(उर्वरित ०.१०.० हे. आर क्षेत्र मसणवटा म्हणून पूर्ववत सुरू राहील.)

DRAFT OF NOTIFICATION

In view of the resolution No. 155 dated the 3rd September 2020 passed by the Mhasala Municipal Council and in exercise of the powers conferred under sub-section (1) of section 253 of the Maharashtra Municipal Council Nagar Panchayat and Industrial Townships Act, 1965, I, Smt. Nidhi Choudhari, Collector Raigad, do hereby direct that area admeasuring 0.61.0 H. R. out of the total area admeasuring 0.71.0 H. R. of following described land situating at village Mhasala, Taluka Mhasala, Dist. Raigad shall cease to be used for the disposal of the dead bodies from dated the 30th September 2020, (Remaining area admeasuring 0.10.0 H. R. of said land shall be continued to be used for the disposal of the dead bodies.)

(UNDER SECTION 144 OF CRIMINAL PROCEDURE CODE, 1973)

No. XI(6)/144/(05)/2020.—Whereas, due to the situation prevailing in the areas under the control of Commissioner of Police, Brihan Mumbai, it is apprehended that subversive/anti- social elements may seek hide outs in the residential areas and there is every likelihood of breach of peace and disturbance of public tranquility with grave danger to human life and injury to private/public property on that account ;

2. And whereas, it is necessary that some checks should be put on landlords/tenants so that terrorist/anti-social elements in the guise of tenants may not cause subversive activities, riots, affray etc. and that immediate action is necessary for the prevention of the same.

3. Now, therefore, I, Shahaji Umap, Dy. Commissioner of Police (Operations), Greater Mumbai and Executive Magistrate, vide powers conferred upon me under section 144 of the Criminal Procedure Code, 1973 (Act II of 1974) r/w the Commissioner of Police Brihan Mumbai's Order dated 23rd December 1959 u/s 10, sub-section (2) of the Maharashtra Police Act, 1951 (Mah. Act XXII of 1951) do hereby order that each landlord/owner/person of any house/property which falls under the jurisdiction of Mumbai Police Commissioner who has let/ sub-let/rent out any accommodation to any person, shall immediately furnish the particulars of the said tenant/tenants to the Senior Police Inspector of the Police station concerned. The persons dealing in property business, shall also inform in writting, to the Senior Police Inspector concerned, in whose jurisdiction the premises fall, about the particulars of the said tenants.

4. If the person to whom the accommodation is let/sub-let/rented out is a Foreigner, then the owner and the Foreigner, shall furnish his Name, Nationality, Passport details i.e. Passport No., Place and date of issue, validity, Visa details i.e. Visa No., category, place and date of issue, validity, registration place and reason for stay in city to the concerned police station.

5. This order shall come into force with effect from 26th September 2020 and shall be effective for a period of 60 days upto 24th November 2020 (both days inclusive) unless withdrawn earlier.

6. Any person contravening this order shall be punishable under section 188 of the Indian Penal Code, 1860.

7. As the notice cannot be served individually to all concerned, the order is hereby passed ex-parte. It shall be published for the information of public, through press and by affixing copies on the Notice Boards of the Police Stations, Divisional ACsP, Zonal DCsP, Municipal Ward Offices and by affixing copies at Tahsil and Ward Offices.

Order

No. CP/RLY/MUMBAI/PROHIBIT ACTS/2020-18.—Whereas, I consider it necessary for the preservation of public peace and public safety in Mumbai Railway Police Commissionerate. I Ravindra Sengaonkar, Commissioner of Police, Railways, Mumbai in exercise of the power conferred upon me under sub-sections (1), (2) and (3) of section 37 of the Maharashtra Police Act, 1951 (Mah. Act XXII of 1951) do hereby prohibit the following acts throughout Mumbai Railway Police Commissionerate for the period from 00.01 hours of 1st October 2020 to 24.00 hrs. of 15th October 2020.

1. (a) The carrying of arms, cudgels, swords, spears, bludgeons, unlicensed gun, knives, sticks or lathis or any other articles which is capable of being used for causing physical harms (violence). Save for such firearms where license has been granted by this authority or where specific permission is sought for carriage of such arms from the competent authority.

(b) The carrying of any corrosive substance or explosive.

(c) The carrying, collection and preparation of stones or other missiles or instruments or means of casting or impelling missiles.

(d) The exhibition of persons or corpses or figures or effigies thereof.

(e) The public utterance of cries, singing of songs, playing of music.

(f) Delivery of harangues, use of gestures or mimetic, representations and the preparations, exhibition or dissemination of pictures, symbols, placards or any other object or thing which may in the opinion of any police officer posted in Mumbai Railway Commissionerate offend against decency or morality or undermine the security of or tend to over-throw the State.

2. If any persons goes armed with such article or carries any corrosive substance or explosive or missile in contravention of such prohibition he shall be liable to be disarmed of the corrosive substance or explosive or missile shall be liable to seized from him by any police officer and the article, corrosive substance, explosive or missile so seized shall be forfeited to the State Government.

3. This order will not be applicable to any person being in service or employment of any Government or Government Undertaking required by his superiors or by the nature of his duties, to carry weapons. The order will also not be applicable to Private Security Guards or Gurkhas or Chowkidars etc. employed on watch-n-ward duties carrying lathis admeasuring in length not exceeding 3¹/2 feet.

4. Notwithstanding the expiration of this order after the period hereinabove mentioned.

(a) Any investigation or legal proceeding may be instituted, continued or enforced.

(b) Any penalty, forfeiture or punishments incurred in respect of any contravention of this order may be imposed, as if this order had not expired.

5. I further direct that this order shall be published and promulgated in Mumbai Railway Police Commissionerate by affixing copies thereof in conspicuous public places and by announcing the same through Railway announcement system, loudspeakers or megaphone, as well as publishing through media.

(UNDER SECTION 144 OF CRIMINAL PROCEDURE CODE, 1973)

No. CP/XI(6)/2266/(07)/2020.—Whereas, it is likely that terrorist/anti-national elements might make use of drones, remote controlled micro-light aircrafts, aerial missiles, para-gliders in their attacks and thereby target VVIPs, endangering the life of public at large, destroy public property and cause disturbance to law and order in the Brihanmumbai Police Commissionerate area ;

2. Whereas, it has become necessary that certain restrictions should be put on the activities of such elements across the Brihanmumbai Police Commissionerate to prevent probable sabotages through such drones, remote controlled micro-light aircrafts, aerial missiles, para-gliders, for which some preventive and proactive measures needed be taken to prevent the same.

3. Therefore, I, Shahaji Umap, Dy. Commissioner of Police (Operations), Brihanmumbai and Executive Magistrate, vide powers conferred upon me under section 144 of the Criminal Procedure Code, 1973 (Act II of 1974) do hereby order that no flying activities of drone, remote controlled micro-light aircrafts aerial missiles, para-gliders, etc. shall be allowed in the jurisdiction of Brihanmumbai Police Commissionerate for the period of next 30 Days, i.e. from 29th September 2020 to 28th October 2020 except for aerial surveillance by Mumbai Police or by specific permission in writing by Dy. Commissioner of Police (Operation), Brihanmumbai.

4. This order shall remain in force with effect 00.01 hrs. of 29th September 2020 till 24.00 hrs. of 28th October 2020 unless withdrawn earlier.

5. Any person contravening this order shall be punishable under section 188 of the Indian Penal Code, 1860.

महाराष्ट्र नागरी सेवा नियम, १९८१ मधील नियम, ३९ नुसार प्रमाणित करणेत येत आहे की, श्री. अे. अे. पांडे, हे अधिकारी जर उपरोक्त कालावधीत रजेवर गेले नसते तर ४थेे सह दिवाणी न्यायाधीश, क. स्तर, पनवेल या पदावर स्थानापन्न म्हणून काम करीत राहीले असते.

श्री. अे. अे. पांडे, हे अधिकारी रजेवर जाण्यापूर्वी जे वेतन आहरित करीत आहेत त्याच दराने वेतन काढणेत यावे. उपरोक्त कालावधीत त्यांचे न्यायालयाचा कार्यभार श्री. ए. एस. सोनवलकर, ५ वे सह दिवाणी न्यायाधीश, क. स्तर, पनवेल यांजकडे राहील.

श्रीमती एम. ए. आनंद, ह्य रजेवर जाण्यापूर्वी जे वेतन आहरित करीत आहेत त्याच दराने वेतन काढणेत यावे. उपरोक्त कालावधीत त्यांचे न्यायालयाचा कार्यभार श्री. आर. जी. अस्मर, जिल्हा न्यायाधीश-१, पनवेल, जिल्हा-रायगड यांचेकडे राहील.

चौकशी करणे.

उपरोक्त न्यायिक अधिकारी जर गैरहजर असतील तर त्यांच्या न्यायालयाचा कार्यभार स्थायी आदेशाप्रमाणे राहील.
