MAHARASHTRA REGIONAL AND TOWN PLANNING ACT, 1966.
No. D. T. P.-D.P. Murtijapur (R)-Sec-127(2)-Notification-TPV-VI-1131-2020.—
Whereas, the Director of Town Planning, Maharashtra State, Pune vide his Notification No. D.P. Murtijapur (R.)-TPV-6-2434, Dated 30th March 1988 has sanctioned the Revised Development Plan of of "C" Class Municipal Council, Murtijapur (hereinafter referred to as the "said Development Plan") under Section 31(1) of the Maharashtra Regional and Town Planning Act, 1966 (Mah.XXXVII of 1966) (hereinaf- ter referred to as "the said Act") and the same has come into force with effect from Date 1st July 1989 ;
And whereas, in the said Development Plan, the land admeasuring 0.65 Ha. from S. No. 21/1 of Mouza Murtijapur, is reserved for Site No. 35 Primary School (hereinafter referred to as "the said Reser- vation") ; for which Appropriate Authority is Municipal Council, Murtijapur (hereinafter referred to as "the said Approriate Authority") ;
And whereas, the land under said reservation has not been acquired by the said Appropriate Authority within ten years from the date on which the said Development Plan came into force ;
And whereas, the owners of 0.71 Ha. land from S. No. 21/1 of Mouza Murtijapur, has served a Notice Under Section 127(1) of the said Act, on the Chief Officer, Municipal Coucils, Murtijapur vide his letter dated 4-4-2000 (hereinafter referred to as "the said Notice");
द्धन्रु]क्ष् रू न् ॅ-+ +द्धन्म््र ह्यम््र ान्म््र, द्ध २६-ह्य १, २०२० / ६-१२, ॅ १९४२ ३And whereas, the said Appropriate Authority, has not acquired the land under the said reservation under Section 127(1) of the said Act, within a period of six months from the date of receipt of the said notice;
And whereas, the Hon'ble High Court Nagpur Bench in Writ Petition No. 2494 of 2019 filed by the owner of the said land has passed the order dated 5th September 2019, that the said reservation have been lapsed to the extent of 1804 Sq.Mt. Under Section 127 of the Said Act ;
And whereas, in accordance with the provision of Section 127(1) of the said Act, the reservation, pertaining to the said land has lapsed and it is accordingly expedient to notify such lapsing under Sec- tion 127(2) of the said Act ;
And whereas, the Government in Urban Development Department under Section 151 of the said Act, vide Resolution No. TPS-1813-3211-CR-508-UD-13, dated 1st December 2016, has delegated the powers exercisable by it under Section 127(2) of the said Act, in respect of Development Plans of all Municipal Councils/Nagar Panchayat and for the development plans undertaken by Zilla Parishad as a Planning Authority, to the Director of Town Planning, Maharashtra State, Pune ;
Now, therefore, in exercise of the powers delegated by the Government, in respect of Sub-section (2) of Section 127 of the said Act and of all other powers enabling it in that behalf, the Director of Town Planning, Maharashtra State, Pune, hereby notifies that the said reservation of Site No. 35 Primary School in said Development PLan of Murtijapur is lapsed partly only in respect of said land (as specified in the schedule herein below) and the said land shall become available to the land owner for the purpose of Development Plan ;
