भारताचे संविधान.
क्रमांक सेप्रनि-२०१८/प्र.क्र.१६/२०१८/जल-२.-----भारताच्या संविधानाच्या अनुच्छेद ३०९ च्या परंतुकाव्दारे प्रदान करण्यात आलेल्या अधिकारांचा वापर करुन, आणि अस्तित्वात असणारे सर्व विद्यमान आदेश किंवा अनुदेश अधिक्रमित करून महाराष्ट्राचे राज्यपाल याद्वारे महाराष्ट्र शासनाच्या मृद व जलसंधारण विभागातील, महाराष्ट्र अभियांत्रिकी सेवा गट " अ " मधील महासंचालक/व्यवस्थापकीय संचालक (स्थापत्य), अपर आयुक्त जलसंधारण/मुख्य दक्षता व गुणनियंत्रण अधिकारी/ मुख्य अभियंता तथा पदसिद्ध सहसचिव (स्थापत्य), प्रादेशिक जलसंधारण अधिकारी/ प्रादेशिक दक्षता व गुणनियंत्रण अधिकारी (स्थापत्य), जिल्हा जलसंधारण अधिकारी (स्थापत्य) व अन्य समकक्ष पदे या पदांच्या सेवाप्रवेशाचे विनियमन करणारे पुढील नियम करीत आहेत, ते असे :-----
१. या नियमांना मृद व जलसंधारण विभागातील महाराष्ट्र अभियांत्रिकी सेवा, गट " अ " मधील महासंचालक/व्यवस्थापकीय संचालक (स्थापत्य), अपर आयुक्त जलसंधारण/मुख्य दक्षता व गुणनियंत्रण अधिकारी/ मुख्य अभियंता तथा पदसिद्ध सहसचिव (स्थापत्य), प्रादेशिक जलसंधारण अधिकारी/प्रादेशिक दक्षता व गुणनियंत्रण अधिकारी (स्थापत्य), जिल्हा जलसंधारण अधिकारी (स्थापत्य) व अन्य समकक्ष पदे (सेवाप्रवेश) नियम, २०१९ असे संबोधण्यात येईल.
२. या नियमांमध्ये संदर्भानुसार अन्य अर्थ अभिप्रेत नसेल तर,----
(i) " आयुक्तालय " याचा अर्थ आयुक्तालय, मृद व जलसंधारण, महाराष्ट्र राज्य ;
(ii) " स्थापत्य अभियांत्रिकी पदवी " याचा अर्थ भारतीय संविधानिक विद्यापिठाची स्थापत्य अभियांत्रिकी पदवी ;
(iii) " विभाग " याचा अर्थ मृद व जलसंधारण विभाग, महाराष्ट्र राज्य ;
भाग चार-अ-----२७६--१२ महाराष्ट्र शासन राजपत्र असाधारण भाग चार-अ, ऑक्टोबर ३१, २०१९/कर्ातिक ९, शके १९४१ (iv) " महासंचालक " याचा अर्थ महासंचालक, जल व भूमी व्यवस्थापन संस्था (वाल्मी), औरंगाबाद ;
(v) " जिल्हा जलसंधारण अधिकारी (स्थापत्य) व अन्य समकक्ष पदे " याचा अर्थ जिल्हा जलसंधारण अधिकारी/उप आयुक्त (जलसंधारण)/उप आयुक्त, दक्षता व गुण नियंत्रण (जलसंधारण)/जिल्हा जलसंधारण अधिकारी, जिल्हा परिषद (लघु पाटबंधारे) ;
(vi) " शासन " याचा अर्थ महाराष्ट्र शासन ;
(vii) " व्यवस्थापकीय संचालक " याचा अर्थ व्यवस्थापकीय संचालक, महाराष्ट्र जलसंधारण महामंडळ, औरंगाबाद ;
(viii) " उप विभागीय जलसंधारण अधिकारी (स्थापत्य) व अन्य समकक्ष पदे " याचा अर्थ उप विभागीय जलसंधारण अधिकारी/ सहायक आयुक्त (जलसंधारण)/सहायक आयुक्त दक्षता व गुणनियंत्रण (जलसंधारण)/सहायक प्रादेशिक जलसंधारण अधिकारी/सहायक गुणनियंत्रण अधिकारी (जलसंधारण)/सहायक जिल्हा जलसंधारण अधिकारी/उप विभागीय जलसंधारण अधिकारी, जिल्हा परिषद (लघु पाटबंधारे).
३. विभागाच्या नियंत्रणाखालील, महाराष्ट्र अभियांत्रिकी सेवा, गट " अ " मधील " महासंचालक/व्यवस्थापकीय संचालक " (स्थापत्य) या पदावरील नियुक्ती,-----
(क) अपर आयुक्त जलसंधारण/मुख्य दक्षता व गुणनियंत्रण अधिकारी/ मुख्य अभियंता तथा पदसिद्ध सहसचिव (स्थापत्य) हे पद धारण करणाया व त्या पदावर ३ वर्षापेक्षा कमी नसेल इतकी नियमित सेवा झालेल्या व्यक्तींमधून ज्येष्ठता अधीन पात्रता या निकषावर योग्य व्यक्तीच्या पदोन्नतीने करण्यात येईल; किंवा
(ख) वरील (क) मध्ये नमूद केलेली पात्रता धारण केलेला उमेदवार उपलब्ध न झाल्यास मृद व जलसंधारण, जलसंपदा क्षेत्रात किमान ५ वर्षापेक्षा कमी नसेल इतका अनुभव असलेल्या केंद्र शासनाच्या वा राज्य शासनाच्या अथवा अन्य कोणत्याही राज्य शासनाच्या अखत्यारीत महासंचालक/व्यवस्थापकीय संचालक (स्थापत्य) या पदास समकक्ष पद धारण करीत असलेल्या व्यक्तींमधून योग्य व्यक्तीच्या प्रतिनियुक्तीने करण्यात येईल.
४. विभागाच्या नियंत्रणाखालील, महाराष्ट्र अभियांत्रिकी सेवा, गट " अ " मधील अपर आयुक्त जलसंधारण/मुख्य दक्षता व गुणनियंत्रण अधिकारी/ मुख्य अभियंता तथा पदसिद्ध सहसचिव (स्थापत्य) या पदावरील नियुक्ती,----
(क) प्रादेशिक जलसंधारण अधिकारी/प्रादेशिक दक्षता व गुणनियंत्रण अधिकारी (स्थापत्य) हे पद धारण करणाया व त्या पदावर ३ वर्षापेक्षा कमी नसेल इतकी नियमित सेवा झालेल्या व्यक्तींमधून ज्येष्ठता अधीन पात्रता या निकषावर योग्य व्यक्तीच्या पदोन्नतीने करण्यात येईल ; किंवा (ख) वरील (क) मध्ये नमूद केलेली पात्रता धारण केलेला उमेदवार उपलब्ध न झाल्यास मृद व जलसंधारण, जलसंपदा क्षेत्रात किमान ५ वर्षापेक्षा कमी नसेल इतका अनुभव असलेल्या केंद्र शासनाच्या वा राज्य शासनाच्या अथवा अन्य कोणत्याही राज्य शासनाच्या अखत्यारीत अपर आयुक्त, जलसंधारण/मुख्य दक्षता व गुणनियंत्रण अधिकारी/ मुख्य अभियंता तथा पदसिद्ध सहसचिव (स्थापत्य) या पदास समकक्ष पद धारण करीत असलेल्या योग्य व्यक्तीच्या प्रतिनियुक्तीने करण्यात येईल.
५. विभागाच्या नियंत्रणाखालील, महाराष्ट्र अभियांत्रिकी सेवा, गट " अ " मधील प्रादेशिक जलसंधारण अधिकारी/ प्रादेशिक दक्षता व गुणनियंत्रण अधिकारी (स्थापत्य) या पदावरील नियुक्ती,------
(क) जिल्हा जलसंधारण अधिकारी (स्थापत्य) व अन्य समकक्ष पद धारण करणाया व त्या पदावर ३ वर्षापेक्षा कमी नसेल इतकी नियमित सेवा झालेल्या व भारतीय सांविधानिक विद्यापीठाची स्थापत्य अभियांत्रिकीमधील पदवी किंवा सक्षम प्राधिकायाने तिच्याशी समकक्ष म्हणून मान्यता दिलेली पदवी धारण करणाया व्यक्तींमधून ज्येष्ठता अधीन पात्रता या निकषावर योग्य व्यक्तीच्या पदोन्नतीने करण्यात येईल; किंवा (ख) वरील (क) मधील पात्रता धारण केलेला उमेदवार उपलब्ध न झाल्यास मृद व जलसंधारण, जलसंपदा क्षेत्रात किमान ५ वर्षापेक्षा कमी नसेल इतका अनुभव असलेल्या केंद्र शासनाच्या वा राज्य शासनाच्या अथवा अन्य कोणत्याही राज्य शासनाच्या अखत्यारीत प्रादेशिक जलसंधारण अधिकारी/ प्रादेशिक दक्षता व गुणनियंत्रण अधिकारी (स्थापत्य) या पदास समकक्ष पद धारण करीत असलेल्या योग्य व्यक्तीच्या प्रतिनियुक्तीने करण्यात येईल.
६. विभागाच्या नियंत्रणाखालील, महाराष्ट्र अभियांत्रिकी सेवा, गट " अ " मधील " जिल्हा जलसंधारण अधिकारी (स्थापत्य) व अन्य समकक्ष पदे " या पदावरील नियुक्ती,----
महाराष्ट्र शासन राजपत्र असाधारण भाग चार-अ, ऑक्टोबर ३१, २०१९/कर्ातिक ९, शके १९४१ ३(क) जलसंपदा विभागामधून मृद व जलसंधारण विभागाकडे विकल्पाद्वारे आलेल्या व खाली नमूद केलेले कोणतेही पद धारण करणाया व सदर पदावर ३ वषार्र्ंपेक्षा कमी नाही इतकी नियमित सेवा झालेल्या व्यक्तींमधून ज्येष्ठता अधिन पात्रता या निकषावर परंतु खाली नमूद केलेल्या प्रमाणात योग्य व्यक्तीच्या पदोन्नतीने करण्यात येईल-----
(i) सहायक कार्यकारी अभियंता ... ४० टक्के
(ii) सहायक अभियंता श्रेणी-१ ... २५ टक्के
(iii) उप विभागीय अभियंता ... २५ टक्के
(iv) उप विभागीय अधिकारी ... १० टक्के
परंतु असे की, उपरोक्त तक्त्यामध्ये विहित केलेल्या प्रमाणानुसार त्या त्या संवर्गात पात्र अधिकारी उपलब्ध न झाल्यास संबंधित संवर्गाच्या जागा उर्वरित संवर्गात प्रमाणशीरपणे विभागण्यात येतील ;
परंतु पुढे असेही की, उपरोक्त नमूद चारही संवर्गातून पात्र अधिकारी उपलब्ध होत नसल्यास खालील नियम (ख) मध्ये विहित केलेल्या तरतुदीनुसार नियुक्ती करण्यात येईल ; किंवा
(ख) उप विभागीय जलसंधारण अधिकारी (स्थापत्य) व अन्य समकक्ष पद धारण करणाया व सदर पदावर ३ वषार्र्ंपेक्षा कमी नसेल इतकी नियमित सेवा झालेल्या व्यक्तींमधून ज्येष्ठता अधिन पात्रता या निकषावर योग्य व्यक्तीच्या पदोन्नतीने करण्यात येईल.
७. नियम ३ (क), ४(क), ५ (क) आणि ६ (क) मधील पदांवर नियुक्त केलेली व्यक्ती या संबंधात तयार करण्यात आलेल्या नियमांनुसार मराठी व हिंदी भाषा परीक्षा अगोदरच उत्तीर्ण झालेली नसेल किंवा त्याला/तिला परीक्षा उत्तीर्ण होण्यातून सूट मिळालेली नसेल तर त्याने/ तिने या परीक्षा उत्तीर्ण होणे आवश्यक राहील.
८. नियम ३ (क), ४(क), ५ (क) आणि ६ (क) मधील पदांवर नियुक्त करण्यात आलेल्या व्यक्तीस महाराष्ट्र शासनाच्या माहिती तंत्रज्ञान संचालनालयाने वेळोवेळी विहित करण्यात आलेले संगणक हाताळणी विषयक प्रमाणपत्र विहित कालावधीत धारण करावे लागेल.
९. नियम ३, ४ व ५ मध्ये नमूद पदावर प्रतिनियुक्तीने नियुक्ती करताना शासनाने वेळोवेळी विहित केलेले प्रतिनियुक्तीचे धोरण/आदेश लागू राहील.
१०. नियम ३, ४, ५ व ६ मधील पदावर नियुक्त केलेली व्यक्ती महाराष्ट्र राज्यामध्ये कोठेही बदली होण्यास पात्र राहील.

NOTIFICATION
CONSTITUTION OF INDIA.
No. RR-2018/ C.R.16/2018/ Jal -2.—In exercise of the powers conferred by the proviso to article 309 of the Constitution of India and in supersession of all existing rules, orders or instruments made in this behalf, the Governor of Maharashtra is hereby pleased to make the following rules regulating recruitment to the posts of Director General/Managing Director (Civil), Additional Commissioner, Water Conservation / Chief Vigilance and Quality Control Officer / Chief Engineer and Ex-officio Joint Secretary (Civil), Regional Water Conservation Officer / Regional Vigilance and Quality Control Officer (Civil), District Water Conservation Officer (Civil) and other equivalent posts, in the Maharashtra Service of Engineers, Group-A, under the Soil and Water Conservation Department of Government of Maharashtra, namely :—
1. These rules may be called the Director General/Managing Director (Civil), Additional Commissioner, Water Conservation / Chief Vigilance and Quality Control Officer / Chief Engineer and Ex-officio Joint Secretary (Civil), Regional Water Conservation Officer / Regional Vigilance and Quality Control Officer (Civil), District Water Conservation Officer (Civil) and other equivalent posts (Recruitment) Rules, 2019.
2. In these rules, unless the context otherwise requires,—
(i) " Commissionerate " means the Commissionerate, Soil and Water Conservation, Maharashtra State;
(ii) " Degree in Civil Engineering " means a Degree in Civil Engineering of a Statutory University ;
(iii) " Department " means the Soil and Water Conservation Department, Government of Maharashtra ;
(iv) " Director General " means the Director General of Water and Land Management Institute (WALMI), Aurangabad ;
(v) " District Water Conservation Officer (Civil) and other equivalent posts " means the District Water Conservation Officer / Deputy Commissioner (Water Conservation) / Deputy Commissioner, Vigilance and Quality Control (Water Conservation) / District Water Conservation Officer, Zilla Parishad (Minor Irrigation) ;
(vi) " Government " means the Government of Maharashtra;
(vii) " Managing Director " means the Managing Director of Maharashtra Water Conservation Corporation, Aurangabad ;
(viii) " Sub-Divisional Water Conservation Officer (Civil) and other equivalent posts " means the Sub-Divisional Water Conservation Officer / Assistant Commissioner (Water Conservation) / Assistant Commissioner, Vigilance and Quality Control (Water Conservation) / Assistant Regional Water Conservation Officer / Assistant Quality Control Officer (Water Conservation) / Assistant District Water Conservation Officer / Sub-Divisional Water Conservation Officer, Zilla Parishad (Minor Irrigation).
महाराष्ट्र शासन राजपत्र असाधारण भाग चार-अ, ऑक्टोबर ३१, २०१९/कर्ातिक ९, शके १९४१ ५3. Appointment to the post of the Director General / Managing Director (Civil), in the Maharashtra Services of Engineers, Group-A shall be made either,—
(a) by promotion on the basis of seniority subject to fitness from amongst the persons holding the post of Additional Commissioner, Water Conservation / Chief Vigilance and Quality Control Officer/Chief Engineer and Ex-officio Joint Secretary, Group-A, in the office of Commissionerate and who has completed not less than three years of regular service on that post ; or
(b) by deputation of a suitable person, if the person with the qualification mentioned in clause (a) is not available, from amongst the persons, who are working and having experience of not less than 5 years in sector of Water Conservation, Water Resources and Soil Conservation and from Central Service or State Service or any other State Service, holding a post equivalent to the post of Director General / Managing Director.
4. Appointment to the post of the Additional Commissioner, Water Conservation/Chief Vigilance and Quality Control Officer / Chief Engineer and Ex-officio Joint Secretary (Civil), in the Maharashtra Services of Engineers, Group-A, shall be made either,—
(a) by promotion on the basis of seniority subject to fitness from amongst the persons holding the post of Regional Water Conservation Officer / Regional Vigilance and Quality Control Officer (Civil) in the office of Commissionerate and who has completed not less than three years of regular service on that post ; or
(b) by deputation of a suitable person, if the person with the qualification mentioned in clause (a) is not available, from amongst the persons, who are working and having experience of not less than 5 years in sector of Water Conservation, Water Resources and Soil Conservation and from Central Service or State Service or any other State Service, holding a post equivalent to the Additional Commissioner, Water Conservation / Chief Vigilance and Quality Control Officer / Chief Engineer and Ex-officio Joint Secretary (Civil). 5. Appointment to the post of the Regional Water Conservation Officer / Regional Vigilance and Quality Control Officer (Civil) in the Maharashtra Services of Engineers, Group-A shall be made either,—
(a) by promotion on the basis of seniority subject to fitness from amongst persons holding the post of District Water Conservation Officer and other equivalent post and who has completed not less than three years of regular service on that post and holding a degree in Civil Engineering or any other equivalent degree recognised by the competent authority ; or (b) by deputation of a suitable person, if the person with the qualification mentioned in clause (a) is not available, from amongst the persons, who are working and having experience of not less than 5 years in the sector of Water Conservation or Water Resources / Soil Conservation from Central Service or State Service / any other State Service, holding a post equivalent to the post of Regional Water Conservation Officer/ Regional Vigilance and Quality Control Officer (Civil).
६ महाराष्ट्र शासन राजपत्र असाधारण भाग चार-अ, ऑक्टोबर ३१, २०१९/कर्ातिक ९, शके १९४१6. Appointment to the post of the District Water Conservation Officer (Civil) and Other equivalent posts in the Maharashtra Services of Engineers, Group-A shall be made,– (a) by promotion in specified proportionate as below mentioned, on the basis of seniority subject to fitness from amongst the persons, who have given their option to the Department and completed not less than three years of regular service on that post :—
(i) Assistant Executive Engineer … 40%
(ii) Assistant Engineer Grade-I … 25%
(iii) Sub-Divisional Engineer … 25%
(iv) Sub-Divisional Officer … 10%
Provided that, if suitable persons are not available in the above proportion from respective cadres then, the remaining posts may be divided proportionately into remaining cadres :
Provided further that, if suitable persons are not available in above motioned four cadres, then the appointment shall be made as per the provisions of clause (b) ; or
(b) by promotion on the basis of seniority, subject to fitness from amongst the persons holding the post of Sub-Divisional Water Conservation Officer (Civil) and other Equivalent post who has completed not less than three years of regular service on that post.
7. The persons appointed to the posts mentioned in rules 3(a), 4(a), 5(a) and 6(a) shall be required to pass the examinations in Hindi and Marathi according to rules made in that behalf unless he has already passed or has been exempted from passing those examinations.
8. The persons appointed to the posts mentioned in rules 3(a), 4(a), 5(a) and 6(a) shall possess a Certificate in Computer Operation within the period as prescribed by the Directorate of Information and Technology, Government of Maharashtra, from time to time.
9. Deputation Rules or Deputation Policy prescribed by the Government, from time to time, shall be applicable to the appointments made by deputation to the posts by deputation mentioned in rules 3, 4 and 5.
10. The persons appointed to the posts mentioned in rules 3, 4, 5 and 6 shall be liable for transfer anywhere in the State of Maharashtra.
