महाराष्ट्र कृ षि उत्पन्न पणन (विकास व विनियमन) अधिनियम, १९६३.

क्रमांक कृ प मं . ० ३ २ ० /प्र . क्र .६ ७ / २ १ - स . – महाराष्ट्र कृ षि उत्प(cid:४००) पणन (विकास व विनियमन) अधिनियम, १९६३ (१९६४ चा २०) याच्या कलम ६० च्या पोट-कलम (१) आणि पोट-कलम (२) च्या खंड (ड) व (यू) याद्वारे प्रदान के लेल्या अधिकारांचा आणि त्याबाबतीत त्यास समर्थ करणाऱ्या इतर सर्व अधिकारांचा वापर करून, महाराष्ट्र शासन, महाराष्ट्र कृ षि उत्प(cid:४००) बाजार समित्या (समितीची निवडणूक) नियम, २०१७ यात सुधारणा करण्यासाठी पुढील नियमांचा मसुदा, त्याद्वारे बाधा पोहोचण्याची शक्यता असलेल्या सर्व व्यक्तींच्या माहितीसाठी, उक्त अधिनियमाच्या कलम ६० च्या पोट-कलम (३) द्वारे आवश्यक असल्याप्रमाणे याद्वारे प्रसिद्ध करीत आहे; आणि याद्वारे अशी नोटीस देत आहे की, उक्त मसुदा दिनांक ८ जानेवारी २०२१ रोजी किंवा त्यानंतर महाराष्ट्र शासनाकडून विचारात घेण्यात येईल.

२. उपरोक्त दिनांकापूर्वी, उक्त मसुद्यासंबंधित कोणत्याही व्यक्तीकडून, पणन संचालक, महाराष्ट्र राज्य, न्यु सेंट्रल बिल्डींग, ३रा मजला, पुणे ४११००१ यांच्याकडे ज्या कोणत्याही हरकती किंवा सूचना प्राप्त होतील त्या शासन विचारात घेईल.

भाग चार-ब-३०७-१

(१)

नियमांचा मसुदा

१. या नियमास, महाराष्ट्र कृ षि उत्प(cid:४००) बाजार समित्या (समितीची निवडणूक) (पहिली सुधारणा) नियम, २०२० असे म्हणावे.

२. महाराष्ट्र कृ षि उत्प(cid:४००) बाजार समित्या (समितीची निवडणूक) नियम, २०१७ (यात यापुढे ज्याचा निर्देश "मुख्य नियम" असा के लेला आहे) याच्या नियम २ मधील खंड २१ ऐवजी, पुढील खंड दाखल करण्यात येईल :--

"(२१) "मतदार" याचा अर्थ, --

(एक) अधिनियमाच्या कलम १३ च्या पोट-कलम (१) च्या उप खंड (अ) च्या प्रयोजनार्थ, राज्य सहकारी निवङणूक प्राधिकरणाने वेळोवेळी विनिर्दिष्ट के लेल्या दिनांकास ज्याचे वय १८ वर्षांहून कमी नाही आणि बाजार कार्यक्षेत्रात कार्यरत असणाऱ्या कृ षि पतसंस्था किंवा बहुउद्देशीय सहकारी संस्था (महाराष्ट्र सहकारी संस्था अधिनियम, १९६० आणि त्याखाली के लेले नियम यांच्या अर्थांतर्गत) यांच्या व्यवस्थापन समितीचा सदस्य असणारा व बाजार कार्यक्षेत्रात राहत आहे असा शेतकरी किंवा बाजार कार्यक्षेत्रात कार्यरत असणाऱ्या ग्रामपंचायतीचा सदस्य ;

(दोन) अधिनियमाच्या कलम १३ च्या पोट-कलम (१) च्या उप खंङ (ब) च्या प्रयोजनार्थ, परवानाधारक व्यापारी किवा अडत्या ;

(तीन) अधिनियमाच्या कलम १३ च्या पोट-कलम (१) च्या उप खंड (ब-१) च्या प्रयोजनार्थ,परवानाधारक तोलारी व हमाल ;

(चार) अधिनियमाच्या कलम १३ च्या, पोट-कलम (१ अ) च्या खंड (अ) च्या उप खंड (एक) च्या प्रयोजनार्थ, राज्यातील इतर कृ षि उत्प(cid:४००) बाजार समित्याचे शेतकरी सदस्य ;

(पाच) अधिनियमाच्या कलम १३ च्या पोट-कलम (१अ) च्या खंड (अ) च्या उप खंड (दोन) च्या प्रयोजनार्थ, मु ंबई बाजार क्षेत्रातील व्यापारी किवा अडत्या म्हणून लायसन धारण करणारा ;

(सहा) अधिनियमाच्या कलम १३च्या पोट-कलम (१-ब) च्या खंड (क) च्या उप खंड (एक) च्या प्रयोजनार्थ, प्रादेशिक बाजार समितीच्या कार्यक्षेत्रात समावेश असलेल्या प्रत्येक जिल्ह्यातून कृ षि उत्प(cid:४००) बाजार समित्यांचे शेतकरी सदस्य ;

(सात) अधिनियमाच्या कलम १३ च्या पोट-कलम (१ ब) च्या खंड (क) च्या उप खंड (दोन) च्या प्रयोजनार्थ, प्रादेशिक बाजार समितीच्या कार्यक्षेत्रात समावेश असलेल्या प्रत्येक तालुक्यातून कृ षि उत्प(cid:४००) बाजार समित्यांचे शेतकरी सदस्य ;

(आठ) अधिनियमाच्या कलम १३ च्या पोट-कलम (१ ब ) च्या खंड (क) च्या उप खंड (तीन) च्या प्रयोजनार्थ, बाजार क्षेत्रात व्यापारी किंवा अडत्या म्हणून काम करण्यास तसा परवाना धारण करणारे ;

(नऊ) उक्त अधिनियमाच्या कलम १३ च्या पोट-कलम (१ ब ) च्या खंड (क ) च्या उपखंड (चार ) च्या प्रयोजनार्थ , बाजार क्षेत्रात हमाल व तोलारी म्हणून काम करण्यास तसा परवाना धारण करणारे, असा आहे."

३. मुख्य नियमांच्या नियम ५ ऐवजी पुढील नियम दाखल करण्यात येईल:--

"५. मतदार यादी तयार करणे.-महाराष्ट्र शासन राजपत्र असाधारण भाग चार-ब, डिसेंबर ९, २०२०/अग्रहायण १८, शके १९४२ ३ (१) १५ ेतरिी कनवडू न दे(cid:507)ा(cid:457)ा (cid:366)र्योजनाथ(cid:330), अकधकनयमा(cid:457)ा लिम १३ (cid:457)ा र्पोट-लिम (१) (cid:457)ा खंड (अ), खंड (ब) व खंड (ब-१) या(cid:554)ारे तरतूद ेि (cid:670)ा(cid:366)माणे, (cid:681)ापारी व अड(cid:529)ांनी र्दोन सद(cid:735) आकण हमाल व र्तोलारी यांनी एि सद(cid:735) कनवडू न दे(cid:507)ासाठी, (cid:366)(cid:529)ेि बाजार (cid:407)े(cid:361)ात पुढील र्गो(cid:⁷⁰⁰)ींचा समावे असेल.–

(अ) सहकारी संस्थेचा मतदारसंघ;

(ब) ग्रामपंचायतीचा मतदारसंघ;

(क) व्यापाऱ्यांचा मतदारसंघ; आणि

(ड) हमाल व तोलारी यांचा मतदारसंघ.

(२) अशा प्रत्येक मतदारसंघांमध्ये संपूर्ण बाजार क्षेत्राचा समावेश असेल.

(३) १२ सदस्य निवडून देण्याच्या प्रयोजनार्थ, अधिनियमाच्या कलम १३ च्या पोट-कलम (१अ) च्या खंड (अ) च्या उप खंड (एक) व (दोन) याद्वारे तरतूद के ल्याप्रमाणे पाच सदस्य व्यापाऱ्यांनी व अडत्यांनी निवडून देण्यासाठी, प्रत्येक बाजार क्षेत्रात पुढील गोष्टींचा समावेश असेल.--

(अ) शेतकरी मतदारसंघ ;

(ब) व्यापारी व अडत्यांचा मतदारसंघ.

(४) १५ शेतकरी निवडून देण्याच्या प्रयोजनार्थ, अधिनियमाच्या कलम १३ च्या पोट-कलम (१अ) च्या खंड (अ) च्या उप खंड (एक) व (दोन) द्वारे तरतूद के ल्याप्रमाणे व्यापारी व अडत्यांनी दोन सदस्य आणि हमाल व तोलारींनी एक सदस्य निवडून देण्यासाठी, प्रत्येक बाजार क्षेत्रात पुढील गोष्टींचा समावेश असेल.–

(अ) शेतकरी मतदार संघ ;

(ब) व्यापारी मतदारसंघ ;

(क) हमाल व तोलारी मतदारसंघ.

४. मुख्य नियमांच्या नियम ६ मध्ये–

(१) उप नियम (१) व (२) ऐवजी पुढील उप नियम दाखल करण्यात येतील,–

"(१) जिल्हा निवडणूक अधिकारी, जिल्हा उप निबंधक, सहकारी संस्था याला कृ षि पत संस्थांच्या आणि बहुउद्देशीय सहकारी संस्थांच्या व्यवस्थापकीय समितीच्या सदस्यांची सूची तयार करण्यास व सादर करण्यास सांगेल, आणि गटविकास अधिकाऱ्यास, बाजार समितीची मुदत संपण्याच्या १८० दिवसांपूर्वी किंवा त्याच्या द्वारे विनिर्दिष्ट करण्यात येईल अशा मुदतीत बाजार क्षेत्रात असणाऱ्या अनुसूचित जाती, अनुसूचित जमातीचे सदस्य स्पष्टपणे दर्शविणाऱ्या ग्रामपंचायतीच्या सदस्यांची सूची तयार करण्यास व सादर करण्यास फर्मावील. जिल्हा निवडणूक अधिकारी, संबंधित मतदारसंघातील निवडणुकीसाठी प्राथमिक मतदार यादी तयार करण्यासाठी, जिल्हा उप निबंधकाकडून प्राप्त झाली असेल अशी कृ षि पत संस्थेच्या आणि बहुउद्देशीय सहकारी संस्थेच्या भाग चार-ब-३०७-१अ४ महाराष्ट्र शासन राजपत्र असाधारण भाग चार-ब, डिसेंबर ९, २०२०/अग्रहायण १८, शके १९४२ व्यवस्थापक समितीच्या सदस्यांची सूची आणि गट विकास अधिकाऱ्याकडून प्राप्त झाली असेल अशी ग्रामपंचायतीच्या सदस्यांची सूची, कृ षी उत्प(cid:४००) बाजार समितीच्या सचिवाकडे प्रस्तुत करेल किंवा प्रस्तुत करण्याची व्यवस्था करेल.

(१अ) अधिनियमाच्या कलम १३ च्या पोट-कलम (१अ) च्या (अ) च्या उपखंड (एक) अन्वये मु ंबई कृ षी उत्प(cid:४००) बाजार समितीच्या शेतकऱ्यांचे प्रतिनिधी निवडून देण्याच्या प्रयोजनार्थ, जिल्हा निवडणूक अधिकारी राज्यातील प्रत्येक महसूल विभागातील प्रत्येक जिल्ह्याच्या जिल्हा उपनिबंधक, सहकारी संस्था याला, याबाबत त्याने विनिर्दिष्ट के लेल्या दिनांकापूर्वी अधिनियमाच्या कलम १३ पोट-कलम (१) च्या खंड (अ) अन्वये त्यांच्या संबंधित अधिकारीतेत निवडून दिलेल्या कृ षी उत्प(cid:४००) बाजार समितीच्या शेतकरी सदस्यांची सूची त्यास सादर करण्यास फर्मावेल.

अशा सूच्या प्राप्त झाल्यावर, जिल्हा निवडणूक अधिकारी प्रत्येक महसूल विभागाकरिता स्वतंत्रपणे मतदार यादी तयार करील आणि अशी प्रत्येक यादी जिल्हा निवडणूक अधिकाऱ्यांच्या, जिल्हा उपनिबंधक, सहकारी संस्था याच्या संबंधित कार्यालयाच्या आणि संबंधित महसूल विभागातील संबंधित जिल्ह्याच्या जिल्हाधिकाऱ्यांच्या कार्यालयाच्या सूचना फलकावर जिल्हा निवडणूक अधिकाऱ्याला योग्य वाटेल अशा इतर कोणत्याही प्रकारे प्रदर्शित करील.

(१ब) अधिनियमाच्या कलम १३ च्या पोट-कलम (१ब)च्या खंड (क) च्या उपखंड (एक), (दोन), (तीन) व (चार) अन्वये शेतकऱ्यांचे प्रतिनिधी निवडून देण्याच्या प्रयोजनार्थ, संबंधित जिल्हाधिकारी विभागीय किंवा प्रादेशिक बाजार समितीच्या रचनेनुसार मतदार यादी तयार करण्यास जिल्हा उपनिबंधक, सहकारी संस्था यास फर्मावील.

अशा याद्या प्राप्त झाल्यावर, संबंधित जिल्हाधिकारी प्रत्येक जिल्ह्यासाठी आणि तालुक्यासाठी स्वतंत्रपणे मतदार यादी तयार करील आणि अशी प्रत्येक यादी अनुक्रमे संबंधित जिल्हाधिकारी यांच्या आणि संबंधित जिल्हा उपनिबंधक, सहकारी संस्था यांच्या कार्यालयाच्या सूचना फलकावर प्रसिद्ध करण्यात येतील.

(२) जिल्हा निवडणूक अधिकाऱ्यांकडून यादी प्राप्त झाल्यापासून ३० दिवसांच्या आत संबंधित कृ षी उत्प(cid:४००) बाजार समितीचे सचिव नमुना ४ मध्ये प्रारूप मतदार यादी तयार करतील. सहकारी संस्था मतदार संघासाठी मतदार यादी संस्थानिहाय तयार करण्यात येईल.

ग्रामपंचायत मतदार संघासाठी मतदार यादी संबंधित सदस्यांचे अनुसूचित जाती व अनुसूचित जमाती, इत्यादी तपशील दर्शवून ग्रामपंचायत निहाय तयार करण्यात येईल.

व्यापारी आणि अडत्यांच्या मतदार संघाच्या बाबतीत, ज्यांनी अधिनियमाच्या कलम १३ च्या पोट-कलम (१)च्या खंड (ब) मध्ये तरतूद के ल्याप्रमाणे असे काम करण्यासाठी म्हणून परवाना धारण के ला असेल त्या व्यापाऱ्यांची व अडत्यांची नावे प्रारुप मतदार यादी मध्ये समाविष्ट करण्यात येतील.

हमाल व तोलारी मतदारसंघाच्या बाबतीत, ज्यांनी कृ षी उत्प(cid:४००) बाजार समितीचा परवाना धारण के ला आहे आणि बाजार क्षेत्रात असे काम करणाऱ्या हमालांची व तोलाऱ्यांची नावे प्रारुप मतदार यादीत समाविष्ट करण्यात येतील.

नियम (५) मध्ये नमूद के लेल्या सर्व मतदार संघाची प्रत्येक मतदार यादी वर्णानुक्रमे, नाव, वय, निवास आणि मतदार ज्या प्रवर्गाचा आहे तो प्रवर्ग यात देण्यात येईल:

परंतु, ज्या कृ षी उत्प(cid:४००) बाजार समितीच्या संचालक मंडळाची निवडणूक काही अपरिहार्य कारणांमुळे किंवा इतर कोणत्याही कारणामुळे कार्यकाल संपण्यापूर्वी होऊ शकत नसेल, तर राज्य सहकारी निवडणूक प्राधिकरणाने ठरविलेल्या दिनांकानुसार प्रारुप मतदार यादी तयार करण्यात येईल.

परंतु आणखी असे की, ज्या कृ षी उत्प(cid:४००) बाजार समितीवर अधिनियमाच्या कलम १३ चे पोट-कलम (२) चे दुसरे परंतुक, कलम १५ अ किंवा कलम ४५ अन्वये प्रशासक अथवा प्रशासकीय मंडळाची नियुक्ती करण्यात आलेली आहे अशा कृ षी उत्प(cid:४००) बाजार समितीच्या मतदारांची प्रारूप यादी राज्य सहकारी निवडणूक प्राधिकरणाने ठरविलेल्या दिनांकानुसार तयार करण्यात येईल.

(२) उपनियम ३ मधील, पुढील मजकू र वगळण्यात येईल:-

"संबंधित बाजार समितीचा सचिव नमुना-३ मध्ये ठेवलेल्या अभिलेखानुसार प्रारुप मतदार यादी प्रमाणित करील.",

(३) उपनियम (४) मध्ये, "त्यास प्राप्त झालेल्या शेतकऱ्यांच्या यादीच्या आधारे" या मजकु राऐवजी, पुढील मजकू र दाखल करण्यात येईल:-

"त्यास जिल्हा उपनिबंधकाकडून प्राप्त झालेल्या कृ षी पतसंस्थेच्या व्यवस्थापन समितीच्या सदस्यांच्या यादीच्या आणि गटविकास अधिकाऱ्यांकडून प्राप्त झालेल्या ग्रामपंचायत सदस्यांच्या यादीच्या आधारे.", (४) उपनियम (६) मध्ये,-

(क) शेतकरी मतदारसंघाच्या "या मजकु राऐवजी, "नियम ५ मध्ये नमूद के लेल्या सर्व मतदार संघाच्या" हा मजकू र दाखल करण्यात येईल ;

(ख) "नमुना-४" या मजकु राऐवजी, नमुना-४(क), नमुना-४(ख) किंवा यथास्थिति, नमुना-४(ग) हा मजकू र दाखल करण्यात येईल.

५. मुख्य नियमाच्या नियम ८ मध्ये.-

(क) उपनियम (१) मधील, विद्यमान पंरतुकाऐवजी पुढील परंतुक दाखल करण्यात येईल:-

"परंतु, कोणतीही व्यक्ती, त्या त्या वेळी अंमलात असलेल्या कायद्यान्वये, कोणत्याही अपात्रतेच्या अधिन असेल तर त्या व्यक्तीस, कोणत्याही मतदार संघातील कोणत्याही निवडणुकीच्या वेळी मतदान करता येणार नाही.",६ महाराष्ट्र शासन राजपत्र असाधारण भाग चार-ब, डिसेंबर ९, २०२०/अग्रहायण १८, शके १९४२ (ख) उपनियम (२) मध्ये, पुढील परंतुक जादा दाखल करण्यात येईल:-

"परंतु, त्या त्या वेळी अंमलात असलेल्या कोणत्याही कायद्यान्वये, जी व्यक्ती प्रतिबंधात्मक स्थानबद्धतेच्या अधीन आहे, त्या व्यक्तीला या उप-नियमतील काहीही लागू असणार नाही.",

(ग) उप-नियम (२)नंतर, पुढील उप-नियम जादा दाखल करण्यात येईल:-

"(३) एखाद्या व्यक्तीने पत्करलेल्या कोणत्याही अनर्हतेच्या अधीन राहून, नियम ७ (क) चा उप-नियम (३) अन्वये अंतिमतः प्रसिद्ध झालेली मतदार यादी ही कोणतीही व्यक्ती मत देण्यासाठी पात्र आहे किंवा नाही, किंवा कोणत्याही निवडणुकीत निवडून येण्यासाठी पात्र आहे किंवा नाही हे ठरविण्याचा प्रयोजनार्थ, निर्णायक पुरावा असेल.".

६. मुख्य नियमांच्या नियम १० मधील-

(क) खंड (फ) मधील, उपनियम (एक) मध्ये, "देणे असलेल्या कोणत्याही फी" या मजकु राऐवजी "देणे असलेल्या, कोणतीही देणी, फी" हा मजकू र दाखल करण्यात येईल ;

(ख) उपनियम (दोन) मधील खंड (एक) मधील, "एखादी व्यक्ती सर्वसाधारणपणे बाजार क्षेत्रांमध्ये राहत नसेल किंवा" हा मजकू र वगळण्यात येईल.

(ग) उपनियम (तीन) ऐवजी खालीलप्रमाणे उपनियम (३) दाखल करण्यात येईल.

"जेव्हा उप-नियम (१) मध्ये नमूद के लेल्या अपात्रतेसंबंधी, कोणतेही प्र(cid:४०८) उपस्थित होतात त्यावेळी ते प्र(cid:४०८) निर्णयासाठी संचालकांकडे पाठविण्यात येतील. अशा रीतीने संदर्भित प्रत्येक प्र(cid:४०८)ाचा निर्णय ३० दिवसांच्या आत संचालकाने दिला पाहिजे. संचालकाच्या निर्णयानुसार किंवा यथास्थिती, अपिलातील निर्णयानुसार ती व्यक्ती अपात्र ठरली असेल तर तिला ती संचालकाने किंवा, यथास्थिति अपील प्राधिकाऱ्याने ज्या दिनांकास निर्णय दिला असेल त्या दिनांकापासून पद धारण करण्याचे बंद करील. बाजार समिती या संबंधीचा निर्णय मिळाल्यानंतर, अधिनियमातील कलम १८ अन्वये, सदस्य म्हणून निवडून येण्यास पात्र असलेल्या एखाद्या व्यक्तीस स्वीकृ त करुन असे पद भरील."

७. मुख्य नियमांच्या नियम २० मधील, उपनियम (४) मध्ये, "किंवा बाजार क्षेत्रात राहणाऱ्या शेतकऱ्यास" हा मजकू र वगळण्यात येईल.

८. मुख्य नियमांच्या नियम २१ मधील,

)क( उपनियम )३( मध्ये, "भटक्या जमाती किंवा इतर मागास वर्ग" या मजकु रानंतर पुढील मजकू र समाविष्ट करण्यात येईल:-

"दुर्बल वर्गाच्या सदस्यांच्या बाबतीत आणि, लगतपूर्वीच्या वर्षाचे त्याचे उत्प(cid:४००) व भू -धारणाचा तपशील"महाराष्ट्र शासन राजपत्र असाधारण भाग चार-ब, डिसेंबर ९, २०२०/अग्रहायण १८, शके १९४२ ७ (ख) उप-नियम (४) मध्ये, "अन्य मतदारसंघातील" या मजकु रानंतर "उमेदवार," हा मजकू र समाविष्ट करण्यात येईल.

९. मुख्य नियमांच्या नियम २७ मधील,-

(क) उप-नियम (१) मध्ये, "दहा दिवसांच्या आत" या मजकु रानंतर "पणन संचालक किंवा पणन संचालकांने प्राधिकृ त के लेला सहसंचालक" हा मजकू र समाविष्ट करण्यात येईल.

)ख ( उप -नियम )२ ( मध्ये , "पणन संचालक" या मजकू राऐवजी "पणन संचालक किंवा त्याने प्राधिकृ त के लेला सहसंचालक" हा मजकू र समाविष्ट करण्यात येईल.

१०. मुख्य नियमांच्या नियम ३६ मधील उप-नियम (३) च्या ऐवजी पुढील उप-नियम समाविष्ट करण्यात येईल:-

"(३) प्रत्येक मतदारास तेवढीच मते असतील जेवढी संबंधित मतदारसंघाच्या वतीने निवडल्या जाणाऱ्या सदस्यांची संख्या असेल, परंतु त्याला एका उमेदवारास एका पेक्षा अधिक मत देता येणार नाही."

११. मुख्य नियमांच्या नियम ७२ नंतर पुढील नियम जादा दाखल करण्यात येईल:-

"७२ अ निवडणुकीच्या विधीग्राह्यतेचे निर्धारण . -

(१) जर बाजार समितीच्या सदस्यांच्या पोट -निवडणुकीसह कोणत्याही निवडणुकीच्या विधीग्राह्यतेवर कोणत्याही निवडून द्यावयाच्या किंवा अशा निवडणुकीत मतदान के लेल्या अर्हताप्राप्त कोणत्याही व्यक्तीने प्र(cid:४०८) उपस्थित के ला तर अशा निवडणुकीच्या संदर्भात, अशा व्यक्तीस, निवडणुकीच्या निकालाच्या घोषणेच्या दिनांकानंतर सात दिवसाच्या आत जिल्हा निवडणूक अधिकाऱ्याकडे लेखी अर्ज करता येईल.

(२) उप नियम )१( अन्वये अर्ज प्राप्त झाल्यानंतर जिल्हा निवडणूक अधिकारी, अर्जदाराला आपले म्हणणे मांडण्याची संधी दिल्यानंतर आणि त्यास योग्य वाटेल अशी चौकशी के ल्यानंतर, निवडणुकीचा घोषित निकाल कायम करणारा किंवा दुरुस्त करणारा किंवा निवडणूक रद्द करणारा आदेश देईल. जर जिल्हा निवडणूक अधिकाऱ्यांने निवडणूक रद्द के ली असेल, तर तो नवीन निवडणूक घेण्याकरिता सोयीप्रमाणे शक्य तितक्या लवकरचा दिनांक निश्चित करील.

(३) जिल्हा निवडणूक अधिकाऱ्यांच्या निर्णयामुळे पीडित कोणत्याही व्यक्तीस, त्याला निर्णय कळवण्यात आल्याच्या दिनांकापासून सात दिवसाच्या आत, विभागीय सहनिबंधकाकडे अशा निर्णयाविरुद्ध अपील दाखल करता येईल.

(४) जिल्हा सहनिबंधकाच्या निर्णयाच्या अधीन राहून अपिलावरील जिल्हा निवडणूक अधिकाऱ्याच्या निर्णय अंतिम राहील."

NOTIFICATION

MAHARASHTRA AGRICULTURAL PRODUCE MARKETING (DEVELOPMENT AND REGULATION) ACT, 1963.

No.KPM-0320/C.R.67/21-C.–The following draft of rules to amend the Maharashtra Agricultural roduce Market Committee (Election to Committee) Rules, 2017, which the Government of Maharashtra proposes to make in exercise of the powers conferred by sub-section (1) and clauses (d) and (u) of sub-section (2) of section 60 of the Maharashtra Agricultural Produce Marketing (Development and Regulation) Act, 1963 (Mah. XX of 1964), and of all other powers enabling it in that behalf, is hereby published, as required by sub-section (3) of section 60 of the said Act, for the information of all the persons likely to be affected thereby; and notice is hereby given that the said draft will be taken into consideration by the Government of Maharashtra on or after 8th January 2021.

2. Any objections or suggestions, which may be received by the Director (Marketing) Maharashtra State, New Central Building, 3rd Floor, Pune 411001, from any person with respect to the said draft before the aforesaid date, will be considered by the Government.

DRAFT RULES

1. These rules may be called the Maharashtra Agricultural Produce Market Committee (Election to Committee) (First Amendment) Rules, 2020.

2. In rule 2 of the Maharashtra Agriculture Produce Marketing Committee (Election to Committee) Rules, 2017 (hereinafter referred to as "the principal Rules"), for clause 21, the following clause shall be substituted, namely :–

"(21) "Voter" means,–

Mah.XXIV of 1961

(i) for the purpose of the sub-clause (a) of sub-section (1) of section 13 of the Act, an agriculturist residing in the Market Area, not being less than 18 years of age on the date specified from time to time by the State Co-operative Election Authority and be the member of the Managing Committee of the Agricultural Credit Societies or Multipurpose Co-operative Societies (within the meaning of the Maharashtra Co-operative Societies Act, 1960 and the Rules made thereunder), functioning in the market area; or the member of the Village Panchayat, functioning in the market area ;

(ii) for the purpose of the sub-clause (b) of sub-section (1) of section 13 of the Act, the licensed trader or commission agent ;

(iii) for the purpose of the sub-clause (b-1) of sub-section (1) of section 13 of the Act, the licensed weighman and hamal;

(iv) for the purpose of the sub-clause (i) of clause (a) of sub-section (1A) of section 13 of the Act, an agriculturist members of other Agricultural Produce Market Committees in the State ;

(v) for the purpose of the sub-clause (ii) of clause (a) of sub-section (1A) of section 13 of the Act, trader or commission Agent, holding license as such in the Bombay Market area ;

(vi) for the purpose of the sub-clause (i) of clause (c) of sub-section (1B) of section 13 of the Act, an agriculturist members of the Agricultural Produce Market Committees from each district included in the area of operation of the Divisional Market Committee ;

(vii) for the purpose of the sub-clause (ii) of clause (c) of sub-section (1B), of section 13 of the Act, an agriculturist members of the Agricultural Produce Market Committees from each taluka included in the area of operation of the Regional Market Committee ;

(viii) for the purpose of the sub-clause (iii) of clause (c) of sub-section (1B) of section 13 of the Act, Trader or Commission Agent, holding license to oprate as such in the market area ;

(ix) for the purpose of the sub-clause (iv) of clause (c) of sub-section (1B) of section 13 of the said Act, hamal and weighman, holding license to operate as such in the market area.".

भाग चार-ब-३०७-२अ१२ महाराष्ट्र शासन राजपत्र असाधारण भाग चार-ब, डिसेंबर ९, २०२०/अग्रहायण १८, शके १९४२ 3. For rule 5 of the principal Rules, the following rule shall be substituted, namely:-

"5. Preparation of list of voters.-

(1) For the purpose of electing fifteen agriculturists, two members to be elected by traders and commission agents and one member to be elected by hamals and weighmen as provided by clauses (a), (b) and (b-1) of sub-section (1) of section 13 of the Act, every market area shall consists of,-

(A) Co-operative Societies' Constituency;

(B) Village Panchayat's Constituency;

(C) Trader's Constituency; and

(D) Hamals' and Weighmen's Constituency.

(2) Each such Constituency shall consist of the whole of the Market area.

(3) For the purpose of electing twelve agriculturists, five representatives to be elected by Traders and Commission Agents as provided by sub-clauses (i) and (ii) of clause (a) of sub- section (1A) of section 13 of the Act, every market area shall consists of,-

(A) Agriculturists Constituency;

(B) Trader's and Commission Agents Constituency.

(4) For the purpose of electing fifteen agriculturists, two members to be elected by traders and commission agents and one member to be elected by hamals and weighmen as provided by sub-clauses (i), (ii), (iii) and (iv) of clause (c) of sub-section (1B) of section 13 of the Act, every market area shall consists of,-

(A) Agriculturists Constituency;

(B) Trader's Constituency;

(C) Hamals and Weighmen's Constitutency.".

4. In rule 6 of the principal Rules,-

(1) for sub-rules (1) and (2), the following sub-rules shall be substituted, namely:-

"(1) The District Election Officer shall call upon the District Deputy Registrar of Co-operative Societies to prepare and furnish to him a list of members of the Managing Committees of the Agricultural Credit Societies and the Multipurpose Co-operative Societies and call upon the Block Development officer to prepare and furnish to him a list of members of the Village Panchayat's showing distinctly the members belonging to the Scheduled Caste and Scheduled Tribes functioning in the market area before 180 days of expiry of term of the Market Committee or within such time as may be specified by him. The District Election Officer shall provide or cause to provide, a list of members of the Managing Committees of the Agricultural Credit Societies and the Multipurpose Co-operative Societies as received from the District Deputy Registrar and a list of members of the Village Panchayat's as received from the Block Development officer, to the Secretary of the APMC for preparation of primary voters list for election to the concerned Constituency.

(1A) For the purposes of electing representatives of agriculturists of the Mumbai Agricultural Produce Market Committee under sub-clause (i), of clause (a) of sub-section (1A) of section 13 of the Act, the District Election Officer shall call upon the District Deputy Registrar of Co-operative Societies of all the districts in each of Revenue Divisions in the State, to furnish to him a list of agriculturist members of Agricultural Produce Market Committees within their respective jurisdiction elected under clause (a) of sub-section (1) of section 13 of the Act, before the date specified by him, in that behalf.

On receipt of such lists, the District Election Officer shall prepare a voters list separately for each of the Revenue Divisions and every such list shall be published on the notice board of the respective offices of District Election Officer, the District Deputy Registrar of the Co-operative Societies and office of the Collector of the respective districts in the respective Revenue Division and in any other manner as District Election Officer my deem fit.

(1B) For the purposes of electing the representatives of the agriculturists under sub-clauses (i), (ii), (iii) and (iv) of clause (c) of sub-section (1B) of section 13 of the Act, the concerned Collector shall call upon the concerned District Deputy Registrar of Co-operative Societies, to prepare the voter's list as per the constitution of the Divisional or Regional Market Committee.

On receipt of such lists, the concerned Collector shall prepare a voters list separately for each of the district and taluka and every such lists shall be published on the notice board of the respective offices of the concerned Collector and the concerned District Deputy Registrar of Co- operative Societies.

(2) Within thirty days of receipt of list from the District Election Officer, a provisional voters list in Form 4 shall be prepared by the Secretary of the Market Committee. The voters list for Co- operative Societies Constituency shall be prepared society wise.

The voters list for Village Panchayats Constituency shall be prepared Village Panchayat wise, indicating the details regarding members belonging to the Scheduled Caste and Scheduled Tribes, etc.

In case of Traders and Commission Agents Constituency, the names of traders and commission agents who hold license of the Agricultural Produce Market Committee as provided in clause (b) of sub-section (1) of section 13 of the Act to operate as such in the market area shall be included in the provisional voters list.

In case of Hamal and Weighmen Constituency, the names of hamal and weighmen who hold licence of the Agricultural Produce Market Committee and operating as such in the market area shall be included in the provisional voters list.

Every list of voters for all the constituencies mentioned in rule 5 shall provide, in alphabetical order, the name, age, residence and the category of the voter to which he belongs.

Provided that, in case of the Market Committee where the elections could not be held before the expiry of the term of the Committee due to unforeseen situations or any other reason, a provisional list of the voters shall be prepared, on the basis of the date fixed by the State Co- operative Election Authority :

Provided also that , the provisional voters list of the Market Committee on which an Administrator or Board of Administrators is appointed under second proviso of sub-section (2) of section 13, section 15A or section 45 of the Act, shall be prepared on the basis of the date fixed by the State Co-operative Election Authority.";

(2) in sub-rule (3), the following words shall be deleted, namely :-

"The Secretary of concerned Market Committee shall certify the provisional voters list as per record maintained in Form 3.";

(3) in sub-rule (4), for the words "agriculturists received by him", the following words shall be substituted, namely:-

"members of the Managing Committee of the Agricultural Credit Societies and the Multipurpose Co-operative Societies as received from the District Deputy Registrar and a list of members of the Village Panchayt's as received from the Block Development Officer by him";

(a) for the words "for agriculturists constituency", the following words and figure "for all the constituencies mentioned in rule 5" shall be substituted;

(b) for the word and figure "Form 4" the words, figures and letters "Form 4, Form 4(A), Form 4(B), or Form 4(C), as the case may be" shall be substituted.

5. In rule 8 of the principal Rules,-

(a) in sub-rule (1), for the existing proviso, the following proviso shall be substituted,-

"Provided that, no person shall vote at any election in any constituency, if he is subject to any disqualification under the law for the time being in force";

(b) to sub-rule (2), the following proviso shall be added, namely:-

"Provided that, nothing in this sub-rule shall apply to a person who is subjected to preventive detention under any law for the time being in force.";

(c) After sub-rule (2), the following sub-rule shall be added, namely:-

"(3) Subject to any disqualification incurred by a person, the voters lists published finally under sub-rules (3) of rule 7(a) shall be conclusive evidence for the purpose of determining whether any person is qualified to vote, or as the case may be or is not qualified to be elected at any election.".

6. In rule 10 of the principal Rules,-

(a) in sub-rule (1), in clause (f), for the words "pay any fees" the words "pay any dues, fees" shall substituted;

(b) in sub-rule (2), in clause (i), the words "if he does not ordinarily reside in the market area or" shall be deleted.

(c) For sub-rule (3), the following sub-rule shall be substituted, namely:-

"(3) Where any question arises as to whether a person has become subject to any of the disqualification mentioned in sub-rule (1), such question shall be decided by the Director within thirty days of its reference. On the decision of the Director or the decision in Appeal, as the case may be, a person who is disqualified shall cease to hold office from the date of the decision by the Director or by the Appellate Authority, as the case may be. The Market Committee shall on receipt of such decision, fill up the vacancy by co-opting a person eligible for being elected as a member as provided under section 18 of the Act."

7. In rule 20 of the principal Rules, in sub-rule (4), the words "or to any agriculturists residing in that area," shall be deleted

8. In rule 21 of the principal Rules,-

(a) in sub-rule (3), after the words "Nomadic Tribes or Other Backward Classes" the following words shall be inserted, namely:-

",and in case of members of weaker section, the details of his income and land holding during the year immediately preceding".

(b) in sub-rule (4), after the words "number in the list of voters of the" the word "candidate," shall be inserted.

9. In rule 27 of the principal Rules,-

(a) in sub-rule (1), for the words "Director of Marketing who" the words "Director of Marketing and Director of Marketing or the Joint Director authorized by him" shall be substituted;

(b) in sub-rule (2), for the words "Director of Marketing" the words "Director of Marketing or the Joint Director authorized by him" shall be substituted.

10. In rule 36 of the principal Rules, for sub-rule (3), the following sub-rule shall be substituted, namely:-

"(3) Every voter shall have as many votes as there are number of members to be elected on behalf of the respective constituency, but he shall not have more than one vote for one candidate.".

11. After rule 72 of the principal Rules, the following rule shall be added, namely:-

"72A. Determination of validity of Election.-

(1) If the validity of any election including bye-election of member of a Market Committee is brought in question by any person qualified either to be elected or to vote at the election to which such election refers, such person may, within seven days after the date of the declaration of the result of the election apply in writing to the District Election Officer.

(2) On receipt of an application under sub-rule (1), the District Election Officer shall, after giving an opportunity to the applicant to be heard and after making such inquiry as he deems fit, pass an order, confirming or amending the declared result of election or setting the election aside.

If the District Election Officer sets aside the election, he shall fix a date, as soon as conveniently may be, for holding a fresh election.

(3) Any person aggrieved by the decision of the District Election Officer, may, within seven days, from the date on which the decision is communicated to him, prefer an appeal, against such decision to the Divisional Joint Registrar.

(4) The decision of the District Election Officer subject to the decision of the Divisional Joint Registrar, in appeal, shall be final.".

12. For FORM 1, appended to the principal Rules, the following Form shall be substituted, namely:-

19 In FORM 11 appended to the principal Rules,-

(i) for the words and figures "in rule 30 of the Maharashtra Co-operative Societies Election Rules, 2014," the words and figures "in rule 34 of the Maharashtra Agricultural Produce Market Committee (Election to Committee) Rules, 2017," shall be substituted;

(ii) the sign, words, brackets "/ Division (Gan)" shall be deleted.

20. In FORM 12 appended to the principal Rules, the sign, words, brackets "/ Division (Gan)" shall be deleted.

21. In FORM 13 appended to the principal Rules, the sign, words, brackets "/ Division (Gan)" shall be deleted.
