क्रमांक प्रोफेब-२०१५/प्र. क्र. ५८/म-१०.---महाराष्ट्र जमीन महसूल अधिनियम, १९६६ (१९६६ चा महा. ४१) च्या कलम ४ पोट-कलम (१) च्या खंड (सहा) द्वारे प्रदान करण्यात आलेल्या तसेच याबाबतीत महाराष्ट्र शासनास समर्थ करणाया इतर सर्व अधिकारांचा वापर करून आणि पूर्वीच्या सर्व अधिसूचना किंवा आदेश किंवा बीड जिल्ह्यच्या अंबाजोगाई तालुक्यात समाविष्ट असलेल्या मालेवाडी गावाचे जेथवर संबंधित असतील तेथवर त्यामध्ये फेरफार करून महाराष्ट्र शासन कलम ४ च्या पोट-कलम (४) द्वारे आवश्यक केल्याप्रमाणे महाराष्ट्र शासन या प्रस्तावास पूर्व प्रसिद्धी दिल्यांनतर कोणत्याही हरकती व सूचना प्राप्त न झाल्यामुळे असे निर्देशित करीत आहे की, १२ सप्टेंबर २०१६ या दिनांकापासून मालेवाडी हे गाव बीड जिल्ह्यच्या अंबाजोगाई तालुक्यातून वगळून ते बीड जिल्ह्यच्या परळी तालुक्यात समाविष्ट करीत आहे.

No. TLC-2015/C.R.58/M-10.—In exercise of the powers conferred by clause (vi) of sub-section (1) of section 4 of the Maharashtra Land Revenue Code,1966 (Mah.XLI of 1966), and of all other powers enabling it in this behalf, and in modification of all the previous notifications or orders, in so far as they relate to the village Malewadi hitherto included in the Ambajogai Taluka of the Beed District, the Government of Maharashtra, after previous publication, as required by sub-section (4) of the said section 4, and having received no objections or suggestions, hereby specifies that the said village shall, with effect from the 12th day of September, 2016, be excluded from the Ambajogai Taluka of the Beed District and shall be included in the Parali Taluka of the Beed District.

क्रमांक मूवक. १५१६/प्र.क्र. १२३/कराधान-१.----महाराष्ट्र मूल्यर्वधित कर अधिनियम, २००२ (२००५ चा महा. ९) च्या कलम ९ च्या उप-कलम (१) द्वारे प्राप्त झालेल्या अधिकारांचा वापर करून, महाराष्ट्र शासन याद्वारे उक्त अधिनियमास जोडलेल्या अनुसूची 'ूु', 'ु' आणि '' मध्ये, दिनांक १७ सप्टेंबर २०१६, पासून खालीलप्रमाणे सुधारणा करीत आहे, म्हणजेच :—

NOTIFICATION

MAHARASHTRA VALUE ADDED TAX ACT, 2002.

No. VAT. 1516/CR 123/Taxation-1.—In exercise of the powers conferred by sub-section (1) of section 9 of the Maharashtra Value Added Tax Act, 2002 (Mah. IX of 2005), the Government of Maharashtra hereby, with effect from the 17th September 2016 amends Schedule 'C', 'D' and 'E' appended to the said Act, as follows, namely :—

In the Maharashtra Value Added Tax Act, 2002,—

I. In Schedule C,—

(1) in the heading, for the figures and sign " 5.5% ", the figure and sign " 6% ", shall be substituted ;

(2) in column (3),—

(i) against entries at serial numbers 1, 2, 3 and 3A for the figures and sign " 5.5% ", wherever it occurs, the figure and sign " 6% ", shall be substituted ;

महाराष्ट्र झोपडपट्टी (सुधारणा, निमर्ुलन व पुर्नविकास) अधिनियम १९७१.

क्रमांक भूसंपा. २०१२/प्र.क्र.२४०/झोपनि-२.---- ज्याअर्थी, मुख्य कार्यकारी अधिकारी, झोपडपट्टी पुनर्वसन प्राधिकरण आणि सक्षम प्राधिकारी, वांद्रे, मुंबई यांच्या अभिवेदनावरून महाराष्ट्र शासनास असे दिसून आले आहे की, उक्त प्राधिकायास यासोबत जोडलेल्या अनुसूचीच्या (यात यापुढे ज्याचा निर्देश उक्त अनुसूची असा करण्यात आला आहे.) स्तंभ-४ मध्ये नमूद केलेल्या झोपडपट्टी पुनर्वसन क्षेत्रावर झोपडपट्टी पुनर्वसन योजना राबविणे शक्य व्हावे म्हणून उक्त अनुसूचीच्या स्तंभ ५ मध्ये विर्िनदिष्ट केलेली जमीन (यात यापुढे जिचा निर्देश उक्त जमीन असा करण्यात आला आहे.) संपादीत करणे आवश्यक आहे.

आणि ज्याअर्थी, महाराष्ट्र झोपडपट्टी (सु.नि. व पु.) अधिनियम, १९७१ (महा. १९७१ चा २८) च्या कलम १४ च्या पोट-कलम (१) (यात यापुढे ज्याचा निर्देश उक्त अधिनियम असा करण्यात आला आहे.) नुसार मुख्य कार्यकारी अधिकारी, झोपडपट्टी पुनर्वसन प्राधिकरण, बांद्रा, मुंबई यांनी बजावलेल्या त्यांच्या क्र. झोपुप्रा /उजि/एल.ए./ आदर्श/प्र.क्र.२८ /सुनावणी/२०१३/ ११०२, दिनांक २६ ऑगस्ट २०१३ तसेच अपर जिल्हाधिकारी (अति./निष्का.), पश्चिम उपनगरे यांनी "द एशियन एज" या इंग्रजी वृत्तपत्रात दिनांक २६ ऑक्टोबर २०१० रोजी जाहीर नोटीस प्रसिद्ध करण्यात येऊन आणि उक्त अधिनियमांच्या कलम ३६ अन्वये, सदर क्षेत्रात सवार्ंना ठळकपणे दिसेल अशा ठिकाणी चिकटवून, उक्त अनुसूचीच्या स्तंभ ६ मध्ये नमुद केलेल्या ज्या व्यक्ती, उक्त जमिनीचे मालक आहेत वा हितसंबंधीय आहेत, अशा व्यक्तींना उपरोक्त नोटीस मिळाल्यापासून वा वृत्तपत्रात नोटीस प्रसिद्ध झाल्याच्या तारखेपासून १५ दिवसांच्या कालावधीत उक्त जमीन का संपादित करण्यात येऊ नये याबाबतची कारणे दाखविण्यास फर्माविले होते,

आणि ज्याअर्थी, मुख्य कार्यकारी अधिकारी, झोपडपट्टी पुनर्वसन प्राधिकारी यांनी संबंधित झोपडीधारकांच्या सहकारी गृहनिर्माण संस्था तसेच जमिनीचे मालक व हितसंबंधित यांच्या घेतलेल्या सुनावणीत संबंधित, झोपडीधारकांच्या सहकारी गृहनिर्माण संस्थेच्या युक्तीवाद, अधिकार अभिलेखांतील नोंदी, उक्त जमिनीवर विकास आराखडयानुसार असलेले आरक्षण तसेच झोपडीधारकांनी सादर केलेली मागणी न्याय्य असल्याबाबत उक्त जमीन संपादनाबाबतचे अभिवेदन मुख्य कार्यकारी अधिकारी, झोपडपट्टी पुनर्वसन प्राधिकरण यांनी राज्य शासनास दिनांक ११ डिसेंबर २०१३ रोजी सादर केले आहे,

आणि ज्याअर्थी, उक्त अधिनियमाच्या प्रकरण I-A च्या कलम ३ (D)(c)(i) च्या परिच्छेद (A) अन्वये सुधारणा करण्यात आलेल्या प्रकरण पाच मधील कलम १४ च्या पोट-कलम (१) नुसार मुख्य कार्यकारी अधिकारी, झोपडपट्टी पुनर्वसन प्राधिकरण,वांद्रे (पू), मुंबई यांनी सादर केलेल्या अभिवेदन, अहवाल व त्यांनी या प्रकरणी केलेली कार्यवाही राज्य शासनास उक्त अनुसूचीमध्ये नमुद केलेल्या झोपडपट्टी पुनर्वसन क्षेत्राच्या विकासासाठी झोपडपट्टी पुनर्वसन योजनेअंतर्गत विकास करणे शक्य व्हावे म्हणून उक्त जमीन संपादित करणे आवश्यक असल्याचे दिसून आले आहे,महाराष्ट्र शासन राजपत्र भाग चार-ब गुरुवार ते बुधवार, फेब्रुवारी ६-१२, २०२०/माघ १७-२३, शके १९४१ ९ त्याअर्थी आता, उक्त अधिनियमाच्या प्रकरण I-A च्या कलम ३ (D)(c)(i) च्या परिच्छेद (A) अन्वये सुधारणा करण्यात आलेल्या प्रकरण पाच मधील कलम १४ च्या पोट-कलम (१) द्वारे प्रदान करण्यात आलेल्या अधिकारांचा वापर करून महाराष्ट्र शासन या नोटिशीद्वारे असे घोषित करीत आहे की त्यानेउक्त जमीन संपादित करण्याचे ठरविले आहे.

NOTIFICATION

MAHARASHTRA SLUM AREAS (IMPROVEMENT, CLEARANCE AND REDEVELOPMENT) ACT, 1971.

No.Bhusampa. 2012/C.R.240/Zopani-2.— Whereas, on representation from the Chief Executive Officer, Slum Rehabilitation Authority, Bandra, Mumbai, it appears to the Government of Maharashtra that in order to enable the said Authority to implement the Slum Rehabilitation Scheme in relation to the Slum Rehabilitation Area mentioned in the Schedule appended hereto (hereinafter referred to as "the said Schedule"), it is necessary that the land specified in the said Schedule (hereinafter referred to as "the said land"), should be acquired ;

And whereas, as required by the proviso to sub-section (1) of section 14 of Chapter V read with paragraph (A) of sub-clause (i) of clause (c) of section 3D of Chapter I-A of the Maharashtra Slum Areas (Improvement, Clearance and Redevelopment) Act, 1971 (Mah.XXVIII of 1971) (hereinafter referred to as "the said Act"), the Chief Executive Officer, Slum Rehabilitation Authority, Bandra, Mumbai, has, by his Notice No. SRA /Dy.Coll. /L A/ adarsh/C.R.28/ Hearing/ 2013/ 1102, dated the 26th August 2013 served in prescribed manner and also by notice published by the Additional Collector (Encroachment or Removal), Brihan-Mumbai in the daily English Newspaper "The Ashian Age" dated the 26th October 2010, and also by affixing in the conspicuous part in the premises situated in the said land, as provided in section 36 of the said Act, called upon the persons mentioned in column (6) of the said Schedule, who are the owners of the said land or any other person interested therein to show cause, within fifteen days from the date of its publication in the newspapers, as to why the proposal to acquire the said land for implementation of the Slum Rehabilitation Scheme for the concerned protected slum dwellers should not be sent to the State Government for approval;

And whereas, the Chief Executive Officer, Slum Rehabilitation Authority, Bandra, Mumbai, after considering, the objections received in this behalf for the acquisition of the said lands, pleading on behalf of the proposed Co-operative Housing Society of the Slum dwellers, entries as to the rights in the land record, reservation in development plan and the legitimate request of the protected slum dwellers, by his representation dated the 11th December 2013 submitted the report for the acquisition of the said land;

And whereas, as required by the first proviso to sub-section (1) of section 14 of Chapter V read with Paragraph (A) of sub-clause (i) of clause (c) of section 3D of Chapter I-A of the said Act, on representation from the Chief Executive Officer, Slum Rehabilitation Authority, Bandra, Mumbai, and after considering his report for the acquisition of said land, it appears to the State Government that in order to enable the Slum Rehabilitation Authority to carry out the development under the Slum Rehabilitation Scheme in the slum rehabilitation area mentioned in the said Schedule, the said land should be acquired.

Now, therefore, in exercise of the powers conferred by sub-section (1) of section 14 read with paragraph (A) of sub-clause (i) of clause (c) of section 3D of the said Act, the Government of Maharashtra hereby declares, by this notice, that it has decided to acquire the said land.

क्रमांक-भूसंपा-२०१६/प्र.क्र.५५/झोपनि-२.----ज्याअर्थी, मुख्य कार्यकारी अधिकारी, झोपडपट्टी पुनर्वसन प्राधिकरण आणि सक्षम प्राधिकारी, वांद्रे, मुंबई यांच्या अभिवेदनावरून महाराष्ट्र शासनास असे दिसून आले आहे की, उक्त प्राधिकायास यासोबत जोडलेल्या अनुसूचीच्या (यात यापुढे ज्याचा निर्देश उक्त अनुसूची असा करण्यात आला आहे.) स्तंभ-४ मध्ये नमूद केलेल्या झोपडपट्टी पुनर्वसन क्षेत्रावर झोपडपट्टी पुनर्वसन योजना राबविणे शक्य व्हावे म्हणून उक्त अनुसूचीच्या स्तंभ ५ मध्ये विर्िनदिष्ट केलेली जमीन (यात यापुढे जिचा निर्देश उक्त जमीन असा करण्यात आला आहे.) संपादित करणे आवश्यक आहे.

आणि ज्याअर्थी, महाराष्ट्र झोपडपट्टी (सु.नि. व पु.) अधिनियम, १९७१ (महा.१९७१ चा २८) च्या कलम १४ च्या पोट-कलम (१) (यात यापुढे ज्याचा निर्देश उक्त अधिनियम असा करण्यात आला आहे.) नुसार मुख्य कार्यकारी अधिकारी, झोपडपट्टी पुनर्वसन प्राधिकरण, बांद्रा, मुंबई यांनी बजावलेल्या त्यांच्या क्र.झोपुप्रा /उजि/एल.ए./भूसंपा/सुनावणी/२०१५/८६, दि.२२.१.२०१६ तसेच मराठी वृत्तपत्र " आपला वार्ताहर '' आणि " दि फ्रि प्रेस जर्नल " या इंग्रजी वृत्तपत्रात दि. ११ सप्टेंबर २०१५ रोजी जाहीर नोटीस प्रसिद्ध करण्यात येवून आणि उक्त अधिनियमांच्या कलम ३६ अन्वये, सदर क्षेत्रात सवार्ंना ठळकपणे दिसेल अशा ठिकाणी चिकटवून, उक्त अनुसूचीच्या स्तंभ ६ मध्ये नमूद केलेल्या ज्या व्यक्ती, उक्त जमिनीचे मालक आहेत वा हितसंबंधीय आहेत, अशा व्यक्तींना उपरोक्त नोटीस मिळाल्यापासून वा वृत्तपत्रात नोटीस प्रसिद्ध झाल्याच्या तारखेपासून ७ दिवसांच्या कालावधीत उक्त जमीन का संपादित करण्यात येवू नये याबाबतची कारणे दाखविण्यास फर्माविले होते ;

आणि ज्याअर्थी, मुख्य कार्यकारी अधिकारी, झोपडपट्टी पुनर्वसन प्राधिकारी यांनी संबंधित झोपडीधारकांच्या सहकारी गृहनिर्माण संस्था तसेच जमिनीचे मालक व हितसंबंधीत यांच्या घेतलेल्या सुनावणीत संबंधित, झोपडीधारकांच्या सहकारी गृहनिर्माण संस्थेच्या युक्तीवाद, अधिकार अभिलेखांतील नोंदी, उक्त जमिनीवर विकास आराखडयानुसार असलेले आरक्षण तसेच झोपडीधारकांनी सादर केलेली मागणी न्याय्य असल्याबाबत उक्त जमीन संपादनाबाबतचे अभिवेदन मुख्य कार्यकारी अधिकारी, झोपडपट्टी पुनर्वसन प्राधिकरण यांनी राज्य शासनास दिनांक २३ फेब्रुवारी २०१६ रोजी सादर केले आहे,

भाग चार--ब----३अ१४ महाराष्ट्र शासन राजपत्र भाग चार-ब गुरुवार ते बुधवार, फेब्रुवारी ६-१२, २०२०/माघ १७-२३, शके १९४१ आणि ज्याअर्थी, उक्त अधिनियमाच्या प्रकरण I-A च्या कलम ३ (D)(c)(i)च्या परिच्छेद (A) अन्वये सुधारणा करण्यात आलेल्या प्रकरण पाच मधील कलम १४ च्या पोट-कलम (१) नुसार मुख्य कार्यकारी अधिकारी, झोपडपट्टी पुनर्वसन प्राधिकरण,वांद्रे (पू), मुंबई यांनी सादर केलेल्या अभिवेदन, अहवाल व त्यांनी याप्रकरणी केलेली कार्यवाही राज्य शासनास उक्त अनुसूचीमध्ये नमूद केलेल्या झोपडपट्टी पुनर्वसन क्षेत्राच्या विकासासाठी झोपडपट्टी पुनर्वसन योजनेअंतर्गत विकास करणे शक्य व्हावे म्हणून उक्त जमीन संपादित करणे आवश्यक असल्याचे दिसून आले आहे.

त्याअर्थी आता, उक्त अधिनियमाच्या प्रकरण I-A च्या कलम ३ (D)(c)(i)च्या परिच्छेद (A) अन्वये सुधारणा करण्यात आलेल्या प्रकरण पाच मधील कलम १४ च्या पोट-कलम (१) द्वारे प्रदान करण्यात आलेल्या अधिकारांचा वापर करून महाराष्ट्र शासन या नोटिशीद्वारे असे घोषित करीत आहे की, त्याने उक्त जमीन संपादित करण्याचे ठरविले आहे :-----

MAHARASHTRA SLUM AREAS (IMPROVEMENT, CLEARANCE AND REDEVELOPMENT)ACT, 1971.

No.Bhusampa-2016/C.R.55/Zopani-2.—Whereas, on representation from the Chief Executive Officer, Slum Rehabilitation Authority, Bandra, Mumbai, it appears to the Government of Maharashtra that in order to enable the said Authority to implement the Slum Rehabilitation Scheme in relation to the Slum Rehabilitation Area mentioned in the Schedule appended hereto (hereinafter referred to as "the said Schedule"), it is necessary that the land specified in the said Schedule (hereinafter referred to as "the said land"), should be acquired.

And whereas, as required by the proviso to sub-section (1) of section 14 of Chapter V read with paragraph (A) of sub-clause (i) of clause (c) of section 3D of Chapter I-A of the Maharashtra Slum Areas (Improvement, Clearance and Re-development) Act, 1971 (Mah.XXVIII of 1971) (hereinafter referred to as "the said Act"), the Chief Executive Officer, Slum Rehabilitation Authority, Bandra, Mumbai, has, by his Notice No.SRA /Dy.Coll. /Busampa/Sunavni/2015/86, dated the 22.1.2016 served in prescribed manner and also by notice published in the daily Marathi newspaper "Apala Vartahar" and English newspaper "The Free Press Journal" dated the 11 September 2015, and also by affixing in the conspicuous part in the premises situated in the said land, as provided in section 36 of the said Act, called upon the persons mentioned in column (6) of the said Schedule, who are the owners of the said land or any other person interested therein to show cause, within Seven days from the date of its publication in the newspapers, as to why the proposal to acquire the said land for implementation of the Slum Rehabilitation Scheme for the concerned protected slum dwellers should not be sent to the State Government for approval;

And Whereas, the Chief Executive Officer, Slum Rehabilitation Authority, Bandra, Mumbai, after considering the objections received in this behalf for the acquisition of the said lands and pleading on behalf of the proposed Co-operative Housing Society of the Slum dwellers, entries as to the rights in the land record, reservation in development plan and the legitimate request of the protected slum dwellers, by his representation dated the 23 February 2016 submitted the report for the acquisition of the said land;

And whereas, as required by the first proviso to sub-section (1) of section 14 of Chapter V read with Paragraph (A) of sub-clause (i) of clause (c) of section 3D of Chapter I-A of the said Act, on representation from the Chief Executive Officer, Slum Rehabilitation Authority, Bandra, Mumbai, and after considering his report for the acquisition of said land it appears to the State Government that in order to enable the Slum Rehabilitation Authority to carry out the development under the Slum Rehabilitation Scheme in the slum rehabilitation area mentioned in the said Schedule, the said land should be acquired.

Now, therefore, in exercise of the powers conferred by sub-section (1) of section 14 read with paragraph (A) of sub-clause (i) of clause (c) of section 3D of the said Act, the Government of Maharashtra hereby declares, by this notice, that it has decided to acquire the said land.

क्रमांक जमीन. २०१५/प्र.क्र.२०४/ज-१.----महाराष्ट्र जमीन महसूल संहिता, १९६६ (१९६६ चा ४१) याच्या कलम ३३० अ आणि त्यासंदर्भात प्राप्त असणाया अन्य सर्व शक्तींद्वारे प्रदान करण्यात आलेल्या अधिकारांचा वापर करून महाराष्ट्र शासन याद्वारे असा निदेश देते की,------

(क) उक्त संहितेच्या कलम ३७अ च्या पोट-कलम (१) खालील राज्य शासनाचे अधिकार हे जेथवर, कब्जेहक्काने किंवा भाडेपट्टयाने प्रदान करण्यात आलेल्या शासकीय किंवा नझूल जमिनीवर उभारण्यात आलेल्या कोणत्याही इमारतीच्या बांधकामाखालील, शासन वेळोवेळी सर्वसाधारण किंवा विशेष आदेशान्वये निर्धारित करेल इतक्या मर्यादेपयर्ंतचे क्षेत्र, अधिक लाभदायी प्रयोजनासाठी वापरण्यास पूर्व परवानगी देण्याशी संबंधित असतील तेथवर ते; आणि

(ख) पोट-कलम (१) खालील परवानगी देताना उक्त संहितेच्या कलम ३७ अ च्या पोट-कलम (२) खालील नजराणा मूल्य किंवा आकार वसूल करण्यासंबंधी शासनाचे अधिकार.

संबंधित जिल्हाधिकारी देखील त्याच्या अधिकारितेच्या हद्दींच्या आत, शासनाने वेळोवेळी सर्वसाधारण किंवा विशेष आदेशान्वये निश्चित केलेल्या अटी व शतर्ींना अधीन राहून, वापर करू शकतील.

MAHARASHTRA LAND REVENUE CODE, 1966.

No. Jamin. 2015/CR-204/J-1.—In exercise of the powers conferred by section 330A of the Maharashtra Land Revenue Code, 1966 (Mah. XLI of 1966), and of all other powers enabling it in that behalf, the Government of Maharashtra hereby directs that the powers of the State Government conferred,—

(a) under sub-section (1) of section 37A of the said Code, in so far as they relate to granting prior permission of the State Government for changing the use of buildings constructed on Government land or Nazual land, granted on occupancy rights or lease hold rights, for more beneficial purpose upto such percentum of such construction, as the State Government may by, order, specify from time to time; and,

(b) under sub-section (2) of said section 37A, in so far as they relate to recovery of premium or charge thereunder for the permission granted in pursuance of sub-section (1) thereof :

MAHARASHTRA INDUSTRIAL DEVELOPMENT ACT, 1961.

No. IDC. 2020/(C.R. 51)/Ind. 14.—In exercise of the powers conferred by sub-section (3) of Section 1 of the Maharashtra Industrial Development Act, 1961 (Mah. III of 1962), the Government of Maharashtra hereby appoints 6th February, 2020 to be the date from which the provisions Chapter VI of the said Act shall take effect in certain areas of Village Talavali Tarf Sonale in Taluka Bhivandi of District Thane, mentioned in the Schedule appended hereto and declares the said area to be an industrial area under clause (g) of section 2 of the said Act, for the purposes of the said Act.

The said area is more clearly defined in red in the map deposited in the offices of the Chief Executive Officer, Maharashtra Industrial Development Corporation, Andheri (East), Mumbai 400 093 and is bounded by the area as indicated in the said schedule.
