Whereas, the Government of Maharashtra Urban Development Department vide its Notification No. TPS- 2795-1267-C.R. 198-95-UD-13, Dated 26th May, 1998 has sanctioned the Revised Development Plan of "B" class Municipal Council, Pusad partly (hereinafter referred to as the "said Development Plan") under Section 31 (1) of the Maharashtra Regional & Town Planning Act, 1966 (Mah. XXXVII of 1966) (hereinafter referred to as "the said Act") and the same has come into force with effect from Dated 26th July, 1998;
And whereas, in the said Development Plan, the land from S. No. 63/1 (Old S. No. 124) of Mouza Pusad Khand 1, is reserved for 15.0 Mt. & 24.0 Mt. Wide Development Plan Roads (hereinafter referred to as "the said Roads"); for which Appropriate Authority is Municipal Council, Pusad (hereinafter referred to as "the said Appropriate Authority");
द्धन्रु]क्ष् रू न् ॅ-+ +द्धन्म््र ह्यम््र ान्म््र, त्र्ॅाम्न््र २७-द्ध ४, २०२० /त्र्ॅा ८-१४, ॅ १९४१ ३And whereas, the land under said Roads has not been acquired by the said Appropriate Authority within ten years from the date on which the said Development Plan came into force;
And whereas, the owners of 650.0 Sq. Mt. land from S. No. 63/1 (Old S. No. 124) Mouza Pusad Khand 1, had served a Notice under Section 127(1) of the said Act, on the Chief Officer, Municipal Council, Pusad vide their letter dated 9th February, 2009 (hereinafter referred to as "the said Notice");
And whereas, the said Appropriate Authority, has not acquired the land under the said Roads under Section 127(1) of the said Act, within a period of six months from the date of receipt of the said notice;
And whereas, the Hon'ble High Court Nagpur Bench in Writ Petition No. 7329 of 2017 filed by the owners of the said land has passed the order dated 8th July, 2019, that the proposal of said Roads to the extent of the said land have been lapsed under Section 127 of the said Act;
And whereas, in accordance with the provision of Section 127(1) of the said Act, the part of the said Roads, pertaining to the said land has lapsed and it is accordingly expedient to notify such lapsing under Section 127(2) of the said Act;
And whereas, the Government in Urban Development Department under Section 151 of the said Act, vide Resolution No. TPS-1813-3211-CR-508-UD-13, dated 1st December, 2016, has delegated the powers exercisable by it under Section 127(2) of the said Act, in respect of Development Plans of all Municipal Councils/Nagar Panchayat and for the Development Plans undertaken by Zilla Parishad as a Planning Authority, to the Director of Town Planning, Maharashtra State, Pune;
Now, therefore, in exercise of the powers delegated by the Government, in respect of sub-section (2) of Section 127 of the said Act and of all other powers enabling it in that behalf, the Director of Town Planning, Maharashtra State, Pune, hereby notifies that the said 15.0 Mt. & 24.0 Mt. wide Development Plan Roads in said Development Plan of Pusad is lapsed partly only in respect of said land (as specified in the schedule herein below) and the said land shall become available to the land owners for the purpose of Development as otherwise, permissible in the case of adjacent land, under the said Development Plan;
