अधिसूचना
महाराष्ट्र मोटार वाहन कर अधिनियम.
क्रमांक खाक्षेस-२००८/प्र.क्र. ५७/रस्ते-९.----ज्याअर्थी महाराष्ट्राचे राज्यपाल यांच्या प्रदान केलेल्या शींचा वापर करुन सार्वजनिक बांधकाम विभाग, मंत्रालय, मुंबई आणि मे. अशोका बिल्डकॉन लिमिटेड, नाशिक ज्यांचे नोंदणीकृत कार्यालय "अशोका हाऊस, अशोका मार्ग, अशोका नगर, वडाळा, नाशिक ४२२०११" येथे आहे, यांचेमध्ये खाजगीकरणांतर्गत बांधा, वापरा व हस्तांतरित करा (बी.ओ.टी.) या तत्वावर अहमदनगर ते घोडेगाव (किलोमीटर १२०/२०० ते १५५/६००) चे चौपदरीकरण आणि घोडेगाव ते वडाळा (किलोमीटर १५५/६०० ते १६२/०००) चे तीन पदरीकरण तसेच सदर रस्त्याचे परिरक्षण, देखभाल व दुरुस्ती करणे (यापुढे "सदर रस्ता" म्हणून संबोधण्यात येईल.) या कामाकरिता सदर प्रकल्पाचा करारनामा १८ डिसेंबर २००६ रोजी साक्षांकित करण्यात आलेला आहे व यानंतर यांचेमध्ये सर्व करारनामे झालेले आहेत ;

भाग चार--ब----१२ महाराष्ट्र शासन राजपत्र भाग चार-ब गुरुवार ते बुधवार, जानेवारी ३०-फेब्रुवारी ५, २०२०/माघ १०-१६, शके १९४१ आणि ज्याअर्थी, सदर करारनाम्यानुसार सदर रस्त्याचे बांधकाम, वापर व देखभाल दुरुस्ती करता १० वर्षे ९ महिने इतका सवलत कालावधी २ वषार्ंच्या बांधकाम कालावधीसह उद्योजकास दिनांक १८ डिसेंबर २००६ या प्रकल्प सुरु होण्याच्या दिनांकापासून मंजूर करण्यात आलेला आहे व तद्नंतर शासन मान्यतेने सवलत कालावधी १२ वर्षे १ दिवस इतका सुधारित करण्यात आला आहे;
आणि ज्याअर्थी, महाराष्ट्र शासनाची अशी धारणा आहे की, सदर रस्त्याचे बांधकाम, वापर आणि देखभाल दुरुस्ती ही जनतेला दिलेली विशेष सेवा आहे, आणि त्यामुळे सदर रस्त्यावर कि.मी. १३२/००० (शेंडी गावाजवळ) येथे पथकर स्थानक उभारुन पथकर आकारणे व वसुली करणे महाराष्ट्र शासनास योग्य वाटत आहे;
आणि ज्याअर्थी, महाराष्ट्र शासनाने शासन अधिसूचना, सार्वजनिक बांधकाम विभाग, क्रमांक खाक्षेस-२००८/प्र.क्र.५७/रस्ते-९, दिनांक ३ मे, २००८ अन्वये दिनांक ४ मे, २००८ पासून दिनांक ७ सप्टेंबर, २०१६ पयर्ंत अहमदनगर जिल्ह्यतील अहमदनगर-औरंगाबाद (भाग-अहमदनगर- वडाळा) राज्य महामार्ग क्र.६० चे किलोमीटर १२०/२०० ते १५५/६०० या लांबीचे चौपदरीकरण व किलोमीटर १५५/६०० ते १६२/००० या लांबीचे तीन पदरीकरण केलेल्या रस्त्यावरुन जाणाया वाहनांवर पथकर शुल्क आकारण्यात आले होते ;
आणि ज्याअर्थी महाराष्ट्र शासनास सदर कालावधी दिनांक ७ सप्टेंबर, २०१७ पयर्ंत वाढविणे योग्य असल्याचे वाटत आहे.
त्याअर्थी महाराष्ट्र मोटार वाहन कर अधिनियम, (१९५८ चा ६५) यांच्या कलम-२० ची पोट-कलमे (१-अ), (१-ब), (१-क), (१-ड) आणि (१-इ) द्वारे प्रदान करण्यात आलेल्या आणि त्याला समर्थनीय करणाया अधिकारांचा वापर करून महाराष्ट्र शासन याद्वारे घोषित करते की, खाजगीकरणाच्या माध्यमातून बांधा, वापरा व हस्तांतरित करा (बी.ओ.टी.) या तवावर मे. अशोका बिल्डकॉन लिमिटेड, नाशिक यांनी स्वखर्चाने बांधलेल्या विषयांकीत रस्त्याचा वापर करणाया व खालील अनुसूचीच्या स्तंभ (२) मध्ये अनुक्रमे विर्िनदिष्ट केलेल्या प्रकाराच्या मोटार वाहनांवर आणि वाहनांकडून ओढून नेल्या जाणाया, अनुयानांवर अनुसूचीच्या स्तंभ (३) मध्ये त्यांच्या समोर विर्िनदिष्ट केलेल्या दराने दिनांक ८ सप्टेंबर, २०१६ पासून दिनांक ७ सप्टेंबर, २०१७ पयर्ंतच्या कालावधीसाठी अहमदनगर-औरंगाबाद या राज्यमार्गावरील कि.मी.१३२/००० (शेंडी गावाजवळ) येथे बांधण्यात आलेल्या पथकर स्थानकावर पथकर शुल्क वसुली करण्यास प्राधिकृत करण्यात येत आहे.

२ मोटार वाहन अधिनियम, १९८८ (१९८८ चा ५९) मध्ये नमूद केलेली हलकी मोटार वाहने:---
(अ) कार, जीप, (चालक वगळून १२ प्रवासी क्षमता असलेली वाहने) जसे की, टाटा सुमो,
कमांडर, ट्रॅक्स, सहा आसनी रिक्षा (टमटम) इत्यादी.
पथकर नाही.
(ब) मिनी बस किंवा इतर तत्सम वाहने (चालक वगळून १२ पेक्षा जास्त परंतु २० प्रवासी
क्षमतेपयर्ंतची वाहने) आणि अ.क्र. ३ व ४ मध्ये नमूद केलेल्या वाहना व्यतिरि माल वाहतूक करणारी वाहने.

१०५.०० ४. मोटार वाहन अधिनियम, १९८८ (१९८८ चा ५९) मध्ये व्याख्या केल्याप्रमाणे व उपरो अ.क्र.३
मध्ये नमूद केलेले ट्रक वगळून माल वाहतूक व प्रवासी वाहतूक करणारी अवजड वाहने जसे. ट्रक-ट्रेलर, दोन पेक्षा अधिक आसांची वाहने इत्यादी.
१८०.०० (१) या प्रयोजनाकरिता अहमदनगर- औरंगाबाद (भाग-अहमदनगर-वडाळा) राज्य महामार्ग क्रमांक ६० रस्त्यावरील वर नमूद केलेल्या पथकर नाक्यावर वर नमूद केलेल्या कालावधीकरिता पथकर गोळा करण्याचा व पथकराची संपूर्ण रक्कम ठेवून घेण्याचा हक्क मे. अशोका बिल्डकॉन लिमिटेड, नाशिक यांना प्रदान करण्यात आला आहे.
महाराष्ट्र शासन राजपत्र भाग चार-ब गुरुवार ते बुधवार, जानेवारी ३०-फेब्रुवारी ५, २०२०/माघ १०-१६, शके १९४१ ३(२) खालील वाहनांना पथकरातून सूट देण्यात येईल:---
(१) भारताचे राष्ट्रपती, उप राष्ट्रपती, राज्यांचे राज्यपाल व वाहनांना लाल दिवा अनुज्ञेय असलेल्या अति महवाच्या लोकप्रतिनीधींची वाहने.
(२) लोकसभा व राज्यसभेचे विद्यमान व माजी सदस्य तसेच महाराष्ट्र विधानसभा व महाराष्ट्र विधानपरिषदेचे विद्यमान व माजी सदस्य प्रवास करीत असलेली वाहने.
(३) महाराष्ट्र राज्य रस्ते वाहतूक महामंडळाच्या (एसटी) प्रवासी बसेस.
(४) स्कूल बसेस.
(५) केंद्र व राज्य शासनाची वाहने.
(६) लष्कराच्या मालकीची वाहने.
(७) पोलीस विभागाची वाहने.
(८) टपाल आणि तार खात्याची वाहने.
(९) रुग्णवाहिका व शववाहिका.
(१०) अग्निशमन दलाची वाहने.
(११) बैलगाडी.
(३) पथकर दराचा फलक पथकर नाक्यावर सवार्ंना दिसेल अशा पद्धतीने लावण्यात यावा. तसेच वाहन धारकांस प्रत्येक वेळी पथकर वसुलीची संगणकीकृत पावती देण्यात यावी.
(४) इलेक्ट्रॉनिक माहिती फलक पथकर नाक्यावर सवार्ंना दिसेल अशा पद्धतीने लावण्यात यावा.
टीपा:-
पथकराच्या दरामध्ये खालीलप्रमाणे सूट देण्यात येईल :---
(अ) पथकराच्या ५० कुपन्सची पुस्तिका आगाऊ खरेदी करणायास पुस्तिकेच्या किमतीमध्ये १० टक्के सवलत देण्यात येईल.
(ब) पथकराच्या १०० कुपन्सची पुस्तिका आगाऊ खरेदी करणायास पुस्तिकेच्या किमतीमध्ये २० टक्के सवलत देण्यात येईल.
(क) वारंवार प्रवास करणाया वाहनांसाठी परतीच्या प्रवासाचे व दैनिक पासाचे दर हे त्या वाहनाच्या एकेरी प्रवास दराच्या अनुक्रमे दीड पट व अडीच पट राहतील. परतीच्या प्रवासाचा पास व दैनिक पास हा ज्या दिवशी पास काढला जाईल त्या दिवशीच्या रात्री १२-०० वाजेपयर्ंत ग्रा राहील.
(ड) मासिक पासाचे दर एकेरी प्रवास दराच्या ५० पट राहतील.

NOTIFICATION
MAHARASHTRA MOTOR VEHICLES TAX ACT.
No. PSP-2008/CR-57/Road-9.—Whereas the Governor of Maharashtra in his executive capacity for the Government of Maharashtra, represented by the Public Works Department, Government of Maharashtra and M/s Ashoka Buildcon Limited, Nashik having its registered office at Ashoka House, Ashoka marg, Ashoka nagar, Wadala, Nashik-422011 have entered into Concession Agreement, on the 18th December 2006 including all the subsequent agreements entered between them, for four lanning of Ahmednagar to Ghodegaon (Km.120/200 to 155/600) and three lanning of Ghodegaon to Wadala (Km.155/600 to 162/000) (hereinafter referred to as "the said road") under the "Built, Operate and Transfer (BOT) Scheme" by M/s Ashoka Buildcon Limited, Nashik ;
And whereas, as per the said agreement, the concession period of 10 years and 9 months including the construction period of two years has been granted to the concessionaire for improvement of the Ahmednagar-Aurangabad Road, part Ahmednagar to Wadala for construction, operation and maintenance from the date of commencement of the work i.e. the 18th December 2006 and the same is revised to 12 years 1 day for extra work done by the concessionaire ;
And whereas, the Government of Maharashtra is of the opinion that the improvement of the Ahmednagar-Aurangabad Road, part Ahmednagar to Wadala for construction, operation and maintenance thereof is the special service to the public and therefore for the work of improvement of four lanning of Ahmednagar to Ghodegaon (Km.120/200 to 155/600) and three lanning of Ghodegaon to Wadala (Km.155/600 to 162/000), considers it expedient to levy and collect the toll at the toll collection centres constructed at kilometers 132/000 (near Shendi village) ;
And whereas, the Government of Maharashtra has, vide Government Notification, Public Works Department, No. PSP.2008/CR-57/Road-9, dated the 3rd May 2008, levied toll on the vehicles passing through the section of the Ahmednagar-Aurangabad Road, (section-Ahmednagar-Wadala) State Highway Number 60, four laned from kilometer 120/200 to kilometer 155/600 and three laned from kilometer 155/600 to kilometer 162/000 in Ahmednager District, with effect from the 4th May 2008 to the 7th September 2016 ;
And whereas, the Government of Maharashtra considers it expedient to extend the said period upto the 7th September 2017 ;
Now, therefore, in exercise of the powers conferred by sub-sections (1-A), (1-B), (1-C), (1-D) and (1-E) of section 20 of the Maharashtra Motor Vehicles Tax Act (LXV of 1958), the Government of Maharashtra hereby declares that the toll shall be levied, on the classes of motor vehicles specified in column (2) of the Schedule appended hereto and on the trailors drawn by such motor vehicles, passing over the said road improved under the "Built, Operate and Transfer (BOT) Scheme" by M/s Ashoka Buildcon Limited, Nashik at their expenses, and collected at the toll collection centres constructed at kilometres 132/000 (near Shendi village) on the said road for the period commencing from the 8th September 2016 and ending on 7th September 2017.

capacity of more than twelve and upto twenty passengers,
excluding driver) and goods carriage vehicles except
vehicles included in entries at serial numbers 3 and 4. 55.00 3. Trucks, Buses.
105.00 4. Heavy goods vehicle and heavy passenger motor vehicles as
defined in the Motor Vehicles Act, 1988 (59 of 1988), such as
Truck-Trailers combination, Multi-axle Vehicles, etc., except
vehicles covered by the entry at serial number 3 above. 180.00 (1) For the purpose of this notification, M/s Ashoka Buildcon Limited, Nashik, is authorised to collect and retain the amount of toll at toll collection centre mentioned above.
(2) The following types of vehicles are exempted from payment of toll, namely:-
(i) VVIP vehicles carrying President of India, Vice-President of India, Governor of State, Public Representatives entitled for red lamp on their vehicles.
(ii) Vehicles carrying sitting Members and Ex-members of, Parliament, Maharashtra Legislative Assembly and Maharashtra Legislative Council.
(iii) Buses of the Maharashtra State Road Transport Corporation (ST).
(iv) School Buses.
(v) State and Central Government Vehicles.
(vi) Defence Vehicles.
(vii) Police Department Vehicles.
(viii) Post and Telegraph Department Vehicles.
(ix) Ambulances, Hearses.

(xi) Bullock cart.
(3) The above mentioned rates shall be displayed on boards clearly visible to the people in the vicinity of the Toll Station. A computerised toll receipt shall be passed on each and every occasion of recovery of toll.
(4) Electronic Display Board shall be installed in vicinity of toll collection centres.
Note.— Concessions in rates of toll are as given below, namely :—
(a) 10 per cent. rebate will be given to the purchase of booklet containing 50 coupons in advance.
(b) 20 per cent. rebate will be given to the purchase of a booklet containing 100 coupons in advance.
(c) For frequently travelling vehicles return and daily pass will be 1.5 times and 2.5 times of their respective one way travel rates. Return journey pass and Daily pass will be valid up to 12.00 hours at midnight for the day of issuing the pass.
(d) Rate of monthly pass will be 50 times of their respective one way travel rates.
