ORDER

Whereas, the Development Plan of Bramhapuri Municipal Council has been partly Sanctioned under Section 31(1) of Maharashtra Regional and Town Planning Act, 1966 (hereinafter referred to as "the said Act") by the Government in Urban Development Department vide Notification No. TPS-2299-1001-CR-101-UD-9, dated 28-06- 2002 and came into force w.e.f. date 26-08-2002 (hereinafter referred to as "the said Development Plan"); and the Municipal Council, Bramhapuri is the Planning Authority for the said Development Plan (hereinafter referred to "as the said Planning Authority");
द्धन्रु]क्ष् रू न् ॅ-+ न् ह्यम््र ान्म््र, त्र्ॅाम्न््र २७-द्ध ४, २०२०/त्र्ॅा ८-१४, ॅ १९४१ ३And whereas, the Development Plan of Excluded part is Sanctioned by the Government in Urban Development Department vide Notification No. TPS-2299-1001-CR-101-Part-2-UD-9, dated 13-07-2005 and came into force w.e.f. dated 01-09-2005;
And whereas, in the said Development Plan, Site No. 64 is reserved for "Girls Hostel" having an area of 0.3620 Hectars and while sanctioning the Development Plan of Excluded area the southern part of the said reservation is deleted from reservation and included in Residential Zone, hence the area under reservation remains as 0.15 Hect. (hereinafter referred to as "the said Reservation") and "Social Welfare Officer" is the Appropriate Authority for the said reservation (hereinafter referred to as "the said Appropriate Authority"). The land bearing S. No. 72/3 admea- suring area 0.15 Hectars, out of these 743.65 m.2 area of the village Delhanwadi (hereinafter referred to as "the said land") is included under the said reservation;
And whereas, the land owner Shri Chandu Fakiraji Bhede on 06-11-2013 has given notice u/s 127 of the said Act to the said Appropriate Authority, regarding the said land under said reservation. The said Appropriate Authority vide its letter dated 21-03-2014 communicated to the said Planning Authority and the land owner that the said land is not required for the said purpose and therefore communicate to delete the reservation on the said land;
And whereas, the said Planning Authority vide its letter date 16-03-2016 communicated to the said Appropriate Authority to submit the proposal for the deletion of the said reservation on the said land as per the provisions of Section 50 of the said act;
And whereas, the said Appropriate Authority vide letter date 27-02-2017 has submitted to the State Govern- ment and Directorate of Town Planning, Maharashtra State, Pune the proposal under-Section 50 of the said act for deletion of the said land;
And, whereas, Planning Authority has clarified about their consent for deletion of reservation u/s 50 in the meeting dated 21-02-2019 and the said Appropriate Authority already on dated 27-02-2019 has submitted the proposal of deletion of the said reservation on the said land to the Government as per the provisions of Section 50 of the Maharashtra Regional and Town Planning Act 1966;
And whereas, as per the request of Planning Authority and Appropriate Authority and after making necessary enquiry it is now clear that the land under the said reservation is no longer required to Social Welfare Officer, Chandrapur and the Director of Town Planning, Maharashtra State, Pune is of the opinion that the said proposal of deletion of the said reservation should be sanctioned;
And whereas, the Town Planner, Chandrapur Branch vide their letter dated 09-08-2019 and applicant's letter date 03-07-2019 respectively communicated that, as per the Government directives dated 20-04-2016, the land owner of the said land under reservation Shri Chandu Fakiraji Bhede have deposited Rs. 34,125 towards the 50% Govern- ment share of 5% premium amount of land value for the area under reservation as per the rate prescribed in the Annual Statement of Rates (ASR) for the year 2019 in the Government Treasury on 28-06-2019 through the Town Planner, Chandrapur Branch and remaining 50% of the 5% premium amount Rs. 34,125 payable to the Planning Authority, has been deposited;
And whereas, the Government in Urban Development Department vide Resolution No. TPS-1813-3211-CR- 508-UD-13, dated 01-12-2016 has delegated the powers exercisable by it under Section 50(2) of the said Act to the Director of Town Planning, Maharashtra State, Pune in respect of Development Plans of all Municipal Councils/ Nagar Panchayat and for the development Plans undertaking by Zilla Parishad as a Planning Authority;
Now, therefore, the Director of Town Planning, Maharashtra State, Pune hereby sanctions the deletion the said reservation in respect of the land u/s. 50(2) of the said Act and for that purpose amends the notification of the said Development Plan, sanctioned dated 13-07-2005 as follows :–
After the last entry in the Schedule of Modifications accompanying the notification of the said sanctioned Development Plan, the following new entry shall be added :–

Publication of Draft Development Plant of Nagar Parishad Wadi U/s 26 of Maharashtra Regional and Town Planning Act, 1966, No. D.D.P. Wadi-Sec. 26 Publication-ADTP-NGP-282 Dt. 10-02-2020.
Whereas, in consonance with the resolution No. 16, Dt. 19-09-2016 passed by the General Body Nagar Parishad, Wadi, Dist. Nagpur has declared its intention to prepare the Development plan of Wadi Nagar Parishad, Dist. Nagpur in Maharashtra Govt. Gazette Part-1A Nagpur Divisional Supplement Dt. 18 April 2017 and Daily Newspaper Lokmat (Marathi) Dt. 27 April and Daily Newspaper Hitavad (English) Dt. 3 May 2017 in pursuance of the power conferred by sub-section (1) of Section 23 of the Maharashtra Regional and Town Planning Act, 1966.
And whereas, the Town Planning Office appointed under Section 24 of the Said Act, has prepared & submitted the existing Land use Map of Nagar Parishad, Wadi, Dist. Nagpur on Dt. 30 January 2018 & submitted Draft Development Plan of Nagar Parishad, Wadi on Dt. 20 February 2020.
And whereas, the General Body Nagar Parishad, Wadi, Dist. Nagpur vide resolution No. Dt. 20 February 2020 has approved the draft development plan of Wadi Nagar Parishad for publication under Section 26 of the said Act. .-ॅ-+-२ (१७९१).
६ द्धन्रु]क्ष् रू न् ॅ-+ न् ह्यम््र ान्म््र, त्र्ॅाम्न््र २७-द्ध ४, २०२०/त्र्ॅा ८-१४, ॅ १९४१Now, therefore, in exercise of the powers conferred under sub-section (1) of Section 26 of the said Act, and all other powers enabling in this behalf Nagar Parishad, Wadi hereby give notice that the draft development plan of Nagar Parishad, Wadi alongwith its report have been prepared and published under Section 26 of the said Act, for which objections or suggestions are invited from the public for a period of 60 (sixty) days from the Publication of this notice in the Official Gazette, the objection of suggestions shall reach to Chief Officer, Nagar Parishad, Wadi, Dist. Nagpur during office hours on all working days so as to consider the same before submitting the said plan to the Government for final sanction under Section 30 of the Maharashtra Regional and Town Planning Act, 1966.
Further, in pursuance of sub-section (1) of Section 26 of the said Act, copy of aforesaid draft development plan alongwith its report are available for inspection for public during office hours on all working days at the following offices, for a period of 60 (sixty) days from publication of this notice in the Maharashtra Government Gazette.

MODIFICATION UNDER SECTION 37 OF MAHARASHTRA REGIONAL AND TOWN PLANNING ACT, 1966.

Whereas, the Development Plan of Katol has been sanctioned by the Government of Maharashtra in Urban Development Department vide it's letter No. TPS-2406-3123-Case No. 133-07-UD-9, dated 04-11-2008 and it has came into force with effect from 15-12-2008.
Whereas, the Planning Authority i.e. Municipal Council, Katol has now decided to make areas modification in the aforesaid sanctioned Development Plan of Katol in respect of the purpose as per Municipal Resolution in follow- ing chart. This change will not change the character of the aforesaid sanctioned Development Plan of Katol.

And whereas, the Plan showing the proposed Modification is kept open in the Office of Municipal Council, Katol during office hours for inspection of public.
Therefore, under Section 37 of the Maharashtra Regional and Town Planning Act, 1966, it's hereby notified that any person having any objection or suggestion regarding the proposed modification may communicate the same in writing to the President, Municipal Council, Katol within a period of not more than one month from the date of publication of this Notice in the Maharashtra Government Gazette.
The objections shall be considered by the Planning Authority before submitting the proposal to the Government for sanction.
