क्रमांक झेडपीए.२०१९/प्र.क्र.५७/पंरा-१.-----ज्याअर्थी, दिनांक १८ जुलै, २०१९ रोजीच्या शासन आदेशान्वये महाराष्ट्र जिल्हा परिषद व पंचायत समिती अधिनियम, १९६१ मधील कलम ९१ (ब) व ७५ (ब) या कलमांना अनुसरून जिल्हा परिषद, नागपूर, धुळे, नंदुरबार, अकोला व वाशिम या ५ जिल्ह्यंतील जिल्हा परिषदांचे मुख्य कार्यकारी अधिकारी यांना जिल्हा परिषदेचे सर्व अधिकार व कर्तव्ये पार पाडण्यासाठी प्राधिकृत करण्यात आले आहे आणि या ५ जिल्हा परिषदा अंतर्गत पंचायत समित्यांचे अधिकार व कर्तव्ये पार पाडण्यासाठी संबंधित पंचायत समितींच्या गट विकास अधिकारी यांना प्राधिकृत केले असल्याने ;
आणि ज्याअर्थी, महाराष्ट्र जिल्हा परिषद अधिनियम, १९६१ (सुधारित) अध्यादेश दिनांक २३ ऑगस्ट, २०१९ च्या कलम ९१ (ब) व ७५ (ब) मध्ये सुधारणा करून प्राधिकृत करण्यात आलेल्या अधिकायांचा कालावधी ४ महिन्यांकरिता व अपवादात्मक परिस्थितीत ६ महिन्यांपेक्षा अधिक नसल्याने ;
आणि ज्याअर्थी, राज्य निवडणूक आयोगाने या ५ जिल्हा परिषदा व त्याअंतर्गत पंचायत समित्यांचा निवडणूक कार्यक्रम माहे जानेवारी, २०२० मध्ये घेण्याचे जाहीर केले असल्याने ;
आणि ज्याअर्थी, दि. २३ ऑगस्ट, २०१९ च्या आदेशान्वये सुधारणा केल्यानुसार या जिल्ह्यतील जिल्हा परिषदा व त्याअंतर्गत पंचायत समित्यांची निवडणूक विहित मुदतीत पार पाडणे शक्य नसल्याने ;
आणि ज्याअर्थी, वरील नमूद केल्याप्रमाणे अपवादात्मक परिस्थिती निर्माण झाल्याने शासनाने प्राधिकृत केलेल्या मुख्य कार्यकारी अधिकारी व गट विकास अधिकारी यांचा कालावधी पुढील दोन महिन्यांसाठी वाढविणे अपरिहार्य ठरले असल्याने ;

भाग चार--ब--४३६--१२ महाराष्ट्र शासन राजपत्र असाधारण भाग चार-ब, डिसेंबर ३१, २०१९/पौष १०, शके १९४१ आता, त्याअर्थी, महाराष्ट्र जिल्हा परिषद अधिनियम, १९६१ (सुधारित) अध्यादेश दिनांक २३ ऑगस्ट, २०१९ च्या कलम ९१ (ब) व ७५ (ब) मध्ये सुधारणा करून प्राधिकृत करण्यात आलेल्या अधिकायांचा, जिल्हा परिषदेचे अधिकार व कर्तव्ये पार पाडण्यासाठी प्राधिकृत करण्यात आलेले जिल्हा परिषदांचे मुख्य कार्यकारी अधिकारी तसेच पंचायत समित्यांचे अधिकार व कर्तव्ये पार पाडण्यासाठी प्राधिकृत करण्यात आलेले संबंधित पंचायत समित्यांचे गट विकास अधिकारी यांची मुदत दिनांक १७ जानेवारी, २०२० पयर्ंत अथवा सदर जिल्ह्यतील जिल्हा परिषदांचे अध्यक्ष, उपाध्यक्ष आणि विषय समित्यांचे सभापती तसेच पंचायत समित्यांचे सभापती, उप सभापती व सरपंच समितीचे सभापती यांची पदे निवडणुकीद्वारे भरली जातील यापैकी जे अगोदर घडेल तोपयर्ंत कालावधी वाढविण्यात येत आहे.

Order
MAHARASHTRA ZILLA PARISHADS AND PANCHYAT SAMITIS ACT, 1961.
Whereas, the Government of Maharashtra has vide Government Order, Rural Development Department, No. ZPA- 2019 / CR. 57 /PR-1, dated the 18th July 2019, issued in pursuance of sections 91 B and 75 B of the Maharashtra Zilla Parishads and Panchayat Samitis Act, 1961 (Mah. V of 1962), authorized the Chief Executive Officers of the Nagpur Zilla Parishad, Akola Zilla Parishad, Washim Zilla Parishad, Dhule Zilla Parishad and Nadurbar Zilla Parishad to exercise all the powers and perform all the duties of the said Zilla Parishads and also authorized the concerned Block Development Officers of the Panchayat Samitis within the said Zilla Parishads, to exercise all the powers and perform all the duties of the respective Panchayat Samitis;
And whereas vide the Maharashtra Zilla Parishads and Panchayat Samitis (Amendment) Ordinance, 2019 (Mah. Ord. XXI of 2019) the said sections 91 B and 75 B of the said Act have been amended, with effect from 23rd August 2019, which inter alia provides that the period of authorization under the said sections shall not exceed four months and in exceptional circumstances to be recorded in the order, the said period may be extended from time to time for such further period as may be specified in the order, but such period of authorization shall not exceed six months in the aggregate;
And Whereas, as per the election program announced by the State Election Commission the elections to the said Zilla Parishads and Panchayat Samitis within the said Zilla Parishads are to be held in the month of January 2020;
And whereas, the elections to the said Zilla Parishads and the Panchayat Samitis within the said Zilla Parishads could not be conducted in time specified in the sections as amended by the said Ordinance;
And Whereas, in view of the above stated exceptional circumstances, the Government considers it expedient to extend the said period of authorization of the Chief Executive Officers and Block Development Officers granted under the said sections by further two months;
Now, therefore, in exercise of the powers conferred by the second provisos to sections 91 B and 75 B of the Maharashtra Zilla Parishads and Panchayat Samitis Act,1961 (Mah. V of 1962), as amended by the said Ordinance, and of all other powers enabling it in that behalf, the Government of Maharashtra hereby extends the said period of authorization, of Chief Executive Officers of the said Zilla Parishads to exercise all the powers and perform all the duties of the said Zilla Parishads and of Block Development Officers of Panchayat Samitis within the said Zilla Parishads to exercise all the powers and perform all the duties of the respective Panchayat Samitis within the said Zilla Parishads, till the 17th January 2020 or till election of President, Vice-president and Chairman of Subject Committees of the said Zilla Parishads, Chairman, Deputy Chairman and Chairman of the Committee of Sarpanchas of the respective Panchayat Samitis within the said Zilla Parishads, whichever is earlier.
