ज्याअर्थी, महाराष्ट्र प्रादेशिक नियोजन आणि नगररचना अधिनियम १९६६ (महा. अधिनियम XXXVII, १९६६) (येथून पुढे उक्त अधिनियम असे निर्देशित करण्यात येईल), च्या कलम ४० च्या उपकलम (१) मधील खंड (ख) द्वारा प्रदान करण्यात आलेल्या अधिकारांचा वापर करून महाराष्ट्र शासनाने दिनांक १० जानेवारी, २०१३ रोजीच्या अधिसूचना क्रमांक टीपीएस-१७१२/४७५/प्र.क्र. ९८/१२/नवि-१२ अन्वये त्यात नमूद केल्याप्रमाणे नवी मुंबई विमानतळ प्रभाव अधिसूचित क्षेत्र (नैना), (येथून पुढे " उक्त अधिसूचित क्षेत्र " असे निर्देशित करण्यात येईल) साठी शहर आणि औद्योगिक विकास महामंडळ (महाराष्ट्र) मर्यादित (महाराष्ट्र शासनाच्या मालकीची व नियंत्रणाखालील कंपनी) (येथून पुढे " महामंडळ " असे निर्देशित करण्यात येईल) म्हणजे ' सिडको ' ची विशेष नियोजन प्राधिकरण (येथून पुढे " एस. पी. ए. " असे निर्देशित करण्यात येईल) म्हणून नेमणूक केली आहे.
आणि ज्याअर्थी, महाराष्ट्र शासनाने अधिसूचना क्रमांक टीपीएस-१८१५/अनौसं/७८/१५/नवि-१३, दि. १७ फेब्रुवारी, २०१६ व १८ मार्च २०१६ अन्वये महाराष्ट्र राज्य रस्ते विकास महामंडळाची (एम.एस.आर.डी.सी.) सदर अधिसूचनेमध्ये नमूद केलेल्या नैनातील काही गावांच्या क्षेत्रासह विशेष नियोजन प्राधिकरण म्हणून नियुक्ती केली. तसेच, नैनाच्या अंतिम विकास योजनेस दिनांक १६ सप्टेंबर २०१९ रोजी मंजुरी देताना शासनाने प्रकल्पाची संलग्नता विचारात घेता नैनामधून ४९ गावे वगळून सदर गावे एम.एस.आर.डी.सी. व ए.के.बी.एस.एन.ए. या विशेष नियोजन प्राधिकरणात समाविष्ट केली. त्यामुळे सिडको आता नैनातील १७५ गावांसाठी विशेष नियोजन प्राधिकरण म्हणून कार्यरत आहे. (येथून पुढे "सुधारित अधिसूचित क्षेत्र" असे निर्देशित करण्यात येईल) ;
आणि ज्याअर्थी, उक्त अधिनियमाच्या कलम २३ च्या उपकलम (१) अन्वये प्रदान करण्यात आलेल्या अधिकारांचा वापर करून महामंडळाने उक्त अधिसूचित क्षेत्राची विकास योजना तयार करण्याचा त्यांचा उद्देश घोषित केल्याची व नोटीस प्रसिद्ध केल्यापासून साठ दिवसांपेक्षा कमी नसेल एवढया कालावधीत जनतेकडून त्यावरील सूचना व आक्षेप मागविण्यासाठीची नोटीस महाराष्ट्र शासन राजपत्र भाग-२, गुरुवार ते शुक्रवार, दिनांक १५-२१ मे, २०१४ द्वारे प्रसिद्ध केली आहे.

भाग दोन--१७--१२ महाराष्ट्र शासन राजपत्र असाधारण भाग दोन, मार्च ४, २०२०/फाल्गुन १४, शके १९४१ आणि ज्याअर्थी, उक्त अधिसूचित क्षेत्राच्या विकास योजनेचा आराखडा तयार होईपयर्ंत महामंडळाने उक्त अधिनियमात नमूद तरतुदींचे पालन करून २३ गावांसाठी ' प्रारूप अंतरिम विकास योजना ' तयार व प्रसिद्ध करून महाराष्ट्र शासनास उक्त अधिनियमाच्या कलम ३० अन्वये दिनांक २२ सप्टेंबर २०१५ रोजी मंजुरीसाठी सादर केलेली आहे;
आणि ज्याअर्थी, महाराष्ट्र शासनाने अधिसूचना क्र. टीपीएस-१२१५/२४५/सीआर-३३२/२०१५/एस.एम./यूडी-१२, दिनांक २७ एप्रिल २०१७ नुसार नैनातील २३ गावांची अंतरिम विकास योजना मंजूर केली आहे. आणि अधिसूचना क्र. टीपीएस. १२१५/२४५/प्र.क्र.३३२/१६/ई.पी./ नवि-१२, दिनांक १ मार्च २०१९ अन्वये अधिनियमाच्या कलम ३१ च्या उपकलम (१) नुसार अंतरिम विकास योजनेचे वगळलेले भाग मंजूर केले आहेत;
आणि ज्याअर्थी, महामंडळाने उक्त अधिनियमाच्या कलम २६ च्या उपकलम (१) अन्वये नैनातील उर्वरित गावांसाठीची (अंतरिम विकास योजनेतील २३ गावे वगळता) विकास योजना दिनांक ७ नोव्हेंबर २०१६ रोजी प्रसिद्ध केली होती. नियोजन समितीने सादर केलेला अहवाल विचारात घेऊन महामंडळाच्या संचालक मंडळाच्या मान्यतेने सुधारित विकास योजना उक्त अधिनियमाच्या कलम ३० च्या उपकलम (१) अन्वये दिनांक २० सप्टेंबर २०१७ रोजी शासनास अंतिम मंजुरीसाठी सादर केली होती;
आणि ज्याअर्थी, शासनाने उक्त अधिनियमाच्या कलम ३१ च्या उपकलम (१) अन्वये नैनाच्या सुधारित अधिसूचित क्षेत्राच्या विकास योजनेस (अंतरिम विकास योजनेचा भाग वगळता) दिनांक १६ सप्टेंबर २०१९ रोजीच्या अधिसूचना क्र. टीपीएस. १७१७/स.क्र.२७५०/प्र.क्र.९१/२०१९/ नवि-१२ अन्वये मंजुरी दिलेली आहे;
आणि ज्याअर्थी, नैनाच्या अंतरिम विकास योजनेत सुधारणा करण्याची आवश्यकता विचारात घेता महामंडळाच्या संचालक मंडळाने दिनांक १६ जानेवारी २०२० च्या ठराव क्र. १२२७४ अन्वये उक्त अधिनियमाच्या कलम ३७ च्या उपकलम (१) अन्वये परिशिष्ट-१ मध्ये नमूद केल्याप्रमाणे नैनाच्या मंजूर अंतरिम विकास योजनेत फेरबदल करण्याच्या प्रस्तावास मान्यता दिलेली आहे;
म्हणून, आता महामंडळ उ अधिनियमाच्या कलम ३७ च्या उपकलम (१) अन्वये प्रदान करण्यात आलेल्या अधिकारांचा वापर करून नैनाच्या मंजूर अंतरिम विकास योजनेतील फेरबदलाच्या प्रस्तावाबाबत राजपत्रात नोटीस प्रसिद्ध झाल्याच्या दिनांकापासून एक महिन्यापेक्षा अधिक नसेल अशा कालावधीत कोणत्याही व्यक्तीकडून आक्षेप व सूचना मागविण्यासाठी ही नोटीस बजावत व प्रसिद्ध करत आहे. आक्षेप व सूचना मुख्य नियोजनकार (नैना) यांचे कार्यालय ७ वा मजला, टॉवर क्र. १०, बेलापूर रेल्वे स्थानक संकुल, सीबीडी बेलापूर, नवी मुंबई ४०० ६१४ येथे विर्िनदिष्ट कालावधीत पोहोचणे आवयक आहे.

FOR INVITING OBJECTIONS AND SUGGESTIONS WITH RESPECT TO THE PROPOSED MODIFICATION TO THE SANCTIONED
INTERIM DEVELOPMENT PLAN OF NAINA

Wheres, the Government of Maharashtra in exercise of powers conferred under clause (b) of sub-section (१) of the section ४० of the Maharashtra Regional and Town Planning Act, १९६६ (hereinafter referred to as the said Act ) declared by Notification, No. TPS -१७१२/४७५/CR-९८/१२/UD-१२, dated १०th January २०१३ (hereinafter referred to as the said Notification) City and Industrial Development Corporation of Maharashtra Limited (being a company owned and controlled by the Government of Maharashtra) (hereinafter referred to as the Corporation) as Special Planning Authority (hereinafter referred to as the SPA ) for Navi Mumbai Airport Influence Notified Area (NAINA). (hereinafter referred to as the notified area ) ;
And Whereas the Government of Maharashtra by its Notification No. TPS-१८१५/UOR/७८/१५/ UD-१३, dated १७th February २०१६ & १८th March २०१६ has appointed the Maharashtra State Road Development Corporation Limited (MSRDC) to be the Special Planning Authority for the area and villages mentioned therein including some villages of NAINA. Further, while according sanction to the Final Development plan of NAINA on १६th September २०१९, considering contiguity of the area, the Government has deleted ४९ villages from NAINA and included the same in MSRDC and AKBSNA. Thereby CIDCO is continued as SPA for NAINA for १७५ villages (hereinafter referred to as the revised notified area ) ;
AND WHEREAS, in pursuance of the provisions of sub-section (१) of the section २३ of the said Act, the Corporation published a notice declaring its intention to prepare Development Plan for the said notified area, and inviting objections or suggestions from the public within a period of not less than sixty days from the publication of the notice in the Maharashtra Government Gazette, Part-२, Thursday to Friday, dated १५-२१ May, २०१४;
AND WHEREAS, pending the preparation of draft Development plan for the said notified area, the Corporation after following due procedure stipulated in the said Act has prepared, published and submitted the modified Draft Interim Development Plan (IDP) for २३ villages to the Government for sanction on २२nd September २०१५ under section ३० of the said Act;
AND WHEREAS, the Government of Maharashtra vide Notification No. TPS-१२१५/२४५/CR-३३२/ २०१५/SM/UD-१२, dated २७th April २०१७ has sanctioned the Interim Development Plan (IDP) for the २३ villages of NAINA, and also vide Notification No. TPS. १२१५/२४५/C.R. ३३२/१६/EP/UD-१२, dated १st March २०१९ has sanctioned the Excluded Parts of the IDP under section ३१(१) of the said Act, AND WHEREAS, the Corporation has published the Draft Development Plan for balance villages under section २६(१) of the said Act (excluding the area of २३ villages of Interim Development Plan (IDP), on ७th November २०१६. After considering the report submitted by the Planning Committee, with due approval of Board of the Corporation, the Modified Draft Development Plan has been submitted to the Government for sanction on २०th September २०१७ under section ३०(१) of the said Act ;
AND WHEREAS, in accordance with sub-section (१) of section ३१ of the said Act, the State Government has sanctioned the Development Plan of revised notified area of NAINA (excluding the area of IDP) vide Notification No.TPS-१७१७/MIS २७५०/C.R.९१/२०१९/UD-१२, dated १६th September २०१९, AND WHEREAS, the Corporation found it expedient to make modification in IDP of NAINA and the Board vide Resolution No. १२२७४, dated १६th January २०२० approved the proposal of carrying out modification to the sanctioned Interim Development Plan of NAINA under section ३७ (१) as stated in the Schedule-ISchedule-ISchedule-ISchedule-ISchedule-I.
महाराष्ट्र शासन राजपत्र असाधारण भाग दोन, मार्च ४, २०२०/फाल्गुन १४, शके १९४१ ५Now, therefore, in exercise of the powers conferred by sub-section (१) of the section ३७ of the said Act, the Corporation hereby issues and publishes notice inviting objections and suggestions from any person with respect to the proposed modification to the sanctioned IDP of NAINA not later than one month from the date of the publication of this Notice in the Maharashtra Government Gazette. The objections and suggestions shall reach the office of Chief Planner NAINA, ७th Floor, Tower No. १०, Belapur Railway Station Complex, CBD Belapur, Navi Mumbai ४०० ६१४ within stipulated time.
