आणि ज्याअर्थी, राज्यात मंजूर असलेल्या प्रादेशिक योजनांमध्ये उक्त अधिनियमाचे कलम २० अन्वये वेळोवेळी कराव्या लागणाऱ्या जमीन वापराच्या फेरबदलासंदर्भाने करावयाच्या कार्यपद्धतीबाबत उक्त अधिनियमाचे कलम १५४ अन्वये शासन निर्णय क्रमांक टीपीएस-१८१५ /प्र. क्र. ४९ / १५ / नवि-१३ , दिनांक ६ मे २०१५ व दिनांक ४ जानेवारी २०१६ अन्वये शासनाने निर्देश दिलेले आहेत ( यापुढे ज्यास " उक्त शासन निर्णय" असे संबोधिले आहे ) व त्या अनुषंगाने शासनाने " प्रस्ताव छाननी समिती " गठित केली आहे ;

आणि ज्याअर्थी , उक्त अधिनियमाचे कलम २० , पोट- कलम (२) मधील तरतुदींनुसार उक्त जमिनी " ना - विकास विभागातून" वगळून , खालील अटींच्या अधीन राहून , " रहिवास विभागात " समाविष्ट करण्याचे प्रस्तावित असून त्याअनुषंगाने उक्त प्रादेशिक योजना सुधारित करणे आवश्यक आहे (यापुढे ज्यास " उक्त फेरबदल " असे संबोधिले आहे ) असे उक्त शासन निर्णयान्वये गठित " प्रस्ताव छाननी समितीचे" मत झाले आहे.

(१) शासनाच्या दिनांक ४ जानेवारी २०१६ च्या निर्णयात नमूद तरतुदींनुसार अधिमूल्य रक्कम भरणे बंधनकारक राहील.

(२) उक्त शासन निर्णयात व त्यासोबतच्या सहपत्रात नमूद केलेल्या मार्गदर्शक सूचनांनुसार, सदर जमिनींचा विकास करणे बंधनकारक राहील .

(३) सदरची परवानगी म्हणजे मालकीहक्काबाबत प्रमाणीकरण नाही. फेरबदल प्रस्तावाखालील जमिनींच्या मालकीहक्काबाबत सर्वस्वी अर्जदार यांची जबाबदारी राहील .

(४) विषयांकित जमिनींमध्ये विकसन करण्यापूर्वी सदर जमिनी वनसंज्ञेमध्ये येत नाहीत, याबाबत वन विभागाकडून ' ना हरकत दाखला' घेणे आवश्यक राहील .

वि (एच) ११

(१) २

महाराष्ट्र शासन राजपत्र, भाग एक- नाशिक विभागीय पुरवणी, गुरुवार ते बुधवार , एप्रिल २८ , २०२० / चैत्र १३ १९ , शके १ ९४२ (५ ) विषयाधीन जमिनींचे विकसन करताना १५ टक्के क्षेत्र " सार्वजनिक सुविधांसाठी " प्रस्तावित करणे आवश्यक आहे .

(६ ) विषयाधीन जमिनींचे विकसन करताना व विकासपश्चात तेथील पाणीपुरवठा, सांडपाणी व्यवस्था , घनकचरा विल्हेवाट / व्यवस्थापन यांकरिता योग्य ती स्वयंपूर्ण व्यवस्था अर्जदार यांनी करणे आवश्यक राहील .

(७) Rainwater Harvesting , Water Recycling ( पाण्याचा पुनर्वापर) व Solar Energy अशा स्वरूपाच्या संकल्पना सदर जमिनींचे विकसन करताना अंमलात आणण्यात याव्यात .

(८) विषयाधीन जमिनींवर अर्जदार / विकसनकर्ते यांनी विकसन करताना प्रती हेक्टरी २५० वृक्ष लावणे बंधनकारक राहील . तसेच विकसित रेखांकनातील भूखंडधारकाने भूखंडात ५ वृक्ष लावणे बंधनकारक राहील. सदरची बाब विकसनास अंतिम मंजुरी देताना पडताळणी करण्यात यावी .

जागेत बांधकाम करणेपूर्वी सार्वजनिक बांधकाम विभागाची परवानगी घेणे तसेच त्यांच्या अटींचे पालन करणे बंधनकारक राहील. (९)

(१० ) जलसंपदा विभागाकडून प्राप्त होणाऱ्या पत्रातील अटी शर्ती अर्जदार यांचेवर बंधनकारक राहतील .

(११ ) जर अभिन्यासात समूह गृहबांधणी योजना विकसित करावयाची असेल , तर जागेत सर्व मूलभूत सुविधा विकसित झाल्याशिवाय भोगवटा प्रमाणपत्र देण्यात येणार नाही .

( १२ ) सदर जमिनींवरील अभिन्यासातील भूखंड / सदनिका यांची विक्री खालील तक्त्यानुसार करणे बंधनकारक राहील .

तक्ता

अभिन्यासातील भूखंड / सदनिका यांची सुविधांच्या विकसनाची सांगड

एकूण २५ टक्के भूखंड / सदनिका विक्री अनुज्ञेय राहील.

(अ ) अभिन्यास अंतिमतः मंजूर झाल्यावर

एकूण ५० टक्के भूखंड / सदनिका विक्री अनुज्ञेय राहील.

(ब) सुमारे ४० टक्के मूलभूत सुविधा पूर्ण झाल्यावर

एकूण ७५ टक्के भूखंड / सदनिका विक्री अनुज्ञेय राहील .

(क) सुमारे ६० टक्के मूलभूत सुविधा पूर्ण झाल्यावर

एकूण ९ ० टक्के भूखंड / सदनिका विक्री अनुज्ञेय राहील.

(ड) सुमारे ८० टक्के मूलभूत सुविधा पूर्ण झाल्यावर

एकूण १०० टक्के भूखंड / सदनिका विक्री अनुज्ञेय राहील.

(इ) सुमारे १०० टक्के मूलभूत सुविधा पूर्ण झाल्यावर

(१३ ) फेरबदल प्रस्तावाखालील जागेपासून पश्चिमेकडील गिरणा नदीपर्यंत जाण्यासाठी पुरेशा रुंदीचा रस्ता प्रस्तावित करणे आवश्यक राहील.

(१४) सदर क्षेत्र गिरणा नदीच्या तीरावर असल्याने जलसंपदा विभागाच्या अभिप्रायात नमूद भविष्यात पूर रेषा निश्चित झाल्यानंतर त्या अनुषंगाने नियमानुसार विकास परवानगी अनुज्ञेय होईल.

(१५ ) १: ५ पेक्षा जास्त तीव्र उतारावर विकसन अनुज्ञेय राहणार नाही.

आणि ज्याअर्थी , शासनाने उक्त अधिनियमाचे कलम १५१ , पोट- कलम ( १) अन्वये शासन निर्णय क्रमांक टीपीएस-१८१५/प्र. क्र. ४९/१५/ नवि-१३ , दिनांक ११ जून २०१५ नुसार कलम २० (२) , २० (३) व २० ( ४) खालील अधिकार विभागीय सहसंचालक, नगररचना यांना प्रदान केलेले आहेत ;

आणि त्याअर्थी, याबाबतीत शासनाने प्रदान केलेल्या अधिकारांनुसार उक्त अधिनियमाच्या कलम २० चे पोट- कलम (३) अन्वये सहसंचालक, नगररचना, नाशिक विभाग , नाशिक उक्त प्रादेशिक योजनेत उक्त फेरबदल करण्याचा हेतू या सूचनेद्वारे घोषित करीत आहे आणि त्याकरिता उक्त प्रस्तावित फेरबदलांच्या अनुषंगाने नागरिकांकडून हरकती व सूचना , ही सूचना महाराष्ट्र शासन राजपत्रात प्रसिद्ध झाल्याच्या तारखेपासून ३० दिवसांच्या मुदतीत लेखी स्वरूपात मागविण्यात येत आहेत .

हरकती / सूचना सहायक संचालक, नगररचना, जळगाव शाखा , जुने बी. जे . मार्केट, डी. हॉल , जळगाव यांच्या कार्यालयाकडे पाठवाव्यात. उक्त प्रस्तावित फेरबदल दर्शविणारा नकाशा नागरिकांच्या अवलोकनार्थ त्यांचे कार्यालयात कार्यालयीन वेळेत उपलब्ध आहे. प्रस्तुत फेरबदलाबाबत विहित मुदतीत प्राप्त होणाऱ्या सूचना/ हरकतींवर सुनावणी देण्यासाठी व त्यावरील अहवाल सादर करण्यासाठी सहायक संचालक, नगररचना, जळगाव यांना " अधिकारी " म्हणून प्राधिकृत करण्यात येत आहे. " अधिकारी " यांनी वैधानिक कार्यवाही पूर्ण करून त्यांचा अहवाल सदस्य- सचिव यांचेकडे सादर करावा .

The Maharashtra Regional and Town Planning Act, 1966

Notice

No. NKDN / P.S.C. / R.P. Jalgaon- Bhusawal / Section 20 ( 3) /Mouje Savkheda Bk . , taluka Jalgaon / Gat No. 28 and Other/351 / 2020.- Whereas , the Government has sanctioned the Regional Plan for Jalgaon district on dated 12th November 1991 ( hereinafter referred to as " the said Regional Plan " ) under the provisions of the Maharashtra Regional and Town Planning Act , 1966 ( hereinafter referred to as " the said Act" ) and has came into force with effect from 1st February 1992 and whereas , in the said Regional Plan , the land admeasuring about 18.18 hectares bearing Gat No. 28 , 30 , 31 , 33 ( Pt. ) , 34 , 35 ( Pt . ) , 36/2 , Mouze Savkheda Bk. , taluka - district Jalgaon ( hereinafter referred to as " the said land ") is included in " Agriculture Zone";

and whereas , the Government vide Resolution No. TPS - 1815/CR - 49 / 15 / UD - 13 , dated 6th May 2015 and dated 4th January 2016 ( hereinafter referred to as " the said Government Resolution " ) has issued the directives under Section 154 of the said Act , regarding the procedure to be followed under Section 20 of the said Act , for making changes in the use of land in the areas of Sanctioned Regional Plans , and for that purpose constituted " Proposal Scrutiny Committee" ;

and whereas , the " Proposal Scrutiny Committee " constituted under the said Government Resolution, is of the opinion that the said land shall be deleted from " No Development Zone " and proposed to be included in " Residential Zone " , and accordingly, it is necessary to modify the said Regional Plan ( hereinafter referred to as " the said Modification " ) in accordance with the provisions of sub - section (2) of Section 20 of the said Act , subject to the following conditions .

(1) It shall be binding to deposit the premium amount as mentioned in Government Resolution , dated 4th January 2016 .

(2) It shall be binding to develop the said land as per the guidelines mentioned in said Government Resolution and Annexure with it .

(3) This permission does not confirm ownership of the said land . The Applicant will be completely responsible regarding any issue about ownership of the said land.

(4) It shall be binding to get " No Objection Certificate " from the Forest Department prior to development of the said land .

(5) While developing the said land it shall be binding to provide 15 per cent Amenity Space .

(6) Applicant / Developer shall make necessary self- contained arrangements to provide Water Supply, Waste Water Treatment , Solid Waste Disposal / Management while developing the said land and after development of the said land at his own cost .

(7) It shall be necessary to develop the concept like Rainwater Harvesting , Water Recycling and SolarEnergy while developing the said land .

(8) It shall be binding to Applicant / Developer to plant 250 trees per hectare , while developing the land and plot holder of sanctioned layout to plant 5 trees per plot. This shall be verified at the time of final sanction to development .

(9) It shall be binding to obtain permission from Public Works Department before construction in the said land and to follow their conditions .

(11 ) If the Group Housing Scheme is proposed in the layout then , Occupancy Certificate shall not be issued unless all basic amenities are fully developed in the said land;

(12) It shall be binding to sale layout Plots / Flats of the said land as per table given below.

Sale of 25 per cent of the total Plots / Flats shall be permissible .

Sale of 50 per cent of the total Plots / Flats shall be permissible .

(b) After approximate 40 per cent development of basic infrastructure.

Sale of 75 per cent of the total Plots / Flats shall be permissible .

Sale of 90 per cent of the total Plots / Flats shall be permissible .

(d) After approximate 80 per cent development of basic infrastructure.

Sale of 100 per cent of the total Plots / Flats shall be permissible .

(e) After approximate 100 per cent development of basic infrastructure .

(13) A road of reasonable width on the west side has to be provided from land under reference upto the Girna River.

(14) As mentioned in the report of Irrigation Department , development permission in this land will be alllowed as per the flood line marked by the said Department in future.

(15) Development will not be allowe on the slope more than 1: 5 .

and whereas , as per the provision of sub - section ( 1) of Section 151 of the said Act , Government vide Notification No. TPS - 1815/CR - 49 / 15 /UD - 13 , dated 11th June 2015 has delegated the powers under Sections 20 (2), 20 (3) and 20 (4) of the said Act to the concerned Joint Director of Town Planning .

Now, therefore, in exercise of the powers delegated by the Government in this regard , as per Section 20(3) of the said Act , the Joint Director of Town Planning , Nashik Division , Nashik by this Notice declares intention to make the said Modification in the said Regional Plan and for the proposed said Modification invites suggestions / objections from the public in writing within 30 days from the date of publication of this Notice in the Maharashtra Government Gazette .

The suggestions / objections shall be addressed to the Assistant Director of Town Planning , Jalgaon Branch , Old B. J. Market , D Hall , Jalgaon . The plan showing the proposed said Modification is kept open for inspection to the public during office hours in their office . Regarding the proposed said Modification , Assistant Director of Town Planning , Jalgaon Branch , Jalgaon is appointed as the " Officer " to hear the suggestions / objections received within the stipulated period and after following legal procedure , the "Officer" shall submit the Report thereon to the Member- Secretary.
