आणि ज्याअर्थी, उक्त प्रादेशिक योजना क्षेत्रामध्ये महानगरपालिका ''अ'', ''ब'' व ''क'' वर्ग नगरपरिषद व नगर पंचायती या स्थानिक स्वराज्य संस्था अंतभर्ूत आहेत (यापुढे ज्यांचा उल्लेख '' उक्त स्थानिक स्वराज्य संस्था '' असा करण्यात आला आहे.) ;

आणि ज्याअर्थी, केंद्र शासनाने प्रधानमंत्री आवास योजनेचे धोरण घोषित केले असून, सदर योजनेची राज्य शासनाच्या गृहनिर्माण विभागाकडून अंमलबजावणी करण्यात येत आहे ;

आणि ज्याअर्थी, उपरोक्त धोरण आणि गृहनिर्माण विभागाची विनंती विचारात घेतल्यानंतर जनहिताच्या दृष्टीने मुंबई, पुणे, औरंगाबाद व नाशिक महानगर प्रादेशिक योजनेतील स्थानिक स्वराज्य संस्थांचे क्षेत्र वगळता महाराष्ट्र राज्यातील उर्वरीत प्रादेशिक योजनेतील उक्त स्थानिक स्वराज्य संस्थांच्या बाहेरील परिघस्त क्षेत्रात प्रधानमंत्री आवास योजना लागू करणे व त्याकरिता उक्त प्रादेशिक योजनेच्या उक्त विकास नियंत्रण नियमावलीमध्ये सुधारणा करणे आवश्यक आहे, असे शासनाचे मत झाले आहे (यापुढे ज्याचा उल्लेख '' प्रस्तावित फेरबदल '' असा करण्यात आला आहे.) ;

त्याअर्थी, आता, उक्त अधिनियमातील कलम २० पोट-कलम (३) मधील तरतुदीनुसार उक्त प्रादेशिक योजनेच्या उक्त विकास नियंत्रण नियमावलीमध्ये खाली विश्लेषित केल्याप्रमाणे प्रस्तावित फेरबदल करण्याचा हेतु या सुचनेद्वारे शासन घोषित करीत आहे आणि प्रस्तावित फेरबदलासंदर्भात आम नागरिकांकडून हरकती आणि/किंवा सूचना मागविण्याची सूचना त्यासोबतच्या परिशिष्ट ''अ'' व ''ब'' मधील प्रारूप नियमावलीसह प्रसिद्ध करीत आहे. प्रस्तावित फेरबदलाच्या अनुषंगाने काही सुचना आणि/किंवा हरकती द्यावयाच्या असतील तर त्या नागरिकांनी ही सूचना शासन राजपत्रात प्रसिद्ध झाल्याच्या दिनांकापासून १ (एक) महिन्याच्या आत संबंधित विभागीय सहसंचालक, नगररचना, यांच्या नावे लेखी स्वरुपात द्याव्यात. प्रस्तावित फेरबदल प्रस्तावावर प्राप्त हरकती/सुचनांवर संबंधितांना सुनावणी देऊन शासनास अहवाल सादर करणेसाठी संबंधित विभागीय सहसंचालक, नगररचना, यांची अधिकारी म्हणून नियुक्ती करण्यात येत आहे. ही सूचना महाराष्ट्र शासनाच्या राजपत्रात प्रसिद्ध झाल्याच्या दिनांकापासून फक्त १ (एक) महिन्याच्या आत प्राप्त होणाया हरकती आणि/किंवा सूचना शासनाकडून विचारात घेण्यात येतील.

प्रस्तावित फेरबदल '' मुंबई, पुणे, औरंगाबाद व नाशिक महानगर प्रादेशिक योजना क्षेत्रातील स्थानिक स्वराज्य संस्था वगळून राज्यातील उर्वरीत प्रादेशिक योजनेतील महानगरपालिका, ''अ'' ''ब'' व ''क'' वर्ग नगरपरिषद व नगरपंचायतीच्या हद्दीबाहेरील खालील नमूद अंतरामधील परीघ क्षेत्रात प्रादेशिक योजना क्षेत्रातील रहिवास विभागात २.५० चटई क्षेत्र निर्देशांक आणि हरीत तसेच ना-विकास विभागात १.०० चटई क्षेत्र निर्देशांकासह प्रधानमंत्री आवास योजना अनुज्ञेय करण्याचे प्रस्तावित आहे.

Regulations to allow '' Pradhan Mantri Awas Yojana '' in Residential Zone

Following New Regulation shall be added in the Development Control Regulations of Regional plans of the state excluding Mumbai, Pune, Aurangabad and Nashik Metropolitan Region to permit "Pradhan Mantri Awas Yojana" in Residential Zone where construction is permitted; for the purpose of providing Affordable Housing to the Economically Weaker Sections (EWS) & Low Income Group (LIG), undertaken by Government / any Institutions authorized by the Government or Owner / any Private Developer (hereinafter referred to as "the Project Proponent"), subject to the following conditions.

Conditions :—

1. These Regulations shall only be applicable for development undertaken under "Pradhan Mantri Awas Yojana" wherein all the tenements shall be constructed for EWS / LIG with the use of latest technology.

2. Such Development shall not be permitted on the lands, which deserve preservation or protection from Environmental conditions viz. Hilltop and Hill slopes, Coastal Regulation Restrictions, restrictions from water bodies and quarries or any restrictions mentioned under Heritage Regulations.

3. Such Development shall not be permitted on the Forest Lands, lands used for Orchards, Nurseries, lands affected by Green Belt Zone, Mangroves, Marshy Lands, area under any Buffer Zone and other environmentally sensitive areas etc.

4. The minimum width of approach road shall be 15.0 mt.

5. The permissible FSI for such projects shall be 2.5

6. The concerned Collector, before granting development permission, shall verify and satisfy himself in respect of the feasibility of providing basic infrastructure facilities like electricity, water supply, Sewerage etc. required for the project.

7. The project proponent shall plan proper internal Road network including major linkage to outside roads, wherever necessary.

8. The project proponent shall provide all the basic facilities and utilities, on-site infrastructure and also off-site infrastructure such as Road, water line, drainage line, street light, Waste Water Recycling Plant etc. at his own cost to the satisfaction of the concerned Collector. In no case the burden of providing infrastructure shall lie with the Planning Authority.

Provided that the project proponent shall lay the water, drainage/sewage lines up to the nearest existing lines which are laid by the concerned Planning Authority.

9. The carpet area of the tenement shall not be more than the carpet area as may be decided by the Government of Maharashtra from time to time in respect of EWS /LIG Housing.

10. Amalgamation of two or more tenements shall not be permissible under any circumstances.

11. All other guidelines and norms shall be followed as may be decided by the Government of India or State Government, from time to time in respect of "Pradhan Mantri Awas Yojana".

Following New Regulation shall be added in the Development Control Regulations of Regional plans of the state excluding Mumbai, Pune, Aurangabad and Nashik Metropolitan Region to permit "Pradhan Mantri Awas Yojana" in Green Zone/No Development Zone for the purpose of providing Affordable Housing to the Economically Weaker Sections (EWS) and Low Income Group (LIG), undertaken by Government / any Institutions authorized by the Government or Owner/any Private Developer (hereinafter referred to as "the Project Proponent"), subject to the following conditions.

Conditions :—

4. The minimum width of approach road shall be 12.0 mt.

5. The permissible FSI for such projects shall be 1.00

7. The project proponent shall plan proper internal Road network including major linkage to outside roads, wherever necessary.

Provided that the project proponent shall lay the water, drainage/sewage lines up to the nearest existing lines which are laid by the concerned Planning Authority.

9. The land under project shall be considered as if it is in the Residential Zone and all concerned regulations, viz. side margin, building height, etc. shall be applicable as per the Residential Zone, except utilisation of TDR and Premium F.S.I.

10. The carpet area of the tenement shall not be more than the carpet area as may be decided by the Government of Maharashtra from time to time in respect of EWS/LIG Housing.

11. Amalgamation of two or more tenements shall not be permissible under any circumstances.

12. All other guidelines and norms shall be followed as may be decided by the Government of India or State Government, from time to time in respect of '' Pradhan Mantri Awas Yojana ''.

MAHARASHTRA REGIONAL AND TOWN PLANNING ACT, 1966.

No. TPS-1219/UOR-86/C.R. 69/20/UD-12.— Whereas, the State Government has sanctioned the Regional Plans (hereinafter referred to as "the said Regional Plans") and the Development Control Regulations (hereinafter referred to as "the said Development Control Regulations") in the State of Maharashtra under the provisions of the Maharashtra Regional and Town Planning Act, 1966 (hereinafter referred to as "the said Act") and the regional plans had come into force with effect from the date metioned in the respective notifications ;

And whereas, the said Regional Plans include the Urban Local Bodies namely, Municipal Corporations, 'A', 'B' and 'C' class Municipal Councils and Nagar Panchayats (hereinafter referred to as "the said Urban Local Bodies") ;

And whereas, Government of India has declared the housing policy known as the Pradhan Mantri Awas Yojana, which is being implemented by the State Government in the Housing Department ;

And whereas, in view of the above policy and as per the request of Housing Department, the Government in the Urban Development Department, is of the opinion that in the public interest, the Pradhan Mantri Awas Yojana should be implemented in the periphery of the said Urban Local Bodies situated in the regional plans in the State of Maharashtra excluding the Urban Local Bodies situated in the Mumbai, Pune, Aurangabad and Nashik Metropolitan Region and accordingly, it is necessary to carry out suitable modification to the said Development Control Regulations, of the said Regional Plans (hereinafter referred to as the "proposed Modification );

Now, therefore, in accordance with the provisions contained in subsection (3) of section 20 of the said Act, the Government hereby, publishes this notice alongwith proposed regulation as shown in 'Schedule-A' and 'Schedule-B' attached herewith for inviting objections and / or suggestions in respect of the proposed modification more specifically described below from the general public within l(one) month from the date of publication of this notice in the Official Gazette. The objections and/or suggestions in this regards shall be addressed to the concerned Joint Director of Town Planning, who is hereby authorised to hear the objections and/or suggestions which may be recieved within the aforesaid prescribed period and submit his report to the Government. The objections and/or suggestions received within the aforesaid stipulated period, shall only be cosidered by the Government.

Proposed Modification

The scheme of Pradhan Mantri Awas Yojana is proposed to be allowed in Residential Zone with 2.50 F.S.I. and Green Zone/ No Development Zone with 1.00 F.S.I. in the Regional Plan along the periphery of the Municipal Corporations, 'A', 'B' and 'C' class Municipal Councils and Nagar Panchayats excluding the urban local bodies in the Mumbai, Pune, Aurangabad and Nasik Metropolitan Regional Plan as described below :—

ज्याअर्थी, संस्थेचे कामकाज हे तिच्या उपविधीत नमूद केलेनुसार सभासदांकडुन ठेवी स्विकारणे, त्याचा विनियोग कर्ज देणे अथवा गुंतवणुक करणे नियमानुसार संस्थेस बंधनकारक आहे ;

ज्याअर्थी, नागरी/ग्रा.बि. शेती सहकारी पतसंस्थांना त्यांनी वितरीत केलेले कर्जाची वसुली वा थकीत कर्जाची वसुली यासाठी कर्जदारांना वसुली नोटीसा निर्गमित करणे, जंगम वा स्थावर मालमत्ता जप्त करणे, कर्जदार व जामीनदार यांचे स्थावर मालमत्तेवर बोजा लावणे, जप्त मिळकतीची लिलावापूर्वीची वाजवी किंमत निश्चित करणे, जप्त मिळकतीचे संस्थेच्या नावे हस्तांतरण करणे इ. अनुषंगीक कामकाज करणे आवश्यक आहे ;

ज्याअर्थी, श्री कृष्ण ग्रा. बि. शेती सहकारी पतसंस्था मर्या. मोहाडी, ता. दिंडोरी, जि. नाशिक या संस्थेने देखील तिच्या थकीत कर्जदारांकडून रकमांचे वसुलीसाठी संस्थेचे व्यवस्थापक श्री. दिलीप काशिनाथ बर्वे यांना महाराष्ट्र सहकारी संस्था अधिनियम १९६० चे कलम १५६ व नियम १०७ नुसार कर्जदारांची मालमत्ता जप्त करुन तिची विक्री करुन रकमा वसूल करणेसाठी कलम १५६ (१) व नियम १०७ नुसार वसुलीचे अधिकार प्रदान करणेची विनंती उपरोक्त वाचावे क्रमांक ८ नुसार या कार्यालयास केलेली आहे व तसा प्रस्ताव आवश्यक त्या कागदपत्रांसह संस्थेचे निबंधक यांचेमार्फत या कार्यालयास सादर केला आहे.

त्याअर्थी, संस्थेने वाचावे क्रमांक ७ चे परिपत्रकात नमूद केलेनुसार आवश्यक ती कागदपत्रे प्रस्तावासोबत सादर केलेली आहे. सबब, संस्थेच्या सर्वसामान्य ठेवीदारांचे र्आथिक हित व संस्थेच्या थकीत कर्जाची वसुली या सर्व बाबींचा साकल्याने विचार करता मी खालीलप्रमाणे आदेश पारित करीत आहे.

महाराष्ट्र सहकारी संस्था अधिनियम, १९६० चे कलम १५६(१) अन्वये मला प्रदान करण्यात आलेल्या शक्तीचा वापर करून मी, सतीश खरे, जिल्हा उप निबंधक, सहकारी संस्था, नाशिक या आदेशान्वये श्री कृष्ण ग्रा.बि. शेती सहकारी पतसंस्था मर्या. मोहाडी, ता. दिंडारी, जि. नाशिक या संस्थेचे खालील अधिकायांना व त्यांचे नावापुढे दर्शविलेल्या कार्यक्षेत्रासाठी महाराष्ट्र सहकारी संस्था अधिनियम, १९६० चे कलम १०१ व कलम ९१ अन्वये प्राप्त झालेल्या वसुली प्रमाणपत्राची अंमलबजावणी/कर्ज वसुली करण्याकरिता महाराष्ट्र सहकारी संस्था अधिनियम, १९६० चे कलम १५६(१) व नियम, १०७ अनुसार मालमत्ता जप्त करून व तिची विक्री करून रकमा वसूल करण्याचे निबंधकाचे अधिकार, खालील अटीस अधीन राहून या आदेशाच्या दिनांकापासून ते दिनांक ३१ मार्च २०२१ या कालावधीकरिता प्रदान करीत आहे :---

अ.क्र. अधिकार प्रदान केलेल्या अधिकार प्रदान केलेल्या शक्तीची व्याप्ती कार्यक्षेत्र अधिकायाचे नाव अधिकायाचा हुद्दा

(१) वसुली अधिकारी यांनी महाराष्ट्र सहकारी संस्था अधिनियम, १९६० चे कलम १५६ व नियम, १९६१ चे नियम १०७ मधील तरतुदीनुसार कर्ज वसुलीची कार्यवाही करावी. कर्ज वसुली करताना सहकार कायदा, नियम यातील तरतुदी व परिपत्रकीय सूचनांचे पालन न केल्याचे निदर्शनास आल्यास आवश्यक ती चौकशी करून आवश्यकता भासल्यास सदरचे अधिकार तात्काळ काढून घेण्यात येतील.

(२) सदरचे अधिकार सहकार कायदा कलम १०१ व ९१ अन्वये प्राप्त वसुली दाखल्याची अंमलबजावणी करण्याकरिता असतील.

(३) वसुली अधिकारी यांनी दरमहा सोबत जोडलेल्या विहित नमुन्यात अ-३, अ-४ व ब कर्ज वसुलीची माहिती संबंधित जिल्हा उप निबंधक, सहकारी संस्था यांचे कार्यालयास सादर करावी. ज्या सहकारी संस्थेचे कार्यक्षेत्र विभाग, दोन विभाग अथवा राज्य कार्यक्षेत्र आहे त्या संस्थांनी देखील त्यांचे मुख्य कार्यालय ज्या जिल्ह्यमध्ये आहे त्या जिल्हा उप निबंधक यांचे कार्यालयास माहिती सादर करावी.

(४) अधिकार प्रदान केलेल्या वसुली अधिकारी असलेल्या व्यक्तीची बदली झाल्यास किंवा सेवानिवृत्ती झाल्यास किंवा सेवेतून काढून टाकल्यास किंवा मृत्यू झाल्यास, अशा अधिकायास प्रदान केलेले अधिकार आपोआप रद्द होतील.

(५) विशेष वसुली अधिकारी यांनी वसूल केलेल्या संपूर्ण सरचार्ज रकमेचा भरणा वसूल केलेल्या महिन्यातच चलनाने शासकीय कोषागारात करावा. वसुली अधिकारी यांनी वसूल केलेला सरचार्ज, त्याचा शासकीय कोषागारात केलेला भरणा याबाबत संस्था स्तरावर स्वतंत्र नोंदवही ठेवण्यात यावी. त्याबाबतचा नमुना अ-१, अ-२, अ-३, अ-४ सोबत जोडलेला आहे.

(६) मा. उच्च न्यायालय, मुंबई यांनी रिट याचिका क्र. १९४२/२०१३ दि बेसिन कॅथोलिक को-ऑप. बँक विरूद्ध महाराष्ट्र राज्य व इतर या याचिकेमध्ये दिनांक ५ डिसेंबर २०१५ रोजी दिलेला आदेश विचारात घेऊन वसुलीची कार्यवाही करताना महाराष्ट्र सहकारी संस्था अधिनियम, १९६० व नियम, १९६१ अन्वये प्राप्त असलेल्या अधिकारानुसारच वसुलीची कार्यवाही करावी.

(७) वसुली अधिकारी यांनी नमूद केलेल्या कालावधीत वसुलीचे कामकाज समाधानकारक केले नसल्याचे निदर्शनास आल्यास किंवा प्रदान केलेल्या अधिकाराचा गैरवापर करीत असल्याचे निदर्शनास आल्यास, प्रदान केलेले अधिकार काढून घेतले जातील व भविष्यात असे कोणतेही अधिकार अशा व्यक्तीस प्रदान करण्यात येणार नाही.

(८) शासन निर्णय क्रमांक संकिर्ण-१५०४/प्र.क्र. २३१/१५-स, दिनांक २३ नोव्हेंबर २००६ अन्वये विशेष वसुली अधिकायांना तीन सिंहाच्या राजमुद्रेचा वापर करता येणार नाही.

(९) वसुली अधिकायास त्याच्या नावापुढे कोठेही ""महाराष्ट्र शासन नियुक्त"" आणि किंवा ""सिव्हील कोर्ट"", ""एक्झीक्युटीव्ह कोर्ट"" या शब्दांचा अथवा तत्सम शब्दांचा वापर करता येणार नाही. त्या ऐवजी वसुली अधिकायांनी त्यांच्या नावापुढे ""वसुली अधिकारी (महाराष्ट्र सह. संस्था अधिनियम, १९६० व नियम, १९६१ चे नियम १०७ अन्वये)"" असे लिहावे.

(१०) वसुली अधिकायास वसुलीसाठी वापर करण्यात येणाया वाहनावर " वसुली अधिकारी ....................... सहकारी बँक/ पतसंस्था " असा फलक लावता येऊ शकेल.

(११) वसुली अधिकायाने पगार जप्तीची कार्यवाही करताना कर्जदाराच्या/जामीनदाराच्या पगार कपातीबाबत राष्ट्रीयीकृत बँका वा अन्य बँका यांचेकडे परस्पर वेतन कपातीचा आदेश देऊन परस्पर पगार कपात करता येणार नाही. संबंधित कर्जदार/जामीनदार ज्या आस्थापनेवर काम करीत आहे त्या आस्थापनेवरील आहरण व संवितरण अधिकारी/पगार करणारा अधिकारी यांचेमार्फत पगारातून कर्ज वसूल करण्याची कार्यवाही करावी.

(१२) वसुली अधिकायास, थकबाकीदाराकडून वसुली दाखल्यानुसार वसूलपात्र रक्कम व सरचार्ज रक्कम याशिवाय इतर कोणतीही रक्कम वसूल करता येणार नाही.

(१३) सोबतच्या यादी प्रमाणे सर्व प्रकरणामध्ये जंगम जप्ती, स्थावर जप्ती, अपसेट प्राईज मंजुरी, जाहिर लिलाव व कलम १००/ ८५ अन्वयेची कार्यवाही ही नियमानुसार विहित मुदतीत पूर्ण करण्यांत यावी. विहित मुदतीत उक्त कार्यवाही पूर्ण न केल्यास आपणांस दिनांक १ एप्रिल २०२३ पासून पुढील कालावधीसाठी कलम १५६ चे अधिकार प्रदान करण्यांत येणार नाही याची गाभीर्याने नोंद घ्यावी व त्याची सर्वस्वी जबाबदारी ही आपली राहील.
