MAHARASHTRA CONTROL OF ORGANISED CRIME ACT , 1999 .
No. SPC 1320/C.R . 36/D - IX .-In exercise of the powers conferred by: - Sub- section ( 1 ) read with sub- section ( 3) of section 5 of the Maharashtra Control of Organized Crime Act , 1999 ( Mah . XXX of 1999 ) (MCOCA for short ) ;
AND
TERRORIST AND DISRUPTIVE ACTIVITIES ( PREVENTION) ACT , 1987 .
Sub- section ( 1 ) read with sub- section ( 4) of section 9 of the Terrorist and Disruptive Activities (Prevention ) Act , 1987 (XXVIII of 1987) (TADA for short ) ;
AND
THEPREVENTION OF TERRORISM ACT , 2002
Sub - section ( 1 ) read with sub- section ( 4) of section 23 of the Prevention of Terrorism Act , 2002 ( XV of 2002 ) ( POTA for short ) ;
AND
NATIONAL INVESTIGATION AGENCY ACT , 2008
Whereas the Central Government and the State Government are empowered under sub - section ( 1) of section 11 and under sub- section ( 1) of section 22 respectively , of the National Investigation Agency Act, 2008 ( Act 34 of 2008 ) ( in short NIA Act ) to constitute one or more Special Courts for the trial of offences under any or all the enactments specified in the Schedule ;

AND
Whereas , the provisions of section 22 ( 2) ( 1) of the NIA Act provides that the references to " Central Government " in Sections 11 and 15 shall be construed as reference to the " State Government " ;
The Government of Maharashtra with the concurrence of the Chief Justice of Bombay High Court , hereby constitutes the Court , presided over by Shri . P. R. Sitre , Judge , City Civil Court and Additional Sessions Judge , Mumbai , in place of Shri . V. S. Padalkar, Judge , City Civil Court and Additional Sessions Judge, Mumbai as a Special Court , for trial of Malegaon Bomb Blast cases under MCOCA/TADA/ POTA and the cases under sections 11 ( 1 ) and 22 ( 1 ) of the NIA Act , 2008 including the offences investigated by ATS within the jurisdiction of Greater Mumbai .
