महाराष्ट्र झोपडप(cid:४४२)ी (सुधारणा, निमू

र्लन व पुनर्विकास) अधिनियम, १९७१.

क्रमांक-भूसंपा-२०१९/प्र.क्र.१६९/झोपनि-२.– ज्याअर्थी, मु(cid:१७६)य कार्यकारी अधिकारी, झोपडप(cid:४४२)ी पुनर्वसन प्राधिकरण आणि सक्षम प्राधिकारी, ठाणे यांच्या अभिवेदनावरून महाराष्ट्र शासनास असे दिसून आले आहे की, उक्त प्राधिकाऱ्यास यासोबत जोडलेल्या अनुसूचीमध्ये (यात यापुढे ज्याचा निर्देश उक्त अनुसूची असा करण्यात आला आहे.) नमूद के लेल्या झोपडप(cid:४४२)ी पुनर्वसन क्षेत्रावर झोपडप(cid:४४२)ी पुनर्वसन योजना राबविणे शक्य व्हावे म्हणून उक्त अनुसूचीमध्ये विनिर्दिष्ट के लेली जमीन ( यात यापुढे जिचा निर्देश उक्त जमीन असा करण्यात आला आहे.) संपादीत करणे आवश्यक आहे.

आणि ज्याअर्थी, महाराष्ट्र झोपडप(cid:४४२)ी (सु.नि. व पु.) अधिनियम, १९७१ (महा.१९७१ चा २८) च्या कलम १४ च्या पोट कलम (१) (यात यापुढे ज्याचा निर्देश उक्त अधिनियम असा करण्यात आला आहे.) नुसार मु(cid:१७६)य कार्यकारी अधिकारी, झोपडप(cid:४४२)ी पुनर्वसन प्राधिकरण, ठाणे यांनी बजावलेल्या त्यांच्या क्र.झोपुप्रा/उजि. स.प्रा.क्र.२/जा.क्र.१८५/२०१८, दि.०६.०७.२०१८ तसेच मराठी वृत्तपत्र "तरुण भारत" आणि "दि आफटरनून" या इंग्रजी वृत्तपत्रात दि. १०.०७.२०१८ रोजी जाहिर नोटीस प्रसिध्द करण्यात येवून आणि उक्त अधिनियमांच्या कलम ३६ अन्वये, सदर क्षेत्रात सर्वांना ठळकपणे दिसेल अशा ठिकाणी चिकटवून, उक्त अनुसूचीच्या स्तंभ ६ मध्ये नमूद के लेल्या ज्या व्यक्ती, उक्त जमीनीचे मालक आहेत वा हितसंबंधीय आहेत, अशा व्यक्तींना उपरोक्त नोटीस मिळाल्यापासून वा वृत्तपत्रात नोटीस प्रसिध्द झाल्याच्या तारखेपासून १५ दिवसांच्या कालावधीत उक्त जमीन का संपादित करण्यात येवू नये याबाबतची कारणे दाखविण्यास फर्माविले होते,

आणि ज्याअर्थी, मु(cid:१७६)य कार्यकारी अधिकारी, झोपडप(cid:४४२)ी पुनर्वसन प्राधिकारी यांनी संबंधित झोपडीधारकांच्या सहकारी गृहनिर्माण संस्था तसेच जमिनीचे मालक व हितसंबंधीत यांच्या घेतलेल्या सुनावणीत संबंधित, झोपडीधारकांच्या सहकारी गृहनिर्माण संस्थेच्या युक्तीवाद, अधिकार अभिलेखांतील नोंदी, उक्त जमिनीवर विकास आराख(cid:५०५)ानुसार असलेले आरक्षण तसेच झोपडीधारकांनी सादर के लेली मागणी न्या(cid:२००)य असल्याबाबत उक्त जमीन संपादनाबाबतचे अभिवेदन मु(cid:१७६)य कार्यकारी अधिकारी, झोपडप(cid:४४२)ी पुनर्वसन प्राधिकरण यांनी राज्य शासनास दि. २९.०७.२०१९ रोजी सादर के ले आहे,

भाग चार-ब-१९७-१ (१)२ महाराष्ट्र शासन राजपत्र असाधारण भाग चार-ब, सप्टेंबर २, २०२०/भाद्र ११, शके १९४२ आणि ज्याअर्थी, उक्त अधिनियमाच्या प्रकरण I-A च्या कलम ३ (D)(c)(i)च्या परिच्छेद (A) अन्वये सुधारणा करण्यात आलेल्या प्रकरण पाच मधील कलम १४ च्या पोट कलम (१) नुसार मु(cid:१७६)य कार्यकारी अधिकारी, झोपडप(cid:४४२)ी पुनर्वसन प्राधिकरण,ठाणे यांनी सादर के लेल्या अभिवेदन, अहवाल व त्यांनी या प्रकरणी के लेली कार्यवाही राज्य शासनास उक्त अनुसूचीमध्ये नमूद के लेल्या झोपडप(cid:४४२)ी पुनर्वसन क्षेत्राच्या विकासासाठी झोपडप(cid:४४२)ी पुनर्वसन योजनेअंतर्गत विकास करणे शक्य व्हावे म्हणून उक्त जमीन संपादित करणे आवश्यक असल्याचे दिसून आले आहे,

त्याअर्थी आता, उक्त अधिनियमाच्या प्रकरण I-Aच्या कलम ३ (D)(c)(i)च्या परिच्छेद (A) अन्वये सुधारणा करण्यात आलेल्या प्रकरण पाच मधील कलम १४ च्या पोट कलम (१) (cid:४६२)ारे प्रदान करण्यात आलेल्या अधिकारांचा वापर करून महाराष्ट्र शासन या नोटिशी(cid:४६२)ारे असे घोषित करीत आहे की त्याने उक्त जमीन संपादित करण्याचे ठरविले आहे.

Notice

MAHARASHTRA SLUM AREAS (IMPROVEMENT, CLEARNACE AND REDEVELOPMENT), ACT, 1971.

No.Bhusampa-2019/C.R.169/Zopani-2.- Whereas, on representation from the Chief Executive Officer, Slum Rehabilitation Authority, Thane it appears to the Government of Maharashtra that in order to enable the said Authority to implement the Slum Rehabilitation Scheme in relation to the Slum Rehabilitation Area mentioned in the Schedule appended hereto (hereinafter referred to as "the said Schedule"), it is necessary that the land specified in the said Schedule (hereinafter referred to as "the said land"), should be acquired;

And whereas, as required by the proviso to sub-section (1) of section 14 of Chapter V read with paragraph (A) of sub-clause (i) of clause (c) of section 3D of Chapter I-A of the Maharashtra Slum Areas (Improvement, Clearance and Re-development) Act, 1971 (Mah.XXVIII of 1971) (hereinafter referred to as "the said Act"), the Chief Executive Officer, Slum Rehabilitation Authority, Thane, has by his Notice No.SRA/Dy. Coll-2/LAQ- 14(1)/2018/185, dated 06.07.2018, served in prescribed manner and also by notice published in the daily Marathi newspaper "Tarun Bharat" and English newspaper "The Afternoon" dated 10.07.2018, and also by affixing in the conspicuous part in the premises situated in the said land, as provided in section 36 of the said Act, called upon the persons mentioned in column (6) of the said Schedule, who are the owners of the said land or any other person interested therein to show cause, within fifteen days from the date of its publication in the newspapers, as to why the proposal to acquire the said land for implementation of the Slum Rehabilitation Scheme for the concerned protected slum dwellers should not be sent to the State Government for approval;

And whereas, the Chief Executive Officer, Slum Rehabilitation Authority, Thane, after considering the objections received in this behalf for the acquisition of the said lands pleading received on behalf of the proposed Co-operative Housing Society of the slum dwellers, entries as to the rights in the land record, reservation in development plan and the legitimate request of the protected slum dwellers, by his representation dated 29.07.2019 has submitted the report for the acquisition of the said land;

And whereas, as required by the first proviso to sub-section (1) of section 14 of Chapter V read with Paragraph (A) of sub-clause (i) of clause (c) of section 3D of Chapter I-A of the said Act, on representation from the Chief Executive Officer, Slum Rehabilitation Authority, Thane and after considering his report it appears to the State Government that in order to enable the Slum Rehabilitation Authority to carry out the development under the Slum Rehabilitation Scheme in the Slum Rehabilitation Area mentioned in the said Schedule, the said land should be acquired;

Now, therefore, in exercise of the powers conferred by sub-section (1) of section 14 read with paragraph (A) of sub-clause (i) of clause (c) of section 3D of the said Act, the Government of Maharashtra hereby declares, by this notice, that it has decided to acquire the said land.
