मोटार वाहन अधिनियम, १९८८.
क्रमांक एमसीटी ०८२०/प्र.क्र.७०/परिवहन-५.----ज्याअर्थी, मोटार वाहन अधिनियम, १९८८ (१९८८ चा ५९) याच्या कलम १६५, उप कलम (१) व (२) द्वारे प्रदान करण्यात आलेल्या अधिकारांचा वापर करून, मोटार वाहनांच्या वापरामुळे झालेल्या व्यक्त्तीचा मृत्यू किंवा त्यांना झालेली शारीरिक इजा किंवा त्यामुळे झालेल्या तिस-या पक्षाच्या कोणत्याही मालमत्तेचे नुकसान किंवा दोन्हीही यांचा अंतर्भाव असणा-या अपघाताच्या संबंधातील नुकसानभरपाईसाठीच्या दाव्यावर अभिनिर्णय करण्याच्या प्रयोजनासाठी बृहंन्मुंबई महानगरपालिकेच्या हद्दीत समाविष्ट असलेल्या क्षेत्रासाठी एकूण आठ, नागपूर येथे एकूण चार, पुणे व ठाणे येथे प्रत्येकी एक अशी एकूण १४ मोटार अपघात दावा न्यायाधिकरणे गठीत करण्यात आली आहेत.
त्याअर्थी, आता मोटार वाहन अधिनियम, १९८८ (१९८८ चा ५९) च्या कलम १६५ अन्वये प्रदान करण्यात आलेल्या अधिकारांचा वापर करुन व त्याखाली तयार करण्यात आलेल्या नियमान्वये महाराष्ट्र शासन याव्दारे श्री. भरत पन्नालाल व्यास, तदर्थ न्यायाधीश, नगर दिवाणी न्यायालय व सहायक सत्र न्यायाधीश, दिंडोशी, मुंबई यांची सदस्य, मोटार अपघात दावा न्यायाधिकरण, मुंबई म्हणून त्यांनी पदभार स्वीकारल्यापासून त्यांच्या वयाची ६० वर्षे पूर्ण होईपर्यत किंवा शासनाचे पुढील आदेश होईपर्यत यापैकी जे अगोदर घडेल तोपयर्ंत नियुक्त्ती करीत आहे.
महाराष्ट्राचे राज्यपाल यांच्या आदेशानुसार व नावाने, २ महाराष्ट्र शासन राजपत्र असाधारण भाग चार-अ, ऑगस्ट १९, २०२०/श्रावण २८, शके १९४२ HOME DEPARTMENT Mantralaya, Mumbai 400 032, dated the 18 August 2020.
NOTIFICATION
MOTOR VEHICLE ACT, 1988.
No. MCT 0820/C.R.70/Transport-5.—Whereas, in exercise of the powers conferred by sub-section (1) and (2) of section 165 of the Motor Vehicle Act, 1988 (59 of 1988), the Government of Maharashtra has constituted 8 Motor Accident Claims Tribunals for the area comprised within the limits of the Municipal Corporation of Brihan Mumbai, 4 Motor Accident Claims Tribunals for Nagpur and 1 Motor Accident Claims Tribunal at Pune and Thane each. Total number of 14 Motor Accident Claims Tribunals for the purpose of adjudicating upon the claims for compensation in respect of accident involving the death or bodily injury to person arising out of the use of motor vehicles or damages to any property of third party or both so arising out of such and accidents.
Now, therefore, in exercise of the powers conferred by section 165 of the Motor Vehicles Act, 1988 (59 of 1988), and rules framed thereunder, the Government of Maharashtra hereby appoints Shri Bharat Pannalal Vyas, Ad-hoc Judge, City Civil Court and Assistant Sessions Judge, Dindoshi, Mumbai as Member, Motor Accident Claims Tribunal, Mumbai with effect from the date they assume charge till they attain the age of 60 years or until further orders of Government, whichever is earlier.
