Under Section 72 (2) of the Maharashtra Regional and Town Planning Act, 1966 and Rule No. 13 (9) of
the Maharashtra Town Planning Scheme, Rule, 1974.

Whereas, the Pardi, Bharatwada, Punapur and Bhandewadi Draft Town Planning Scheme No. 1, Nagpur (hereinafter referred to as "the said draft Scheme") as submitted by the Nagpur Improvement Trust vide its letter dated 06th July 2018 has been sanctioned by the State Government,vide Notification No. TPS-2418-Nag, Cam-9-CR-281- 2018-UD-9, dated 06th October, 2018 under sub-section (2) of Section 68 of the Maharashtra Regional and Town Planning Act, 1966 (hereinafter referred to as "the said Act" and published in the Maharashtra Government Gazette Extra ordinary, Part I-A, Nagpur Division Supplement dated 24th October, 2018 at Pages No. 1 to 54 ;
द्धन्रु]क्ष् रू न् +रून् ॅ-+ न् ह्यम््र ान्म््र, म्न््र १६, २०२० / रु २६, ॅ १९४१ ३And whereas, the Government of Maharashtra in Urban Development Department has appointed Assistant Director of Town Planning, Nagpur Branch, Nagpur as the Arbitrator for the said sanctioned Draft Scheme vide Notification No. TPS-2418-Nag. Camp.9-C.R.-281-2018-UD-9, dated 15th November, 2018 under sub-section (1) of Section 72 of the said Act. This Notification has been appeared in the Maharashtra Government Gazette, Extra ordinary, Nagpur Division Supplement, Part-I-A, dated 16th November, 2018 on Page Nos. 6-7 ;
And whereas, the Arbitrator, in accordance with Rule No. 13(1) of Maharashtra Town Planning Scheme Rule, 1974 (hereinafter referred to as "the said Rules") declared by Notice Bearing No. ARB-TPS-1-NAG-Rule-13-ADM-2550-2018, dated 22nd November, 2018 appeared in Maharashtra Government Gazette, Extra-ordinary, Part-1-A, Nagpur Division Supplement dated 28th December, 2018 at Pages No. 1 to 2 and appeared in Newspaper (1) Daily Lokmat dated 29th December, 2018 (2) Daily Hitavada dated 29th December, 2018 that, he has commenced the duties as Arbitrator in respect of Town Planning Scheme Pardi, Bharatwada, Punapur and Bhandewadi, TPS No. 1, Nagpur from dated 22nd November 2018;
And whereas, the special notices in prescribed Form No. 4 have been served to every owner of the lands included in the said scheme and the hearing in this regards have been completed;
And whereas, the Town Planning Scheme Pardi, Bharatwada, Punapur and Bhandewadi, TPS No. 1, Nagpur has been sub-divided by the Arbitrator into Prelimiarny Scheme and Final Scheme on 18th February, 2019 as provided under sub section (3) of Section 72 of the said Act;
And whereas, the Arbitrator has followed the procedure, prescribed in Rule No. 13 of the said Rules and has carried out the duties laid down in sub-section (4) of Section 72 of the said Act;
Now, therefore, the under signed as Arbitrator hereby declares that the Preliminary Town Planning Scheme Pardi, Bharatwada, Punapur and Bhandewadi, TPS No. 1, Nagpur has been drawn up on dated 15th January 2020 as provided under sub-section (7) of Section 72 of the said Act read with Rule 13 (9) of the said Rule.
The Preliminary Scheme so drawn up by the undersigned has been published and copies thereof have been kept open for the inspection to the land owners and public during office hours at the office of Arbitrator and Assistant Director of Town Planning, Administrative Building No. 1, 2nd Floor, Civil Lines, Nagpur and Special Purpose Vehicle appointed for Nagpur Municipal Corporation, Office of the Chief Executive Officer, Nagpur Smart & Sustainable City Development Corporation Limited, 7th Floor, Shree Chhatrapati Shivaji Maharaj Administrative Building, Nagpur Municipal Corporation, Civil Lines, Nagpur- 440001.
