क्रमांक एमईडी १०१९/प्र.क्र.२४७/१९/शिक्षण-२.-----महाराष्ट्र शरीररचनाशास्त्र अधिनियम (१९४९ चा अधिनियम अकरा) च्या कलम २ पोट-कलम (१) द्वारे प्रदान करण्यात आलेल्या अधिकाराचा वापर करून महाराष्ट्र शासन याद्वारे सिंबायोसिस आंतरराष्ट्रीय (अभिमत विद्यापीठ) लवळे, तालुका मुळशी, जिल्हा पुणे या संस्थेला कलम ५ च्या पोट-कलम (१), (२) व (३) मध्ये नमूद केलेल्या प्रयोजनार्थ, उक्त संस्था सदर अधिनियमाच्या कलम ५-ई मधील तरतुदींचे पालन करेल या अटीच्या अधीन राहून मान्यताप्राप्त संस्था म्हणून घोषित करीत आहे.

NO. MED. 1019/CR-247/19/EDU-2.—In exercise of the powers conferred by sub-section (1) of section 2 of the Maharashtra Anatomy Act (XI of 1949), the Government of Maharashtra hereby Symbiosis International (Deemed to be University), Lavale, Tal. Mulshi, Dist. Pune as an approved institution for the purposes of sub-section (1), (2) and (3) of section 5 of the said Act, subject to the condition that the said institute shall comply with the provisions of section 5E of the said Act.

क्रमांक आयडीसी. २०१९/प्र.क्र. १६९/उ-१४.ज्याअर्थी, महाराष्ट्र औद्योगिक विकास अधिनियम, १९६१ च्या कलम ४३ च्या खंड (१ ब) (cid:४६२)ारे प्रदान करण्यात आलेल्या अधिकारांचा वापर करुन महाराष्ट्र औद्योगिक विकास महामंडळाने (यात यानंतर ज्याचा उल्लेख ""उक्त महामंडळ"" असा करण्यात आला आहे) काढलेल्या अधिसूचना क्र. मऔविम/IIA/B-९१२०९/२०१९, दिनांक ११ जून, २०१९ (cid:४६२)ारे ""एकात्मिक औद्योगिक क्षेत्र"" (यात यानंतर ज्याचा उल्लेख ""उक्त आयआयए"" असा करण्यात आला आहे) म्हणून, मे.लोढा डेव्हलपर्स लि. (यात यानंतर ज्याचा उल्लेख ""उक्त विकासक"" असा करण्यात आला आहे.) यांच्याकडून विकसीत करण्यात येत असलेल्या ठाणे जिल्हातील अंबरनाथ तालुक्याच्या उसाटणे गावामधील ५०.१७५७ हे.आर इतके क्षेत्र (यात यानंतर ज्याचा उल्लेख ""उक्त क्षेत्र"" असा करण्यात आला आहे) अधिसूचित के लेले आहे ;

आणि ज्याअर्थी अशी अधिसूचना काढण्यात आल्यानंतर महामंडळ हे, महाराष्ट्र प्रादेशिक व नगररचना अधिनियम, १९६६ (यात यानंतर ज्याचा उल्लेख ""उक्त अधिनियम"" असा करण्यात आला आहे) अन्वये, उक्त ""आयआयए"" यासाठी ""विशेष नियोजन प्राधिकरण"" झालेले आहे ;

आणि ज्याअर्थी, शासन निर्णय उद्योग, ऊर्जा व कामगार विभाग क्रमांक आयडीसी. २०१५/प्र.क्र. ९३/उद्योग-१४, दि. २७ डिसेंबर, २०१६ (cid:४६२)ारे महाराष्ट्र शासनाने ""आयआयए"" च्या किंवा एकात्मिक माहिती तंत्रज्ञान नगराच्या विकासासंबंधीची कार्यपद्धती विहीत करण्यात आलेली आहे,

आणि ज्याअर्थी, उक्त अधिनियमाच्या कलम १५१ च्या पोट-कलम (१) अन्वये प्रदान करण्यात आलेल्या अधिकारांनुसार खाजगी जमिनींवरील एकात्मिक औद्योगिक क्षेत्राच्या किंवा एकात्मिक माहिती तंत्रज्ञान नगराच्या संबंधित, उक्त अधिनियमाच्या कलम ४०, पोट-कलम (३) च्या खंड (ड) च्या उप खंड (१) अन्वये नियोजन प्रस्ताव मंजूर करण्याचा अधिकार, शासकीय अधिसूचना नगरविकास विभाग क्रमांक टीपीबी. ४३१७/प्र.क्र. ५४/२०१७/नवि-११, दि. २ जून २०१७ (cid:४६२)ारे अपर मुख्य सचिव (उद्योग) यांना प्रदान करण्यात आला आहे;

आणि ज्याअर्थी, उक्त महामंडळाने उक्त अधिनियमाच्या कलम ४० मध्ये तसेच कलम ११५ च्या पोट-कलम (२) मध्ये निर्धारित के लेली कार्यपद्धती पार पाडलेली आहे आणि राज्य शासनाकडे त्याच्या मंजुरीसाठी बृहत आराखडा प्रस्ताव सादर के ला आहे;

त्याअर्थी, आता उक्त अधिनियमाच्या कलम ४० च्या पोट-कलम (३) चा खंड (ड) तसेच कलम ११५ चे पोट-कलम (३) या(cid:४६२)ारे प्रदान करण्यात आलेल्या अधिकारांचा आणि याबाबत त्यास समर्थन करणाऱ्या इतर सर्व अधिकारांचा वापर करुन, अपर मुख्य सचिव (उद्योग), उद्योग, ऊर्जा व कामगार विभाग या(cid:४६२)ारे, आराख(cid:५०५)ावर दर्शविण्यात आल्याप्रमाणे, उक्त्त क्षेत्राच्या बृहत आराखडा प्रस्तावाला पुढील शर्तीच्या अधिनतेने मंजुरी देत आहे :

(१) जमिनीचा वापर, सोयी-सुविधांच्या जागा, मोक(cid:२०८)या जागा, रस्त्याचे स्वरुप यासारख्या सदर मंजुरी के वळ प्रस्तावित प्रस्तावांसाठी आहे.

(२) महाराष्ट्र औद्योगिक विकास महामंडळाच्या ""आयआयए"" विकास नियंत्रण नियमावलीनुसार, महाराष्ट्र औद्योगिक विकास महामंडळाकडून विन्यास/बांधकामाचा आराखडा अंतर्गत प्रवेश मार्ग, तलपृष्ठ निर्देशांक, वाहनतळ व्यवस्था इत्यादींची सखोल छाननी करण्यात यावी.

भाग चार-ब–१अ४ महाराष्ट्र शासन राजपत्र भाग चार-ब गुरुवार ते बुधवार, नोव्हेंबर १४-२०, २०१९/कर्ातिक २३-२९, शके १९४१ (३) महाराष्ट्र प्रदुषण नियंत्रण मंडळाने नमूद के लेल्या शर्ती आणि संबंधित प्राधिकरणाकडील पर्यावरण विषयक परवानगी (लागू असल्यास) बंधनकारक राहील.

(४) बांधकाम आराख(cid:५०५)ाला मंजुरी देताना, महाराष्ट्र औद्योगिक विकास महामंडळ (म.औ.वि.म.) सार्वजनिक बांधकाम विभाग, महावितरण (म.रा.वि.म.) इत्यादी विभागांकडून जेथे जेथे आवश्यक असेल तेथे तेथे ना- हरकत प्रमाणपत्र घेईल.

(५) प्रस्तावित सोयी-सुविधांची जागा आणि मोकळी जागा यामध्ये करण्यात येणारे वापर महाराष्ट्र औद्योगिक विकास महामंडळाच्या आयआयए विकास नियंत्रण नियमावलीच्या आवश्यकतेनुसार असतील.

(६) उक्त विकासक, भूमी-अभिलेख विभागाकडील, नियोजन प्रस्तावानुसार सीमांकन आराखडा प्राप्त करील.

(७) उक्त अधिनियमाच्या कलम ४० च्या पोट-कलम (३) चा खंड (ड) तसेच कलम ११५ चे पोट-कलम (३) यान्वये मान्यता मिळाल्याच्या दिनांकापासून प्रस्ताव तात्काळ अंमलात येतील.

नियोजन प्रस्ताव दर्शविणारा आराखडा सामान्य जनतेच्या निरीक्षणासाठी महाराष्ट्र औद्योगिक विकास महामंडळाच्या कार्यालयांमध्ये कार्यालयीन वेळेत उपलब्ध करुन देण्यात येईल.

Order

MAHARASHTRA REGIONAL AND TOWN PLANNING ACT, 1966.

No. IDC. 2019/C.R. 169/IND-14.—Whereas, Maharashtra Industrial Development Corporation (hereinafter referred to as 'the said Corporation') vide Notification No. MIDC/IIA/B-91209/2019, dated the 11thJune, 2019 issued in exercise of powers conferred by clause (1B) of section 43 of the Maharashtra Industrial Development Act, 1961 has notified an area of 50.1757 Hectare Are from village Usatane of Taluka Ambernath in District Thane (hereinafter referred to as 'the said Area') for being developed by M/s. Lodha Developers Ltd. (hereinafter referred to as 'the said Developer') to be an 'Integrated Industrial Area' (hereinafter referred to as 'the said IIA');

And whereas upon such notification, the Corporation has become the 'Special Planning Authority ' for the said IIA under the Maharashtra Regional and Town Planning Act, 1966 (hereinafter referred to as 'the said Act') ;

And whereas, the Government of Maharashtra vide Government Resolution, Industry, Energy and Labour Department No.IDC/2015/C.R.93/Industry-14, dated the 27th December, 2016 has laid down the procedure regarding development of the IIA or Integrated Information Technology Township ;

And whereas, in pursuance of the powers conferred under sub-section (1) of section 151 of the said Act, the power to approve Planning Proposals under sub-clause (1) of clause (d) of sub-section (3) of section 40 of the said Act regarding Integrated Industrial Area or Integrated Information Technology Township on private lands has been delegated to Additional Chief Secretary (Industries) vide Government Notification, Urban Development Department No. TPB 4317/CR- 54/2017/UD-11, dated the 2nd June 2017 ;

And whereas, the said corporation has completed the procedure laid down in section 40 read with sub-section (2) of section 115 of the said Act and submitted the Master Plan proposal to the State Government for its approval ;

Now therefore, in exercise of the powers conferred by clause (d) of sub-section (3) of section 40 read with sub-section (3) of section 115 of the said Act and of all other powers enabling him in this behalf, the Additional Chief Secretary (Industries) of Industry, Energy and Labour Department hereby grant approval to the Master Plan proposal of the said Area as shown on plan, subject to following conditions, namely :—

(1) This sanction is only for the planning proposals like proposed land use, amenity spaces, open spaces, road pattern.

(2) Detailed scrutiny of layout/building plans, internal means of access, FSI, parking etc. should be done by MIDC according to MIDC's IIA DCR.

(3) Conditions mentioned by MPCB (Maharashtra Pollution Control Board) and Environmental Clearance from the respective authority shall be binding (if applicable).

(4) While sanctioning building plans, MIDC shall take NOC from PWD, Mahavitaran (MSEB) etc. Departments wherever necessary.

(5) Users provided in proposed amenity space and open space shall be as per requirement of MIDC's IIA DCR.

(6) The said developer shall obtain demarcation plan as per planning proposals from the landrecord department.

(7) The proposals shall immediately came into effect from date of approval under clause (d) if sub-section (3) of section 40 read with sub-section (3) of section 115 of the said Act.

The plan showing the planning proposal shall be made available for inspection for general public during office hours in offices of MIDC.

दुरुस्तीपत्रक

क्रमांक आयडीसी २०१८/(३६९)/उद्योग-१४.—ज्या अर्थी, अनुसुचित उल्लेखिलेल्या क्षेत्रात महाराष्ट्र औद्योगिक विकास अधिनियम, १९६१ चे प्रकरण सहाची अधिसूचना क्रमांक आयडीसी २००७/(३३४)/उद्योग-१४, दि. १२ फेब्रुवारी, २००९, महाराष्ट्र शासनाच्या राजपत्रातील भाग चार-ब पृष्ठ क्र. ३११ ते ३३७ वर महाराष्ट्र शासनाने सदर अधिसूचनेच्या अनुसूचीत उल्लेखिलेल्या क्षेत्रात महाराष्ट्र औद्योगिक विकास अधिनियम, १९६१ (१९६२ चा महा. तीन) (यापुढे ज्याचा उल्लेख उक्त अधिनियम असा करण्यात येईल) चे कलम सहा, दिनांक १२ फेब्रुवारी, २००९ अंमलात आणले होते व उक्त अधिनियमाच्या आधारे मौजे कुभार्ते, निजामपूर, भाले, कांदळगांव(बु), जावटे, बोंडशेत, ता. माणगांव, जिल्हा रायगड व पाथरशेत, जामगांव व पहूर, तालुका रोहा, जि. रायगड उक्त अनुसूचित नमूद केलेले क्षेत्र अधिनियमाच्या कलम २, खंड (ग) अन्वये औद्योगिक क्षेत्र म्हणून जाहीर केलेले आहे;

ज्याअर्थी मौजे जावटे, तालुका माणगांव, जिल्हा रायगड व मौजे पाथरशेत, जामगांव व पहूर, तालुका रोहा जिल्हा रायगड गावातील काही सव्र्हे नंबर मधील क्षेत्र संयुक्त मोजणी अंती कमी जास्त झाले असल्याचे संयुक्त मोजणी अहवालावरून निदर्शनास आले असल्यामुळे सदर सव्र्हे नंबरच्या क्षेत्रामध्ये बदल झाला असल्याने प्रकरण-६ मध्ये दुरुस्ती करणे आवश्यक आहे.

तर, महाराष्ट्र्र सामान्य कलम कायदा, १९०४ च्या कलम २१ सोबत वाचण्यात येणाया उक्त अधिनियमाच्या कलम १, उप-कलम ३ आणि कलम २ चे उप-कलम (ग) अन्वये प्रदान करण्यात आलेल्या अधिकारांतर्गत महाराष्ट्र शासन असे जाहीर करते की, सदर अधिसूचनेत खालीलप्रमाणे बदल लागू झाले आहेत असे मानण्यात येईल :—

No. IDC 2018/(369)/Ind. 14.--Whereas, the Government of Maharashtra, by the Government Notification, issued by the Industry, Energy and Labour Department, No. IDC. 2007/(334)/IND - 14, dated 12th February 2009, published in the Maharashtra Government Gazette, Part IV-B, dated the 19 February 2009 at pages 253-430 (hereinafter referred to as "the said Notification"), issued in exercise of the powers conferred by sub-section (3) of section 1 of the Maharashtra Industrial Development Act, 1961(Mah. III of 1962), appointed the 19th February, 2009 to be the date from which the provisions of Chapter- VI of the said Act shall take effect in certain areas of villages Kumbharte, Nijampur, Bhale, Kandalgaon (B), Jawthe & Bondsheth in Mangaon Taluka, Raigad District and Patharshet, Jamgaon and Pahoor in Roha Taluka, Raigad District and declare to be an industrial area under clause (g) of section 2 of the said Act for the purposes of the said Act ;

And Whereas, in the joint measurement report of villages Jawthe in Mangaon Taluka, Raigad District and Patharshet, Jamgaon and Pahoor in Roha Taluka Raigad District there are differences shown in some survey numbers areas which is less or more. It is necessary to amend the area of said notification ;

Now, therefore, in exercise of the powers conferred by the sub-section (3) of section 1 and clause (g) of section 2 of the Maharashtra Industrial Development Act, 1961 read with section 21 of the Maharashtra General Clauses Act (I of 1904), and all of other powers enabling it in this behalf, the Government of Maharashtra hereby, amends the said notification, as under,---
