अधिसूचना
भारताचे संविधान.
क्रमांक आरटीआर. २०१०/प्र.क्र. ५९३/का. दोन.----भारताच्या संविधानाच्या अनुच्छेद ३०९ परंतुकान्वये प्रदान करण्यात आलेल्या शक्तींचा वापर करून महाराष्ट्राचे राज्यपाल, याद्वारे, विधि व न्याय विभागातील उप सचिव (विधि) (गट-अ), अवर सचिव (विधि) (गट-अ) आणि अधीक्षक (विधि) (गट-ब) (सेवाप्रवेश) नियम, २०१२ या नियमामध्ये सुधारणा करण्यासाठी पुढील नियम करीत आहेत :----
१. या नियमांना " विधि व न्याय विभागातील उप सचिव (विधि) (गट-अ), अवर सचिव (विधि) (गट-अ) आणि अधीक्षक (विधि) (गट-ब) (सेवाप्रवेश) (सुधारणा) नियम, २०२० " असे संबोधण्यात यावे.
२. विधि व न्याय विभागातील उप सचिव (विधि) (गट-अ), अवर सचिव (विधि) (गट-अ) आणि अधीक्षक (विधि) (गट-ब) (सेवाप्रवेश) नियम, २०१२ (यापुढे ज्याचा निर्देश " मुख्य नियम " असा करण्यात आला आहे) मधील नियम ४ मध्ये पोट-नियम (ब) नंतर पुढील परंतुक जादा दाखल करण्यात येईल :----
" परंतु, पदोन्नतीद्वारे उक्त पदावर नियुक्तीकरिता योग्य व पात्र उमेदवार उपलब्ध नसतील तर, ते पद, दिवाणी न्यायाधीश (कनिष्ठ स्तर) व न्यायदंडाधिकारी (प्रथम वर्ग) या संवर्गामध्ये तीन वषार्ंहून कमी नसेल इतका अनुभव धारण करणाया सुयोग्य न्यायिक अधिकायाची प्रतिनियुक्तीवर बदली करून, भरण्यात येईल. ".
३. मुख्य नियमाच्या नियम क्र. ५ ऐवजी पुढील नियम दाखल करण्यात येईल :----
" ५. " अधीक्षक (विधि) " या पदावरील नियुक्ती " सहायक (विधि) " हे पद धारण करीत असलेल्या व या पदावर पाच वषार्ंहून कमी नाही इतकी नियमित सेवा पूर्ण केलेल्या व्यक्तींमधून, सेवाज्येष्ठतेच्या आधारे पात्रतेनुसार सुयोग्य व्यक्तीच्या पदोन्नतीद्वारे करण्यात येईल ".

भाग चार-अ----२१-१२ महाराष्ट्र शासन राजपत्र असाधारण भाग चार-अ, फेब्रुवारी ६, २०२०/माघ १७, शके १९४१ ४. मुख्य नियमाच्या नियम क्रमांक ६ ऐवजी पुढील नियम दाखल करण्यात येईल :----
" ६. नियम ४ पोट-नियम (ब) खंड (तीन) (उप खंड) (एक), (दोन), (तीन) आणि (चार) यांमध्ये काहीही अंतभर्ूत असले तरी, जर निवडीच्या कोणत्याही टप्प्यावर, आयोगाच्या मते, अनुसूचित जाती (बौद्ध धमार्ंतरित व्यक्तींसह), अनुसूचित जमाती आणि विमुक्त जाती (निरधिसूचित जमाती) किंवा भटक्या जमाती यांमधील उमेदवारांकरिता राखीव असलेली रिक्त पदे भरण्यासाठी आवश्यक त्या कालावधीचा अनुभव धारण केलेले उमेदवार पुरेशा संख्येने उपलब्ध नसतील तर, आयोगास, अशा निवडीच्या बाबतीत, आवश्यक असलेला अनुभवाचा कालावधी एक वर्षापयर्ंत शिथिल करता येईल आणि या जातींमधील किंवा जमातींमधील योग्य उमेदवारांची निवड करता येईल. " ५. मुख्य नियमाच्या नियम ६ ऐवजी पुढील नियम दाखल करण्यात येईल :----
" ७. नियम ४ मध्ये नमूद केलेल्या अवर सचिव (विधि) या पदावरील नियुक्ती ही, पदोन्नती व नामनिर्देशन याद्वारे ४०:६० या प्रमाणात करण्यात येईल. "

NOTIFICATION
CONSTITUTION OF INDIA.
No. RTR. 2010/C.R. 593/Desk-2.—In exercise of the powers conferred by the proviso to article 309 of the constitution of India, the Governor of Maharashtra is hereby pleased to make the following rules to amend the Deputy Secretary (Legal) (Group A), Under Secretary (Legal) (Group A), and Superintendent (Legal) (Group B), in the Law and Judiciary Department (Recruitment) Rules, 2012 namely :—
1. These rules may be called the Deputy Secretary (Legal) (Group A), Under Secretary (Legal) (Group A), and Superintendent (Legal) (Group B), in the Law and Judiciary Department (Recruitment) (Amendment) Rules, 2020.
2. In the Rules 4 of the Deputy Secretary (Legal) (Group A), Under Secretary (Legal) (Group A), and Superintendent (Legal) (Group B), in the Law and Judiciary Department (Recruitment) Rules, 2012 (hereinafter referred to as " the Principal Rules "), after sub-rule (b), the following proviso shall be added namely :—
" Provided that, if the candidates for appointment to the said post by way of promotion are not available, the post shall be filled in by transfer on deputation of a suitable Judicial Officer from the cadre of Civil Judge Junior Division and Judicial Magistrate First Class, having not less than three years experience in that cadre."
3. For rule 5 of the Principal Rules, the following rule shall be substituted, namely :—
" 5. Appointment to the post of Superintendent (Legal), shall be made by promotion of a suitable person on the basis of seniority subject to fitness from amongst the persons holding the post of Assistant (Legal), having not less than five years regular service in that post ".
4. For rule 6 of the Principal Rules, the following rule shall be substituted, namely :—
" 6. Notwithstanding anything contained in Sub-Clauses (i), (ii), (iii) and (iv) of Clause (III) of sub-rule (b) of rule 4, if at any stage of selection, the Commission is of the opinion that sufficient number of candidates possessing the requisite period of experience are not available to fill up the vacancies reserved for candidates belonging to Scheduled Castes (including converts to Buddhism), Scheduled Tribes and De-notified Tribes or Nomadic Tribes, then the Commission may, in the matters of such selection, relax the requirement in respect of the period of experience upto one year and select suitable candidate belonging to such Castes or Tribes. ".
5. For rule 7 of the Principal Rules, the following rule shall be substituted, namely :—
" 7. The Appointment to the post of Under Secretary (Legal) mentioned in the rule 4, by promotion, and nomination shall be made in ratio of 40:60 ".
