In pursuance of clause (3) of Article 348 of the Constitution of India, the following translation in English of the Maharashtra Municipal Corporations (Amendment) Bill, 2019 (L.A. Bill No. XLVIII of 2019), introduced in the Maharashtra Legislative Assembly on the 19th December 2019, is hereby published under the authority of the Governor.

A BILL
further to amend the Maharashtra Municipal Corporations Act.
LIX of 1949.
WHEREAS it is expedient further to amend the Maharashtra Municipal Corporations Act, for the purposes hereinafter appearing; it is hereby enacted in the Seventieth Year of the Republic of India as follows :—
Short title.
1. This Act may be called the Maharashtra Municipal Corporations (Amendment) Act, 2019.

2. In section 5 of the Maharashtra Municipal Corporations Act, in sub- section (3), in the first proviso, after the words, brackets and figures "the Maharashtra Municipal Corporations and the Maharashtra Municipal Councils, Nagar Panchayats and Industrial Townships (Amendment) Act, 2016" the words, brackets and figures "but till the day immediately preceding the date of the publication of the Maharashtra Municipal Corporations (Amendment) Act, 2019 in the Official Gazette" shall be inserted.
द्धन्रु]क्ष् रू न् +रून् +, ह्यरूदन् १९, २०१९/+ २८, ॅ १९४१ ३STATEMENT OF OBJECTS AND REASONS.
Sub-section (3) of section 5 of the Maharashtra Municipal Corporations Act (LIX of 1949), prior to enactment of the Maharashtra Act No. IX of 2017, provided that each of the ward of the Muncipal Corporations shall elect only one Councillor. By the said Act of 2017, sub-section (3) of section 5 of the Maharashtra Municipal Corporations Act was amended, so as to provide that, each of the wards shall elect as far as possible four Councillors but not less than three and not more than five Councillors, and each voter shall be entitled to cast the same number of votes, as the number of Councillors to be elected in his ward.
2. After taking the review of the present position and for smooth functioning and specific representation in wards as well as ensuring more accountability in rapid development of the Corporations, the State Government considers it expedient to provide that, each of the wards of the Municipal Corporation shall elect, only one Councillor, by amending first proviso to sub-section (3) of section 5 of the said Act, suitably.
3. The Bill seeks to achieve the above objectives.
