क्रमांक जि/ भुसं / कार्या - ९ /प्र.क्र.७ ९ ७ /एलएक्यू/एसआर / २७७ / २०१ ९ .- भूमिसंपादन , पुनर्वसन व पुनर्वसाहत करताना उचित भरपाई मिळण्याचा आणि पारदर्शकतेचा हक्क अधिनियम , २०१३ ( २०१३ चा ३० ) याच्या कलम ३ च्या खंड ( इ) च्या परंतुकाद्वारे प्रदान करण्यात आलेल्या अधिकारांचा वापर करून काढण्यात आलेली शासकीय अधिसूचना , महसूल व वन विभाग क्रमांक संकिर्ण ११ / २०१४ /प्र.क्र.७७ / अ-२ , दिनांक १ ९ जानेवारी, २०१५ ( यात यापुढे जिचा निर्देश " उक्त अधिसूचना " असा करण्यात आला आहे. ) याद्वारे असे अधिसूचित केले आहे की , उक्त अधिनियमाच्या कलम ३ च्या खंड (झेड ए) मध्ये व्याख्या केलेल्या एखाद्या सार्वजनिक प्रयोजनासाठी , एखाद्या जिल्ह्यातील ५०० हेक्टरपेक्षा अधिक नसेल इतक्या क्षेत्राकरीता जमीन संपादन करण्याच्या संबंधात , अशा जिल्ह्याचा जिल्हाधिकारी हा उक्त अधिनियमाच्या प्रयोजनासाठी समुचित शासन असल्याचे मानण्यात येईल .
२. ज्याअर्थी , उक्त अधिसूचनेनुसार समुचित शासन असलेल्या , मुंबई उपनगर जिल्ह्याच्या जिल्हाधिकाऱ्यास यासोबत जोडलेल्या अनुसूची मध्ये अधिक तपशीलवार वर्णन केलेली जमीन ( यात यापुढे जिचा निर्देश " उक्त जमीन " असा करण्यात आला आहे. ) मुंबई मेट्रो मार्गिका ६ च्या आदर्श नगर मेट्रो स्थानक ते जोगेश्वरी मेट्रो स्थानकाला जोडण्यात येणाऱ्या व्हायडक्ट व फ्लायओव्हरकरिता ( Vai Duct & Fly- over ) या प्रयोजनासाठी (यात यापुढे जिचा निर्देश उक्त " सार्वजनिक प्रयोजन " असा करण्यात आला आहे. ) आवश्यक आहे अथवा तिची आवश्यकता भासण्याची शक्यता आहे , असे वाटते आणि म्हणून उक्त अधिनियमाच्या कलम ११ च्या पोट- कलम ( १ ) च्या तरतुदीन्वये याद्वारे असे अधिसूचित करण्यात येते की , उक्त जमिनीची उक्त सार्वजनिक प्रयोजनासाठी आवश्यकता भासण्याची शक्यता आहे.
३. ज्याअर्थी सदर भूसंपादन प्रस्तावातील मिळकत ही उक्त सार्वजनिक प्रयोजनार्थ पायाभूत सुविधासाठी संपादन करण्यात येत असल्याने सदर प्रस्तावास महाराष्ट्र शासन राजपत्र दिनांक २६ एप्रिल , २०१८ मधील कलम १० ( क) अन्वये भूमी संपादन , पुनर्वसन व पुनर्वसाहत करताना उचित भरपाई मिळण्याचा आणि पारदर्शकतेचा हक्क अधिनियम , २०१३ ( यापुढे ज्याचा निर्देश उक्त " भूसंपादन कायदा " असा करण्यात आला आहे. ) मधील प्रकरण क्रमांक २ व ३ मधील (कलम ४ ते १० मधील ) तरतूदी लागू करण्यापासून सूट देण्यात आली आहे.
४. आणि ज्याअर्थी, उक्त जमिनी उक्त सार्वजनिक प्रयोजनासाठी आवश्यक असल्याबाबतची जिल्हाधिकारी , मुंबई उपनगर जिल्हा यांची खात्री झाली आहे.

भाग एक (को.वि.पु. )- ४०-१ २ महाराष्ट्र शासन राजपत्र असाधारण भाग एक- कोकण विभागीय पुरवणी , सप्टेंबर १८ , २०२० /भाद्र २७ , शके १९ ४२ ५. त्याअर्थी , आता असे घोषित करण्यात येत आहे की, उक्त अधिनियमाच्या कलम ११ च्या पोट- कलम ४ अनुसार कोणतीही व्यक्ती , ही अधिसूचना प्रसिद्ध झाल्याच्या दिनांकापासून ते उक्त अधिनियमाच्या प्रकरण- चार खालील कार्यवाही पूर्ण होईल त्या कालावधीपर्यंत उक्त जमिनीचा अथवा तिच्या भागाचा कोणताही व्यवहार करणार नाही किंवा उक्त जमिनीवर कोणताही भार निर्माण करणार नाही . परंतू, उक्त जमिनीच्या अथवा तिच्या भागाच्या मालकाने अर्ज केल्यावर , जिल्हाधिकाऱ्यास विशेष परिस्थितीची कारणे लेखी नमूद करून अशा मालकास उपरोक्त तरतुदीच्या प्रवर्तनातून सूट देता येईल; परंतू आणखी असे की , जर कोणत्याही व्यक्तीने या तरतुदीचे बुद्धीपुरस्सर उल्लंघन केल्यामुळे तिला झालेल्या कोणत्याही हानीची किंवा क्षतीची जिल्हाधिकाऱ्याकडून भरपाई दिली जाणार नाही. तसेच , उक्त अधिनियमाच्या कलम ११ च्या पोट कलम ( ५ ) अनुसार, जिल्हाधिकारी भूमिसंपादन , पुनर्वसन व पुनर्वसाहत करताना उचित भरपाई मिळण्याचा व पारदर्शकतेचा हक्क ( महाराष्ट्र) नियम, २०१४ (यात यापुढे ज्यांचा निर्देश " उक्त नियम " असा करण्यात आला आहे. ) च्या नियम १० च्या उप - नियम ( ३ ) द्वारे विहित केल्याप्रमाणे भूमि अभिलेखाच्या अद्ययावतीकरणाचे काम हाती घेणार असल्याचे व पूर्ण करणार असल्याचे देखील घोषीत करण्यात येत आहे . आणि उक्त अधिनियमाच्या कलम ३ च्या खंड (छ ) अन्वये , समुचित शासन असलेला जिल्हाधिकारी , उक्त अधिनियमाखालील जिल्हाधिकाऱ्यांची कार्ये पार पाडण्यासाठी उप जिल्हाधिकारी ( भूसंपादन ) क्र. ४ , मुंबई उपनगर जिल्हा यास पदनिर्देशित करीत आहे .

NOTIFICATION
RIGHT TO FAIR COMPENSATION AND TRANSPARENCY IN LAND ACQUISITION , REHABILITATION AND RESETTLEMENT ACT, 2013 .
No. C / ACQ/ Desk- 9/ CR.796/ LAQ/ SR /277 / 2019 .- Whereas , the Government of Maharashtra vide Government Notification , Revenue and Forests Department , No. MIS - 11 / 2014/C.R.77 /A- 2 , dated the 19th January 2015 ( hereinafter referred to as " the said notification " ) issued in exercise of the powers conferred by the proviso to clause ( e ) of section 3 of the Right to Fair Compensation and Transparency in Land Acquisition , Rehabilitation and Resettlement Act , 2013 (30 of 2013) , has notified that in relation to acquisition ofland in respect of a public purpose , as defined in clause (za ) of section 3 of the said Act , in a District for an area not exceeding 500 hectors , the Collector of such District shall be deemed to be the appropriate Government , for the purposes of the said Act ;
2. Whereas , it appears to the Collector of Mumbai Suburban District being the appropriate Government in view of the said notification , that land more particularly described in schedule appended hereto ( hereinafter referred to as " the said land " ) , is needed or likely to be needed for the public purpose for Via-Ductand Fly - over connecting Adarsh Nagar Metro Station to Jogeshwari Metro Station of Metro line - 6. ( hereinafter referred to as " the said public purpose " ) , and therefore , it is hereby notified under provisions of sub - section ( 1 ) of section 11 of the said Act, that the said land is likely to be needed for the said public purpose;

Whereas , the land under this project is acquired for infrastructural facilities , this project is exempted from the application of provisions of chapters 2 and 3 ( from section 4 to 10) of Rightto Fair Compensation and Transparency in Land Acquisition , Rehabilitation and Resettlement Act , 2013. ( hereinafter referred as " Said Acquisition Act " ) by section 10 ( A) of State Government notification dated 26th April , 2018 ;
4. And whereas , the Collector , Mumbai Suburban District , is satisfied that the said land is needed for the said public purpose .
5. Therefore , it is declared that as per sub- section ( 4) of section 11 of the said act , no person shall make any transaction of said land or part thereof or create any encumbrances on said land from the date of publication of this Notification till such time as the proceeding under Chapter IV of the said Act are completed : Provided that , the collector may, on the application made by the owner of the said land or part thereof exempt in special circumstances to be recorded in writing , such owner from the operation of the above provision : Provided further that , any loss or injury suffered by any person due to his willful violation of this provision shall not be made up by the Collector . It is further declared that according to sub - section ( 5) of section 11 of the said Act , the Collector is going to undertake and complete the exercise of updating ofland records as prescribed by sub - rule ( 3) of rule 10 of the Right to Fair Compensation and Transparency in Land Acquisition , Rehabilitation and Resettlement ( Maharashtra ) Rules , 2014 ( hereinafter referred as the said Rules ) ; And Whereas , under clause ( g ) of section 3 of the said Act , the Collector being the appropriate Government is pleased to designate Deputy Collector ( Land Acquisition ) No. 4, Mumbai Suburban District to perform the functions of a Collector under the said act .
