अधिसूचना

क्रमांक बीडी/भुसंपादन/मुमरी/एस ु/१/२०२०.—ळर्ुेव्ुॄ़ुींरुुुब्रु पुनर्वसन व पुनर्वसाहत, करताना उचित भरपाई मिळण्याचा आणि पारदर्शकतेचा हक्क अधिनियम, २०१३ (२०१३ वर ३०) मधील कलम ३ च्या खंड (इ) च्याद्वारे प्रदान करण्यात आलेल्या अधिकाराचा वापर करून काढण्यात आलेली अधिसूचना, महसूल व वन विभाग क्र. संकीर्ण-११/२०१४/प.क्र.७७ /अ-२, दिनांक १९ जानेवारी २०१५ (याज यापुढे जिचा निर्देश उक्त अधिसूचना असा करण्यात आला आहे.) याद्वारे असे अधिसुचित केले आहे, उक्त अधिनियमाच्या कलम ३ च्या खंड (झेड अ) मध्ये व्याख्या केलेल्या सार्वजनिक प्रयोजनासाठी, एखाद्या जिल्ह्यतील ५०० हेक्टर अधिक नसेल इतक्या क्षेत्राकरिता जमीन संपादन करण्याच्या संबंधात अशा जिल्ह्यचा अधिकारी हा उक्त अधिनियमांच्या प्रयोजनासाठी समुचित शासन असलेल्या ठाणे जिल्ह्यच्या जिल्हाधिकायास या सोबत जोडलेल्या अनुसूची एक मध्ये अधिक तपशीलवार वर्णन केलेली जमीन (यात यापुढे ज्याचा निर्देश " उक्त जमीन " असा करण्यात आला आहे.) सार्वजनिक प्रयोजनासाठी (यात यापुढे ज्याचा निर्देश " उक्त सार्वजनिक प्रयोजन " असा करण्यात आला आहे.) आवश्यक आहे. अथवा तिची आवश्यकता भासण्याची शक्यता आहे असे वाटते. ज्याचे स्वरुपाचे विवरण यासोबत जोडलेल्या अनुसूची दोनमध्ये दिलेले आहे आणि म्हणुनच उक्त अधिनियमाच्या कलम ११ च्या पोट-कलम (१) च्या तरतुदी अन्वये याद्वारे असे अधिसूचित करण्यात येते की, उक्त जमिनीची उक्त सार्वजनिक प्रयोजनासाठी आवश्यकता भासण्याची शक्यता आहे. आणि ज्याअर्थी, प्रस्तावित भूमिसंपादनाच्या अनुषंगाने बाधित व्यक्तींचे विस्थापन करण्यास भाग पडणारी कारणे, यासोबत जोडलेल्या अनुसूची तीन मध्ये दिलेली आहेत. त्याअर्थी, असे घोषित करण्यात येत आहे की, उक्त अधिनियमाच्या कलम ११ चा पोट-कलम (४) नुसार कोणतीही व्यक्ती ही अधिसूचना प्रसिद्ध झाल्याच्या दिनांकापासून ते उक्त अधिनियमाच्या प्रकरण चार खालील कार्यवाही पूर्ण होईल त्या कालावधी पयर्ंत उक्त जमिनीचा अथवा तिच्या भागाचा कोणताही व्यवहार करणार नाही किंवा उक्त जमिनीवर कोणतेही भार निर्माण करणार नाही. परंतु उक्त जमिनीच्या अथवा तिच्या भागाच्या मालकाने अर्ज केल्यावर जिल्हाधिकायास विशेष परिस्थितीची कारणे लेखी नमूद करून अशा मालकास उपरोक्त तरतुदीच्या प्रवर्तनातुन सुट देता येईल. परंतु आणखी असे की, जर कोणत्याही व्यक्तीने या तरतुदीचे बुद्धीपुरस्पर उल्लंघन केल्यामुळे तिला झालेल्या कोणत्याही हानीची किंवा क्षतीची जिल्हाधिकायाकडून भरपाई दिली जाणार नाही.

तसेच उक्त अधिनियमाच्या कलम ११ च्या पोट-नियम (५) नुसार जिल्हाधिकारी भूमिसंपादन पुनर्वसन व पुनर्वसाहत करताना उचित भरपाई मिळण्याचा आणि पारदर्शकतेचा हक्क महाराष्ट्र नियम १४ (यापुढे ज्याचा निर्देश " उक्त नियम " असा करण्यात आला आहे.) याच्या नियम १० च्या उपनियम (३) द्वारे विहित केल्याप्रमाणे भूमि अभिलेखाच्या अद्यावतीकरणाचे कामहाती घेणार असल्याचे व पूर्ण करणार असल्याचे देखील घोषित करण्यात येत आहे.

भाग एक (कोविपु) ७४--१ (१)२ महाराष्ट्र शासन राजपत्र असाधारण भाग एक-कोकण विभागीय पुरवणी, डिसेंबर ४, २०२०/अग्र १३, शके १९४२ आणि ज्याअर्थी, उक्त अधिनियमाच्या कलम ३ चा खंड (छ) समुचित शासन असलेल्या जिल्हाधिकरी, उक्त अधिनियमाखालील जिल्हाधिकायाची कार्य पार पाडण्यासाठी उपविभागीय अधिकारी, भिवंडी विभाग, भिवंडी यांस पदनिर्देशित केले आहे.

पुर्नवसाहत क्षेत्राचे वर्णन

मुमरी धरणाच्या बांधकामामुळे मौजे सारंगपुरी, कोठारे, खैरे व जुनवणी येथील १०२ कूटुंब, ३४९ लोकसंख्या विस्थापीत होत आहेत. त्यांचे पुनर्वसनासाठी मौजे खैरे येथील जम्ीान खरेदी करण्यात आलेली आहे परंतु या अधिसुचित होणाया सव्र्हे नंबर मधील खातेदार विस्थापित होत नसल्याने पुनर्वसन व पुर्नवसाहत करणेचा प्रश्न उद्भवत नाही.

पूनर्वसन व पुर्नवसाहत योजनेचा तपशील

मौजे सारंगपुरी, खैरे, व कोठारे ता. शहापुर, जि.ठाणे, क्षेत्र २४-०२-१० हे.आर. जमीन भातसा प्रकल्पांतर्गत मुमरी धरणासाठी संपादन होत आहे. कोणतेही खातेदार विस्थापित होत नसल्याने पुनर्वसन व पुर्नवसाहत करणेचा प्रश्न उद्भवत नाही.

टीप.—उक्त जमिनीच्या नकाशाचे उप विभागीय अधिकारी, भिवंडी निरीक्षण करता येऊ शकते.

SUB DIVISIONAL OFFICER AND SUB DIVISIONAL MAGISTRATE

NOTIFICATION

No. BD / Bhusampadan / Mumari / SR-1 / 2020.—Whereas, the Government of Maharashtra vide Government Notification, Revenue and Forest Department, No. MIS-11/ 2014C.R.77/A-2, date the 19th January 2015 (hereinafter referred to as "the said notification") issued in exercise of the powers conferred by the proviso to clause (e) of section 3 of the Right to Fair Compensation and transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 (30 of 2013), has notified that in relation to acquisition of land in respect of a public purpose, as defined in clause (z a) of section 3 of the said Act, in a District for an area not exceeding 500 hectors, the collector of such District shall be deemed to be the appropriate Government, for the purpose of the said act ;

And whereas, it appears to the Sub Divisional Officer, Bhiwandi Division, Bhiwandi, Thane District Being the appropriate Government in view of the said notification, that land more particularly described in Scheduled I appended here to (hereinafter referred to as "the said land"), is needed or likely to be needed for the public purpose, (a statement of the nature thereof is contained in schedule II appended here to) and therefore, it is hereby notified under the provisions of sub-section (1) of section 11 of the said Act, that the land is likely to be needed for the said public purpose;

And whereas, the reasons necessitating the displacement of the affected persons in view of the purpose land acquisition are contained in Schedule III appended here to (if there as any displacement then state the reasons in this Schedule);

And whereas, the particulars of an administrator appointed for the purpose of rehabilitation and resettlement under sub-section (1) of section 43 contained in Schedule V appended here to (if required to be appointed then state the particulars in this Schedule).

Now therefore, it is declared that as per sub-section (4) of section 11 of the said Act, no person shall make any transaction of land or part there of or create any encumbrances on said land from the date of publication of this notification till such time as the proceeding under Chapter IV of the said Act are completed ;

Provided that, the Sub Divisional Officer may, on the application made by the owner of the said land or part there of exempt in special circumstances to be recorded in writing, such owner from the operation of the above provision ;

It is further declared that according to sub-section (5) of section 11 of the said Act, the S.D.O. is going to undertake and complete the exercise of updating of land records as prescribed by sub-rule (3) of rule 10 of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement (Maharashtra) Rules, 2014 (hereinafter referred as the said Rules)

And Whereas, under clause (g) of section 3 of the said Act, the Collector being the Appropriate Government Please to designate Sub-Divisional Officer, Bhiwandi Division, Dist. Thane (name and address of the officer to filled in before issue) to perform the function of a Collector under the said Act.

After completion of Mumari Dam Water should be stored. Because of water storage, in village Sarangpuri, Khaire, Kothare And Junavani, 102 families having 349 peoples are displaced. The Rehabilitation land acquired at village Khaire by Direct Purchase. But There is no one Khatedars displace of this notification the question of rehabilitation dose not arise.

Schedule IV

(Summery of the rehabilitation and resettlement scheme is Specified.)

In village Sarangpuri,Khaire, and Kothare, Tal, Shahapur, Dist. Thane Land Acquired 24-02-10 H.R for Mumari Dam Under Bhatasa Project. There is no one Khatedars displace of this notification the question of rehabilitation dose not arise.

N.B.—A plan of the said land can be inspected at the office of Sub Divisional Officer, Bhiwandi Division Bhiwandi.
