NOTIFICATION

No. GAD/G/REG/2441

In pursuance of sub-section (2) of Section 124 of the Major Port Trusts Act, 1963 (38 of 1963), the Board of Trustees of the Port of Mumbai have published Notification No. GAD/G/REG/850, dated 6th February 2020 regarding "The Mumbai Port Trust (General Management of Port) Regulations, 2019" made by them in exercise of the powers, conferred by Section 123 of that Act, in replacement of the ' Bombay Port Trust General Bye Laws, 1990' in the Maharashtra Government Gazette, dated 27th February 2020 and 7th March 2020.

The Board of Trustees of the Port of Mumbai hereby publish the following corrigendum regarding ' Regulation No. 9-Obstruction of approaches to wharves by boats, etc.' of the Mumbai Port Trust (General Management of Port) Regulations, 2019 for the information of the persons likely to be affected thereby and notice is hereby given that the approval thereto of the Central Government as required under sub-section (1) of Section 124 of that Act, will be applied for on or after the expiry of fourteen days from the date on which this Notification is first published in this Gazette.

9. Obstruction of approaches to wharves by boats, etc.

Obstructions of the approaches to wharves/ pier/ jetty/ waterways/ channel by Boats/ vessels/ barges, etc., remaining alongside while not actually engaged in loading or unloading cargo, or in the case of passenger vessels while not actually engaged in embarking or disembarking passengers, after the Master, Tindal or owner shall have been warned by an officer of the Port Trust to keep a clear passage for other boats, is strictly prohibited, and the offending boat or vessel may, if not immediately removed, be shifted by an Officer of the Port Trust at the sole risk and cost of the owner of such boat or vessel. Any person infringing this Regulation shall be liable to fine of Rs. 5000/- for each offence or such amount as may be revised by the Board from time to time or in the case of continuing infringement, to further fine of Rs. I000/- per day after such warning has been given, or such amount as may be revised by the Board from time to time.

ज्याअर्थी, मिरा-भाइर्ंदर शहराची विकास योजना महाराष्ट्र प्रादेशिक व नगररचना अधिनियम, १९६६ चे कलम ३१(१) नुसार (यापुढे " उक्त अधिनियम" असे संबोधण्यात येत आहे) शासन अधिसूचना क्र. टीपीएस-१२९६/८४७/सीआर-१६२/९६/युडी-१२, दिनांक १४ मे १९९७ अन्वये मंजूर करण्यात आलेली असून ती अनुक्रमे दिनांक १५ जुलै १९९७ पासून अंमलात आलेली आहे.

आणि ज्याअर्थी, वगळलेल्या भागाची विकास योजना "उक्त अधिनियमाचे" कलम ३१ (१) नुसार शासन अधिसूचना क्र. टीपीएस- १२९८/९४१/सीआर-८९/९८/युडी-१२, दिनांक २५ ऑगस्ट २००० अन्वये मंजूर झाली असून दिनांक १५ ऑक्टोबर २००० पासून अंमलात आलेली आहे.

मिरा-भाइर्ंदर महानगरपालिका क्षेत्रात विविध मान्यवरांचे पुतळे खालील नमूद ठिकाणी प्रस्तावित करणेसाठी महाराष्ट्र प्रादेशिक व नगररचना अधिनियम, १९६६ चे कलम ३७ (१) अन्वये फेरबदल करणे प्रस्तावित केले आहे :----

जागा क्र. १ - मंजूर विकास योजनेनुसार मौजे पेणकरपाडा, स.क्र. ७५ या जागेमधील आ.क्र. १८७ (बगीचा) मध्ये प्रस्तावित लोहपुरुष सरदार वल्लभभाई पटेल यांचा पुर्णाकृती पुतळा. (मोजमाप ९.०० मी. x १०.०० मी.) जागा क्र. २ - मौजे नवघर, स.क्र. (२०९) १५ मधील असून मंजूर विकास योजनेनुसार ना विकास क्षेत्र (No development Zone) सी.आर.झेड. ने बाधित आहे. सदर जागेत भारतरत्न अब्दुल कलाम यांचा अर्धाकृती पुतळा. (मोजमाप ९.०० मी. x १०.०० मी.)

जागा क्र. ३ - मंजूर विकास योजनेनुसार मौजे गोडदेव, स.क्र. ५९(१०१)/५ पै., या जागेमधील ३०.०० मी. रुंद विकास योजना रस्त्याचे जंक्शनमध्ये प्रस्तावित महाराणा प्रताप यांचा अश्वारुढ पुतळा. (मोजमाप १२.०० मी. x ३४.०० मी.) जागा क्र. ४ - मंजूर विकास योजनेनुसार मौजे गोडदेव, स.क्र. ७४७ पै., ७४८ पै., या जागेमधील १५.०० मी. व ३०.०० मी. रुंद विकास योजना रस्त्याचे जंक्शनमध्ये प्रस्तावित जिजामाता यांचा अर्धाकृती पुतळा. Whereas, the Development Plan of Mira Bhayandar Municipal Corporation has been sanctioned by the Govt. Under Section 31(1) of the Maharashtra Regional and Town Planning Act, 1966 (Hereinafter referred to as the "Said Act") vide Notification No. TPS- 1296/847/CR-162/96, UD-12, Dt.14th May1997 and came into force from the Dt.15th July 1997.

And whereas excluded portion has been sanctioned U/s. 31(1) of "Said Act" by the Govt. vide Notification No. TPS/1298/941/CR-89/98, UD-12, Dt. 25th August 2000 and came into force from Dt. 15th October 2000.

And whereas, Mira Bhayander Municipal Corporation has decided vide General Body Resolution No. 98, Chapter No. 83, Dt.31st January 2020 (Adjourned General Body Meeting dt. 20th December 2019) to make the modification in Sanctioned Development Plan U/s. 37 of "Said Act" as described below.

In Mira Bhayandar Municipal Corporation Area erection of statues of various dignitaries in below mention area to be proposed in Development Plan of Mira Bhayandar Municipal Corporation as per revise section 37 (1) of the Maharashtra Regional and Planning Act 1966.

Place No. 1 - As per the approved development plan, in Mauje Penkarpada, S.No.75, S.No. A full-sized statue of the Iron Man Sardar Vallabhbhai Patel proposed in 187 (garden).

Place No. 2 - Mauje Navghar, S.No. (209) 15 and as per approved development plan No Development Zone CRZ. is affected by A bust of Bharat Ratna Abdul Kalam in this place. (Dimensions 9.00 m. X 10.00 m.)

Place No. 3 - As per approved development plan, Mauje Goddev, S.No.59 (101) / 5 Pa., 30.00 m. Proposed equestrian statue of Maharana Pratap at the junction of Rund Vikas Yojana road. (Dimensions 12.00 m x 34.00 m)

Place No. 4 - As per approved development plan, Mauje Goddev, S.No.747 Pa., 748 Pa., 15.00 m. And 30.00 m. An official statue of Jijamata proposed at the junction of Rund Vikas Yojana road (Dimensions 9.00 m. X 10.00 m.)

Place No. 5 - As per approved development plan, 45.00 m. In Mauje Bhayander, S.No.678 / 4.

An official statue of Lokmanya Tilak proposed at the junction of the wide development scheme road (Measuring 9.00 m x 10.00 m).

Place No. 6 - As per the approved development plan, the official statue of Savitribai proposed in A.122B in Mauje Khari, S.No.200P. (Dimensions 9.00 m. X 10.00 m.) Place No. 7 - As per the approved development plan, Mauje Kashi, S.No.2 H.No. 6 Pa., 18.00 m. Proposed statue of Mata Ramabai Ambedkar at the junction of Rund Vikas Yojana road. (Measurement 9.00 m. X 10.00 m.)

Place No. 8 - As per the approved development plan, the proposed Bharat Ratna at National Highway No. 8 near Mauje Kashi, Dr. A bust of Babasaheb Ambedkar.
