No. SPP.1019/1985/C.R.224/Desk-14.—In exercise of the powers conferred by Section 15 of the Scheduled castes and the scheduled tribes (Prevention of Atrocities) Act, 1989, the Government of Maharashtra hereby designate the following Additional Public Prosecutor as the ' Special Public Prosecutor ' for conducting the Court cases relating to the said Act before the Courts in Session Court, Mumbai until further order.

No. SPP.2019/U.O.R.59/D-XIV.—In exercise of the powers conferred by sub-section (8) of the section 24 of the Code of Criminal Procedure, 1973 (Act No. II of 1974), the Government of Maharashtra hereby appoints Adv.Pradip D. Gharat, as " Special Public Prosecutor " for conducting the cases in Special M.P.I.D. Court, Sessions Court, Mumbai and Hon'ble High Court, Mumbai, arising out of C.R. No.29/2019, registered with Economic Offences Wing, Mumbai.

2. The fees and other charges of Adv. Pradip D. Gharat, Special Public Prosecutor, shall be paid by Home Department as per the proposal approved by this department.

3. His appointment is strictly subject to the conditions of service laid down in the Maharashtra Law Officers (Appointment, Conditions of Service and Remuneration) Rules, 1984.

4. The Government reserves the right to revoke/modify/annul the order without assigning any reasons.

टिपा.---- (१) शासनाकडून संबंधित संवर्ग/पदांसाठी विहित वेळेत मागणीपत्र प्राप्त होईल; या गृहितकाच्या आधारे अंदाजित वेळापत्रक प्रस्तावित करण्यात आले आहे. शासनाकडून विहित वेळेत मागणीपत्र प्राप्त झाल्यासच नियोजित महिन्यामध्ये पदे विज्ञापित करणे व वेळापत्रकाप्रमाणे परीक्षा घेणे शक्य होईल. (२) वेळापत्रक अंदाजित असून जाहिरातीच्या अथवा परीक्षेच्या प्रस्तावित महिना/दिनांकामध्ये कोणत्याही प्रकारचा बदल होऊ शकतो. असा बदल झाल्यास तो आयोगाच्या संकेतस्थळावर प्रसिद्ध करण्यात येईल. (३) अंदाजित वेळापत्रकाबाबतची सद्य:स्थिती दर्शविणारी अद्ययावत माहिती (Updates) वेळोवेळी आयोगाच्या संकेतस्थळावर प्रसिद्ध करण्यात येईल. (४) संबंधित परीक्षेची परीक्षा योजना, अभ्यासक्रम, निवड पद्धत इत्यादी तपशील आयोगाच्या संकेतस्थळावर प्रसिद्ध करण्यात आला आहे/ येईल व आयोगाच्या धोरणानुसार वेळोवेळी अद्ययावत करण्यात येईल. (५) संबंधित परीक्षेमधून भरावयाच्या पदसंख्येबाबतचा सविस्तर तपशील जाहिरात/अधिसूचनेद्वारे उपलब्ध करून देण्यात येईल.

क्रमांक ना.बँका/१ सआ/क. १५६/कर्मवीर भाऊराव पाटील मल्टी/१६८०/२०१९.-------- मी, डॉ. पी. एल. खंडागळे, अपर निबंधक (पतसंस्था), सहकारी संस्था, महाराष्ट्र राज्य, पुणे मला महाराष्ट्र सहकारी संस्था अधिनियम, १९६० चे कलम १५६ अन्वये प्राप्त अधिकारांचा वापर करून उक्त कलम १५६(१) अन्वये कर्मवीर भाऊराव पाटील मल्टीस्टेट को-ऑप.क्रेडिट सोसायटी जि. कोल्हापूर या बहुराज्यीय सहकारी पतसंस्थेच्या प्रस्ताव दिनांक १४ फेब्रुवारी २०१९ अनुसार उक्त बहुराज्यीय पतसंस्थेच्या खालील अधिकायांस त्यांच्या नावापुढे दर्शविलेल्या कार्यक्षेत्रासाठी, सदर बहुराज्यीय सहकारी पतसंस्थेमध्ये रुपांतरीत होणेपूर्वीच्या वितरित केलेल्या कर्जाची वसुली करणेकामी, महाराष्ट्र सहकारी संस्था अधिनियम, १९६० चे कलम १०१ व कलम ९१ अन्वये प्राप्त केलेल्या वसुली दाखल्यांची महाराष्ट्र सहकारी संस्था नियम, १९६१ चा नियम १०७ अनुसार वसुली अधिकायामार्फत अंमलबजावणी करणेसाठी, कसूरदाराची मालमत्ता जप्त करून तिची विक्री करून रकमा वसूल करण्याचे निबंधकाचे अधिकार, खालील अटीस अधीन राहून दिनांक ३१ मार्च २०२० पयर्ंत प्रदान करीत आहेत :—

(१) वसुली अधिकारी यांना सदरचे अधिकार कर्मवीर भाऊराव पाटील मल्टीस्टेट को-ऑप.क्रेडिट सोसायटी, जि. कोल्हापूर या बहुराज्यीय सहकारी पतसंस्थेमध्ये रुपांतरित होणे पूर्वीच्या दिनांकास दाखल असलेल्या महाराष्ट्र सहकारी संस्था अधिनियम १९६० चे कलम १०१ व ९१ अंतर्गत प्रकरणापुरतेच वापरता येतील अन्यथा इतर प्रकारे सदर अधिकारांचा वापर करता येणार नाही.

(२) सदरचे अधिकार महाराष्ट्र सहकारी संस्था अधिनियम, १९६० चे कलम १०१ व कलम ९१ अन्वये प्राप्त वसुली दाखल्यांची अंमलबजावणी करण्याकरिता असतील.

(३) वसुली अधिकारी यांनी महाराष्ट्र सहकारी संस्था अधिनियम, १९६० चे कलम १५६ व नियम १९६१ चे नियम १०७ मधील तरतुदीनूसार कर्ज वसुलीची कार्यवाही करावी. कर्ज वसुली करताना सहकार कायदा, नियम यातील तरतुदी व परिपत्रकीय सूचनांचे पालन न केल्याचे निदर्शनास आल्यास आवश्यक ती चौकशी करून आवश्यकता भासल्यास सदरचे प्रदान केलेले अधिकार तत्काळ काढून घेण्यात येतील.

(४) वसुली अधिकारी यांनी मालमत्तेच्या वाजवी किमतीस (अपसेट प्राईज) निबंधकाची पूर्व मान्यता घेणे आणि मालमत्तेची विक्री कायम करणे या कामी या कार्यालयाचे परिपत्रक जा.क्र. ना.बँका/डी-४/अपसेट प्राईज विक्री कायम/२०१५/८७०, दिनांक १७ एप्रिल २०१५ अनुसार जिल्हा उप निबंधक, सहकारी संस्था, कोल्हापूर यांची मान्यता घ्यावी. जिल्हा उप निबंधक, सहकारी संस्था, कोल्हापूर यांनी उक्त बँकेच्या वाजवी किमतीस (अपसेट प्राईज) पूर्व मान्यता देणे आणि मालमत्तेची विक्री कायम करणेसंबंधी प्रस्तावाबाबत महाराष्ट्र सहकारी संस्था नियम, १९६१ चे नियम १०७ मधील तरतुदीनुसार उचित कार्यवाही करावी.

(५) वसुली अधिकारी यांनी दरमहा या कार्यालयाचे परिपत्रक दिनांक ३१ ऑक्टोबर २०१८ अन्वये विहित केलेल्या नमुन्यात कर्ज वसुलीची माहिती जिल्हा उप निबंधक, सहकारी संस्था कोल्हापूर यांचे कार्यालयास सादर करावी.

(६) अधिकार प्रदान केलेल्या वसूली अधिकारी असलेल्या व्यक्तीची बदली झाल्यास किंवा सदर व्यक्ती सेवानिवृत्ती झाल्यास सदर व्यक्तीस सेवेतून काढून टाकल्यास किंवा त्याचा मृत्यू झाल्यास, असा अधिकायास प्रदान केलेले अधिकार आपोआप रद्द होतील.

(७) मा. उच्च न्यायालय, मुंबई यांनी रिट याचिका क्रमांक १९४२/२०१३, दि बेसिन कॅथोलिक को-ऑप. बँक विरूद्ध महाराष्ट्र राज्य व इतर या याचिकेमध्ये दिनांक ५ डिसेंबर २०१५ रोजी दिलेला आदेश विचारात घेऊन वसुलीची कार्यवाही करताना महाराष्ट्र सहकारी संस्था अधिनियम, १९६० व नियम, १९६१ अन्वये प्राप्त असलेल्या अधिकारानुसारच वसुलीची कार्यवाही करावी.

(८) वसुली अधिकारी यांनी नमूद केलेल्या कालावधीत वसुलीचे कामकाज समाधानकारक केले नसल्याचे निदर्शनास आल्यास किंवा प्रदान केलेल्या अधिकाराचा गैरवापर करीत असल्याचे निदर्शनास आल्यास, प्रदान केलेले अधिकार काढून घेतले जातील व भविष्यात असे कोणतेही अधिकार अशा व्यक्तीस प्रदान करण्यात येणार नाहीत.

(९) शासन निर्णय क्रमांक संकिर्ण १५०४/प्र.क्र.२३१/१५स, दिनांक २३ नोव्हेंबर २००६ अन्वये वसूली अधिकायास तीन सिंहाच्या राजमुद्रेचा वापर करता येणार नाही.

(१०) वसुली अधिकायास त्याच्या नावापुढे कोठेही ""महाराष्ट्र शासन नियुक्त"" आणि किंवा "" सिव्हील कोर्ट"", ""एक्झीक्युटीव्ह कोर्ट"" या शब्दांचा अथवा तत्सम शब्दांचा वापर करता येणार नाही. त्याऐवजी वसुली अधिकायंानी त्यांच्या नावापुढे ""वसुली अधिकारी (महाराष्ट्र सहकारी संस्था अधिनियम, १९६० व नियम, १९६१ चे नियम १०७ अन्वये )"" असे लिहावे.

(११) वसुली अधिकायास वसुलीसाठी वापर करण्यात येणाया वाहनावर ""वसुली अधिकारी, कर्मवीर भाऊराव पाटील मल्टीस्टेट को-ऑप.क्रेडिट सोसायटी जि. कोल्हापूर "" असा फलक लावता येऊ शकेल.

(१२) वसुली अधिकायाने पगार जप्तीची कार्यवाही करताना कर्जदाराच्या/जामीनदाराच्या पगार कपातीबाबत राष्ट्रीयीकृत बँका वा अन्य बँका यांचेकडे परस्पर वेतन कपातीचा आदेश देऊन परस्पर पगार कपात करता येणार नाही. संबंधित कर्जदार/जामीनदार ज्या आस्थापनेवर काम करीत आहे त्या आस्थापनेवरील आहरण व संवितरण अधिकारी/पगार करणारा अधिकारी यांचेमार्फत पगारातून कर्ज वसूल करण्याची कार्यवाही करावी.

(१३) वसुली अधिकायास, थकबाकीदाराकडून वसुली दाखल्यानुसार वसूलपात्र रक्कम व या कार्यालयाचे कलम १५६ आणि त्याखालील नियम १०७ अन्वयेे आदेश ६ एप्रिल २०१८ मध्ये नमूद केल्याप्रमाणे व दराने अंमलबजावणी खर्चाची रक्कम याशिवाय इतर कोणतीही रक्कम वसूल करता येणार नाही.

(१४) या कार्यालयाचे दिनांक ३१ ऑक्टोबर २०१८ रोजीच्या परिपत्ररीय सुचनांचे वसूली अधिकारी यांनी तंतोतंत पालन करावे. बँकेचे मुख्य कार्यकारी अधिकारी यांनी दरमहा वसूली अधिकायांचे कामकाजाचा कर्जदारनिहाय आढावा परिपत्रकातील प्रपत्र पाच मध्ये नमूद केल्याप्रमाणे घ्यावा.

(१५) वसुली अधिकारी यांनी निर्गमित करावयाच्या नोटीस/आदेश/घोषणा यामध्ये त्यांना अधिकार प्रदान केलेल्या व आदेशाचा संदर्भ नमूद करावा.

(१६) एका वसुली अधिकायाकडे १०० पेक्षा जास्त वसुली प्रकरणे देण्यात येऊ नयेत.

(१७) वसुली अधिकारी यांना प्रदान केलेल्या अधिकारांची उपरोक्त मुदत संपणेपूर्वी तीन महिनेचे आत अधिकाराचे नूतनीकरण करणेसाठीचा प्रस्ताव, नूतनीकरणाच्या समर्थनार्थ आवश्यक त्या कागदपत्रांसह सादर करणे बंधनकारक राहील.

(२) सदरचे अधिकार महाराष्ट्र सहकारी संस्था अधिनियम, १९६० चे कलम १०१ व कलम ९१ अन्वये प्राप्त केलेल्या वसुली दाखल्यांची अंमलबजावणी करण्याकरिता असतील.

(३) वसुली अधिकारी यांनी महाराष्ट्र सहकारी संस्था अधिनियम, १९६० चे कलम १५६ व नियम १९६१ चे नियम १०७ मधील तरतुदीनूसार कर्ज वसुलीची कार्यवाही करावी. कर्ज वसुली करताना सहकार कायदा, नियम यातील तरतुदी व परिपत्रकीय सूचनांचे पालन न केल्याचे निदर्शनास आल्यास आवश्यक ती चौकशी करून आवश्यकता भासल्यास सदरचे प्रदान केलेले अधिकार तत्काळ काढून घेण्यात येतील.

(४) वसुली अधिकारी यांनी मालमत्तेच्या वाजवी किमतीस (अपसेट प्राईज) निबंधकाची पूर्व मान्यता घेणे आणि मालमत्तेची विक्री कायम करणे याकामी या कार्यालयाचे परिपत्रक जा.क्र. ना.बँका/डी-४/अपसेट प्राईज विक्री कायम/२०१५/८७०, दिनांक १७ एप्रिल २०१५ अनुसार जिल्हा उप निबंधक, सहकारी संस्था, अहमदनगर यांची मान्यता घ्यावी. जिल्हा उप निबंधक, सहकारी संस्था, अहमदनगर यांनी उक्त बँकेच्या वाजवी किमतीस (अपसेट प्राईज) पूर्व मान्यता देणे आणि मालमत्तेची विक्री कायम करणेसंबंधी प्रस्तावाबाबत महाराष्ट्र सहकारी संस्था नियम, १९६१ चे नियम १०७ मधील तरतुदीनुसार उचित कार्यवाही करावी.

(५) वसुली अधिकारी यांनी दरमहा या कार्यालयाचे परिपत्रक दिनांक ३१ ऑक्टोबर २०१८ अन्वये विहित केलेल्या नमुन्यात कर्ज वसुलीची माहिती जिल्हा उप निबंधक, सहकारी संस्था, अहमदनगर यांचे कार्यालयास सादर करावी.

(६) अधिकार प्रदान केलेल्या वसुली अधिकारी असलेल्या व्यक्तीची बदली झाल्यास किंवा सेवानिवृत्ती झाल्यास किंवा सेवेतून काढून टाकल्यास किंवा त्याचा मृत्यू झाल्यास, अशा अधिकायास प्रदान केलेले अधिकार आपोआप रद्द होतील.

(८) वसुली अधिकारी यांनी नमूद केलेल्या कालावधीत वसुलीचे कामकाज समाधानकारक केले नसल्याचे निदर्शनास आल्यास किंवा प्रदान केलेल्या अधिकाराचा गैरवापर करीत असल्याचे निदर्शनास आल्यास, प्रदान केलेले अधिकार काढून घेतले जातील व भविष्यात असे कोणतेही अधिकार अशा व्यक्तीस प्रदान करण्यात येणार नाहीत.

(१०) वसुली अधिकायास त्याच्या नावापुढे कोठेही ""महाराष्ट्र शासन नियुक्त"" आणि/किंवा "" सिव्हील कोर्ट"", ""एक्झीक्युटीव्ह कोर्ट"" या शब्दांचा अथवा तत्सम शब्दांचा वापर करता येणार नाही. त्याऐवजी वसुली अधिकायंानी त्यांच्या नावापुढे ""वसुली अधिकारी (महाराष्ट्र सहकारी संस्था अधिनियम, १९६० व नियम, १९६१ चे नियम १०७ अन्वये )"" असे लिहावे.

(११) वसुली अधिकायास वसुलीसाठी वापर करण्यात येणाया वाहनावर ""वसुली अधिकारी, निशांत मल्टीस्टेट को-ऑप.क्रेडीट सोसायटी लि., अकोला"" असा फलक लावता येऊ शकेल.

(१२) वसुली अधिकायाने पगार जप्तीची कार्यवाही करताना कर्जदाराच्या/जामीनदाराच्या पगार कपातीबाबत राष्ट्रीयीकृत बँका वा अन्य बँका यांचेकडे परस्पर वेतन कपातीचा आदेश देऊन परस्पर पगार कपात करता येणार नाही. संबंधित कर्जदार/जामीनदार ज्या आस्थापनेवर काम करीत आहे त्या आस्थापनेवरील आहरण व संवितरण अधिकारी/पगार करणारा अधिकारी यांचेमार्फत पगारातून कर्ज वसूल करण्याची कार्यवाही करावी.

(१३) वसुली अधिकायास, थकबाकीदाराकडून वसुली दाखल्यानुसार वसूलपात्र रक्कम व या कार्यालयाचे कलम १५६ आणि त्याखालील नियम १०७ अन्वयेचे आदेश दिनांक ६ एप्रिल २०१८ मध्ये नमूद केल्याप्रमाणे व दराने अंमलबजावणी खर्चाची रक्कम याशिवाय इतर कोणतीही रक्कम वसूल करता येणार नाही.

(१४) या कार्यालयाचे दिनांक ३१ ऑक्टोबर २०१८ रोजीच्या परिपत्ररीय सुचनांचे वसूली अधिकारी यांनी तंतोतंत पालन करावे. पतसंस्थेच्या मुख्य कार्यकारी अधिकारी यांनी दरमहा वसुली अधिकायांचे कामकाजाचा कर्जदारनिहाय आढावा परिपत्रकातील प्रपत्र पाच मध्ये नमूद केल्याप्रमाणे घ्यावा.

(१५) वसुली अधिकारी यांनी निर्गमित करावयाच्या नोटीस/आदेश/घोषणा यामध्ये त्यांना अधिकार प्रदान केलेल्या या आदेशाचा संदर्भ नमूद करावा.

(१६) एका वसुली अधिकायाकडे १०० पेक्षा जास्त वसुली प्रकरणे सोेपविण्यात येऊ नयेत.

(१७) वसुली अधिकारी यांना प्रदान केलेल्या अधिकारांची उपरोक्त मुदत संपणेपूर्वी तीन महिनेचे आत अधिकाराचे नूतनीकरण करणेसाठीचा प्रस्ताव, नूतनीकरणाच्या समर्थनार्थ आवश्यक त्या कागदपत्रांसह सादर करणे बंधनकारक राहील.

(२) सदरचे अधिकार महाराष्ट्र सहकारी संस्था अधिनियम, १९६० चे कलम १०१ व कलम ९१ अन्वये प्राप्त केलेल्या वसुली दाखल्यांची अंमलबजावणी करण्याकरिता असतील.

(३) वसुली अधिकारी यांनी महाराष्ट्र सहकारी संस्था अधिनियम, १९६० चे कलम १५६ व नियम १९६१ चे नियम १०७ मधील तरतुदीनूसार कर्ज वसुलीची कार्यवाही करावी. कर्ज वसुली करताना सहकार कायदा, नियम यातील तरतुदी व परिपत्रकीय सूचनांचे पालन न केल्याचे निदर्शनास आल्यास आवश्यक ती चौकशी करून आवश्यकता भासल्यास सदरचे प्रदान केलेले अधिकार तत्काळ काढून घेण्यात येतील.

(४) वसुली अधिकारी यांनी मालमत्तेच्या वाजवी किमतीस (अपसेट प्राईज) निबंधकाची पूर्व मान्यता घेणे आणि मालमत्तेची विक्री कायम करणे या कामी या कार्यालयाचे परिपत्रक जा.क्र. ना.बँका/डी-४/अपसेट प्राईज व विक्री कायम/२०१५/८७०, दिनांक १७ एप्रिल २०१५ अनुसार संबंधित जिल्हा उप निबंधक, सहकारी संस्था सातारा यांची मान्यता घ्यावी संबंधित जिल्हा उप निबंधक, सहकारी संस्था यांनी उक्त बँकेच्या वाजवी किमतीस (अपसेट प्राईस) पूर्व मान्यता देणे आणि मालमत्तेची विक्री कायम करणे संबंधी प्रस्तावाबाबत महाराष्ट्र सहकारी संस्था नियम, १९६१ चे नियम १०७ मधील तरतुदीनुसार उचित कार्यवाही करावी.

(५) वसुली अधिकारी यांनी दरमहा या कार्यालयाचे परिपत्रक दिनांक ३१ ऑक्टोबर २०१८ अन्वये विहित केलेल्या नमुन्यात कर्ज वसुलीची माहिती जिल्हा उप निबंधक, सहकारी संस्था सातारा यांचे कार्यालयास सादर करावी.

(६) अधिकार प्रदान केलेल्या वसूली अधिकारी असलेल्या व्यक्तीची बदली झाल्यास किंवा सेवानिवृत्ती झाल्यास सेवेतून काढून टाकल्यास किंवा त्याचा मृत्यू झाल्यास, अशा अधिकायास प्रदान केलेले अधिकार आपोआप रद्द होतील.

(७) मा. उच्च न्यायालय, मुंबई यांनी रिट याचिका क्रमांक १९४२/२०१३, दि बेसिन कॅथोलिक को-ऑप. बँक विरूद्ध महाराष्ट्र राज्य व इतर या याचिकेमध्ये दिनांक ५ डिसेंबर २०१५ रोजी दिलेला आदेश विचारात घेऊन वसुलीची कार्यवाही करताना महाराष्ट्र सहकारी संस्था अधिनियम, १९६० व नियम, १९६१ अन्वये प्राप्त असलेल्या अधिकारानुसारच वसुलीची कार्यवाही करावी.

(८) वसुली अधिकारी यांनी नमूद केलेल्या कालावधीत वसुलीचे कामकाज समाधानकारक केले नसल्याचे निदर्शनास आल्यास किंवा प्रदान केलेल्या अधिकाराचा गैरवापर करीत असल्याचे निदर्शनास आल्यास, प्रदान केलेले अधिकार काढून घेतले जातील व भविष्यात असे कोणतेही अधिकार अशा व्यक्तीस प्रदान करण्यात येणार नाहीत.

(९) शासन निर्णय क्रमांक संकिर्ण १५०४/प्र.क्र.२३१/१५स, दिनांक २३ नोव्हेंबर २००६ अन्वये वसूली अधिकायास तीन सिंहाच्या राजमुद्रेचा वापर करता येणार नाही.

(१०) वसुली अधिकायास त्याच्या नावापुढे कोठेही ""महाराष्ट्र शासन नियुक्त"" आणि किंवा "" सिव्हील कोर्ट"", ""एक्झीक्युटीव्ह कोर्ट"" या शब्दांचा अथवा तत्सम शब्दांचा वापर करता येणार नाही. त्याऐवजी वसुली अधिकायंानी त्यांच्या नावापुढे ""वसुली अधिकारी (महाराष्ट्र सहकारी संस्था अधिनियम, १९६० व नियम, १९६१ चे नियम १०७ अन्वये )"" असे लिहावे.

(११) वसुली अधिकायास वसुलीसाठी वापर करण्यात येणाया वाहनावर ""वसुली अधिकारी, डॉ. विजयराव बोरावके मल्टीस्टेट को-ऑप.क्रेडीट सोसायटी ता. फलटण, जि. सातारा"" असा फलक लावता येऊ शकेल.
