ज्याअर्थी अंबरनाथ-कुळगांव बदलापूर व परिसर अधिसूचित क्षेत्राची विकास योजना शासनाचे नगरविकास विभाग अधिसूचना क्र. टीपीएस-१२०४/९४१/सीआर-१६३/०४/नवि-१२, दिनांक २५ जुलै २००५ अन्वये शासनाने मंजूर केली आहे आणि उक्त विकास योजना दिनांक १२ ऑगस्ट २००५ पासून अंमलात आलेली आहे (यात यापुढे ज्याचा उल्लेख " उक्त एमएमआरडीए विकास योजना " असा करण्यात आला आहे) ;
ज्याअर्थी, महाराष्ट्र प्रादेशिक नियोजन व नगररचना अधिनियम, १९६६ (यात यापुढे ज्याच्या निर्देश " उक्त अधिनियम " असा करण्यात आला आहे) चे कलम ११३(१) द्वारे प्रदान करण्यात आलेल्या अधिकारांचा वापर करून शासनाने नगरविकास, सार्वजनिक आरोग्य व गृहनिर्माण विभागाची अधिसूचना क्रमांक आरपीबी. ११७१/१८१२४/११३/आयडब्ल्यू, दिनांक २० मार्च १९७१ द्वारे, यात नमूद करण्यात आलेले क्षेत्र हे नवी मुंबई ह्य नवीन नगराचे क्षेत्र म्हणून घोषित केले आहे व सिडकोस नगरविकास, सार्वजनिक आरोग्य व गृहनिर्माण विभागाची अधिसूचना क्रमांक आरपीबी. १८१२४/II डब्ल्यू, दिनांक २० मार्च १९७१ अन्वये, उक्त अधिनियमांच्या कलम ११३(३अ) नुसार नवी मुंबई या नवीन नगर क्षेत्रासाठी (उक्त नवनगरक्षेत्र) नवनगर विकास प्राधिकरण म्हणून नियुक्त केले आहे ;
आणि ज्याअर्थी, उक्त अधिनियमाच्या कलम ३१(१) द्वारे प्रदान करण्यात आलेल्या अधिकारांचा वापर करून, शासनाने उक्त नवनगर क्षेत्रासाठी सिडकोने सादर केलेल्या रचनाबद्ध आराखडयाच्या (Structural Plan) स्वरूपात असलेल्या प्रारूप विकास योजनेस (उक्त अंतिम विकास योजना) नगरविकास व सार्वजनिक आरोग्य विभाग अधिसूचना क्रमांक आरपीबी. ११७५/६३५/यूडी-५, दिनांक १८ ऑगस्ट १९७९ सह अधिसूचना क्रमांक आरपीबी. ११७५/६३५/यूडी-५, दिनांक १८ जानेवारी १९८० अन्वये मंजुरी दिलेली आहे आणि उक्त विकास योजना दिनांक १ मार्च १९८० पासून अंमलात आलेली आहे ;
आणि ज्याअर्थी, महाराष्ट्र महानगरपालिका अधिनियम (यात यापुढे ज्याचा उल्लेख " उक्त महानगरपालिका अधिनियम " असा करण्यात आला आहे) चे कलम ३ च्या पोट-कलम (४) नुसार महाराष्ट्र शासन नगरविकास विभाग अधिसूचना क्रमांक पनवेल महानगरपालिका --- २९१४/ व्हीआयपी सं.क्र. ३०१/प्र.क्र. ३५४/नवि-२३, दिनांक २६ सप्टेंबर २०१६ अन्वये पनवेल नगरपरिषदेचे संपूर्ण क्षेत्र व २९ महसुली गावांच्या क्षेत्रासाठी पनवेल महानगरपालिकेची स्थापना करण्यात आली असून ती दिनांक १ ऑक्टोबर २०१६ पासून अस्तित्वात आली आहे ;

भाग दोन--२०--१२ महाराष्ट्र शासन राजपत्र असाधारण भाग दोन, फेब्रुवारी ११, २०२०/माघ २२, शके १९४१ आणि ज्याअर्थी, पनवेल महानगरपालिका हद्दीमध्ये उक्त एमएमआरडीए विकास योजनेतील ११ महसुली गावांचा समावेश पनवेल महानगरपालिकेच्या हद्दीत करणेत आलेला आहे ;
आणि ज्याअर्थी, उक्त अंतिम विकास योजना व उक्त मंजूर एमएमआरडीए विकास योजना या एकमेकांना लागून आहेत आणि मंजूर विकास योजनेतील रस्ते उक्त मंजूर एमएमआरडीए विकास योजनेच्या हद्दीपयर्ंत तयार करण्यात आलेले आहेत.
आणि ज्याअर्थी, उक्त अंतिम विकास योजना व उक्त मंजूर एमएमआरडीए विकास योजनामध्ये Missing Links असल्याने पनवेल महानगरपालिका क्षेत्रातील वाहतूक सोयीची व दळणवळण सुकर होण्यासाठी नवीन जोड रस्ते तयार करणे गरजेचे आहे.
आणि ज्याअर्थी, महाराष्ट्र महानगरपालिका अधिनियमाचे कलम २०५, २०६ व २०९ अन्वये महानगरपालिका क्षेत्रामध्ये नवीन रस्ते तयार करणे, रस्त्याची रुंदी निश्चित करणे व रस्त्यांची सुधारणा करणेचा अधिकार महानगरपालिकेला आहे ;
आणि ज्याअर्थी, वरील संदर्भ उक्त करण्यासाठी पनवेल महानगरपालिकेच्या सर्वसाधारण सभेने ठराव क्र. १९०, दिनांक ५ सप्टेंबर २०१९ अन्वये आयुक्त, पनवेल महानगरपालिका यांना प्राधिकृत केले आहे ;
त्याअर्थी, मी गणेश देशमुख, आयुक्त, पनवेल महानगरपालिका मला प्राप्त अधिकारांन्वये खालील परिशिष्ट 'अ' मध्ये विर्िनदिष्ट केलेल्या नवीन जोड रस्त्याचे आखणी व परिशिष्ट 'ब' मध्ये नकाशात दर्शविल्याप्रमाणे रस्त्याचे संरेखांकन जाहीर करीत आहे. सदर परिशिष्ट 'अ' व परिशिष्ट 'ब' च्या प्रती नागरिकांच्या पाहणीकरिता सहायक संचालक, नगररचना विभाग, पनवेल महानगरपालिका यांचे कार्यालयात कार्यालयीन दिवशी व कार्यालयीन वेळेत खुला ठेवण्यात आलेल्या आहेत.
कोणत्याही नागरिकास प्रस्तावित रस्त्याचे आखणीबाबत काही हरकती किंवा सूचना असल्यास हे जाहीर प्रकटन महाराष्ट्र शासनाच्या राजपत्रात प्रसिद्ध झालेल्या दिनांकापासून ३० दिवसांचे आत सहायक संचालक, नगररचना विभाग, ३ रा मजला, अग्निशमन इमारत, देवाळे तलाव, पनवेल महानगरपालिका यांचे कार्यालयात कार्यालयीन दिवशी व कार्यालयीन वेळेत सादर कराव्यात. महाराष्ट्र शासन राजपत्रात प्रसिद्ध दिनांकापासून ३० दिवसांचे आत प्राप्त झालेल्या सूचना किंवा हरकती यांचाच विचार केला जाईल. मुदतीनंतर प्राप्त झालेल्या हरकती व सूचना विचारात घेतल्या जाणार नाहीत.

रस्त्याचे संक्षिप्त विवरण
खारघर नोडमधील व्हॅली शिल्प निवासी संकुलासमोरील सिडकोने विकसित केलेला विद्यमान ३५.०० मी. रुंदीच्या रस्त्याला पुढे मौजे- आडिवली - किरवली या महसुली गावांच्या स.नं. ८९(पैकी) च्या पूर्वेकडील हद्दीपयर्ंत विद्यमान राष्ट्रीय महामार्गाला जोडणारा ३५.०० मी. रुंदीचा सार्वजनिक रस्ता आखणे व तयार करणे आणि, प्रस्तावित Missing Link ला व एमएमआरडीएच्या AKBSNA च्या मंजूर विकास आराखडयामध्ये दर्शविलेला २४ मी. रुंदीच्या रस्त्याला जोडणारा, बीड महसुली गावाच्या स.नं. ४२ पासून ते मौजे रोहिंजण या महसुली गावाच्या स.नं. १०९ पयर्ंतच्या २४ मीटर रुंदीचा प्रस्तावित रस्ता.
प्रस्तावित रस्त्याचे संरेखांकनामुळे बाधित होणारे सव्र्हे नं./गट नं. खालीलप्रमाणे आहेत :----

PANVEL MUNICIPAL CORPORATION
Public Notice
(Maharashtra Municipal Corporation Act,1949 Section 205, 206 and 209) No. PMC/TPD/ADTP/Missing Links/405/2020
Whereas the Ambarnath, Kulgaon Badlapur and Surrounding Notified area Development Plan has been sanctioned by the Government of Maharashtra in Urban Development Department vide Notification No. TPS. 1204/941/CR-1630/UD -12, dated 25th July 2005 and it has came into force with effect from 12th August 2005 (hereinafter referred as the said MMRDA Development Plan);
And Whereas, the Government in exercise of the powers conferred by Section 113(1) of the Maharashtra Regional and Town Planning Act, 1966 (hereinafter referred to as "said Act") has designated site for New – Town of Navi Mumbai( hereinafter referred to as "Said New Town") vide Urban Development and Public Health Department's (UD and PH) Notification No. RPB. 1171/18124/I.W., dated the 20th March 1971 and CIDCO has been appointed as New Town Department Authority (NTDA) for the said New Town Under Section 113(3A) of the said Act vide Urban Development and Public Health Department's Notification No. RPB. 117/18124/II.W., dated the 20th March 1971;
And whereas, the Government in exercise of the powers conferred by Section 31(1) of the said Act vide UD and PHD's Notification No. RPB. 1175/635/UD-5, dated the 18th January 1980 has been sanctioned the Draft Development Plan (hereinafter referred to as said Final Development Plan) in the form of structural plan submitted by CIDCO for the said New Town Area and the said Final Development Plan came into force with effect from 1st March 1980 ;
And whereas, the Government in exercise of the power conferred by Section 3 of the Maharashtra Municipal Corporation Act, 1949 (hereinafter referred to as the "said MMC Act") vide the Urban Development Department Notification No. PNP. 2014/VIP No. 301/CR. 354/UD/23, dated the 25th September, 2016 constituted the Panvel Municipal Corporation for the areas of whole area of Panvel Municipal Council and 29 revenue villages specified therein, which came into force with effect from 1st October 2016 ;
And whereas; the said MMRDA Development Plan's 11 revenue villages has been included in the Panvel Municipal Corporation Area ;
And whereas, the said Final Development Plan and said MMRDA Developed Plan are adjacent to each other and the roads already developed in the said Sanctioned Development Plan are upto the said MMRDA Development Plan limit ;
And whereas there are Missing links in the said Final Development Plan and the said MMRDA Development Plan it has become expedient to connect the Missing Links by preparing new roads so as to enable the traffic Smoothly and to make the conveniently traffic within the Panvel Municipal Corporation ;
And whereas, as per the provisions of the said MMC Act, Sections 205, 206, and 209 empowers the Municipal Corporation to prepare the new roads, to decide the width of the roads and to improve the roads within the Municipal Corporation Area ;
And whereas, the Panvel Municipal Corporation vide General Body Resolution No. 190, dated 5th September 2019 delegated the powers under Section 205, 206 and 209 of the said MMC Act to Commissioner, Panvel Municipal Corporation ;
Therefore, as per the powers delegated by Panvel Municipal Corporation to the Commissioner, Panvel Municipal Corporation and in exercise of the powers, I, Ganesh Deshmukh Commissioner, Panvel Municipal Corporation here by declares the Missing Links as mentioned in the Schedule 'A' and a planमहाराष्ट्र शासन राजपत्र असाधारण भाग दोन, फेब्रुवारी ११, २०२०/माघ २२, शके १९४१ ५ appended hereto Schedule 'B' showing the alignment of the Missing Links is kept open for the inspection of the public on all working days and in working hours in the office the of the Assistant Director of Town Planning, Panvel Municipal Corporation.
Any citizen, who want to submit any objection and/or suggestion about the proposed alignment of the road, he/ she may submit in writing to the Assistant Director of Town Planning, Panvel Municipal Corporation, Town Planning Department, 3rd floor Fire Brigade Building, Near Devale Talav, Panvel. within 30 days from the publication of this notice in Maharashtra Government Gazette. It shall be noted that, suggestion or objection if any, received by Panvel Municipal Corporation in writing within 30 days from the date of publication of this notice in the Maharashtra Government Gazette would only be considered by the Municipal Commissioner, Panvel Municipal Corporation. The suggestion/objection received after 30 days would not be considered.

Description of Road
Connection of Missing Links by preparing the new road extending from existing 35 m wide road in the Kharghar Node abutting Valley Shilp Residential Complex to be extended upto the Eastern boundary of S.No. 69 of Adiwali - Kirawali revenue village as well as connecting to Mumbai - Pune National Highway No. 48. And 24 m wide road connecting proposed missing link and 24 m wide D.P. road as shown in sanction MMRDA AKBSNA plan from S.No. 42 of Beed revenue village to S.No. 109 of Rohinjan village.
