extension of High School" and land thus released, is included in Commercial Zone as shown on the plan, subject to the condition mentioned specified below"
Conditions :—The revised permission shall be obtained for layout on the land bearing Gut No. 79.
A copy of the Notification along with the part plan showing the aforesaid sanctioned modification, shall be available for inspection of the general public, in the office of the Chief Officer, Bhandara Municipal Council, Bhandara during office hours on all working days for a period of one month.

Whereas, the Government in Urban Development Department vide Notification No. TPS-2202-1260-C.R.- 2(B)-2004-UD-9, dated 16th August, 2005 has sanctioned the (Revised + Additional Area) Development Plan for the Ballarpur Town & same has come into force with effect from 1st October, 2005 (hereinafter referred to as "the said Development Plan") under Section 31(1) of the Maharashtra Regional and Town Planning Act, 1966 (Mah. XXXVII of 1966) (hereinafter referred to as "the said Act");
And whereas, in the said Development Plan, land bearing Survey No. 180/3, admeasuring area 1.32 Ha. is reserved for Site No. 86 "Fire Brigade", Site No. 85. "Dispensary" and site No.84 "High School" (hereinafter referred to as "the said Reservations");
And whereas, the Ballarpur Municipal Council, being the Planning Authority in respect of the said Land (here- inafter referred to as "the said Planning Authority") vide its Resolution No. 02, dated 15th March, 2018 has resolvedद्धन्रु]क्ष् रू न् ॅ-+ न् ह्यम््र ान्म््र, +]क्ष्दन् १०-१६, २०१९/+ह्य १८-२४, ॅ १९४१ ७ to delete the said reservations and to include in Residential Zone by carrying out a modification to the said Develop- ment Plan, by following all the legal formalities stipulated under Section 37 (1) of the said Act. and forwarded the proposal to Government for sanction vide letter dated 06th October, 2018 (hereinafter referred to as "the said Modification");
And whereas, in view of above and after making necessary enquiries and after consulting the Director of Town Planning, Maharashtra State, Pune from the planning point of view the Government is of opinion that the said Modification needs to be rejected;
Now, therefore, in exercise of the powers conferred by sub-section (2) of Section 37 of the said Act, the Government of Maharashtra hereby refuses to accord sanction to the said Modification;
This Notification shall be kept open for inspection by the general public during office hours in the office of the Chief Officer, Ballarpur Municipal Council, Ballarpur, Dist. Chandrapur;
This Notification shall also be available on the Government web site www.maharashtra.gov.in (ॅ म् ह्यद्ध) By order and in the name of the Governor of Maharashtra,

Whereas, Revised Development Plan of Nagpur City has been sanctioned by the Government vide Urban Development Department's Notification No. TPS-2496-2643-C.R. 300(A)-97-UD-9, dated 7th January, 2000 and finally sanctioned vide Government Notification No. TPS-2400-1628-CR-200-2000-UD-9, Dated 10th September, 2001 & has come into force with effect from the 1st March, 2000 & 21st September, 2001 respectively (hereinafter referred to as "the said Development Plan") under Section 31(1) of the Maharashtra Regional and Town Planning Act, 1966 (Mah. XXXVII of 1966) (hereinafter referred to as "the said Act");
And whereas, in the said Development Plan, the land admeasuring 0.498 Ha., bearing Khasara No. 3 of Mouja Ajani is included in 'Public/Semi-Public Zone as designated School' (hereinafter referred to as the "the said Land"); And whereas, the Nagpur Municipal Corporation, being the Planning Authority (hereinafter referred to as "the said Planning Authority") vide its Resolution No. 277, dated 24th September, 2018 has resolved to delete the said land occupied by Laxminagar Zopadpatti which is designated as a "School" under Public/Semi-Public Zone and to include in Residential Zone. Accordingly after following all the legal procedure as per the provisions of sub-section (1) of Section 37 of the said Act, the said Planning Authority submitted a modification proposal to the Government, for its sanction, (hereinafter referred to as "the said Proposed Modification");
And whereas, after making necessary enquiries and consulting the Director of Town Planning, Maharashtra State, Pune the Government is of opinion that the proposed Modification should be sanctioned;
Now, therefore, in exercise of the powers conferred on it under sub-Section (2) of Section 37 of the said Act, the Government hereby, sanctions the said Modification proposal and for that purpose amends the said Development Plan Notification as follows;
"In the Schedule of Modifications appended to the Notification sanctioning the said Development Plan, the following new entry shall be added after the last entry—
ENTRY
The land admessuring 0.498 Ha. bearing Khasara No. 3 of Mouja Ajani is deleted from Public/Semi-Public Zone which is designated as a "School" and included in Residential as shown on the Plan"
A copy of the part plan of the aforesaid sanctioned Modification shall be available for public inspection in the office of the Commissioner, Nagpur Municipal Corporation, Nagpur during office hours on all working days for a period of one month.
