आनंद विवाह अधिनियम, १९०९

क्रमांक : विनोंका-२०१२/प्र.क्र.३८७/कुटुंब कल्याण.------आनंद विवाह अधिनियम, १९०९ (१९०९ चा ७) यांच्या कलम ६ (१) द्वारे प्रदान केलेल्या अधिकारांचा वापर करून, महाराष्ट्र शासन, आनंद विवाह नोंदणीसंदर्भात तरतूद करण्यासाठी याद्वारे पुढील नियम करीत आहे, ते असे :---

१. संक्षिप्त नाव व प्रारंभ.----

(१) या नियमांस महाराष्ट्र आनंद विवाह नोंदणी नियम, २०२० असे म्हणावे.

२. व्याख्या.----या नियमांना, संदर्भानुसार दुसरा अर्थ अपेक्षित नसेल तर,

(क) "अधिनियम" याचा अर्थ, आनंद विवाह अधिनियम, १९०९ (१९०९ चा VII) आहे.

(ख) "आनंद विवाह" याचा अर्थ, अधिनियमांतर्गत यथाविधी सामान्यत: आनंद करज म्हणून केलेला आनंद विवाह, असा आहे.

(ग) "जिल्हा निबंधक" याचा अर्थ, नोंदणी कायदा, १९०८ (१९०८ चा १६) नुसार जिल्ह्यंसाठी नियु केलेला सह जिल्हा निबंधक, असा आहे.

(घ) "प्रपत्र" याचा अर्थ, या नियमांना जोडलेले प्रपत्र, असा आहे.

(च) "नोंदवही" याचा अर्थ, विवाह निंबंधकाने आनंद विवाहाची नोंद करण्यासाठी ठेवलेली नोंदवही, असा आहे.

(छ) "निबंधक" याचा अर्थ, कायद्याच्या कलम ६ (१) नुसार राजपत्रात प्रसिद्ध केलेल्या अधिसूचनेनुसार राज्य शासनाचा अधिकारी किंवा राज्य शासनाने प्राधिकृत केलेला स्थानिक प्राधिकारी, असा आहे.

३. अधिकारिता.-----

आनंद विवाहाची नोंदणी ज्याच्या कार्यक्षेत्रात विधीवत आनंद विवाह संपन्न होईल त्या संबंधित निबंधकाकडे नोंदविण्यात येईल.

४. आनंद विवाह नोंदवही ठेवणे.----

(१) निबंधक, प्रपत्र-एक मध्ये आनंद विवाह नोंदवही जतन करेल.

(२) अधिनियमातील कलम ६ (२) नुसार निबंधक, अर्जदाराच्या मागणीनुसार विवाह नोंदवहीतील प्रमाणित प्रती उपलब्ध करून देईल. प्रत्येक प्रमाणित प्रतीसाठी प्रती पान रू. २ इतके शुल्क आकारले जाईल.

५. नोंदणीची कार्यपध्दती.-----

(१) आनंद विवाह विधीसंपन्न झाल्याच्या दिनांकापासून तीस दिवसाच्या कालावधीत संबंधित पक्षकार नोंदणी शुल्क रु. ५० व विवाह झाल्याच्या पृष्ठयर्थ दस्तऐवजांसह विवाह नोंद करण्यासाठी प्रपत्र-दोन मध्ये दोन प्रतीत निबंधकांकडे ज्ञापन सादर करतील :

परंतु, या नियमांच्या प्रारंभपूर्वी विधिसंपन्न केलेल्या विवाहांच्या नोंदणीसाठी, असे ज्ञापन हे रु. २०० नोंदणी शुल्क आणि प्रपत्र-तीन सह नियम लागू झाल्याच्या दिनांकापासून एक वर्षाच्या कालावधीत सादर केले जाईल.

(२) ज्ञापन, आनंद विवाह करणाया संबंधित दोन्ही पक्षकार आणि या विवाहाचे किमान दोन साक्षीदार यांचे स्वाक्षरीने करण्यात येईल.

(३) पोटनियम (१) अन्वये विर्िनदिष्ट केलेल्या कालावधीमध्ये ज्या आनंद विवाहाची नोंद झाली नाही, अशा विवाहाचे संबधित पक्षकार प्रपत्र-दोन आणि प्रपत्र-तीन मधील प्रतिज्ञापत्रासह आनंद विवाह झाल्याच्या पृष्ठयर्थ आवश्यक दस्तऐवजाच्या पुराव्यासह व दोनशे रुपये इतके नोंदणी शुल्कासह संबंधित निबंधकांकडे ज्ञापन सादर करून नोंदणी करतील.

परंतु, असे प्रतिज्ञापत्र हे संसद सदस्य किंवा विधानसभा सदस्य किंवा स्थानिक स्वराज्य संस्थेच्या सदस्य किंवा राजपत्रित अधिकारी अथवा नोटरी यांच्याकडून साक्षांकित करण्यात येईल.

६. पडताळणी व विवाह नोंदणी.-----

(१) नियम ५ पोटनियम (१) किंवा पोटनियम (३) अन्वये प्राप्त ज्ञापन व दस्तऐवजांच्या पडताळणी व छाननीअंती आनंद विवाह विधीपूर्वक झालेला आहे अशी निबंधकांना खात्री होताच, तो नोंदवहीत विवाहाचा तपशील नोंदवेल आणि प्रपत्र-चार मध्ये आनंद विवाहाचे प्रमाणपत्र देईल.

(२) जेव्हा निबंधकाला,

(क) संबंधित पक्षकारांचा विवाह आनंद विवाह विधी अनुसार पार पडलेला नाही, किंवा

(ख) पक्षकारांच्या ओळखीबाबत अथवा आनंद विवाह संपन्न झाल्याची साक्ष देणाया संबंधित साक्षीदारांची ओळख सिद्ध झालेली नाही, अथवा

(ग) पुरविण्यात आलेल्या दस्तऐवजावरून संबंधित पक्षकारांची विवाहित स्थिती सिध्द होत नाहीत, असे मानण्यास कारणे असतील तर तो निवेदन मिळाल्याच्या दिनांकापासून तीस दिवसांच्या कालावधीत त्याला सादर केलेल्या माहितीचा अचूकपणा सिध्द करण्यासाठी किंवा संबंधित पक्षकार व साक्षीदारांची ओळख सिध्द करण्यासाठी, त्याला आवश्यक वाटेल, अशी अधिक माहिती किंवा कागदपत्रे देण्यास संबंधित पक्षकारांना निर्देशित करेल.

७. आनंद विवाहाच्या नोंदणीस नकार.----

निबंधक, नियम ६ च्या पोटनियम (२) अन्वये त्याने दिलेल्या निदेशाचे अनुपालन करण्यात विवाह नोंदणीचे संबंधित पक्षकार अपयशी ठरत असल्यास, लेखी कारणे नमूद करून, विवाह नोंदणीस नकार देईल.

८. नोंदवहीतील नोंदीच्या दुरूस्ती.----

निबंधक, आनंद विवाह नोंदणीच्या पक्षकाराने केलेल्या अर्जावर, नाव, वय किंवा विवाहाचा दिनांक याच्याशी संबंधित नोंदणी प्रमाणपत्रावर किंवा नोंदवहीत केलेल्या नोंदींमध्ये टंकलेखन विषयक किंवा लेखनासंबंधी चुका आहेत याचे समाधान झाले तर, जिल्हा निबंधकांच्या पूर्व मंजूरीने योग्य दुरूस्ती करेल व अशा प्रत्येक दुरूस्तीसाठी त्याची स्वाक्षरी करेल.

९. अपील.-----

(१) निबंधकाच्या निर्णयामुळे व्यथित झालेली कोणतीही व्यी अथवा पक्षकार निर्णय विदित केल्याच्या दिनांकापासून तीन महिन्याच्या कालावधीमध्ये जिल्हा निबंधकाकडे अपील दाखल करेल.

परंतु, असे अपील दाखल करण्यात विलंब झाल्यास, अर्जदाराने त्यांचा विर्िनदिष्ट कालावधीमध्ये अपील दाखल न करण्यासाठी पुरेसे कारण होते, याबाबत जिल्हा निबंधकाचे समाधान केले तर, जिल्हा निबंधक त्याची कारणे लेखी नोंदवून विलंब क्षमापित करेल.

(२) जिल्हा निबंधक, संबंधित व्यींना सुनावणीची संधी देऊन, पंधरा दिवसांच्या कालावधीत अपील निकाली काढेल.

१०. ज्ञापन जमा करणे.----

(१) प्रत्येक महिन्याच्या १० तारखेपूर्वी निबंधक त्याच्याकडे महिन्याभरात प्राप्त झालेल्या ज्ञापनाच्या दुय्यम प्रती जिल्हा निबंधकाना अग्रेषित करेल.

(२) महाराष्ट्र विवाह नोंदणी अधिनियम, १९९८ (महा १९९९ चा XX) नुसार निबंधक तथा जिल्हा निबंधक प्राप्त झालेल्या ज्ञापनाच्या मूळ प्रती व दुय्यम प्रती जतन करेल.

(३) निबंधक नियम ७ अनुसार केलेल्या सुधारणांचा तपशील सुधारणेच्या दिनांक व प्रतीसह जिल्हा निबंधकांना अग्रेषित करेल.

NOTIFICATION

ANAND MARRIAGE ACT, 1909.

No. VINOKA-2012/CR 387/F.W..— In exercise of the powers conferred by sub-sections (1) and (2) of section 6 of the Anand Marriage Act, 1909 (7 of 1909), the Government of Maharashtra hereby makes the following rules to provide for registration of Anand Marriages, Namely :—

1. Short Title.—These rules may be called the Maharashtra Anand Marriages Registration Rules, 2020.

2. Definations.—In these rules, unless the context requires otherwise—

(a) "Act" means the Anand Marriage Act, 1909 (7 of 1909),

(b) "Anand marriage" means the marriage solemnized according to the Sikh Marriage ceremony called Anand (Commonly known as Anand Karaj),

(c) "District Registrar" means the Joint District Registrar appointed under the Registration Act, 1908 (16 of 1908) for the District,

(d) "Form" means a register of Anand marriages maintained by the Registrar under the Act, (e) "Register" means a register of Anand marriages maintained by the Registrar under the Act, (f) "Registrar" means such officer of the State Government or of a local authority authorized by the State Government, by notification in the Official Gazette, under sub-section (1) of section 6 of the Act. 3. Jurisdiction.—The Anand marriage shall be registered with the Registrar within whose jurisdiction such marriage is solemnized.

4. Maintenance of Register of Anand Marriage.—

(i) The Registrar shall maintain Register of Anand marriage in Form-I.

(ii) The Registrar shall on an application give a certified extract from the Register to the parties of the marriage on payment of a fee of rupees two per page.

5. Procedure for Registration.—(1) The parties to the Anand marriage shall prepare a memorandum in duplicate in Form-II and submit the same to the Registrar alongwith documents to prove the solemnization of the Anand marriage to the satisfaction of the Registrar and registration fee of rupee fifty within a period of thirty days form the date of solemnization of their Anand marriage :

Provided that, for registration of anand marriage solemnized before the commencement of these rules such memorandum may be submitted within a period of one year from the date of commencement of these rules.

(2) The memorandum shall be signed by both the parties to the Anand marriage and at least two other persons who have witnessed the Anand marriage.

(3) The parties to the Anand marriage who have not registered their Anand marriage within the period specified under sub-rule(1) may get their Anand marriage registered by submitting the memorandum to the Registrar in Form-II and a Declaration in Form-III along with documents to prove the solemnization of the Anand marriage to the satisfaction of the Registrar and Registration alongwith a fee of rupees of two hundred :

Provided that, such Declaration shall be attested by a Gazetted Officer or Member of Parliament or Member of Legislative Assembly or Local Self Government Institutions or notary.

6. Verification and registration of marriages.—(1) Where on verification and scrutiny of the memorandum and documents received under sub-rule (1) or sub-rule (3) of rule 5 the Registrar is satisfied that the Anand marriage has been solemnized, be may enter the particulars of the Anand marriage in the Register and issue a Certificate of Anand Marriage in Form-IV.

(2) Where the Registrar has reasons to believe that :—

(a) the marriage between the parties has not been performed in accordance with Anand marriage ceremony; or

(b) the identity of the parties or the witness testifying the solemnization of the Anand marriage is not established; or

(c) the document tendered before him do not prove the marital status of the parties, he may, call upon the parties to produce such further information or documents as he may deem necessary, for establishing the identity of the parties and witness or correctness of the information or documents presented to him within a period of thirty days from the date of receipt of memorandum.

7. Refusal of registration of Anand marriage.—The Registrar may, for the reasons to be recorded in writing, refuse the registration of Anand marriage, if the parties of the Anand marriage fails to comply with the directions issued by him under sub-rule (2) of rule (6).

8. Correctness of the parties of Anand marriage.—(1) The Registrar may, on an application made by any party to the Anand marriage, if satisfied that there is typographical or clerical mistakes in the entries made in the Register or in the Certificate of Registration in relation to the name, age or date of Anand marriage, make suitable corrections with previous sanction of the District Registrar and affix his signature to each such correction.

9. Appeal.—(1) Any person or party aggrieved by the decision of the Registrar may, file an appeal to the District Registrar within a period of three months from the date of communication of such decision:

Provided that, the delay, if any, in filing such appeal may be condoned for the reasons to be recorded in writing by the District Registrar, if the appellant satisfies District Registrar that he had sufficient cause for not preferring an appeal within the specified period.

(2) The District Registrar shall, after giving an opportunity of hearing to the parties concerned, dispose of the appeal within a period of fifteen days.

10. Filling of memorandum.—(1) The registrar shall forward duplicate copies of the memorandum received in a month to the District Registrar before the 10th day of every subsequent month.

(2) The originals of the memorandum received by the Registrar and duplicate copies forwarded to the District Registrar shall be retained under the Maharashtra Registration of Marriage Bureaus and Registration of Marriages Act, 1998 (Mah. XX of 1999).

(3) The Registrar shall also forward particulars of the corrections made under rule 7 with the date of correction and a copy thereof to the District Registrar.
