भारताचे संविधान
क्रमांक : परीक्षा-४५१८/प्र.क्र.५/उद्योग-३.----भारताच्या संविधानाच्या अनुच्छेद ३०९ च्या परंतुकान्वये प्रदान करण्यात आलेल्या शक्तींचा वापर करून आणि याबाबतीत करण्यात आलेले व राज्यामध्ये अंमलात असलेले सर्व विद्यमान नियम व आदेश यांचे अधिक्रमण करून, महाराष्ट्राचे राज्यपाल महाराष्ट्र शासनाच्या उद्योग, ऊर्जा व कामगार विभागाच्या नियंत्रणाखालील उद्योग संचालनालयातील उद्योग निरीक्षक गट-क पदाकरिता घ्यावयाच्या सेवा प्रवेशोत्तर प्रशिक्षण परीक्षाकरिता खालील नियमावली करीत आहेत :----
१. संक्षिप्त नाव व प्रारंभ.----
(अ) या नियमावलीस उद्योग संचालनालयाचे उद्योग निरीक्षक, गट-क पदाकरिता सेवाप्रवेशोत्तर प्रशिक्षण परीक्षा नियम, २०२० असे संबोधण्यात यावे.
(ब) ही नियमावली राजपत्रात प्रसिद्ध झाल्याच्या दिनांकापासून अंमलात येईल.
२. व्याख्या.----या नियमावलीत, संदर्भानुसार दुसरा अर्थ अपेक्षित नसेल तर,-----
(अ) "परिशिष्ट" याचा अर्थ, या नियमावलीचे परिशिष्ट ;
(ब) "प्रारंभ दिनांक" याचा अर्थ, हे नियम अंमलात येतील तो दिनांक ;
(क) "संचालनालय" याचा अर्थ, महाराष्ट्र शासनाचे उद्योग संचालनालय आणि त्यांच्या प्रशासकीय नियंत्रणाखालील सर्व कार्यालये ;
(ड) "परीक्षा" याचा अर्थ, परिशिष्ट "अ" मध्ये र्िवनिदिष्टित केलेल्या अभ्यासक्रमानुसार उद्योग निरीक्षक पदाकरिता संचालनालयामार्फत घेण्यात येणारी सेवाप्रवेशोत्तर प्रशिक्षण परीक्षा ;
(इ) "उद्योग निरीक्षक" याचा अर्थ, संचालनालयाच्या आस्थापनेवर उद्योग निरीक्षक गट-क पदावर नामनिर्देशनाद्वारे नियुक्त केलेली व्यक्ती किंवा टिप्पणी सहाय्यक किंवा वरिष्ठ लिपिक (सांख्यिकी) या पदावरून पदोन्नत झालेली व्यक्ती ;
(१)२ महाराष्ट्र शासन राजपत्र भाग चार-अ, गुरुवार ते बुधवार, एप्रिल ३०-मे ६, २०२०/वैशाख १०-१६, शके १९४२ ३. कालावधी आणि परीक्षा उत्तीर्ण होण्यासाठी संधींची संख्या.-----(१) या नियमावलीच्या तरतुदींच्या अधीन राहून, प्रत्येक उद्योग निरीक्षक यांनी,----
(अ) प्रारंभ दिनांकानंतर नियुक्त झाले असल्यास त्यांच्या नियुक्तीच्या दिनांकापासून चार वर्षाच्या आत आणि तीन संधीमध्ये परीक्षा उत्तीर्ण होणे आवश्यक आहे.
(ब) प्रारंभ दिनांकापूर्वी नियुक्त झाले असल्यास प्रारंभ दिनांकापासून चार वर्षाच्या आत आणि तीन संधीमध्ये परीक्षा उत्तीर्ण होणे आवश्यक आहे, जर तो परीक्षा पूर्वीच उत्तीर्ण झाला नसेल किंवा विद्यमान नियमांतर्गत परीक्षा उत्तीर्ण होण्यापासून सूट मिळाली नसेल.
(क) जर कोणत्याही कारणास्तव कोणत्याही विशिष्ट वर्षी परीक्षा घेण्यात आली नसेल तर, या उप नियम (अ) मध्ये उल्लेखिलेल्या वर्षाच्या एकूण मुदतीची गणना करताना उक्त वर्ष वगळण्यात येईल.
(२) जर कोणत्याही कारणास्तव कोणत्याही विशिष्ट वर्षी परीक्षा घेण्यात आली नसेल तर, या उप नियम (१) मध्ये उल्लेखिलेल्या वर्षाच्या एकूण मुदतीची गणना करताना उक्त वर्ष वगळण्यात येईल.
४. परीक्षा उत्तीर्ण न झाल्यास होणारे परिणाम :----
उद्योग निरीक्षक नियम ३ मध्ये विहित केलेल्या कालावधीमध्ये व संधीमध्ये परीक्षा उत्तीर्ण झाला नाही तर,----
(अ) तो परीक्षा उत्तीर्ण होईपयर्ंत किंवा परीक्षा उत्तीर्ण होण्यापासून नियम ६ अन्वये त्यास सूट मिळेपयर्ंत,----
(१) त्याला उद्योग निरीक्षकाच्या पदावर कायम करण्यात येणार नाही ; आणि
(२) पुढील वेतनवाढ त्याला देण्यात येणार नाही ;
(ब) त्याला आपली उद्योग निरीक्षक संवर्गातील ज्येष्ठता गमावून ते त्या सर्व उद्योग निरीक्षकांखाली जे ही परीक्षा त्याच्या अगोदर उत्तीर्ण झाले असतील आणि असे उद्योग निरीक्षक, जे ज्येष्ठता सूचीमध्ये त्याच्या खाली होते आणि त्यांनी विहित कालावधीमध्ये व संधीमध्ये नियम ३ मध्ये उल्लेखलेली परीक्षा उत्तीर्ण झालेले आहेत त्या सवार्ंच्या खाली त्यांची ज्येष्ठता ठेवली जाईल :
परंतु असे की, नियम (अ) च्या पोट-नियम (२) अन्वये अशा तहेने रोखून ठेवलेल्या वेतनवाढी, तो ज्या दिनांकास परीक्षा उत्तीर्ण होईल त्या दिनांकापासून किंवा त्याला परीक्षा उत्तीर्ण होण्यामधून नियम ६ अन्वये सूट मिळाल्याच्या दिनांकापासून देय होतीलआणि पुढील सर्व वेतनवाढी, जणू काही वेतनवाढ रोखण्यात आलेली नव्हती, असे समजून देय ठरतील परंतु या वेतनवाढीची थकबाकी मिळण्यास तो पात्र असणार नाही.
५. परीक्षेला बसण्यासाठी संधी :---
नियम ४ मधील तरतुदींस अधीन राहून उद्योग निरीक्षक यास परीक्षेस बसण्यासाठी कितीही वेळा संधी मिळू शकेल.
६. सूट :----उद्योग निरीक्षक यास परीक्षा उत्तीर्ण होण्यापासून सूट देण्यात येईल जर----
(अ) तो प्रारंभ दिनांकापूर्वी उद्योग निरीक्षक, गट-क पदावर स्थायी झाला असेल, किंवा
(ब) प्रारंभ दिनांकास किंवा त्यानंतर कोणत्याही दिनांकास त्यांनी वयाची पन्नास वर्षे पूर्ण केली असतील.
७. प्रशिक्षण वर्ग :----
(१) संचालनालयाने मुख्यालय स्तरावर तसेच विभागीय स्तरावर परीक्षा घेण्याच्या दिनांकाच्या कमीत कमी एक महिना अगोदर परीक्षेला बसू इच्छिणाया उमेदवारांकरिता प्रशिक्षण वर्ग आयोजित करावेत किंवा उमेदवारांना परीक्षेच्या तयारीसाठी आवश्यक असलेली साधनसामग्री जसे टिपण्ण्या, शासकीय धोरणे, नियम, अधिसूचना, शासन निर्णय, लघुपुस्तिका इत्यादींच्या प्रती इत्यादी उपलब्ध करून द्यावी.
(२) ज्या उमेदवारास परीक्षेसाठी बसावयाचे असेल किंवा प्रशिक्षण घ्यावयाचे असेल, याकरिता परिशिष्ट-ब मध्ये दिल्याप्रमाणे अर्ज करू शकेल.
८. अभ्यासक्रम :----
या परीक्षेला तीन लेखी प्रश्नपत्रिका असतील. प्रत्येक प्रश्नपत्रिका शंभर गुणांची व तीन तासांची असेल. प्रश्नपत्रिका एक ही पुस्तकांच्या मदतीने सोडवण्यात येईल व प्रश्नपत्रिका दोन व तीन ही पुस्तकांशिवाय सोडवण्यात येतील. ही परीक्षा मराठी भाषेतून होईल. परीक्षेच्या अभ्यासक्रमात परिशिष्ट-अ मध्ये उल्लेख केलेल्या विषयांचा किंवा शासन वेळोवेळी आदेशाद्वारे निर्देश देईल अशा इतर विषयांचा अंतर्भाव राहील.

(१) संचालनालयाने वर्षातून एकदा मार्च किंवा एप्रिल महिन्यामध्ये ही परीक्षा घ्यावी; काही विशेष कारणास्तव एखाद्या विशिष्ट वर्षी ही परीक्षा घेणे शक्य होणार नाही असे विकास आयुक्त (उद्योग) यांचे मत असल्याशिवाय,
परंतु असे की, विशेष कारणास्तव ही परीक्षा एखाद्या वर्षी दोनदा घेण्यासाठी विकास आयुक्त (उद्योग) निर्णय घेऊ शकतात.
(२) विकास आयुक्त (उद्योग) यांच्या आदेशानुसार ही परीक्षा मुंबईमध्ये किंवा अन्य ठिकाणी घेण्यात यावी.
(३) ही परीक्षा परीक्षेच्या सर्व केंद्रांमध्ये एकाच दिवशी घेण्यात यावी.
(४) प्रत्येक परीक्षेसाठी सर्व केंद्रांतील प्रश्नपत्रिका एकसारख्या राहतील. प्रश्नपत्रिका विकास आयुक्त (उद्योग) तयार करतील किंवा त्यांनी निर्देशित केलेली व्यक्ती तयार करील.
१०. परीक्षा उत्तीर्ण होण्याचे मानक :----
(अ) परीक्षा उत्तीर्ण होण्यासाठी प्रत्येक विषयामध्ये पंचेचाळीस टक्के व सर्व मिळून पन्नास टक्के गुण मिळणे आवश्यक आहे.
(ब) जर संबंधित उमेदवारास परीक्षा उत्तीर्ण होण्यासाठी अनुग्रह गुण आवश्यक असतील तर ते एकूण पाच गुण देण्यात यावेत.
११. विशेष गुणवत्ता :----
जो उद्योग निरीक्षक पहिल्या प्रयत्नामध्ये परीक्षा उत्तीर्ण होईल आणि कोणत्याही प्रश्नपत्रिकेमध्ये सत्तर टक्के किंवा त्याहून अधिक गुण मिळवील, त्याच्या त्या प्रश्नपत्रिकेमधील विशेष गुणवत्तेची नोंद त्याच्या गोपनीय अहवालामध्ये करण्यात येईल.
१२. कोणत्याही प्रश्नपत्रिकेस बसण्यापासून सूट :----
जर एखादा उमेदवार परीक्षेमध्ये अनुत्तीर्ण झाला पण एखाद्या विषयामध्ये पन्नास टक्के किंवा त्यापेक्षा अधिक गुण मिळाले असतील तर त्याला त्या प्रश्नपत्रिकेस पुन्हा बसण्यापासून सूट देण्यात येईल :
परंतु, नंतरच्या प्रयत्नात परीक्षेला बसताना, लेखी अर्ज करून त्या उमेदवाराने सूट मिळण्याची मागणी करणे आवश्यक आहे. सूट मिळण्यासाठी असा अर्ज न केल्यास उमेदवाराला सूट घेण्याची इच्छा नाही असे गृहित धरण्यात येईल.

NOTIFICATION
CONSTITUTION OF INDIA.
No. EXAM-4518/CR-3/Ind-3.—In exercise of the powers conferred by the proviso to article 309 of the Constitution of India and in supersession of all existing rules and orders issued in this behalf, the Governor of Maharashtra is hereby pleased to make the following Post Recruitment Training Examination rules for the posts of Industries Inspector, Group 'C' in the Directorate of Industries under the Industries, Energy and Labour Department of the Government of Maharashtra, namely:—
1. Short title and commencement.—(1) These rules may be called the Post Recruitment Training Examination for Industries Inspector, Group 'C' in the Directorate of Industries Rules, 2020.
(2) These rules shall come into force on the date of its publication in the Official Gazette.
2. Definitions.—In these rules, unless the context requires otherwise,—
(a) "Appendix" means the Appendix to these rules ;
(b) "date of commencement" means the date on which these rules come into force;
(c) "Directorate" means the Directorate of Industries, Government of Maharashtra and includes all the offices under its administrative control;
(d) "Examination" means the Post Recruitment Training Examination held by the Directorate for Industries Inspector according to the syllabus prescribed in the Appendix "A";
(e) "Industries Inspector" means a person appointed in the Directorate on the post of Industries Inspector, Group 'C', either by nomination or by promotion from the post of Noting Assistant or Senior Clerk (Statistics).
3. Period and number of chances for passing Examination.—(1) Subject to the provisions of these rules, every Industries Inspector,—
(a) appointed after the date of commencement shall be required to pass the Examination within a period of four years from the date of his appointment and within three chances;
(b) appointed before the date of commencement shall be required to pass the Examination within a period of four years from the date of commencement and within three chances unless he has already passed or is exempted from passing the Examination under the existing rules.
(2) If for any reasons an Examination is not held in a particular year, that year shall be excluded in computing the total period of years mentioned in sub-rule (1).
4. Consequences of not passing the Examination.—A Industries Inspector who fails to pass the Examination within the period and chances specified in rule 3,—
(a) shall not, until he passes the Examination or is exempted from passing the Examination under rule 6,—
(i) be confirmed in the post of Industries Inspector; and
(ii) be entitled to take the benefit of next increment;
(b) shall lose his seniority in the cadre of Industries Inspector to all those who pass the Examination before him and rank below all such Industries Inspector who have passed the Examination before him and also below all those who have been below him in the seniority and passes such Examination within the period and chances specified in rule 3:
Provided that, the increments so withheld under sub-clause (ii) of clause (a) shall become payable to him with effect from the date on which he passes the Examination or from the date of exemption fromमहाराष्ट्र शासन राजपत्र भाग चार-अ, गुरुवार ते बुधवार, एप्रिल ३०-मे ६, २०२०/वैशाख १०-१६, शके १९४२ ९ passing such Examination in accordance with rule 6 and all future increments shall accrue to him as if no increment is withheld. However, he shall not be eligible to obtain such arrears of increment.
5. Chances to appear for Examination.—Subject to the provisions of rule 4, a Industries Inspector may be allowed to appear for the Examination in any number of chances.
6. Exemptions.—An Industries Inspector shall be exempted from passing the Examination if,—
(a) he has already been confirmed in the post of Industries Inspector before the date of commencement; or (b) he has attained the age of fifty years on the date of commencement or on any date thereafter.
7. Training Sessions.—(1) The Directorate shall arrange training sessions at headquarters and regional level before at least one month of the Examination for the candidates who are willing to appear for the Examination or shall make available necessary material based on syllabus such as notes, Government Policies, rules, notifications, Government Resolutions, books, etc. to candidates for preparation of Examination.
(2) A candidate who is appearing for the Examination or training shall submit the applicationas per form specified in APPENDIX "B".
8. Syllabus.—The Examination shall consist of three written papers, each paper being of hundred marks and of three hours duration. Paper I may be answered with the aid of books and Papers II and III shall be answered without the aid of books. The Examination shall be in Marathi Language. The syllabus for the Examination shall consist of the subjects mentioned in the APPENDIX "A" or such other subjects, as the Government may, by order, from time to time, direct.
9. Examination when to be held.—(1) The Examination shall be held by the Directorate once in a year in the month of March or April unless the Development Commissioner (Industries) is of the view that it is not possible to held such Examination in any particular year for any special reason :
Provided that the Development Commissioner (Industries) may take decision to held Examination twice in a year for any specific reasons.
(2) The Examination shall be held in Mumbai or any other place and date as directed by the Development Commissioner (Industries).
(3) The Examination shall be held at all Examination centres on the same day.
(4) Question papers at all centres shall remain same in every Examination. Question Papers shall be prepared by the Development Commissioner (Industries) or a person nominated by him.
10. Criteria of passing the Examination.—(1) The percentage of passing the Examination shall be fourty five percent.in each paper and fifty percent.marks in all the papers.
(2) If a candidate to pass the Examination requires grace marks, then total five marks shall be allotted.
11. Special Merit.—Industries Inspector who passes the Examination in first attempt and secures seventy percent.marks or more of the marks, an entry of special merit of that paper shall be recorded in his confidential report.
12. Exemption from appearing in any paper.—Where a candidate secures fifty percent. marks or more marks in any paper, he shall be exempted from appearing again in that paper:
Provided that, the exemption shall be specially claimed by the candidate by making an application in writing at the time of appearing for the Examination in his subsequent attempts. In the absence of such written application claiming exemption, it shall be presumed that the candidate does not wish to avail the exemption.
