Notification u/s 20 (4) of Maharashtra Regional and Town Planning Act, 1966.—

Whereas, the Revised Regional Plan of Nagpur Region (hereinafter referred to as "the said Regional Plan") has been sanctioned by the Government vide Urban Development Department's Notification No. TPS-2496-1505-CR-273-96-UD-9, dated the 6th May, 2000 under Section 15 of the Maharashtra Regional and Town Planning Act, 1966 (Mah.XXXVII of 1966) (hereinafter referred to as "the said Act") and has came into force with effect from the 15th July, 2000;

Whereas, the Government vide Resolution No. TPS 1815-CR-49-15-UD-13, dated 6th May, 2015 has issued directives under Section 154 of the Maharashtra Regional and Town Planning Act, 1966 regarding the procedure to be followed under Section 20 of the said Act for making zone changes in the use of land in the areas of sanctioned Regional Plans under the said Act;

Whereas, the Government vide Resolution No. TPS 1815-CR-49-15-UD-13, dated 6th May, 2015 issued directives under Section 154 of the Maharashtra Regional and Town Plan- ning Act, 1966 regarding the procedure to be followed under Section 20 of the said Act for making changes in the use of land in the areas of sanctioned Regional Plans under the said Act and issued order to follow revised procedure related to above directives vide Government Resolution No. TPS 1815- C.No.-49-15-UD-13, dated 4th January, 2016; and in exercise of the powers conferred by sub-section (1) of Section 151 of the said Act, the Government vide is notification No. TPS 1815-CR-49-15-UD-13, dated 6th May, 2015, delegated the powers exercisable by it under४ द्धन्रु]क्ष् रू न् ॅ-+ न् ह्यम््र ान्म््र, द्ध ५-११, २०२०/त्र्ॅा १५-२१, ॅ १९४१ the provisions of Section 20 (3) & 20 (4) of the said Act, (subject to conditions mentioned therein) to the Divisional Joint Director of Town Planning for Nagpur Adiministrative Divi- sion;

And whereas, land admeasuring about 9.18 hectare bearing Kh. No. 143, 148, 149/2,149/1, 149/2, 149/3 & 152 of Mouja Ghoturli, Tal. Umred, District Nagpur (herein- after referred to as "the said area") was included in "Agriculture Zone" in the sanctioned Regional Plan of Nagpur.

And whereas, the "Proposal Scrutiny & Sanctioning committee" established under the above mentioned Government Resolution, is of the opinion that the said area should be deleted from "Agriculture Zone to Residential Zone" in accordance with the provision of sub-Section (2) of Section 20 of said Act subject to compliance of conditions ;

Conditions laid down in the above said Govenment Resolution; and payment of requi- site premium and,

As per Directives given by the Government of Maharashtra Urban Developement vide letter Dated 29-06-2017 in this connection;

And whereas, in pursuant to the above, a notice bearing No. R. P. Nagpur/Mouja Ghoturli/ Tal. Umred Kh. No. 148,149/2,143,152, 149/1 & 149/3 Section 20 (3) JDTP/1253 Dated 29-08-2017 regarding the proposed modification under sub-Section (3) of the Section 20 of the said Act, was published by Joint Director of Town Planning, Nagpur Division, Nagpur which appeared in the Maharashtra Government Official Gazette, Part-I-A Nagpur Division Supplement dated, 27th July to 02nd August, 2017 on Pages No. 3 and 4, for inviting suggestions and /or objections from the general public and the Assistant Director of Town Planning, Nagpur Branch, Nagpur, was appointed an 'Officer' (hereinafter referred to as the "said Officer") to hear suggestions and / or objections and submit his report to the undersigned;

And whereas, the said officer submitted its report and the "Proposal Scrutiny and sanctioning committee" is of the opinion that the said lands, should be deleted from "Agriculture Zone" and be included in "Residential Zone" subject to certain conditions;

And whereas, out of land bearing Survey No. 143, 148, 149/1, 149/2, 149/3 & 152 total area admeasuring 9.18 ha. which was included in Agriculture Zone of Proposed Land Use Map of sanctioned Regional plan of Nagpur region, partial land bearing Survey No. 143, 148, 149/2 & 152 area admeasuring 6.57 ha. was deleted from "Agriculture Zone and included in "Residential Zone" Section 20 (4)of Maharashtra Regional and Town Planning Act, 1966 vide Notification No. R. P. Nagpur Mouja Ghoturli, tal, Umred, Kh. No. 148, 149/ 2, 143 & 152 Section 20 (4) Part JDTP-04-2018, dated 2-1-2018;

And whereas, the owner of land b earing Kh. No. 149/1 & 149/3 Mouja Ghoturli, Tah. Umred, District Nagpur has deposited necessary permium and charges in the Government Treasury in this regard'

Now, therefore, in exercise of the powers under sub-section (4) of Section 20 of the said Act, delegated to him Joint Director of Town Planning, Ngapur Division, Nagpur hereby sanctions the proposed modification and for that purpose directs that in the Schedule of Modifications appended to the Notification dated the 6th May, 2000 sanctioning the said Regional Plan, after the last entry, the following new entry shall be added;

ENTRY

The allocation of land bearing Kh. No. 149/1 & 149/3 Mouja Ghoturli, Tah. Umred, District Nagpur area admeasuring 2.61 ha. changed from 'Agriculture Zone' to 'Residentialद्धन्रु]क्ष् रू न् ॅ-+ न् ह्यम््र ान्म््र, द्ध ५-११, २०२०/त्र्ॅा १५-२१, ॅ १९४१ ५ Zone' more specifically shown on Plan, subject to the following conditions :-

Condition No. 1. It shall be the responsibility of the concerned Land Owner /Developer to provide basic infrastructure and civic amenities, drinking water supply, sewerage network, roads, solid waste menagement, waste water treat- ment plan etc. in the said lands under modification.

Condition No. 2. The sale of plots / tenements shall be permissible as per the conditions given in undertaking in pursuance of aforesaid Government resolution dated 6-5-2015 and also all conditions mentioned in the said resolution as modified time to time, shall be binding.

If Group Housing Scheme is proposed in the layout then the occupancy certificate shall not be given unless civic amenities specified by the Collector are fully developed.

In case breach of any of the above conditions, layout approval and non agriculture permission shall be liable to be cancelled.

The copy part plan showing the above sanctioned modification shall be kept open for inspection by general public during office hours on all working days for a period of one month at the following offices ;

(1) The Collector, Nagpur.

(2) The Joint Director of Town Planning, Nagpur Division, Nagpur.

(3) The Assistant Director of Town Planning, Nagpur Branch, Nagpur.

Notification u/s 20 (4) of Maharashtra Regional and Town Planning Act, 1966.—

Whereas, the Revised Regional Plan of Nagpur Region (hereinafter referred to as "the said Regional Plan") has been sanctioned by the Government vide Urban Development Department's Notification No. TPS-2496-1505-CR-273-96-UD-9, dated the 6th May, 2000 under Section 15 of the Maharashtra Regional and Twon Planning Act, 1966 (Mah.XXXVII of 1966) (hereinafter referred to as "the said Act") and has came into force with effect from tha 15th July, 2000;

Whereas, the Government vide Resolution No. TPS 1815-CR-49-15-UD-13, dated 6th May, 2015 issued directives under Section 154 of the said Act, regarding the procedure to the followed under Section 20 of the said Act for making changes in the use of land in the areas of sanctioned Regional Plans under the said Act and issued order to follow revised procedure related to above directives vide Government Resolution No. TPS 1815-CR-49-15-UD-13, dated 4th January, 2016; and in exercise of the powers conferred by sub-section (1) of Section 151 of the said Act, the Government vide is notification No. TPS 1815-CR-49-15-UD-13, dated 6th May, 2015, delegated the powers exercisable by it under the provisions of Section 20 (3) & 20 (4) of the८ द्धन्रु]क्ष् रू न् ॅ-+ न् ह्यम््र ान्म््र, द्ध ५-११, २०२०/त्र्ॅा १५-२१, ॅ १९४१ said Act, (subject to conditions mentioned therein) to the Divisional Joint Director of Town Planning for Nagpur Adiministrative Division;

And whereas, land admeasuring about 12.53 hectare bearing Kh. No. 434/1,434/2 & 435 of Mouja Makardhokada, Tal. Umred, District Nagpur (hereinafter referred to as "the said area") was included in "Agriculture Zone" in the sanctioned Regional Plan of Nagpur.

And whereas, "Proposal Scurtiny & Sanctioning committee" established under the above mentioned Government Resolution, is of the opinion that the said area should be deleted from "Agriculture Zone to Residential Zone" in accordance with the provision of sub-Section (2) of Section 20 of said Act subject to compliance of conditions laid down in the above said Government Resolution and payment of requisite preminum ;

And whereas, in pursuant to the above, a notice bearing No. R. P. Nagpur/Mouja Makardhokada/ Tal. Umred Kh. No. 434/1,434/2 & 435 Section 20 (3) JDTP/1288 Dated 13-08-2018 regarding the proposed modification under sub-Section (3) of the Section 20 of the said Act, was published by Joint Director of Town Planning, Nagpur Division, Nagpur which appeared in the Maharashtra Government Official Gazette, Part-I-A Nagpur Division Supplement dated, 30th August to 05th September, 2018 on Pages No. 12 and 13, for inviting suggestions and /or objections from the general public and the Assistant Director of Town Planning, Nagpur Branch, Nagpur, was appointed an 'Officer' (hereinafter referred to as the "said Officer") to hear suggestions and / or objections and submit his report to the undersigned;

And whereas, no suggestions and/or objections are received within preseribed time limit as per the report submitted by the said Officer the "Proposal Scrutiny and Sanction- ing Committee" is of the opinion that the said lands, should be deleted from "Agriculture Zone" and be included in "Residential Zone" subject to certain conditions;

And whereas, the owner of land bearing Kh. No. 434/1,434/2 & 435 Mouja Makardhokada, Tah. Umred, District Nagpur has deposited necessary premium and charges in the Government Treasury in this regard;

Now, therefore, in exercise of the powers under sub-section (4) of Section 20 of the said Act, delegated to him Joint Director of Town Planning, Nagpur Division, Nagpur hereby sanctions the proposed modification and for that purpose directs that in the Schedule of Modifications appended to the Notification dated the 6th May, 2000 sanctioning the said Regional Plan, after the last entry, the following new entry shall be added;

ENTRY

The allocation of land bearing Kh. No. 434/1,434/2 & 435 Mouja Makardhokada, Tah. Umred, District Nagpur area admeasuring 12.53 ha. changed from 'Agriculture Zone' to 'Residential Zone' more specifically shown on Plan, subject to the following conditions :-

Condition No. 1. It shall be the responsibility of the concerned Land Owner /Developer to provide basic infrastructure and civic amenities, drinking water supply, sewerage network, roads, solid waste management, waste water treat- ment plan etc. in the said land under modification.

If Group Housing Scheme is proposed in the layout then the occupancy certificate shall not be given unless civic amenities specified by the Collector are fully developed.

Whereas, Development Plan of katol has been sanctioned by the Goverment of Maharashtra in Urban Development Department Vide it's letter No. TPS/ 2406/3123/Case No. 133/07/UD-9, Dated 04-11-2008 and it has came into Force with effect from 15-12-2008.

Whereas, the Planning Authority i.e. Municipal Council, Katol has now decided to make areas modification in the aforesaid sanctioned Development Plan of Katol in respect of the purpose as per Municipal Resolution in following chart.
