क्रमांक भाख्रिवि.२०१६/१०१४२/प्र.क्र. १००१/कु.क.---- भारतीय ख्रिश्चन विवाह अधिनियम, १८७२ (कायदा क्र. १५/१८७२) च्या कलम ६ व ९ मधील तरतुदीनुसार रेव्ह. दयानंद पोपटराव साळवी, राहणार झायन व्हिला, जयमाला नगर, ५१७/३२, सांगवी, पुणे ४११ ०२७ यांना या अधिसूचनेद्वारे बेथनी वर्कस, पुणे या नोंदणीकृत चर्चमध्ये भारतीय ख्रिश्चन लोकांचे विवाह योग्य त्या विधीसह लावण्याचा परवाना तसेच त्यांना विवाहाचे प्रमाणपत्र देण्याचा अधिकार शासन प्रदान करीत आहे. रेव्ह. दयानंद पोपटराव साळवी, यांनी विवाह विधी पार पाडताना उक्त अधिनियमातील तरतुदींचे काटेकोरपणे पालन करावे.

Shishir Hiray as "Special Public Prosecutor" for conducting the case in District and Sessions Court, Yavatmal which is arising out of C.R. No. 737/2018 registered Police Station, Arni, Dist. Yavatmal.

2 . The fees of Adv. Shishir Hiray, Special Public Prosecutor shall be paid by Home Department as per the proposal approved by this department.

Metropolitan Magistrate, Mumbai and Sessions Court, Mumbai which is arising out of C.R.No.86/ 2019 registered at Economic Offences Wing, Mumbai (Bhandup Police Station, Mumbai, C.R.No.375/ 2019).

अ.क्र. अधिकार प्रदान करावयाचे अधिकार प्रदान करावयाचे शक्तीची व्याप्ती कार्यक्षेत्र जिल्हा अधिकायाचे नाव अधिकायाचा हुद्दा

कोल्हापूर, सातारा व सांगली जिल्ह्यपुरते मर्यादित.

अटी :---

(१) वसुली अधिकारी यांनी महाराष्ट्र सहकारी संस्था अधिनियम, १९६० चे कलम १५६ व नियम, १९६१ चे नियम १०७ मधील तरतुदीनुसार कर्ज वसुलीची कार्यवाही करावी. कर्ज वसुली करताना सहकार कायदा, नियम यातील तरतुदी व परिपत्रकीय सूचनांचे पालन न केल्याचे निदर्शनास आल्यास आवश्यक ती चौकशी करून आवश्यकता भासल्यास सदरचे प्रदान केलेले अधिकार तात्काळ काढून घेण्यात येतील.

(२) सदरचे अधिकार सहकार कायदा कलम १०१ व कलम ९८ अन्वये प्राप्त वसुली दाखल्याची अंमलबजावणी करण्याकरिता असतील.

(३) वसुली अधिकारी यांनी या कार्यालयाने दिनांक ३१ ऑक्टोबर, २०१८ रोजी निर्गमित केलेल्या परिपत्रकानुसार दरमाह विहित नमुन्यात कर्ज वसुलीची माहिती जिल्हा उप निबंधक, सहकारी संस्था, रत्नागिरी यांना सादर करावी.

(४) वसुली अधिकार प्रदान केलेल्या व्यक्तीची बदली झाल्यास किंवा सदर व्यक्ती सेवानिवृत्ती झाल्यास किंवा सदर व्यक्तीस सेवेतून काढून टाकल्यास किंवा त्याचा मृत्यू झाल्यास, अशा अधिकायास प्रदान केलेले अधिकार आपोआप रद्द होतील.

(५) वसुली अधिकारी यांनी नमूद केलेल्या कालावधीत वसुलीचे कामकाज समाधानकारक केले नसल्याचे निदर्शनास आल्यास किंवा प्रदान केलेल्या अधिकाराचा गैरवापर करीत असल्याचे निदर्शनास आल्यास, प्रदान केलेले अधिकार काढून घेतले जातील व भविष्यात असे कोणतेही अधिकार अशा व्यक्तीस प्रदान करण्यात येणार नाहीत.

(६) शासन निर्णय क्रमांक संकीर्ण-१५०४/प्र.क्र.२३१/१५-स, दिनांक २३ नोव्हेंबर २००६ अन्वये वसुली अधिकायांना तीन सिंहाच्या राजमुद्रेचा वापर करता येणार नाही.

(७) वसुली अधिकायास त्याच्या नावापुढे कोठेही ""महाराष्ट्र शासन नियुक्त"" आणि/किंवा "" सिव्हील कोर्ट"", ""एक्झीक्युटीव्ह कोर्ट"" या शब्दांचा अथवा तत्सम शब्दांचा वापर करता येणार नाही. त्याऐवजी वसुली अधिकायांनी त्यांच्या नावापुढे वसुली अधिकारी (महाराष्ट्र सहकारी संस्था अधिनियम, १९६० व नियम, १९६१ चे नियम १०७ अन्वये) असे लिहावे.

(८) वसुली अधिकायास वसुलीसाठी वापर करण्यात येणाया वाहनावर ""वसुली अधिकारी, रत्नागिरी अर्बन को-ऑप. बँक लि., रत्नागिरी "" असा फलक लावता येईल.

(९) वसुली अधिकायाने पगार जप्तीची कार्यवाही करताना कर्जदाराच्या/जामीनदाराच्या पगार कपातीबाबत राष्ट्रीयीकृत बँका वा अन्य बँका यांच्याकडे परस्पर वेतन कपातीचा आदेश देऊन परस्पर पगार कपात करता येणार नाही. संबंधित कर्जदार/जामीनदार ज्या आस्थापनेवर काम करीत आहे त्या आस्थापनेवरील आहरण व संवितरण अधिकारी/पगार करणारा अधिकारी यांचेमार्फत पगारातून कर्ज वसूल करण्याची कार्यवाही करावी.

(१०) वसुली अधिकायास, थकबाकीदाराकडून वसुली दाखल्यानुसार वसुलपात्र रक्कम व या कार्यालयाचे कलम १५६ आणि त्याखालील नियम १०७ अन्वये आदेश दिनांक ६ एप्रिल २०१८ मध्ये नमूद केल्याप्रमाणे व दराने अंमलबजावणी खर्चाची रक्कम याशिवाय इतर कोणतीही रक्कम वसूल करता येणार नाही.

(११) या कार्यालयाचे दिनांक ३१ ऑक्टोबर २०१८ रोजीच्या परिपत्रकीय सूचनांचे वसुली अधिकारी यांनी तंतोतंत पालन करावे. बँकेचे मुख्य कार्यकारी अधिकारी यांनी दरमहा वसुली अधिकायांचे कामकाजाचा कर्जदारनिहाय आढावा परिपत्रकातील प्रपत्र-पाच मध्ये नमूद केल्याप्रमाणे घ्यावा.

(१२) वसुली अधिकारी यांनी निर्गमित करावयाच्या नोटीस/आदेश/घोषणा यामध्ये त्यांना अधिकार प्रदान केलेल्या या आदेशाचा संदर्भ नमूद करावा.

(६) शासन निर्णय क्रमांक संकीर्ण-१५०४/प्र.क्र.२३१/१५-स, दिनांक २३ ऑक्टोबर २००६ अन्वये वसुली अधिकायांना तीन सिंहाच्या राजमुद्रेचा वापर करता येणार नाही. त्याऐवजी या कार्यालयाचे परिपत्रक दिनांक ६ जून २०१९ मध्ये निश्चित केलेल्या बँकेच्या नावाच्या मोहरेचा वापर करण्यात यावा.

(१) आपण महाराष्ट्र सहकारी संस्था अधिनियम, १९६० चे कलम १५६ व नियम, १९६१ चे नियम १०७ मधील तरतुदीनुसार कर्ज वसुलीची कार्यवाही करावी. कर्ज वसुली करतांना सहकारी कायदा, नियम यातील तरतुदी व परिपत्रकीय सूचनांचे पालन न केल्याचे निदर्शनास आल्यास, आवश्यक ती चौकशी करून आवश्यकता भासल्यास, सदरचे प्रदान केलेले अधिकार तत्काळ काढून घेण्यात येतील.

(२) सदरचे अधिकार सहकार कायदा कलम १०१ व कलम ९१ अन्वये प्राप्त वसुली दाखल्याची अंमलबजावणी करण्याकरिता असतील.

(३) आपण दरमहा सोबत जोडलेल्या विहित नमुन्यात "अ-३", "अ-४", व "ब" कर्ज वसुलीची माहिती संबंधित जिल्हा उप निबंधक, सहकारी संस्था कार्यालयास सादर करावी.

(४) आपली बदली झाल्यास किंवा सेवानिवृत्ती झाल्यास किंवा सेवेतून काढून टाकल्यास किंवा मृत्यू झाल्यास, प्रदान केलेले अधिकार आपोआप रद्द होतील.

(५) आपण केलेल्या संपूर्ण सरचार्ज रकमेचा भरणा वसूल केलेल्या महिन्यातच चलनाने शासकीय कोषागारात करावा. वसुल केलेला सरचार्ज, त्याचा शासकीय कोषागारात केलेला भरणा याबाबत संस्था स्तरावर स्वतंत्र नोंदवही सोबत जोडलेल्या नमूना "अ-१", "अ-२", ""अ-३"" व "अ-४" मध्ये ठेवावी.

(६) " मा. उच्च न्यायालय, मुंबई रिट याचिका क्रमांक १९४२/२०१३, दि बेसिन कॅथोलिक को-ऑप. बँक विरुद्ध महाराष्ट्र राज्य व इतर " या याचिकेमध्ये दिनांक ५ डिसेंबर, २०१६ रोजी दिलेला आदेश विचारात घेऊन व वसुलीची कार्यवाही करताना महाराष्ट्र सहकारी संस्था अधिनियम, १९६० व नियम, १९६१ अन्वये प्राप्त असलेल्या अधिकारानुसारच वसुलीची कार्यवाही करावी.

(७) आपण नमूद केलेल्या कालावधीत वसुलीचे कामकाज समाधानकारक केले नसल्याचे निदर्शनास आल्यास किंवा प्रदान केलेल्या अधिकाराचा गैरवापर करीत असल्याचे निदर्शनास आल्यास, प्रदान केलेले अधिकार काढून घेतले जातील व भविष्यात असे कोणतेही अधिकार अशा व्यक्तीस प्रदान करण्यात येणार नाहीत.

(८) शासन निर्णय क्रमांक संकीर्ण-१५०४/प्र.क्र.२३१/१५-स, दिनांक २३ नोव्हेंबर, २००६ अन्वये आपणास तीन सिंहाच्या राजमुद्रेचा वापर करता येणार नाहीत.

(९) आपणास आपल्या नावापुढे कोठेही ""महाराष्ट्र शासन नियुक्त"" किंवा "" सिव्हील कोर्ट"", ""एक्झीक्युटीव्ह कोर्ट"" या शब्दांचा अथवा तत्सम शब्दांचा वापर करता येणार नाही. त्याऐवजी ""वसुली अधिकारी (महाराष्ट्र सहकारी संस्था अधिनियम, १९६० व नियम, १९६१ चे नियम १०७ अन्वये"") असे लिहावे.

(१०) आपण वसुलीसाठी वापर करण्यात येणाया वाहनावर ""वसुली अधिकारी ....................... सहकारी बँक/पतसंस्था ......................."" असा फलक लावता येऊ शकेल.

(११) आपण पगारजप्तीची कार्यवाही करताना कर्जदाराच्या/जामीनदाराच्या पगार कपातीबाबत राष्ट्रीयीकृत बँका वा अन्य बँका यांच्याकडे परस्पर वेतन कपातीचा आदेश देऊन परस्पर पगार कपात करता येणार नाही. संबंधित कर्जदार/जामीनदार ज्या आस्थापनेवर काम करीत आहे त्या आस्थापनेवरील आहरण व संवितरण अधिकारी/पगार करणारा अधिकारी यांचेमार्फत पगारातून कर्ज वसूल करण्याची कार्यवाही करावी.

(१२) आपणास थकबाकीदाराकडून वसुली दाखल्यानुसार वसूलपात्र रक्कम व सरचार्ज रक्कम याशिवाय इतर कोणतीही रक्कम वसुली करता येणार नाही.

(१३) नुतणीकरणाचा प्रस्ताव मा. सहकार आयुक्त व निबंधक, सहकारी संस्था, म.रा., पुणे यांचे परिपत्रक दिनांक १ जानेवारी, २०१७ मध्ये दिलेल्या सुचनेनुसारच प्रस्ताव दाखल करण्यात यावा.

(३) (४) (५) १ श्री. पंडीत बाजीराव देशमाने वसुली अधिकारी वसुली अधिकारी नाशिक जिल्हा (१) वसुली अधिकारी यांनी महाराष्ट्र सहकारी संस्था अधिनियम, १९६० चे कलम १५६ व नियम, १९६१ चे नियम १०७ मधील तरतुदीनुसार कर्ज वसुलीची कार्यवाही करावी. कर्ज वसुली करताना सहकार कायदा, नियम यातील तरतुदी व परिपत्रकीय सूचनांचे पालन न केल्याचे निदर्शनास आल्यास, आवश्यक ती चौकशी करून आवश्यकता भासल्यास, सदरचे अधिकार तात्काळ काढून घेण्यात येतील.

(२) सदरचे अधिकार सहकार कायदा कलम १०१ व ९१ अन्वये प्राप्त वसुली दाखल्याची अंमलबजावणी करण्याकरिता असतील.

(३) वसुली अधिकारी यांनी दरमहा सोबत जोडलेल्या विहित नमुन्यात अ-३, अ-४ व ब प्रमाणे कर्ज वसुलीची माहिती संबंधित जिल्हा उप निबंधक, सहकारी संस्था यांचे कार्यालयास सादर करावी. ज्या सहकारी संस्थेचे कार्यक्षेत्र विभाग, दोन विभाग अथवा राज्य कार्यक्षेत्र आहे त्या संस्थांनीदेखील त्यांचे मुख्य कार्यालय ज्या जिल्ह्यमध्ये आहे त्या जिल्हा उप निबंधक यांचे कार्यालयास माहिती सादर करावी.

(४) अधिकार प्रदान केलेल्या वसुली अधिकारी असलेल्या व्यक्तीची बदली झाल्यास किंवा सेवानिवृत्ती झाल्यास किंवा सेवेतून काढून टाकल्यास किंवा त्याचा मृत्यू झाल्यास, अशा अधिकायास प्रदान केलेले अधिकार आपोआप रद्द होतील.

(५) विशेष वसुली अधिकारी यांनी मा. सहकार आयुक्त व निबंधक, सहकारी संस्था, महाराष्ट्र राज्य, पुणे यांचेकडील दिनांक ६ एप्रिल २०१८ रोजीचे आदेशाप्रमाणे केलेल्या आदेशिकेच्या खर्चाचा (Cost of Process) व शिल्लक रक्कमेचा तपशील संस्थेस न चुकता विहित नमुन्यात सादर करावा.

(६) " मा. उच्च न्यायालय, मुंबई यांनी रिट याचिका क्रमांक १९४२/२०१३, दि बेसिन कॅथोलिक को-ऑप. बँक विरुद्ध महाराष्ट्र राज्य व इतर " या याचिकेमध्ये दिनांक ५ डिसेंबर २०१५ रोजी दिलेला आदेश विचारात घेऊन वसुलीची कार्यवाही करताना महाराष्ट्र सहकारी संस्था अधिनियम, १९६० व नियम, १९६१ अन्वये प्राप्त असलेल्या अधिकारानुसारच वसुलीची कार्यवाही करावी.

(७) वसुली अधिकारी यांनी नमूद केलेल्या कालावधीत वसुलीचे कामकाज समाधानकारक केले नसल्याचे निदर्शनास आल्यास किंवा प्रदान केलेल्या अधिकाराचा गैरवापर करीत असल्याचे निदर्शनास आल्यास, प्रदान केलेले अधिकार काढून घेतले जातील व भविष्यात असे कोणतेही अधिकार अशा व्यक्तीस प्रदान करण्यात येणार नाहीत.

(९) वसुली अधिकायास त्याच्या नावापुढे कोठेही ""महाराष्ट्र शासन नियुक्त"" आणि किंवा "" सिव्हील कोर्ट"", ""एक्झीक्युटीव्ह कोर्ट"" या शब्दांचा अथवा तत्सम शब्दांचा वापर करता येणार नाही. त्याऐवजी वसुली अधिकायंानी त्यांच्या नावापुढे ""वसुली अधिकारी (महाराष्ट्र सहकारी संस्था अधिनियम, १९६० व नियम, १९६१ चे नियम १०७ अन्वये)"" असे लिहावे.

(१०) वसुली अधिकायास वसुलीसाठी वापर करण्यात येणाया वाहनावर ""वसुली अधिकारी, ............................ सहकारी बँक/ पतसंस्था"" असा फलक लावता येऊ शकेल.

(११) वसुली अधिकायाने पगार जप्तीची कार्यवाही करताना कर्जदाराच्या/जामीनदाराच्या पगार कपातीबाबत राष्ट्रीयीकृत बँका वा अन्य बँका यांच्याकडे परस्पर वेतन कपातीचा आदेश देऊन परस्पर पगार कपात करता येणार नाही. संबंधित कर्जदार/जामीनदार ज्या आस्थापनेवर काम करीत आहे त्या आस्थापनेवरील आहरण व संवितरण अधिकारी/पगार करणारा अधिकारी यांचेमार्फत पगारातून कर्ज वसूल करण्याची कार्यवाही करावी.

(१२) वसुली अधिकायास, थकबाकीदाराकडून वसुली दाखल्यानुसार वसुलपात्र रक्कम व सरचार्ज रक्कम याशिवाय इतर कोणतीही रक्कम वसूल करता येणार नाही.

(१३) सोबतच्या यादीप्रमाणे सर्व प्रकरणामध्ये जंगम जप्ती, स्थावर जप्ती, अपसेट प्राईज मंजुरी, जाहीर लिलाव व कलम १००/८५ अन्वयेची कार्यवाही ही विहित मुदतीत पूर्ण करण्यात यावी. सदर मुदतीत उक्त कार्यवाही पूर्ण न केल्यास आपणांस दिनांक १ एप्रिल २०२० पासून पुढील कालावधीसाठी कलम १५६ चे अधिकार प्रदान करण्यात येणार नाही याची गांभीर्याने नोंद घ्यावी व त्याची सर्वस्वी जबाबदारी ही आपली राहील.
