Whereas, the Development Plan of Umred Municipal Council has been Sanctioned under the Provisions of Section 31 (1) of Maharashtra Regional and Town Planning Act, 1966 (hereinafter referred to as " the said Act)" by the Government in Urban Development Department vide Notification No. TPS-2498-287-CR-25-98-UD-9, dated 8th July 2003 and came into force with effect from Dated 25th August 2003 (hereinafter referred to as " the said Development Plan "; and the Umred Municipal Council, Umred is the Planning Authority for said Development Plan (hereinafter referred to as " the said Planning Authority ");
द्धन्रु]क्ष् रू न् ॅ-+ न् ह्यम््र ान्म््र, द्ध १२-१८, २०२०/त्र्ॅा २२-२८, ॅ १९४१ ३And whereas, in the said Development Plan, out of 5600.00 Sq.mt. area of Khasra No./Survey No. 8 of Mauje Parsodi an area admeasuring 4800.00 Sq.mt. (hereinafter referred to as " the said land ") is reserved for Site No. 63, " Primary School ", (hereinafter referred to as " the said Reservation ") for which Umred Municipal Council, is the Appropriate Authority, for the said Reservation (hereinafter referred to as " the said Appropriate Authority ");
And whereas, the land under said reservation has not been acquired by the said Authority within ten years from the date on which the said Development Plan came into force ;
And whereas, the owners of the said land i.e. Shri Keshavrao Narayan Chichaghare has issued a notice dated 21st July 2015 under Section 127(1) of the said Act (hereinafter referred as " the said Notice ") on the said Authority;
And whereas, even after serving of the said notice as aforesaid, the said land has not acquired within a stipulated period from the date of service of the said notice under sub-section (1) of the Section 127 of the said act, by the said authority ;
And whereas, the owners of the said land has filed an Writ Petition No. 1343-2017 in Hon'ble High Court of Judicature at Bombay, Bench at Nagpur ;
And whereas, the Hon'ble High Court of Judicature at Bombay, Bench at Nagpur in its decision dated 1st August 2017, in Writ Petition No. 1343-2017 in this regard, has declared about lapsing of the said Reservation and that the said land has become available for the purpose of development as otherwise permissible in adjacent land ;
And whereas, Municipal Council vide its letter No. MCU-741-2018, Dt. 6th December 2018 has submitted the proposal for declaration about lapsing of Reservation in the notice under the provisions contained in Section 127(2) ;
And whereas, the Director of Town Planning, Maharashtra State, Pune is of the opinion that, it is necessary to issue the notification under Section 127(2) of the said act, regarding the Lapsing of the said Reservation on the said land ;
And whereas, the Government in Urban Development Department vide Resolution No. TPS-1813-3211-CR-508- UD-13, dated 1st December 2016 has delegated the powers exercisable by it under Section 127(2) of the said Act to the Director of Town Planning, Maharashtra State, Pune in respect of Development Plans of all Municipal Councils/Nagar Panchayats and for the Development Plans undertaken by Zilla Parishad as a Planning Authority ;
Now therefore, the Director of Town Planning, Maharashtra State, Pune hereby notify the lapsing of the said Reservation in respect of the said land u/s. 127(2) of the said Act and for that purpose amends the notification of the said Development Plan, sanctioned dated 8th July 2003 as follows :–
After the last entry in the Schedule of Modification accompanying the nodification of the said Sanctioned Develop- ment plan, the following new entry shall be added.–
" The reservation Site No. 63 "Primary School " in respect of land bearing S. No. 8 of Mauje Parsodi, is lapsed from the above said reservation and the land so released from the reservation shall become available to the owner for the purpose of development as otherwise permissible of adjacent land under the relevant Plan."
Note : (1) A Copy of the Part Plan of the said Development Plan showing the aforesaid Modification shall be made available for inspection in the office of Umred Municipal Council, Umred during office hours on all working days.
(2) This Notification shall also be published on the Directorate website www.dtp.maharashtra.gov.in.

Publication of Draft Development Plan of Hingna Nagar Panchayat U/s. 26(1) of

Whereas, Government of Maharashtra, Urban Development Department vide Notification No. TPS-1899-1991- C.R.80-98-99-UD-13, dated 23-07-1999 constituted Nagpur Metropolitan Area and vide Notification No. TPS-2409- 2890-C.R.-336-09-UD-9, dated 31-08-2010 appointed Nagpur Improvement Trust as Special Planning Authority for said area. Revenue Area of Mauza Hingna, Ta. Hingna, Distt. Nagpur was included in above said Metropolitan Area ;
And whereas, Government of Maharashtra vide Notification No. NMRDA-3316-CR-55-UD-7, dated 04-03-2017 appointed Nagpur Metropolitan Region Development Authority as Development Authority for above area. The Develop- ment Plan of said Metropolitan Area was sanctioned by Government vide Notification No. TPS-2416-C.R.-22A-2016- UD-9, dated 05-01-2018 ;
And whereas, Government of Maharashtra vide Notification No. MUN-2014-C.R.-98-UD-18, dated 19-03-2015 included the area of revenue village of Mouza Hingna in Nagar Panchayat, Hingna. The said revenue area of newly formed Hingna Nagar Panchayat was excluded from above said Development Plan of Metropolitan Area, by Modification No. SM-10 of Excluded Part of above Development Plan ;
And whereas, Planning Authority, Nagar Panchayat, Hingna vide Resolution No. 7, dated 20-02-2017 declares the intention u/s 23(1) alongwith Section 21(2) of Maharashtra Regional & Town Planning Act, 1966 to prepare the Development Plan of area included in Hingna Nagar Panchayat boundary. And it was published in Government Gazette Part-1A, Nagpur Division, Nagpur, on dated 18-24 May, 2017 and daily newspaper " Lokmat " (Marathi) and " Lokmat Times" (English) on dated 10-05-2017 ;

And whereas, the General Body of Nagar Panchayat, Hingna vide Resolution No.1, date 17-02-2020 has approved the Draft Development Plan with few modifications alongwith its report for publication under Section 26(1) of the above said Act.
Now, therefore, in exercise of the powers conferred under sub-section (1) of Section 26 of the above said Act and of all other powers enabling in this behalf, Nagar Panchayat, Hingna hereby give notice that the Draft Development Plan of Nagar Panchayat, Hingna alongwith its report have been prepared and published under Section 26(1) of the above said Act, for which objections/suggestions are invited from the public for a period of thirty (30) days from the publication of this notice in the Official Gazette. The objections/suggestions shall be submitted to the Chief Officer, Nagar Panchayat, Hingna, Ta. Hingna, Distt. Nagpur in office hours on all working days so as to consider before submitting the Draft Development Plan to the Government for final sanction u/s 30 of the Maharashtra Regional & Town Planning Act, 1966.
