BY DIRECTOR OF TOWN PLANNING

MAHARASHTRA REGIONAL AND TOWN PLANNING ACT, 1966.

No. D.T.P-D.P.Karanja(R)-Sec-127(2)-Notification-TPV-VI-347-2020.—

Whereas, the Director of Town Planning, Maharashtra State, Pune Vide its Notification No. DP-Karanja(R)-TPV-IV-7231-A, dated 29th October 1988 has sanctioned the Revised Development Plan of Karanja (hereinafter referred to as the "said Development Plan") under Section 31(1) of the Maharashtra Regional & Town Planning Act, 1966 (Mah XXXVII of 1966) (hereinafter referred to as "the said Act") and the same has come into force with effect from 1st January, 1992;

And whereas, in the said Development Plan, the land from S.No. 178 & 179 of Mouza Kali Karanja is reserved for Site No. 8 " Government Technical High School " admeasuring 1.20 hect., Site No. 9 " Play Ground" admeasuring 1.33 hect. (hereinafter referred to as " the said Reservations") & 18.00 mtr. wide Development Plan Road for which Appropriate Authority is Government of Maharashtra Technical Education Department & Municipal Council, Karanja respectively (hereinafter referred to as " the said Appropriate Authorities" );

And whereas, the land under said reservation have not been acquired by the said Appropriate Authorities within ten years from the date on which the said Development Plan came into force;

And whereas, the owners of 1.26 hect. land from S. No. 178/1 (hereinafter referred to as " the said Land") had served a notice about Site No. 8 " Government Technical High School". Site No. 9 " Play Ground" & 15.00 mtr. wide Development Plan Road of Mouza Kali Karanja in the said Development Plan under Section 127(1) of the said Act, on the Chief Officer, Municipal Council, Karanja, the Assistant Director of Town Planning, Washim Branch, Washim, the Director of Town Planning, Maharashtra State, Pune, the Hon'ble Secretary, Government of Maharashtra, Urban Development Department, Mantralaya, Mumbai, the Collector, Washim & the Head Master, Government Technical Secondary School Centre, Karanja (Lad) vide their letter dated 24th October, 2011 (hereinafter referred to as " the said notice") ; +.-ॅ-+-२ (१७८१).

And whereas, as per the said Development Plan 18.00 mtr. wide road is proposed on the owners land and not 15.00 mtr. wide road, hence the notice served for 15.00 mtr. wide road is not tenable;

And whereas, the said Appropriate Authorities, have not acquired or no steps as contemplated in the Section 127(1) of the said Act, has commenced for its acquisition within the period of twelve months from the receipt of the aforesaid said notice;

And whereas, the Chief Officer, Municipal Council, Karanja (Lad) vide his letter No. 4268/2019, dated 2nd December 2019 & the Head Master, Government Technical High School Centre, Karanja (Lad) Vide his letter No. 324, dated 18th December 2019 have communicated that they have not initiated any land acquisition procedure after receipt of the said notice under Section 127(1) of the said act; And Whereas, in accordance with the provision of Section 127(1) of the said Act, the part of the said Reservations, pertaining to the said land, has lapsed and it is accordingly expedient to notify such lapsing under Section 127(2) ot the said Act;

And whereas, the Government in Urban Development Department under Section 151 of the said Act, Vide Resolution No. TPS-1813-3211-CR-508-UD-13, dated 1st December, 2016, has delegated the powers exercisable by it under Section 127(2) of the said Act, in respect of Development Plans of all Municipal Councils/ Nagar Panchayat and for the Development Plans undertaken by Zilla Parishad as a Planning Authority, to the Director of Town Planning, Maharashtra State, Pune;

Now, therefore, in exercise of the powers delegated by the Government, in respect of Sub-Section (2) of Section 127 of the said Act and of all other powers enabling it in that behalf, the Director of Town Planning, Maharashtra State, Pune, hereby notifies that the said Reservations of Site No. 8 "Govern- ment Technical High School" & Site No. 9 " Play Ground" are lapsed partly only in repect of said Land ( as specified in the schedule herein below) and the said land shall become available to the land owners for the purpose of Development as otherwise, permissible in the case of adjacent land, under the said Development Plan;

in respect of the proposed modification of the site Reservation No. 1, 5, 6, 8, 31, 33 of lands

shown in the final Development Plan of Jalgaon Jamod Town.

Whereas, the final Development Plan of Jalgaon Jamod Town has approved by the Director of Town Planning, Maharashtra State, Pune Vide Notification No. TPS 2605-908-CR-136-(A)-2205-UD-30, Dated 19th December 2005 has come into force with effect from date 15th January 2006. Whereas, the final Development has made applicable from 15th January 2006.

Whereas, in final Development Plan the land has been reserve for following purposes.

Whereas, the City Council has proposed to alter the above reserved land for residential purposes as per the General Proposal No. 2 of the general body for the benefit of the encroached and private owners under the Pradhan Mantri Awas Yojana.

The propose modification have shown in red colour in final development map has kept in the office of the Municipal Council for inspection of general public.

Now, therefore the undersigned by this public notice in pursuance provision of Sec. 37 Maharashtra Regional and Town Planning Act, 1966, invites objection and suggestion from general public respect of proposed changes and alteration proposed to be made in the site question, within 30(Thirty)days from the notice published in Government Gazette. All the objections/suggestions shall be considered by Municipal Council before submitting the said minor modification to the Government for sanction.
