आणि ज्याअर्थी, उप विभागीय अधिकारी, जुन्नर उप विभाग, खेड (पुणे) यांनी उक्त अधिनियमातील कलम ३२ च्या पोट-कलम १ नुसार, भाग एक पुरवणी, पृष्ठ क्र. २९४४-२९६० वर दिनांक २१ ऑगस्ट २००८ च्या महाराष्ट्र शासनाच्या राजपत्रात नोटीस क्रमांक सजल/भुसं./एसआर- २५/१९९६, दिनांक ८ ऑगस्ट २००८ रोजी प्रसिद्ध करून, उक्त औद्योगिक क्षेत्रासाठी भूसंपादन केलेले आहे आणि उक्त कलम ३२ च्या पोट-कलम ४ नुसार उक्त नोटीसेत नमूद केलेले क्षेत्र सर्व भार मुक्त होऊन राज्य शासनाच्या ठायी निहीत झाले आहे ;

आणि ज्याअर्थी, या सोबत जोडलेल्या अनुसुचितील जमिनीचा (यापुढे जिचा उल्लेख " उक्त जमीन " असा करण्यात येईल) ताबा राज्य शासन किंवा त्यांच्यावतीने घेण्यात आलेला नाही आणि उक्त जमीन उक्त कायद्याच्या प्रयोजनासाठी आवश्यक नाही असे राज्य शासनाचे मत झाले आहे.

त्याअर्थी, आता, उक्त अधिनियमाच्या कलम ३२ च्या पोट-कलम (४) मधील परंतुक व इतर अधिकारांचा वापर करून राज्य शासन उक्त जमीन संपादनातून काढून घेत आहे आणि असे घोषित करीत आहे की, ही सूचना महाराष्ट्र शासन राजपत्रात प्रसिद्ध झाल्यानंतर कलम ३२ च्या पोट-कलम (१) नुसार नोटीस प्रसिद्ध होण्याच्या लगतपूर्वी उक्त जमीन जिच्याकडे निहीत होती त्या व्यक्तीकडे ती त्यावेळी अस्तित्वात असतील असे भारांना अधीन राहून पूर्वलक्षी प्रभावासह पुर्ननिहित होईल.

MAHARASHTRA INDUSTRIAL DEVELOPMENT ACT, 1961.

No. IDC. 2017/(C.R. 270)/IND. 14.—Whereas, by the Government Notification, Industries, Energy and Labour Department, No. IDC. 2196/2774/IND-14, dated the 1st August 1996 issued under Sub-section (3) of section 1 of the Maharashtra Industrial Development Act, 1961 (Mah.III of 1962) (hereinafter referred to as "the said Act"), the Government of Maharashtra has appointed the 2nd August 1996 to be the date from which the provisions of Chapter VI of the said Act shall take effect in certain areas in village Shinde and Warale in Taluka Khed, District Pune men- tioned in the Schedule appended to the said notification and declared the said area as an indus- trial area under clause (g) of section 2 of the said Act ;

And wheress, the Sub Divisional Officer, Junner Sub Division, Khed (Pune) has, by issuing notice No. सजल/भूसं./एसआर-२५/१९९६, dated 8th August 2008, published in the Maharashtra Govern- ment Gazette, Part I Supplementary, dated 21st August 2008, on pages 2944-2960, under sub-section (1) of section 32 of the said Act, acquired the lands in the said industrial area, and as such, the lands mentioned in the said notice have been vested absolutely in the State Government free from all encumbrances under Sub-section (4) of said section 32 ;

And whereas, the actual possession of the land mentioned in the Schedule appended hereto (thereinafter referred to as " the said land") is not taken by or on behalf of the State Government and it appears to the State Government that the said land is no more required for the purpose of the said Act.

Now, therefore, in exercise of the powers conferred by the provioso to Sub-section (4) of section 32 of the said Act and of all others powers enabling it in that behalf, the Government of Maharashtra hereby withdraws the said land from acquistion and declares that, on the publica- tion of this Notice in the Maharashtra Government Gazette, the said land shall re-vest with retro- spective effect in the person in whom it was vesting immediately before the publication of the notice under sub-section (1) of the said section 32, subject to such encumbrances, if any, as may be Sub sisting at that time.

MAHARASHTRA SLUM AREAS (IMPROVEMENT, CLEARANCE AND REDEVELOPMENT) ACT, 1971.

No. Zopasu 1203/ C.R. 186/2016/zopasu-1(3).—In exercise of the powers conferred by sub- section (1) of section 3, sub-section (1) of section 3Y and sub-section (1) of section 35 of Maharashtra Slum Areas (Improvement, Clearance and Redevelopment) Act, 1971 (Mah. XXVIII of 1971) and in supersession of Government Notification, Housing Department, No. Zopasu-1203/C.R. 68/2016/ Zopasu-1, dated the 27th June 2016 and all orders issued in this behalf, the Government of Maharashtra, for the area of Municipal Corporation of Thane, hereby,—

(a) appoints the officers mentioned in column (2) of the Schedule appended hereto, to be the Competent Authority for the purposes of the said Act, for the areas specified respectively against each of them in column (3) thereof ;

(b) appoints the officers mentioned in column (4) of the Schedule appended hereto, to be the Appellate Authority for the purpose of sub-section (1) of section 35 of the said Act, to whom any person aggrieved by any notice, order or direction issued or given by the Competent Authority mentioned respectively against each of them in column (2) thereof, may appeal to; and (c) authorised appoints the officers mentioned in column (2) of the Schedule appended hereto, to be Authorized Officer for the purpose of section 3Y of the said Act, for the areas specified respectively against each of them in column (3) thereof.

No. BEST-2515/C.R. 679/UD-21.—Whereas, the Brihan Mumbai Electric Supply and Transport Undertaking of the Municipal Corporation of Brihan Mumbai, (hereinafter refer to as to said Undertaking) is engaged in the supply of electric supply and transport services in Brihan Mumbai ;

Whereas, the employees of the said Undertaking engaged in the electric supply and transport services provided by the said Undertaking in the Brihan Mumbai are likely to go on Strike ;

And whereas, the supply of electricity and transport service are essential services within the meaning of sub-clause (i) and (ii) of clause (a) of section 2 of the Maharashtra Essential Services Maintenance Act, 2011 (Mah. XII of 2012) ;

And whereas, the Government of Maharashtra is satisfied that it is necessary, in the public interest, to prohibit the strike necessary in the said essential services provided by the said Undertaking.

Now, therefore, in exercise of the powers conferred by sub-section (1) of section 4 read with sub-clauses (i), and (ii) of clause (a) of section 2 of the Maharashtra Essential Services Maintenance Act, 2011 (Mah. XII of 2012), the Government of Maharashtra hereby prohibit strikes from 29th August 2016 by the worker employees of the said Undertaking in the electric supply and transport services provided by it.

No. CDA. 2016 /(374/2016)/CAD(Works).—To exercise the powers and discharging the duties allocated in Maharashtra Management of Irrigation System by Farmers Act, 2005, the powers are given to Government of Maharashtra to appoint appropriate Canal Officers. As per MMISF Act section 2 (f).

Henceforth as per Maharashtra Irrigation Act, 1976 section 2(4), The Government of Maharashtra appoints following Canal Officers as per following table to exercise the powers and discharging the duties under the MMISF Act, 2005.

क्रमांक सीडीए -२०१६/(३७४/ २०१६)/ लाक्षेवि (कामे).-----महाराष्ट्र सिंचन पद्धतीचे शेतक-यांकडून व्यवस्थापन अधिनियम, २००५ मधील कलम १ चे उप कलम (३) अन्वये प्रदान करण्यात आलेल्या अधिकारांचा वापर करुन महाराष्ट्र राज्याचे राज्यपाल खालील तक्त्यात स्तंभ क्र. (२), (३), (४), (५) व (६) मध्ये विनिर्दीष्ट केल्याप्रमाणे उपरोक्त अधिनियम लागू करण्यासाठी पाटबंधारे प्रकल्पाचे नाव, क्षेत्र, अधिनियमातील कलमे, लागू करण्याच्या तारखा व इतर तपशील अधिसूचीत करत आहेत. प्रस्तुत अधिनियमातील कलम क्र. ७ मधील तरतुदीनुसार अधिसूचीत क्षेत्रात समुचित प्राधिकरण वैयक्ितक जमीनधारक अथवा भोगवटादारास पाणीपुरवठा करणार नाही आणि पाणी वापर संस्थेतर्फेच पाणीपुरवठा करण्याची पद्धत सिंचन पद्धतीचे शेतक-यांकडून व्यवस्थापन या योजनेखालील कार्यक्षेत्रातील सर्व जमीनधारक व भोगवटादारास बंधनकारक राहील. अ. क्र. प्रकल्पाचे नाव कायदा लागू होणारे क्षेत्र (हे) लागू करण्याची कलमे ज्या तारखेपासुन लागू शेरा

No. CDA-2016/(374/16)/CAD (Works).—In exercise of the powers conferred by Section 1(3) of Maharashtra Management of Irrigation System by Farmers (MMISF) Act, 2005 (Mah. 23 of 2005) the Governor of Maharashtra, hereby, Notifies Areas, Irrigation Projects, Sections of the Act and Date of Applications as specified in columns (2), (3), (4), (5) & (6) of the table below for bringing in force the Act. In said notified area, as provided under section 7, no water shall be supplied by the Appropriate Authority to an individual holder or occupier of such land and the system of supply of water through Water Users Association shall be binding on all the holders and occupiers of the land under Management of Irrigation System by Farmers.

क्रमांक सीडीए/२०१६ (३७४ / १६)/लाक्षेवि(कामे).----महाराष्ट्र सिंचन पद्धतीचे शेतक-यांकडून व्यवस्थापन अधिनियम, २००५ मधील अधिकारांचा वापर करण्यासाठी आणि कर्तव्ये पार पाडण्यासाठी कालवा अधिकारी यांची नियुक्ती करण्यासाठी या कायद्यातील कलम २(च) नुसार राज्य शासनास अधिकार दिले आहेत.
