ज्याअर्थी, अंबरनाथ-कुळगाव बदलापूर व परिसर अधिसूचित क्षेत्राची विकास योजना शासनाचे नगरविकास विभाग अधिसूचना क्र. टीपीएस-१२०४/९४१/सीआर-१६३/०४/नवि-१२, दिनांक २५ जूलै २००५ अन्वये शासनाने मंजूर केली आहे आणि उक्त विकास योजना दिनांक १२ ऑगस्ट २००५ पासून अंमलात आलेली आहे (यात यापुढे ज्याचा उल्लेख "उक्त एम.एम.आर.डी.ए. विकास योजना" असा करण्यात आला आहे) ;
आणि ज्याअर्थी, महाराष्ट्र प्रादेशिक नियोजन व नगररचना अधिनियम, १९६६ (यात यापुढे ज्याचा निर्देश "उक्त अधिनियम" असा करण्यात आला आहे) चे कलम ११३(१) द्वारे प्रदान करण्यात आलेल्या अधिकारांचा वापर करून शासनाने नगरविकास, सार्वजनिक आरोग्य व गृहनिर्माण विभागाची अधिसूचना क्रमांक आरपीबी. ११७१/१८१२४/११३/आय डब्ल्यू, दिनांक २० मार्च १९७१ द्वारे, यात नमूद करण्यात आलेले क्षेत्र हे नवी मुंबई ह्य नवीन नगराचे क्षेत्र म्हणून घोषित केले आहे व सिडकोस नगरविकास, सार्वजनिक आरोग्य व गृहनिर्माण विभागाची अधिसूचना क्रमांक आरपीबी. १८१२४/II डब्ल्यू, दिनांक २० मार्च १९७१ अन्वये, उक्त अधिनियमांच्या कलम ११३(३अ) नुसार नवी मुंबई या नवीन नगर क्षेत्रासाठी (उक्त नवनगरक्षेत्र) नवनगर विकास प्राधिकरण म्हणून नियुक्त केले आहे ;
आणि ज्याअर्थी, उक्त अधिनियमाच्या कलम ३१(१) द्वारे प्रदान करण्यात आलेल्या अधिकारांचा वापर करून, शासनाने उक्त नवनगर क्षेत्रासाठी सिडकोने सादर केलेल्या रचनाबद्ध आराखडयाच्या (Structural Plan) स्वरूपात असलेल्या प्रारूप विकास योजनेस (उक्त अंतिम विकास योजना) नगरविकास व सार्वजनिक आरोग्य विभाग अधिसूचना क्रमांक आरपीबी. ११७५/६३५/यूडी-५, दिनांक १८ ऑगस्ट १९७९ सह अधिसूचना क्रमांक आरपीबी. ११७५/६३५/यूडी-५, दिनांक १८ जानेवारी १९८० अन्वये मंजुरी दिलेली आहे आणि उक्त विकास योजना दिनांक १ मार्च १९८० पासून अंमलात आलेली आहे ;
आणि ज्याअर्थी, महाराष्ट्र महानगरपालिका अधिनियम (यात यापुढे ज्याचा उल्लेख "उक्त महानगरपालिका अधिनियम" असा करण्यात आला आहे) चे कलम ३ च्या पोट-कलम (४) नुसार महाराष्ट्र शासन नगरविकास विभाग अधिसूचना क्रमांक पनवेल महानगरपालिका --- २९१४/ व्हीआयपी सं.क्र. ३०१/प्र.क्र. ३५४/नवि-२३, दिनांक २६ सप्टेंबर २०१६ अन्वये पनवेल नगरपरिषदेचे संपूर्ण क्षेत्र व २९ महसुली गावांच्या क्षेत्रासाठी पनवेल महानगरपालिकेची स्थापना करण्यात आली असून ती दिनांक १ ऑक्टोबर २०१६ पासून अस्तित्वात आली आहे ;

भाग दोन---६७---१२ महाराष्ट्र शासन राजपत्र असाधारण भाग दोन, डिसेंबर ८, २०२० / अग्रहायण १७, शके १९४२ आणि ज्याअर्थी, उक्त एम.एम.आर.डी.ए. विकास योजनेतील ११ महसुली गावांचा समावेश पनवेल महानगरपालिकेच्या हद्दीत करणेत आलेला आहे ;
आणि ज्याअर्थी उक्त अंतिम विकास योजना व उक्त मंजूर एम.एम.आर.डी.ए. विकास योजना यांच्या हद्दी एकमेकांना लागून आहेत आणि मंजूर विकास योजनेतील रस्ते उक्त मंजूर एम.एम.आर.डी.ए. विकास योजनेच्या हद्दीपयर्ंत प्रस्तावित करण्यात आलेले आहे ;
आणि ज्याअर्थी उक्त अंतिम विकास योजना व उक्त मंजूर एम.एम.आर.डी.ए. विकास योजनामध्ये Missing Links असल्याने पनवेल महानगरपालिका क्षेत्रातील वाहतूक सोयीची व दळणवळण सुकर होण्यासाठी नवीन जोड रस्ते तयार करणे गरजेचे आहे ;
आणि ज्याअर्थी मा. महानगर आयुक्त, मुंबई महानगरप्रदेश विकास प्राधिकरण, मुंबई यांनी कार्यालय पत्र क्र. No. MMRDA/RHD/ D-२३७/३१/२०२०, दिनांक १४ फेब्रुवारी २०२० अन्वये मौजे रोहिंजण येथील मुंबई महानगर प्रदेश विकास प्राधिकरणाने मंजूर केलेल्या भाडेतत्वावरील घरे अंतर्गत योजनेच्या जमिनीत अंबरनाथ, कुळगांव-बदलापूर आणि परिसर अधिसूचित क्षेत्राच्या मंजूर विकास योजनेतील नियोजित २४ मी. रुंदीच्या रस्त्याच्या आखणीमध्ये बदल करणे व मौजे रोहिंजण येथील स.नं. ७२ पासून ते स.नं. ८० लगतच्या सिडको प्राधिकरणाच्या सीमेपयर्ंत २४ मी. रुंदीचा नवीन रस्ता तयार करून जोडणे याबाबत सूचना केली आहे.
आणि ज्याअर्थी, महाराष्ट्र महानगरपालिका अधिनियमाचे १९४९ च्या कलम २०५, २०६ व २०९ अन्वये महानगरपालिका क्षेत्रामध्ये नवीन सार्वजनिक रस्ता आखणे व तयार करणे, महानगरपालिकेकडे निहित असलेला विद्यमान सार्वजनिक रस्ता किंवा त्याचा कोणताही भाग फिरविणे किंवा वळविणे, रस्त्याची रुंदी निश्चित करणे व रस्त्यांची सुधारणा करणेचा अधिकार महानगरपालिकेला आहे ;
आणि ज्याअर्थी, वरील संदर्भ उक्त करण्यासाठी पनवेल महानगरपालिकेच्या सर्वसाधारण सभेने ठराव क्र. १९०, दिनांक ५ सप्टेंबर २०१९ अन्वये आयुक्त, पनवेल महानगरपालिका यांना प्राधिकृत केले आहे ;
आणि ज्याअर्थी, परिशिष्ट----- 'अ' व 'ब' मध्ये नमूद केलेल्या नियोजित रस्त्याचे संरेखन व नवीन सार्वजनिक रस्त्याची आखणीबाबत महाराष्ट्र महानगरपालिका अधिनियमाचे कलम २०५, २०६ व २०९ अंतर्गत या कार्यालयाचे जाहीर प्रकटन क्रमांक पमपा/नरवि/रस्ते/५७२/ २०२०, दिनांक ४ मार्च २०२० अन्वये महाराष्ट्र शासनाचे राजपत्र असाधारण क्र. ३०, दिनांक ५ मार्च २०२० व दिनांक ६ मार्च २०२० रोजीच्या दै. सकाळ, दै. लोकसत्ता, दै. रामप्रहार व दैनिक कर्नाळा या वर्तमानपत्रात प्रसिद्धी देऊन नागरिकांकडून वरील प्रकटन शासनाचे राजपत्रात प्रसिद्ध झालेल्या दिनांकापासून ३० दिवसाचे आत हरकती व सूचना मागविण्यात आलेल्या आहेत ;
आणि ज्याअर्थी वरील बाबतीत नागरिकांकडून प्राप्त झालेल्या हरकती व सूचनाबाबत सुनावणी घेण्यात येऊन संबंधित हरकती/सूचना धारकांचे म्हणणे ऐकूण घेण्यात आले ;
आणि ज्याअर्थी, उक्त विकास योजनेतील सदरच्या नियोजित विद्यमान सार्वजनिक रस्त्याचे फिरविलेल्या संरेखनास व नवीन सार्वजनिक रस्त्याची आखणी करण्यास संबंधित हरकती / सूचनाधारकांनी सहमती दर्शविली आहे ;
आणि ज्याअर्थी, सदरच्या नियोजित विद्यमान सार्वजनिक रस्त्याचे फिरविलेल्या संरेखनास व नवीन सार्वजनिक रस्त्याची आखणी करण्यास अंतिम मान्यता देण्यात आली आहे.
त्याअर्थी, मी, सुधाकर देशमुख, आयुक्त, पनवेल महानगरपालिका मला प्राप्त अधिकारांन्वये खालील परिशिष्ट 'अ' व परिशिष्ट 'ब' मध्ये नकाशात दर्शविल्याप्रमाणे विर्िनदिष्ट केलेल्या विकास योजनेतील विद्यमान रस्त्याचे आखणीमध्ये बदल व नवीन जोड रस्त्याचे आखणीप्रमाणे रस्त्याचे संरेखांकन मंजूर करीत आहे.

रस्त्याचे संक्षिप्त विवरण
मौजे रोहिंजण येथील मुंबई महानगर प्रदेश विकास प्राधिकरणाने मंजूर केलेल्या भाडेतवावरील घरे अंतर्गत योजनेच्या व इतर जमिनीवर अंबरनाथ, कुळगांव-बदलापूर आणि परिसर अधिसूचित क्षेत्राच्या मंजूर विकास योजनेतील नियोजित २४ मी. रुंदीच्या ABCD प्रमाणे दर्शविल्यानुसार रस्त्याच्या आखणीमध्ये AEFD प्रमाणे दर्शविल्यानुसार बदल करणे व मौजे रोहिंजण येथील स.न ७२ पासून ते स.नं. ८० लगतच्या सिडको प्राधिकरणाच्या हद्दीतील रस्त्याला जोडणारा २४ मी. रुंदीचा नवीन रस्ता तयार करून जोडणेे.
प्रस्तावीत वरील दोन्ही रस्त्याचे संरेखांकनामुळे बाधित होणारे सव्र्हे नं./गट नं. खालीलप्रमाणे आहेत :---

वरील दोन्ही रस्त्याचे प्रस्तावित मंजूर संरेखांकन दर्शविणारा नकाशा नागरिकांच्या अवलोकनार्थ कामकाजाच्या दिवशी कार्यालयीन वेळेत सहायक संचालक, नगररचना विभाग, पनवेल महानगरपालिका यांचे कार्यालयात ठेवण्यात आलेला आहे.

(MAHARASHTRA MUNICIPAL CORPORATION ACT, 1949 UNDER SECTION 205, 206 AND 209) NO. PMC/TPD/Road/1745/2020, dated 8th December 2020
Whereas, the Ambarnath, Kulgaon, Badlapur and Surrounding Notified area Development Plan has been sanctioned by the Government of Maharashtra in Urban Development Department vide notification No. TPS – 1204/941/CR – 163/04/UD -12, dated 25th July 2005 and it has come into force with effect from 12th August 2005 (hereinafter referred as the said MMRDA Development Plan) ;
And Whereas, the Government, in exercise of the powers conferred by section 113(1) of the Maharashtra Regional and Town Planning Act, 1966 (hereinafter referred to as "said Act") has designated the site for New – Town of Navi Mumbai (hereinafter referred to as "said New Town") vide Urban Development and Public Health Department's (UD and PH) Notification No. RPB. 1171/18124/I.W., dated the 20th March 1971 and CIDCO has been appointed as New Town Department Authority (NTDA) for the said New Town Under section 113(3A) of the said Act vide Urban Development and Public Health Department's Notification No. RPB. 117/18124/II.W., dated the 20th March 1971 ;
And whereas, the Government in exercise of the powers conferred by section 31(1) of the said Act vide UD and PHD's Notification No. RPB. 1175/635/UD-5, dated the 18th January 1980 has been sanctioned the Draft Development Plan (hereinafter referred to as " said Final Development Plan " in the form of structural plan submitted by CIDCO for the said New Town area and the said Final Development Plan came into force with effect from 1st March 1980 ;
And whereas, the Government in exercise of the power conferred by section 3 of sub-section (4) the Maharashtra Municipal Corporation Act, 1949 (hereinafter referred to as the "said MMC Act") vide the Urban Development Department notification No. PNP.2014/VIP No. 301/CR. 354/ UD/23, dated the 25th September, 2016 constituted the Panvel Municipal Corporation for the areas of whole area of Panvel Municipal Council & 29 revenue villages specified therein, which came into force with effect from 1st October 2016 ;
And whereas, the said MMRDA Development Plan of 11 revenue villages of has been included in the Panvel Municipal Corporation Area ;
And whereas, the said Final Development Plan and the said MMRDA Development Plan Boundaries are adjacent to each other and the road's already developed in the said Sanctioned Development plan are Proposed upto the said MMRDA Development Plan limit ;
And whereas, In the metropolitan Region there is Missing links in between the said Final Development Plan & the said MMRDA Development Plan it has become expedient to connect the Missing Links by preparing new road so as to enable the smooth & convenient traffic flow in the said final Development plan which are already proposed upto the said MMRDA Development Plan limit within the Panvel Municipal Corporation ;
And whereas Commissioner Mumbai Metropolitan Regional Development Authority, Mumbai vide letter No. MMRDA/RHD/D-237/31/2020, dated 14th February 2020 has directed to realign the proposed 24 M. wide D.P. Road of Ambarnath, Kulgaon, Badlapur and Surrounding Notified Area and to make and connect new 24 M. wide road from S. No. 72 to S. No. 80 adjacent to CIDCO authority Boundary for Rental Housing Projects sanctioned by Mumbai Metropolitan Region Development Authority ;
महाराष्ट्र शासन राजपत्र असाधारण भाग दोन, डिसेंबर ८, २०२० / अग्रहायण १७, शके १९४२ ५And whereas, in accordance with the provisions contained in the sections 205, 206, and 209 of Maharashtra Municipal Corporation Act, 1949 empowers the Municipal Corporation to layout and make a New Public Street, divert or turn an existing Public Street vested in the Corporation or a portion thereof ;
And whereas, the Panvel Municipal Corporation vide General Body Resolution No. 190, dated 5th September 2019 delegated the powers under section 205, 206 and 209 of the said MMC Act to Commissioner, Panvel Municipal Corporation ;
And whereas, Panvel Municipal Corporation has published the Notice vide No. PMC/TPD/ Roads/572/2020, dated 4th March 2020 in Maharashtra Government Extra-Ordinary Gazette No. 30, dated 5th March 2020 and published in Daily Sakal, Daily Loksatta, Daily Ramprahar and Daily Karnala newspapers on 6th March 2020 for inviting suggestions and objections to the said proposed diversion of road alignment shown in the said Development Plan and to modify layout and to make a New Public Road as shown in the Annexure 'A' and Annexure 'B' with the provisions contained in the sections 205, 206 and 209 of Maharashtra Municipal Corporation Act, 1949 from the public thereof within 30 days from the date of publication of the notice in Maharashtra Government Extra-Ordinary Gazette;
And whereas, hearing regarding suggestions and objections received from public was held and suggestions and objections have been noted and considered ;
And whereas, the concerned Persons has agreed for the diversion and alignment of road shown in the said Development Plan and to modify layout and make a new public road ;
And whereas, proposed diversion of road alignment shown in the said Development Plan and proposed layout and make a new public road has been sanctioned.
Therefore, I, Sudhakar Deshmukh, Commissioner, Panvel Municipal Corporation, by the powers vested upon me sanction the diversion of road alignment shown in the said Development Plan and to layout and make a new public road as shown in the Annexure 'A' and Annexure 'B'.
