BY DIRECTOR OF TOWN PLANNING
MAHARASHTRA REGIONAL AND TOWN PLANNING ACT, 1966.
No. D.P.Khamgaon(R)-Sec-127(2)-Notification-TPV-VI-2037-2020.—
Whereas, the Director of Town Planning, Maharashtra State, Pune vide its Notification No. D.P.Khamgaon(R)- TPV-6-2562, dated 30-04-1992 has sanctioned the Revised Development Plan of Khamgaon (hereinafter referred to as the "said Development Plan") under Section 31 (1) of the Maharashtra Regional and Town Planning Act, 1966 (Mah. XXXVII of 1966) (hereinafter referred to as "the said Act") and the same has come into force with effect from date 01-11-1993;
And whereas, in the said Development Plan, from S. No. 116 (part) of Khamgaon the land admeasuring 0.80 Hect., is reserved for Site No. 04 "Garden"and Land admeasuring 0.60 hect., is reserved for Site No. 12 "Primary School"(hereinafter referred to as "the said Reservation") for which Appropriate Authority is Municipal Council, Khamgaon (hereinafter referred to as "the said Appropriate Authority");
And whereas, the land under said reservation has not been acquired by the said Appropriate Authority within ten years from the date on which the said Development Plan came into force;
And whereas, the owners of 1.92 Hect. land from S. No.116/2 had served a Notice uner Section 127 (1) of the said Act, on the said Appropriate Authority vide their letter dated 15-10-2004 & the present land owner Shri.Gadodiya has given the copy of the said notice to Khamgaon Municipal Council vide his letter date 09-05-2006 & requested to do the necessary action under Section 127 of the the said Act (hereinafter referred to as "the said Notice");
And whereas, after taking the remarks of Law & Judiciary Department, the Government has connunicated to the directorate vide its letter dated 16-02-2019 that, the said notice is considered to be vilid from date 09-05-2006 and also communicated that since the notification for land acquisition has not issued within prescribed time limit from said valid notice, the necessary action uder Section 127 of the said Act shall be carried out;
And whereas, land from S. No. 116/2 admeasuring 0.80 Hect. is affeced by Site No. 04 "Garden"& 0.60 Hect.
is affected by Site No. 12 "Primary School" (hereinafter referred to as "the said Land");
And whereas, after confirming that, the said Appropriate Authority, has not acquired or no steps as contem- plated in the Section 127 (1) of the said Act, has commenced for its acquistion within the period of Six months from the receipt of the aforesaid notice or notification of land acquisition under Section 127of the said Act has not been issued within six months after receipt of notice on 09-05-2006 , the Director of Town Planing is now of the opinion that in accordance with the provision of Section 127(1) of the said Act, the said Reservation, pertaining to the said land, has lapsed fully and it is accordingly expedient to notify such lapsing under Section 127 (2) of the said Act; And whereas, the Government in Urban Development Department under Section 151 of the said Act, vide Resolution No. TPS-1813-3211-CR-508-UD-13, dated 01-12-2016, has delegated the powers exercisable by it under Section 127 (2) of the said Act, in respect of Development Plans of all Municipal Councils-Nagar Panchayats and for the development plans undertaken by Zilla Paridhad as a PlanningAughority, to the Director of Town Planning, Maharashtra State, Pune;
Now, therefore, in exercise of the powers delegated by the government, in respect of Sub-section (2) of Section 127 of the said Act and of all other powers enabling it in that behalf, the Director of Town Planning, Maharashtra४ द्धन्रु]क्ष् रू न् ॅ-+ +द्धन्म््र ह्यम््र ान्म््र, रू]क्ष्दन्क्ष् १०-१६, २०२०/ १९--२५, ॅ १९४२ State, Pune, hereby notfies that the said Reservation of Site No. 04 "Garden" & Site No. 12 "Primary Shcool" are lapsed fully only in respect of said Land (as specified in the Schedule herein below) and the said land shall become available to the land owners for the purpose of Development as otherwise, permissible in the case of adjacent land, under the said Development Plan.
