BY DIRECTOR OF TOWN PLANNING
MAHARASHTRA REGIONAL AND TOWN PLANNING ACT, 1966.—
No. DTP-Pardi, Bharatwada, Punapur and Bhandewadi Draft TPS No. I Nagpur /ADV-poss/ Sec. 83(2) TPV-2-5502-2019.—
Whereas, the Pardi, Bharatwada, Punapur and Bhandewadi Draft Town Planning Scheme No. I, Nagpur (hereinafter referred to as the " said draft scheme ") as submitted by the Nagpur Improve- ment Trust (hereinafter referred to as the " said Planning Authority ") vide its letter dated 06th July 2018, has been sanctioned by the State Government, vide Notification No. TPS-2418-Nag.Camp-9-CR- 281/2018-UD-9, dated 06th October 2018 under sub-section (2) of Section 68 of the Maharashtra Regional and Town Planning Act, 1966 (Mah. XXXVII of 1966) (hereinafter referred to as the " said Act ") ;
And whereas, the State Government vide Notification No. TPS-2411-Nag.Camp-9-CR-281/2018- UD-9, dated 15th November 2018 issued under sub-section (1) of Section 72 of the said Act, read with the Maharashtra Town Planning Scheme Rules, 1974 has appointed the Assistant Director of Town Planning, Nagpur Branch as the Arbitrator (hereinafter referred to as the " said Arbitrator ") in respect of the said draft Scheme ;
४ द्धन्रु]क्ष् रू न् ॅ-+ न् ह्यम््र ान्म््र, म्दन् २८-ह्यरूदन् ४, २०१९/+ ७-१३, ॅ १९४१And whereas, the Resolution No. 1/1169, dated 20th May 2017 has been passed by the said Planning Authority to authorize Nagpur Municipal Corporation and Nagpur Smart & Sustainable City Develop- ment Corporation Ltd. (NSSCDCL) as Special Purpose Vehicle (hereinafter referred to as the " said Special Purpose Vehicle-SPV ") to prepare the said draft scheme ;
And whereas, in the said draft scheme, the lands bearing various Final Plot Nos. (which are without any buildings) reserved for EWS Housing as Reservation No. 323, 327, 396 and 382 and shown in red lines on the Plan and kept open for the inspection by the public in office of the said Planning Authority ;
And whereas, on the request of said SPV, the said Planning Authority vide Resolution No. 12/1183- 26-11-2018-SE-Planning dated 26th November 2018, has resolved that, in the interest of the public it is necessary to take the advance possession to undertake forthwith the execution of works included in the said draft scheme, for EWS Housing as mentioned above and shown on the said scheme plan;
And whereas, the said Planning Authority has on 05th January 2019 made an application to the Arbitrator, duly appointed in respect of the said scheme, that to submit the proposal of advance possession to Government as required by sub-section (1) of Section 83 of the said Act, to vest in it the lands reserved for EWS Housing as shown in the said draft scheme ;
And whereas, the Arbitrator, after hearing the persons affected, as required by the proviso to sub-section (2) of Section 83 of the said Act, submitted his report to the State Government on 23rd July 2019 along with the proposal of advance possession ;
And whereas, the Government vide Notification No. TPS-1813-3211-CR-508-UD-13, dated 01st December 2016 has delegated the powers exercisable by it, under sub-section (2) of Section 83 of the said Act, to the Director of Town Planning, Maharashtra State, Pune. Accordingly the Government forwarded the above proposal of advance possession of Director of Town Planning, Maharashtra State, Pune for further action on 06th August 2019 ;
And whereas, the Arbitrator mentioned in his report that it is not suitable to take advance possession of lands under Reservation No. 327, 396 and 382 EWS Housing, as these lands are regularised under Maharashtra Gunthewari Act by the said Planning Authority. Therefore, lands under these Reservation No. 327, 396 and 382 EWS Housing are not consider for advance possession ;
And whereas, Arbitrator also mentioned that the landowner of land under Reservation No. 323, EWS Housing requested to shift Reservation No. 323 in their family's and nearby. Accordingly, the Arbitrator communicated this fact to the said Planning Authority i.e. NIT and recommended for advance possession ;
And whereas, in the sanctioned Revised Development Plan of Nagpur City the lands covered by the said draft scheme are included in Residential, Industrial, Commercial, No Development Zone and Reservations. The said Planning Authority has resolved that the above land uses and reservations are to be deleted and included in the said draft scheme. Accordingly, after following all legal procedures as per provisions of sub-section (1) of Section 37 of the said Act, submitted a modification proposal to the Government for its sanction;
And whereas, under sub-section (2) of Section 37 of the said Act the Government sanctioned the above modification proposal vide Notification No. TPS-2418-1704-CR-293-2018-UD-9, dated 14th November 2018 and for that purpose amends the Development Plan as follows—
"The lands from Green belt control scheme of Nagpur Improvement Trust admeasuring 1730 Acre (700.404 Hectare) from mouje Pardi, Bharatwada, Punapur and Bhandewadi which are included in the Central Government Smart City Mission, are deleted from proposed reservations and land uses in the sanctioned Development Plan proposals and included in land uses as per Draft Town Planning Scheme No. I as shown on the plan, subject to the condition specified below. "—
Condition:–Proposal on the lands from mouze Pardi, Bharatwada, Punapur and Bhandewadi as per Draft Town Planning Scheme No. I sanctioned under Section 68(2) by the Government shall become part of the sanctioned Development Plan.
द्धन्रु]क्ष् रू न् ॅ-+ न् ह्यम््र ान्म््र, म्दन् २८-ह्यरूदन् ४, २०१९/+ ७-१३, ॅ १९४१ ५And whereas, the Government vide Notification No. TPS-2419-1419-CR-154-2019-UD-9, dated 27th August 2019 permits the Nagpur Municipal Corporation to exercise the powers of Planning Authority under the said Act in the entire area under its jurisdiction including the area covered by the Seven Scheme of the Nagpur Improvement Trust and NIT will cease to exercise the powers of a Planning Authority under the said Act ;
And whereas, as per Government Notification dated 14th November 2018 the said draft scheme shall become part of the sanctioned Development Plan. Therefore, as per sanction Development Control Regulation No. 13.5 the Authority may shift the reservation in Development Plan. And whereas, as per the Government Notification dated 27-08-2019 the Nagpur Municipal Corporation is the Planning Authority for said Draft Scheme and in that capacity the Commissioner, Nagpur Municipal Corporation has shifted the Reservation No 323, EWS Housing area 27523.0 sq. mtr. from Final Plot No. 323 to Final Plot No. 66/1 and 66/2 vide their Order No. 556, dated 25th September 2019 ;
And whereas, Commissioner, Nagpur Municipal Corporation has accordingly submitted the copy of order dated 25th September 2019 along with copy of part plan thereof, to the Director of Town Planning, Maharashtra State, Pune. Therefore, Reservation No. 323, EWS Housing area 27523.0 sq. mtr. bearing CTS No. 148, Original Plot No. 66, Final Plot No. 66/1 & 66/2 ( hereinafter referred to as the " said Land " ) is now become the proposal of the said draft scheme. Hence, said land can be considered for advance possession under sub-section (1) of Section 83 of the said Act ;
And whereas, the Director of Town Planning, Maharashtra State, Pune after considering the report of the Arbitrator, is satisfied that it is urgently necessary in the public interest to empower the Nagpur Municipal Corporation being the Planning Authority to enter on the said lands, and for that purpose take advance possession of the said lands urgently thereof, for execution of the said EWS Housing works as proposed in the said draft scheme.
Now, therefore, in exercise of the powers delegated to him, under sub-section (2) of the Section 83 of the said Act, and all other powers enabling in this behalf, the Director of Town Planning, Maharashtra State, Pune hereby directs the Arbitrator to take advance possession of the said lands mentioned in the Schedule appended hereto and take further necessary action as would be necessary in this regard.

Modification under Section 37 of Maharashtra Regional and Town Planning Act, 1966
No. NMC-TPD-ACT-37-1134-2019.—
Whereas, the Development control Regulations of Nagpur Municipal Corporation has been sanctioned by the Government vide Urban Development Notification No. TPS-2400-1684-CR-192-2000-UD-9, dated the 31st March, 2001 under Section 31(1) of the Maharashtra Regional and Town Planning Act, 1966 and have come into force with effect from the 9th April, 2001. Also Nagpur Municipal Corporation has been declared as 'Planning Authority' for Nagpur City excluding seven schemes which are retained with Nagpur Improvement Trust, Nagpur vide Govt. Notification No.TPS- 2401-855-CR-76-UD-9, Dt. 27th February, 2002.
In view of the above General Body of Nagpur Municipal Corporation has passed Resolution No. 437/356 in the General Body Meeting held on dated 22nd August 2019 proposed modification the following provision of Development Control Regulations of Nagpur City. Under section 37 of the Maharashtra Regional and Town Planning Act 1966.
Where as in the provision No. 2.9(3) of the said Development Control Regulations there is a provision regarding the additional FSI for the Building of Government and Semi-Government offices and public sector undertaking. In the other Municipal Corporation of the state the provision for allowing the additional FSI has been incorporated for the Building of Government and Semi-Government offices and public sector undertaking. Therefore the Government is of opnion that a provision consistant with this provision in other Municipal Corporation in this state is necessary to incorporate in the said provision of DCR Nagpur, for this purpose Government has given the direction U/s 154 of the MR & TP Act 1966 to the NMC vide Notification No. TPS-2418-704-CR-40-2019-UD-9, dated 8th March, 2019. As per the said Govt. directions the following modifications are proposed by the Nagpur Municipal Corporation.

The details regarding aforesaid proposed modification are available at the office of Town Planning Deptt., Nagpur Municipal Corporation, 3rd floor, Administrative Bulding, Nagpur Municipal Corporation, Civil Lines, NMC Road, Nagpur- 440 001 for inspection by public during office hours on all working days. The Suggestions and objections which may be received by the Municipal Corporation in respect of the said modifications within a period of 1 month from the date of publication of this notice in the Official Govt. Gazette will be considered by the Commissioner, Nagpur, Municipal Corporation, Nagpur before submitting the said proposed modification proposal to the Govt. for sanction.
