क्रमांक नि.वि. /वि.यो./लोणी-कदम/२ ९ ४ /११-२०२० .--ज्याअर्थी , भारतीय संविधानाच्या अनुच्छेद २४३ - त मधील खंड (ग) आणि महाराष्ट्र महानगर नियोजन समिती (रचना व कामे) अध्यादेश , १ ९९९ ( १ ९९९ चा अध्यादेश महा. बारा) चे कलम २ (म ) मधील तरतुदीनुसार प्राप्त अधिकाराचा वापर करून महाराष्ट्र शासनाने नगर विकास विभागाकडील अधिसूचना क्रमांक टीपीएस-१८ ९९ /११ ९ १ /प्र.क्र.८० /९९/नवि-१३ , दिनांक २३ जुलै १ ९९९ अन्वये पुणे शहराभोवतालचे काही क्षेत्र भारतीय संविधानाच्या भाग-९-अ च्या प्रयोजनार्थ " पुणे महानगर क्षेत्र " म्हणून घोषित केले आहे ;
आणि ज्याअर्थी, महाराष्ट्र शासन , नगर विकास विभागाकडील अधिसूचना क्रमांक पीएमआरडी-३३१६/प्र.क्र. ५४/नवि-७ , दिनांक ११ जुलै २०१६ अन्वये पुणे महानगर प्रदेशासाठी सदर अधिसूचनेसोबत जोडलेल्या अनुसूचित नमूद केलेल्या क्षेत्राकरिता मा . भारताचे राष्ट्रपती महोदयांनी वेळोवेळी घोषित केलेले अनुसूचित क्षेत्र वगळून पुणे महानगर प्रदेश विकास प्राधिकरणाची स्थापना केली आहे (यापुढे " उक्त प्राधिकरण " असे संबोधिलेले आहे) ;
आणि ज्याअर्थी, शासनाच्या नगर विकास विभागाने दिनांक १८ जानेवारी २०१८ रोजीची अधिसूचना क्रमांक टीपीएस-१८१७/प्र.क्र. १७३/ २०१७/नवि -१३ अन्वये उक्त अधिनियमाचे कलम ४० ( १) नुसार अन्वये पुणे महानगर प्रदेश क्षेत्रातील अधिसूचनेमध्ये नमूद अधिसूचित क्षेत्रासाठी पुणे महानगर प्रदेश विकास प्राधिकरणाची दिनांक ३१ मार्च २०१५ पासून विशेष नियोजन प्राधिकरण म्हणून नियुक्ती केली आहे.
आणि ज्याअर्थी, महाराष्ट्र प्रादेशिक नियोजन व नगर रचना अधिनियमाच्या कलम २३ ( १) अन्वये महानगर आयुक्त तथा मुख्य कार्यकारी अधिकारी , पुणे महानगर प्रदेश विकास प्राधिकरण यांनी, त्यांना बहाल करण्यात आलेल्या अधिकाराचा वापर करून पुणे महानगर प्रदेश विकास प्राधिकरण हे नियोजन प्राधिकरण म्हणून पुणे महानगर प्रदेशासाठी, पुणे व पिंपरी - चिंचवड महानगरपालिका सभोवतालचे क्षेत्र तसेच पुणे जिल्ह्यातील मावळ, हवेली, मुळशी, पुणे शहर या तालुक्यांचे पूर्ण क्षेत्र तसेच वेल्हा , पुरंदर , भोर , दौड, शिरूर व खेड या तालुक्यांतील काही भागांकरिता ( पुणे व पिंपरी - चिंचवड महानगरपालिका, तळेगाव- दाभाडे, लोणावळा , आळंदी , शिरूर, चाकण, राजगुरूनगर, सासवड या नगरपालिका आणि पुणे , देहुरोड व खडकी कटकमंडळे यांचे क्षेत्र व गावांचे गावठाण व इतर नियोजन प्राधिकरणाचे क्षेत्र वगळून) विकास योजना तयार करण्यासाठी दिनांक १९ जून २०१७ रोजी इरादा जाहीर केल्याबाबतची सूचना प्रसिद्ध केलेली आहे ;

महाराष्ट्र शासन राजपत्र, भाग एक असाधारण- पुणे विभागीय पुरवणी, नोव्हेंबर २१ , २०२० / कार्तिक ३० , शके १९ ४२ आणि ज्याअर्थी, शासनाच्या नगर विकास विभागाने उक्त अधिनियमाचे कलम २ (१५)(क) (i) मधील तरतुदीनुसार अधिसूचना क्रमांक टीपीएस- १८६ ९/१६०४५-W, दिनांक १३ जून १ ९ ६ ९ अन्वये पुणे जिल्हा परिषदेस लोणी काळभोर व कदम वाकवस्ती या गावांच्या भागशः महसुली क्षेत्रासाठी नियोजन प्राधिकरण म्हणून अधिकार वापरणेस अनुमती दिली होती ( यापुढे याचा उल्लेख " उक्त क्षेत्र " असा केला आहे);
आणि ज्याअर्थी, शासनाच्या नगर विकास विभागाने दिनांक १३ मार्च १ ९ ७५ रोजीची अधिसूचना क्रमांक टीपीएस -१८७५/१६०२ /W - ०२ अन्वये उक्त क्षेत्राची विकास योजना ( यापुढे " उक्त विकास योजना " असे संबोधलेली ) मंजूर केली असून ती दिनांक १ जून १९७५ पासून अंमलात आली आहे ;
आणि ज्याअर्थी, उक्त विकास योजना मंजुरीनंतर जिल्हा परिषद, पुणे यांनी उक्त मंजूर विकास योजना सुधारित करणेची कार्यवाही सुरुवात केलेली नसल्याने शासनाचे निर्णय क्रमांक टीपीएस-१८१ ९/व्हीआयपी/२०५ /प्र.क्र. १४८/१ ९/नवि-१३ , दिनांक ११ सप्टेंबर २०१ ९ अन्वये मौजे लोणी काळभोर व मौजे कदम वाकवस्ती विकास योजनेच्या क्षेत्रासह उक्त प्राधिकरणाचे अधिसूचित क्षेत्राचा एकसंघ विकास होण्याच्या दृष्टीने सदर क्षेत्राचे नियोजन व विकास उक्त प्राधिकरणाने करण्यात यावा असे निर्देश दिले आहेत ;
त्याअर्थी , उक्त अधिनियमाच्या कलम १५१ (१) अन्वये प्रदत्त असलेल्या आणि त्यासंदर्भातील इतर सर्व अधिकारांचा वापर करून संचालक, नगर रचना, महाराष्ट्र राज्य, पुणे यांनी मंजूर विकास योजना लोणी काळभोरच्या क्षेत्रासाठी पुणे जिल्हा परिषदेकडे शासन अधिसूचना दिनांक १३ जून १९ ६ ९ अन्वये दिलेला उक्त क्षेत्रासाठीचा नियोजन प्राधिकरणाचा दर्जा रद्द केलेला आहे ;
आणि ज्याअर्थी , मा . अध्यक्ष , पुणे महानगर प्रदेश विकास प्राधिकरण तथा मुख्यमंत्री, महाराष्ट्र राज्य यांनी दिनांक २१ ऑक्टोबर २०२० रोजी महानगर आयुक्त तथा मुख्य कार्यकारी अधिकारी , पुणे महानगर प्रदेश विकास प्राधिकरण यांना पुणे महानगर प्रदेशासाठी विकास योजना तयार करण्यासाठीच्या उद्देशाची घोषणा करण्यासाठी मान्यता दिलेली आहे .
आता त्याअर्थी , उक्त अधिनियमाच्या २३ ( १ ) अन्वये बहाल करण्यात आलेल्या अधिकाराचा वापर करून उक्त प्राधिकरणाच्या अधिसूचित क्षेत्राचा विकास योजनेसमवेत , लोणी काळभोर व कदम वाकवस्ती या गावांच्या भागशः महसुली क्षेत्राची विकास योजना तयार करणेसाठी जनतेकडून सूचना आणि/हरकती मागविण्यासाठी उक्त प्राधिकरणाचा नियोजन प्राधिकरण म्हणून इरादा जाहीर करणेबाबतची सूचना प्रसिद्ध करीत आहे. सूचना आणि/ हरकती असल्यास महानगर आयुक्त तथा मुख्य कार्यकारी अधिकारी , पुणे महानगर प्रदेश विकास प्राधिकरण , उपने स . क्र. १५२-१५३ , महाराजा सयाजीराव गायकवाड उद्योग भवन , चौथा मजला , औंध , पुणे-४११ ०६७ यांचे नावे हा इरादा महाराष्ट्र शासन राजपत्रात प्रसिद्ध झालेल्या दिनांकापासून ६० ( साठ) दिवसांच्या आत पाठवाव्यात.
फक्त विहित मुदतीतच प्राप्त होणाऱ्या सूचना आणि हरकती विचारात घेण्यात येतील . लोणी काळभोर व कदमवाकवस्ती या गावांचे भागशः महसुली क्षेत्र दर्शविणारा नकाशा पुणे महानगर प्रदेश विकास प्राधिकरणाच्या औंध, पुणे ४११ ०६७ येथील कार्यालयात कार्यालयीन कामकाजाच्या दिवशी व कामकाजाच्या वेळेत जनतेच्या निरीक्षणासाठी ठेवण्यात आलेला आहे.

Declaration of Intention for the preparation of Development Plan of
Loni Kalbhor and Kadam Wakwasti
Public Notice
PL/DP / Loni - Kadam /294/ 11 / 2020.-Whereas , Government in Urban Development Department vide it'sNotification No. TPS- 1899 / 1191 /CR - 80/99/ UD - 13 , dated the 23rd July 1999 issued in exercise of the powers conferred by Clause (c) of Article 243 - P of the Constitution of India read with Clause ( c) of Section 2 of the Maharashtra Metropolitan Planning Committees ( Constitution and Functions ) Ordinance , 1999, (Mah . Ord . XII of 1999 ) a certain area, in and around the City of Pune has been declared as the " Pune Metropolitan Area " for the purposes of Part IX-A of the Constitution of India ;
महाराष्ट्र शासन राजपत्र, भाग एक असाधारण-- पुणे विभागीय पुरवणी , नोव्हेंबर २१ , २०२० / कार्तिक ३० , शके १९४२ ३ and whereas , the Government of Maharashtra in Urban Development Department , vide Notification No. PMRDA - 3316/CR - 54/UD - 7 , dated the 11th July 2016 had established the Metropolitan Region DevelopmentAuthority to be called " the Pune Metropolitan Region Development Authority " for the Pune Metropolitan Region more specifically described in the Schedule appended hereto , excluding the area declared as the Scheduled areas by the Hon'ble President of India from time to time ( here in after referred to as " the said Authority " ) ;
and whereas , the Government in Urban Development had appointed the said Authority as the Special Planning Authority under Section 40 ( 1) ( d) of the said Act vide Notification No. TPS - 1817/ CR -173 /2017 / UD -13 dated 18th January 2018 with retrospective effect from 31st March 2015 for the notified area ;
and whereas , Metropolitan Commissioner and Chief Executive Officer, PMRDA in exercise of the powers conferred by sub - section ( 1 ) of Section 23 of the Maharashtra Regional and Town Planning Act , 1966 , published a Public Notice dated 19th June 2017 for the declaration of intention of the said Authority as Planning Authority to prepare the Development Plan for the area in and around the City of Pune and Pimpri - Chinchwad Municipal Corporation comprising the whole area of Maval , Haveli , Mulshi , Pune City and part of Velhe , Purandar, Bhor, Daund , Shirur and Khed Talukas of Pune District within the notified boundaries ( Excluding Pune and Pimpri - Chinchwad Municipal Corporations , Talegaon Dabhade , Lonavala, Alandi , Shirur, Chakan , Rajgurunagar, Sasawad Municipal Counsils and Pune , Dehuroad and Khadki CantonmentBoards , Village Gaothans and other Planning Authority Areas ) ;
and whereas , the Government in Urban Development Department , under Section 2( 15) ( c) ( i) of the said Act had appointed the Pune Zillha Parishad as the Planning Authority for the part revenue area of villages Loni Kalbhor and Kadam Wakwasti vide Notification No. TPS - 1869 /16045 - W dated 13th June 1969 (here in after referred to as " the said Area " ) ;
and whereas , the Government in Urban Development Department had sanctioned the Development Planfor the said Area vide Notification No. TPS - 1875/1602/W- 02 , dated 13th March 1975 and which has came into force from dated 1st June 1975 (hereinafter referred to as " the said Sanctioned Development Plan") ;
and whereas , since Zillha Parishad , Pune has not started the revision of the Sanctioned Development Planof Loni Kalbhor and Kadam Wakwasti , the Government in Urban Development Department issued directives under Section 154 of the said Act to Pune Metropolitan Regional Development Authority vide Notification No. TPS - 1819 /VIP/205 /CR - 148 / 19/UD - 13 dated 11th September 2019 to prepare planning proposal for the said Area ;
and whereas , in exercise of the powers conferred by Section 2( 15) ( c) of the said Act and all other powers enabling him in this behalf , the Director of Town Planning , Maharashtra State, Pune has withdrawn the powers given under Notification dated 13th June 1969 to Zillha Parishad , Pune as Planning Authority for the said Area ;
and whereas , the Hon'ble Chairman of the Pune Metropolitan Region Development Authority and ChiefMinister, Maharashtra State on dated 21st October 2020 has accorded sanction to the Metropolitan Commissioner and Chief Executive Officer, Pune Metropolitan Region Development Authority to declare the intention for the preparation of the Development Plan for the Loni Kalbhor and Kadam Wakwasti .
Now therefore , in exercise of the power conferred by sub - section ( 1 ) of Section 23 of the said Act, a notice of declaration of intention of the said Authority as Planning Authority to prepare the Development Plan for the part revenue area of the villages Loni Kalbhor and Kadam Wakwasti alongwith the Development ४
महाराष्ट्र शासन राजपत्र, भाग एक असाधारण- पुणे विभागीय पुरवणी , नोव्हेंबर २१ , २०२० / कार्तिक ३० , शके १ ९४२ Planof notified Area of the said Authority, is hereby published for inviting suggestions and / or objections , if any, from public to the proposed preparation of the Development Plan for the part revenue area of villages Loni Kalbhor and Kadam Wakwasti . The suggestions and / or objections , if any, should reach the Metropolitan Commissioner and Chief Executive Officer, Pune Metropolitan Region Development Authority (PMRDA) , Sr. Nos . 152-153 , Maharaja Sayajirao Gaikwad Udyog Bhavan , 4th Floor, Aundh , Pune 411 067 within a period of 60 ( Sixty) days from the date of publication of this Notice in the Maharashtra Gazette .
The suggestions and / or objections received within the stipulated period shall only be considered .
A copy of the Plan showing the part revenue area of Loni Kalbhor and Kadam Wakwasti is kept for the inspection of the public at the office of the Metropolitan Commissioner and Chief Executive Officer, Pune Metropolitan Region Development Authority, Pune ( PMRDA) , Aundh , Pune 411 067 on all working days during office hours.
