No. BYE-2020/CR. 241/20/XXXIII.—In pursuance of section 153, of the Representation of People Act, 1951 (43 of 1951), the following is published for General Information :—

NOTIFICATION
No. 100/MT-LC/02/2020/LAC.—WHEREAS, the Election Commission of India, vide Press Note No. ECI/PN/29/2020, dated 4th March 2020 announced bye-election to the Maharashtra Legislative Council from Dhule-cum-Nandurbar Local Authorities' constituency to fill the vacancy caused due to resignation of the sitting member Shri Amrishbhai Rasiklal Patel, which was notified vide Notification No.100/MT-LC/02/2020-LAC, dated 5th March 2020. After the last date of withdrawal on 16th March 2020, the list of contesting candidates in Form 7B was published with 2 candidates in fray. The election was to be conducted on 30th March 2020 (Monday) and the date before which election was to be completed as earlier announced by the Commission was 1st April 2020 (Wednesday) as per the Notification dated 5th March 2020.
2. WHEREAS, considering the unforeseen situation of public health emergency due to COVID-19 and the guidelines & orders passed under the Disaster Management Act, 2005 by the competent authority, the Election Commission, under Article 324 of Constitution of India read with Section 153 of the Representation of the People Act, 1951, vide its Notification dated 24th March 2020 had extended the period of election by 60 days, which was further extended by 45 days and to a later date vide Notification dated 22nd May 2020 and 6th July 2020 respectively.

Whereas, it was also specified that the list of activities already carried out under the Notification dated 5th March 2020 was to remain valid for the purpose of remaining activities as was prescribed under the said notification.
4. Whereas, the Commission, having considered the inputs received from the Chief Electoral Officer, Maharashtra has now decided that above mentioned bye-election to the Dhule-cum- Nandurbar Local Authorities' constituency of Maharashtra be held in accordance with the following programme :—

Now, therefore, in view of the above and in exercise of the powers vested under article 324 of the Constitution read with Section 153 of the Representation of the People Act, 1951, the Election Commission hereby makes further amendment in its Notification No.100/MT-LC/02/ 2020-LAC, dated 5th March, 2020 as under :—
sub-para (d) & (e) of para (B) of the said Notification shall be substituted with "(d) the 1st December 2020 (Tuesday), as the date on which a poll shall, if necessary, be taken ; and
(e) the 7th December 2020 (Monday), as the date before which the election shall be completed ;
Further, para (C) of the said notification shall be substituted with
"(C) fixes the hours from 8-00 a.m. to 5-00 p.m., as the hours during which the poll shall, if necessary, be taken on the date specified above for the election."
