Whereas, the Development Plan (Revised + Additional Area) of Kalameshwar Brahmani Municipal Council has been Sanctioned under the Provisions of Section 31(1) of Maharashtra Regional and Town Planning Act, 1966 (herein- after referred to as "the said Act") by the Director of Town Planning, Maharashtra State, Pune vide their Notification No. DP-Kalmeshwar (R. + AA)-TPV-2-4287, dated 21-7-1992 and came into force w.e.f. dated 1-10-1992 (hereinafter re- ferred to as "the said Development Plan") ; and the kalmeshwar Municipal Council, Kalmeshwar is the Planning Author- ity for said Development Plan (hereinafter referred to as "the said Planning Authority") ;
And whereas, in the said Development Plan, land bearing S. No. 874 (pt), 875 (pt), & 907 (pt), having area 3500.00m2 is reserved for Site No. 10 "Dispensory" & land bearing S. No. 875 (pt), & 907 (pt), having area 3600.00m2 is reserved for Site No. 11, "Shopping Centre" & Kalmeshwar Municipal Council is the Appropriate Authority (hereinafter referred as "the said Appropriate Authority"), for the said reservations, (hereinafter referred as "said reservations");
And whereas, in the said Development Plan Site No. 10,Dispensary having an area of 3500.0 mt Sq on lands bearing S. No. 874(pt), 875(pt) & 907 (pt) And Site No. 11, "Shopping Center", having an area of 3600.0 mt. Sq on lands bearing S. No. 875 (pt) & 907 (pt) are proposed for above Public amenities ;
And whereas, in the said Development Plan, the land bearing Khasara No./Survey No. 875 area ameasuring 11000.00 Sq.mt. of Mauje Kalmeshwar (hereinafter referred to as "the said land") is reserved as Site No. 10, "Dispensary" (Partly), Site 11, "Shopping Center" (Partly), 18.0 mtr. North-South Development Plan Road, (hereinafter referred to as "the said reservations") and remaining area is under Residential Zone. Kalmeshwar Municipal Council, is the Appropriate Authority, for the said reservations (herein after referred to as "the said Appropriate Authority".) And whereas, the owner of the said land has handed over the 2340.00 Sq.mt area under 18.0 mtr wide North- South Development Plan Road to the Kalmeshwar Municipal Council on dt 5-10-2007 by an agreement in lieu of releasing the balance land under the said reservations ;
And whereas, the land has not been acquired by the said Authority within ten years from the date on which the said Development Plan came into force ;
And whereas, the owners of the said land i.e., Shri Manohar Gagadhar Gadge has issued a notice dated 21-2-2012 under Section 127(1) of the said Act (hereinafter referred as "the said Notice") on the said Authority ;
And whereas, even after serving of the said Notice as aforesaid, the said land has not acquired within a stipulated period from the date of service of the said notice under sub-section (1) of the Section 127 of the said act, by the said authority ;
And whereas, the owners of the said land has filed an Writ Petition No. 5614/2018 in Hon'ble High Court of Judicature at Bombay, Bench at Nagpur ;
And whereas, the Hon'ble High Court of Judicature at Bombay, Bench at Nagpur in its decision dated 10th October 2019, in Writ Petition No. 5614/2018 in this regard, directed the Principal Secretary, Urban Development Department to issue Notification under Section 127(2) of MRTP Act, in terms of the recommendations of Joint Director, Town Planning, Nagpur Division, Nagpur contained in the letter dated 19th June 2015 and issue the notification within a period of four weeks from Today ;
And whereas, Government in Urban Development Department vide letter No. HCR-3019-1293-CR-198-2019-UD- 9, dt 6-12-2019 has communicated directorate to notify lapsing of the said reservations on the said land under Section 127(2) of the said act;
And whereas, the Director of Town Planning, Maharashtra State, Pune is of the opinion that, it is necessary to issue the notification under Section 127(2) of the said act, regarding the lapsing of the said reservation on the said land ;
And whereas, the Government in Urban Development Department, vide Resolution No. TPS-1813-3211-CR-508- UD-13, dated 1-12-2016 has delegated the powers exercisable by it under Section 127(2) of the said Act to the Director of Town Planning, Maharashtra State, Pune in respect of Development Plans of all Municipal Councils/Nagar Panchayats and for the Development Plans undertaken by Zilla Parishad as a Planning Authority ;
४ द्धन्रु]क्ष् रू न् ॅ-+ न् ह्यम््र ान्म््र, त्र्ॅाम्न््र १३-१९, २०२०/द्ध २४-३०, ॅ १९४१Now, therefore, the Director of Town Planning, Maharashtra State, Pune hereby notify the lapsing of the said reservations partly in respect of the said land u/s 127(2) of the said Act and for that purpose amends the notification of the said Develpment Plan, sanctioned dated 21-7-1992 as follows :-
After the last entry in the Schedule of Modifications accompanying the Notification of the said sanctioned Development Plan, the following new entry shall be added :-
"Site No. 10 and Site No. 11 reserved as "Dispensary" and "Shoppingo Center" respectively in respect of S. No. 875 of Mouje Kalmeshwar, is lapsed Partly for the area contained in said notice from the above said reservation and the land so released from the reservations shall become available to the owners for the purpose of development as other- wise permissible of adjacent land under the relevant Plan."
Note :-(1) A copy of the Part Plan of the said Development Plan showing the aforesaid Modification shall be made available for inspection in the office of Kalmeshwar Municipal Council, Kalmeshwar during office hours on all working days.

ORDER

Whereas, the Revised Development Plan of Tumsar (hereinafter referred to as the "said Development Plan") under Section 31(1) of Maharashtra Regional and Town Planning Act, 1966 (hereinafter referred to as "the said Act") has been sanctioned by the Director of Town Planning, Maharashtra State, Pune vide its Notification No. DP-Tumsar (Revised)- TPV-ii-4961, dated 20-8-1992 has came into force w.e.f. 1-11-1992 ;

६ द्धन्रु]क्ष् रू न् ॅ-+ न् ह्यम््र ान्म््र, त्र्ॅाम्न््र १३-१९, २०२०/द्ध २४-३०, ॅ १९४१And whereas, in the said Development Plan, G. No. 1458(P), 1459 (P), 1460 (P), 1461 (P), 1464 (P), 1465 (P), 1466 (P) having Area of 1.80 hect. of Tumsar are reserved for Site No. 1 " Police Department " (hereinafter referred to as the "said reservation") for which Maharashtra State "Superintendent of Police, Bhandara" is the Appropriate Authority ;
And whereas, Adv. Krishna Motavani on behalf of the land owner Phulachand Budwaik and others has served a Notice u/s 127 of Maharashtra Regional and Town Planning Act, 1966 (hereinafter referred to as "the said Act") dated 29-5-2013 and dated 23-9-2013 upon Tumsar Municipal Council and the Appropriate Authority (i.e. Superintendent of Police, Bhandara) ;
And whereas, Superintendent of Police, Bhandara vide it's letter dated 31-5-2016 submitted the proposal for deletion of the said reservation on the said land under Section 50 of the said Act to this Directorate ;
And whereas, the Director of Town Planning, Maharashtra State, Pune vide Order No. D.T.P.-34-3217-D.P. Tumsar- Sec-127(2)-Order-TPV-2-1170, dt 8-3-2017 has notified about lapsing of said reservation (Partly) on the said lands G. No. 1458(P), 1459 (P), 1460 (P), 1461 (P), 1464 (P), 1465 (P), 1466 (P) area 1.06 Hect. Under Section 127(2) of the Maharashtra Regional & Town Planning Act, 1966 ;
And whereas, considering the request of Superintendent of Police, Bhandara (i.e. Appropriate Authority) vide letter dated 31-5-2016 it is in principle agreed to delete the reservation on remaining lands bearing G.No. 1458 (P), 1465 (P), and 1466 (P) under Section 50(2) of said Act and communicated to Tumsar Municipal Council, vide letter No. 1252 date 9-3-2017 to deposit the amount of 5% Premium to concern land owners as per the rate of concern lands in annual statement of rates to Bhandara branch office and Tumsar Municipal Council and to submit the copies of challans to the directorate ;
And whereas, the Chief Officer, Municipal Council, Tumsar and Town Planner, Bhandara Branch vide their letter dated 29-6-2019 and 24-7-2019 respectively communicated that as per the Government directives dated 20-4-2016, out of the said reservation the land owner Shri Umashankar Gopalkrishna Aggrawal of G. No. 1458 (Part) hav deposited Rs. 61,570 towards the 50% Government share of 5% premium amount of land value for an area 0.13 hectare, as per the rate prescribed in the Annual Statement of Rates (ASR) for the year 2019 in the Government Treasury on 28-5-2019 through the Town Planner, Bhandara Branch and remaining 50% of the 5% premium amount Rs. 61,570 payable to the Planning Authority, has been deposited ;
And whereas, the Government in Urban Development Department vide Resolution No. TPS-1813-3211-CR-508- UD-13, dated 1-12-2016 has delegated the powers exercisable by it under Section 50(2) of the said Act to the Director of Town Planning, Maharashtra State, Pune in respect of Development Plans of all Municipal Councils, Nagar Panchayat and for the Development Plans undertaken by Zilla Parishad as a Planning Authority.
And whereas, Tumsar Municipal Council is 'B' Class Municipal Council.
Now, therefore, the Director of Town Planning, Maharashtra State, Pune hereby sanctions the deletion of the said land from the said reservation (Partly) of "Police Department" Site No. 1 under Section 50(2) in respect of G. No. 1458 (Part) and for that purpose amends the Notification sanctioning the said Development Plan, dated 20-8-1992 as follows :-
After the last entry in the Schedule of Modifications accompanying the notification sanctioning the said Develop- ment Plan, the following new entry shall be added :-
"Out of Site No. 1, "Police Department" on the lands bearing G. No. 1458 (P), 1465 (P), 1466 (P) the area admeasuring 0.13 Hect. of land bearing G. No. 1458 (P) is deleted (Partly) from the reservation as shown on the sanctioned Development Plan of Tumsar.
The Modification is shown in Green colour on the part plan accompanying this Notification.
Note : The copy of the part plan of the said Development Plan showing the aforesaid deletion is available for inspection in the office of Tumsar Municipal Council during office hours on all working days.
