महाराष्ट्र प्राणी रक्षण अधिनियम, १९७६.
क्रमांक पविआ-१०२० / प्र.क्र.१४ / पदुम -३ . महाराष्ट्र प्राणी रक्षण अधिनियम , १ ९ ७६ (१ ९ ७७ चा महा.९ ) याच्या कलम ४ द्वारे प्रदान करण्यात आलेल्या अधिकाराचा आणि याबाबतीत त्यास समर्थ करणाऱ्या इतर सर्व अधिकारांचा वापर करून महाराष्ट्र शासन, याद्वारे शासन अधिसूचना कृषि व सहकार विभाग , क्रमांक एपीए. १०८ ९ / ३४० ९९ / ( २४६ ) / एएच-३ , दिनांक २४ जुलै १ ९ ८७ मध्ये पुढील सुधारणा करण्यात येत आहे : -
उक्त अधिसूचनेला जोडलेल्या अनुसूचीनंतर खालीलप्रमाणे मजकूराचा अंतर्भाव करण्यात येत आहे ;
२. महाराष्ट्र प्राणी रक्षण कायदा ( सुधारणा) १ ९९ ५ च्या अनुसूचीमध्ये अंतर्भुत असणाऱ्या प्राण्यांच्या कत्तलीसंदर्भात कत्तलपूर्व तपासणी करीता सक्षम प्राधिकारी: -
(अ ) मांस निर्यातीकरिता, APEDA अथवा केंद्र शासनाच्या तत्सम प्राधिकरणांद्वारे प्राधिकृत असलेल्या राज्यातील अधिकृत कत्तलखान्यांनी नियुक्त केलेल्या , भारतीय पशुचिकित्सा अधिनियम , १ ९ ८४ मधील तरतुदीनुसार नोंदणीकृत असलेल्या ; सोबत जोडलेल्या प्रपत्र - अ मध्ये नमूद खाजगी पशुवैद्यकांना ; संबंधित कत्तलखान्याकरिता महाराष्ट्र प्राणी रक्षण कायदा ( सुधारणा) १९९ ५ च्या अनुसूचीमध्ये अंतर्भुत असणाऱ्या प्राण्यांच्या कत्तलीसंदर्भात कत्तलपूर्व तपासणी करण्यासाठी " सक्षम प्राधिकारी " म्हणून घोषित करण्यात येत आहे .
(ब) महाराष्ट्र प्राणी रक्षण कायदा ( सुधारणा ) १ ९९ ५ व प्राणी क्लेष प्रतिबंधक ( कत्तलखाना) नियम , २००१ च्या सर्व तरतुदींचे काटेकोरपणे पालन करण्याची जबाबदारी , वर ( अ) मध्ये सक्षम प्राधिकारी म्हणून घोषित केलेल्या भारतीय पशुचिकीत्सा अधिनियम , १ ९८४ मधील तरतुदीनुसार नोंदणीकृत पशुवैद्यकिय पदवीधरांची व संबंधित कत्तलखान्यांची राहील .
(क) वर ( अ) मध्ये नमूद सक्षम प्राधिकारी , त्यांचा नियुक्तीचा कालावधी संपुष्टात आल्यास अथवा, त्यांची नियुक्ती रद्द झाल्यास ते सक्षम प्राधिकारी म्हणून कार्य करू शकणार नाहीत.

NOTIFICATION

MAHARASHTRA ANIMAL PRESERVATION ACT , 1976
No. PAVIA. 1020/ C.R.14 /ADF - 3.- In exercise of the powers conferred by the section 4 of the Maharashtra Animal Preservation Act , 1976 ( Mah . IX of 1977 ) and all of other powers enabling it in this behalf , the Government of Maharashtra hereby amends , the Government Notification , Agriculture and Co - operation Department , No.APA.1089 / 34029 I ( 246 ) /AH - 3 , Dated the 24th July 1987 , namely :-
After the Schedule , appended to the said notification , following matter has been inserted ;
2. Appointment of the officers to perform the functions of " Competent Authority " under the said Act ;
( a ) The Veterinary Private Practitioners ; mentioned in Annexure - A; registered under provisions of the Veterinary Council Act , 1984 are hereby declared as the " Competent Authority " to perform the Ante - mortem examination of animals incorporated in the Schedule ofMaharashtra Animal Preservation (Amendment ) Act , 1995 to be slaughtered at concerned slaughterhouse authorized by APEDA or other similar Authorities of Central Government for the purpose of meat export .
( b ) Responsibility to strictly abide by all the provisions of Maharashtra Animal Preservation ( Amendment ) Act 1995 and Prevention of Animals Cruelty to Animals (Slaughterhouse ) Rules , 2001 , rests with Veterinary graduates registered as per the provisions of Indian Veterinary Act , 1984 declared hereby as " Competent Authority " mentioned above in ( a ) at the concerned slaughterhouses .
(c) The " Competent Authority " mentioned above in ( a ) , will not be able to act as the " Competent Authority " after the completion of period of their appointment or , cancellation of their appointment .
