DIRECTOR OF TOWN PLANNING
MAHARASHTRA REGIONAL & TOWN PLANNING ACT, 1966.—
No. D.T.P-D.P.Morshi (A.A.)-Sec-127(2)-Notification-TPV-VI-6292.—
Whereas, the Government of Maharashtra Urban Development Department vide its Notification No. TPS- 2803-1698-C.R. 377(B)-2003-UD-30, Dated 11th July, 2005 has sanctioned the Development Plan of Additional Area of "C" class Municipal Council, Morshi partly (hereinafter referred to as the "said Development Plan") under Section 31(1) of the Maharashtra Regional & Town Planning Act, 1966 (Mah. XXXVII of 1966) (hereinafter referred to as "the said Act") and the same has come into force with effect from date 1st September, 2005;
And whereas, in the said Development Plan, the land admeasuring 0.34 Ha. & 2.61 Ha., from S. No. 7/2 of Mouza Durgwada, Taluka Morshi is reserved for "Site No. 22-Shopping Centre" & "Site No. 23 - Garden" respectively (hereinafter referred to as "the said Reservation"); for which Appropriate Authority is Municipal Council, Morshi (hereinafter referred to as "the said Appropriate Authority");
४ द्धन्रु]क्ष् रू न् ॅ-+ +द्धन्म््र ह्यम््र ान्म््र, म्न््र ९-१५, २०२० / रु १९--२५, ॅ १९४१And whereas, the land under said reservations has not been acquired by the said Appropriate Authority within ten years from the date on which the said Development Plan came into force;
And whereas, the owners of 2.98 Ha. land from S. No. 7/2 of Mouza Durgwada, Taluka Morshi had served a Notice under Section 127(1) of the said Act on the Chief Officer, Municipal Council, Morshi vide their letter dated 31st August, 2015 (hereinafter referred to as "the said Notice");
And whereas, the said Appropriate Authority, has not acquired the land under the said Reservations under Section 127(1) of the said Act, within a period of twenty four months from the date of receipt of the said notice;
And whereas, the Hon'ble Supreme Court in Civil Appeal No. 6661 of 2019 filed by the owners of the said land has passed the order dated 27th August 2019, that the said reservations to the extent of the said land have been lapsed under Section 127 of the Said Act;
And whereas, in accordance with the provision of Section 127(1) of the said Act, the part of the said Reservations, pertaining to the said land has lapsed and it is accordingly expedient to notify such lapsing under Section 127 (2) of the said Act;
And whereas, the Government in Urban Development Department under Section 151 of the said Act, vide Resolution No. TPS-1813-3211-CR-508-UD-13, dated 1st December 2016, has delegated the powers exercisable by its under Section 127(2) of the said Act, in respect of Development Plans of all Municipal Councils/Nagar Panchayat and for the Development Plans undertaken by Zilla Parishad as a Planning Authority, to the Director of Town Planning, Maharashtra State, Pune;
Now, therefore, in exercise of the powers delegated by the Government, in respect of Sub-section (2) of Section 127 of the said Act and of all other powers enabling it in that behalf, the Director of Town Planning, Maharashtra State, Pune, hereby notifies that the said Reservations of "Site No. 22-Shopping Centre" & "Site No. 23 - Garden" in said Development Plan of Morshi is lapsed partly only in respect of said land (as specified in the schedule herein below) and the said land shall become available to the land owners for the purpose of Development as otherwise, permissible in the case of adjacent land, under the said Development Plan;
